    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En fecha 29 de octubre de 2026 el Alcalde-Presidente del Ayuntamiento de Santa Eugenia ha dictado la siguiente resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Antecedentes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Mediante Resolución de Alcaldía 2026-0009 de fecha 21 de enero de 2026 se aprobó la Oferta de Empleo Público correspondiente al ejercicio 2026.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Posteriormente, mediante acuerdo del Pleno del Ayuntamiento de fecha 29 de septiembre de 2026 elevado a definitivo, se aprobó la modificación de la plantilla de personal y de la Relación de Puestos de Trabajo del Ayuntamiento, incorporando una plaza de Técnico/a de Administración General (TAG), personal funcionario de carrera, encuadrada en la Escala de Administración General, Subescala.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vista la Providencia de Alcaldía de inicio del expediente y el informe emitido por la Secretaría Municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Fundamentos jurídicos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Visto lo que disponen los artículos 91 de la Ley 7/1985, de 2 de abril, reguladora de las Bases del Régimen Local; 70 del Texto Refundido de la Ley del Estatuto Básico del Empleado Público, aprobado por Real Decreto Legislativo 5/2015, de 30 de octubre; y 128 del Texto Refundido de las disposiciones legales vigentes en materia de régimen local, aprobado por Real Decreto Legislativo 781/1986, de 18 de abril.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Visto que la plaza creada se encuentra dotada presupuestariamente y cumple con los requisitos legales para su inclusión en la Oferta de Empleo Público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En ejercicio de las atribuciones conferidas por el artículo 21.1.g) de la Ley 7/1985, de 2 de abril, reguladora de las Bases del Régimen Local,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;RESUELVO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Primero&lt;/strong&gt;.- Aprobar la modificación de la Oferta de Empleo Público correspondiente al ejercicio 2026, mediante la inclusión de la siguiente plaza:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Segundo&lt;/strong&gt;.- Publicar la presente modificación de la Oferta de Empleo Público en el Boletín Oficial de las Illes Balears, así como en el tablón de anuncios y en la página web www.ajsantaeugenia.es de conformidad con lo establecido en la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Tercero&lt;/strong&gt;.- Convocar las plazas ofertadas en ejecución de la presente Oferta de Empleo Público dentro del plazo improrrogable de tres años a contar desde su fecha de publicación&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta resolución que agota la vía administrativa se pueden interponer, alternativamente, los siguientes recursos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Directamente el recurso contencioso-administrativo ante el Tribunal que resulte competente, en el plazo de dos meses, a contar a partir del día siguiente de la notificación de la presente resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) El recurso de reposición potestativo ante el órgano que ha dictado esta resolución (Batlia), en el plazo de un mes, a contar a partir del día siguiente de la notificación de la presente resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la desestimación por silencio del recurso de reposición, que se producirá por el transcurso de un mes desde su presentación sin que se haya resuelto expresamente ni se haya notificado, podrá interponerse el recurso contencioso-administrativo, en el plazo de seis meses, a contar a partir del día siguiente a la desestimación presunta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstante lo anterior, se puede ejercitar, en su caso, cualquier otro recurso que se estime pertinente. Todo ello de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa y de la Ley 39/2015, de 1 de octubre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
