    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La convocatoria de ayudas especifica que las comunicaciones y las notificaciones se realizarán a los interesados mediante su publicación en el &lt;em&gt;Boletín Oficial de las Illes Balears &lt;/em&gt;de acuerdo con los términos previstos en la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La vicepresidenta en Materia Agraria del FOGAIBA, con fecha 27 de octubre de 2026, firmó la siguiente resolución,&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. En fecha de 9 de diciembre de 2025 se publicó, en el Boletín Oficial de las Islas Baleares núm. 162 la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), por la que se convocan subvenciones para las Inversiones no productivas vinculadas a la mitigación y la adaptación al cambio climático.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes para la convocatoria 2025 finalizó el día 30 de enero de 2026.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. En fecha de 24 de enero de 2026 se publicó, en el Boletín Oficial de las Islas Baleares núm. Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se modifica el punto 1 del apartado tercero de la resolución inicial y el primer párrafo del punto 1 del apartado sexto, incrementando el plazo de presentación de solicitudes hasta el 13 de febrero de 2026.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Una vez evaluadas las solicitudes de ayuda por los órganos gestores, y de acuerdo con los criterios de elegibilidad establecidos, los interesados señalados en el Anexo I adjunto, han desistido de la solicitud, tal y como se detalla en el citado anexo.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. En fecha de 9 de diciembre de 2025 se publicó, en el Boletín Oficial de las Islas Baleares núm. 162 la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), por la que se convocan subvenciones para las inversiones no productivas vinculadas a la mitigación y la adaptación al cambio climático, correspondientes a los años 2025 y 2026.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. En fecha de 24 de enero de 2026 se publicó, en el Boletín Oficial de las Islas Baleares núm. 65 la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se modifica el punto 1 del apartado tercero de la resolución inicial y el primer párrafo del punto 1 del apartado sexto, incrementando el plazo de presentación de solicitudes hasta el 13 de febrero de 2026.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Orden 10/2023 de la consejera de Agricultura, Pesca y Alimentación, de 5 de abril de 2023, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco de las intervenciones para el desarrollo rural de las Islas Baleares 2023-2027, corresponde aprobar la convocatoria de estas ayudas mediante.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. Por todo ello, y vistas las propuestas, dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Considerar desistidas las solicitudes presentadas por los interesados relacionados en el Anexo I, que son un total de 7 expedientes y que comienza con ANTONI GARCIAS SIMON y termina con ISABEL FELIX DOMINGUEZ, por los motivos descritos en el citado anexo, corresponden a la convocatoria 2025 de la línea de ayuda mitigación y adaptación al cambio climático, 2025-2026».&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Declarar concluido el procedimiento y proceder al archivo de los expedientes relacionados en el Anexo I.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Notificar la resolución a cada uno de los interesados del Anexo I.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante el conseller de Agricultura, Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;
