    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A fecha de la firma electrónica, el director general de Economía Circular, Transición Energética y Cambio Climático ha formulado la siguiente propuesta definitiva: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El 2 de julio de 2026, en el BOIB núm. 83, se publicó la Resolución del consejero de Empresa, Autónomos y Energía por la que se aprueba la convocatoria pública de subvenciones 2026-2027 para el fomento de inversiones en energías renovables, almacenamiento eléctrico e infraestructura de recarga dentro del marco de Factor de Insularidad de las Islas Baleares (FACTOR 2026).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Las personas que figuran en el anexo de esta propuesta de resolución provisional presentaron una solicitud de subvención en el marco de la convocatoria de referencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Los técnicos de la Dirección General de Economía Circular, Transición Energética y Cambio Climático han examinado las solicitudes y han emitido un informe favorable de los siguientes aspectos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &amp;nbsp;Las personas o entidades solicitantes, por naturaleza, pueden ser beneficiarias de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &amp;nbsp;Las personas o entidades han adjuntado la documentación prevista en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &amp;nbsp;Las personas o entidades solicitantes están al corriente de las obligaciones con la Seguridad Social y con la Administración tributaria, tanto estatal como autonómica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Los técnicos de la Dirección General de Economía Circular, Transición Energética y Cambio Climático, en aplicación del procedimiento de concesión que establece el punto décimo de la citada Resolución, han informado favorablemente sobre la concesión de las subvenciones descritas en el anexo, las cuales se han calculado de acuerdo con la Resolución de la convocatoria de estas ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El orden de prelación de la valoración de los expedientes no viene determinado por el número de expediente, sino por la fecha y hora de entrada de la solicitud en el registro de la CAIB. El número de expediente lo asigna la aplicación de gestión de subvenciones una vez que ha entrado en la bandeja de entrada, que puede diferir de la fecha y hora de entrada real por error en el proceso de transferencia de datos entre sistemas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. En fecha 14 de agosto de 2026 se emitió la propuesta de resolución provisional del director general de Economía Circular, Transición Energética y Cambio Climático por la cual se conceden las subvenciones en el marco de la convocatoria pública de subvenciones para el fomento de inversiones en energías renovables, almacenamiento eléctrico e infraestructura de recarga dentro del marco de Factor de Insularidad de las Illes Balears (FACTOR 2026) (BOIB núm. 104, de 20 de agosto de 2026).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Se ha agotado el plazo que se concedía para presentar alegaciones sin que se haya presentado ninguna.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones (BOIB núm. 196, de 31 de diciembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El Decreto 75/2004, de 27 de agosto, por el que se desarrollan determinados aspectos de la Ley de Finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 122, de 2 de septiembre de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La Resolución del consejero de Empresa, Autónomos y Energía por la que se aprueba la convocatoria pública de subvenciones 2026-2027 para el fomento de inversiones en energías renovables, almacenamiento eléctrico e infraestructura de recarga dentro del marco de Factor de Insularidad de las Islas Baleares (BOIB núm. 83, de 25 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Propuesta de resolución definitiva &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Propongo al consejero de Empresa, Autónomos y Energía que dicte resolución en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Aprobar la concesión de una subvención para el fomento de inversiones en energías renovables, almacenamiento eléctrico e infraestructura de recarga en el marco de Factor de Insularidad de las Illes Balears por un importe total de 308.833,98 euros y 3 beneficiarios. En el Anexo de esta propuesta figuran los datos de cada beneficiario sobre la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Autorizar y disponer el gasto de 308.833,98 euros a los 3 beneficiarios que figuran en el anexo y por los importes que se detallan para cada uno, con cargo a la partida presupuestaria indicada en el anexo de los presupuestos de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los fondos de esta convocatoria proceden del Factor Insularidad, de acuerdo con lo que establece el Real Decreto Ley 4/2019, de 22 de febrero, del Régimen especial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Disponer que las inversiones objeto de la solicitud se llevarán a cabo dentro de los siguientes períodos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a) &lt;/em&gt;Inicio de las actuaciones: desde el día de la presentación de la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b) &lt;/em&gt;La finalización de la ejecución de las actuaciones será como máximo, la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Para el programa de actuación 1 con potencia hasta 10 kWp: 4 meses a contar desde la fecha de la notificación de esta propuesta de resolución provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Para el programa de actuación 1 con potencia pico superior a 10 kWp hasta 50 kWp: 5 meses a contar desde la fecha de la notificación de esta propuesta de resolución provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Para el programa de actuación 1 con potencia pico superior a 50 kWp hasta 100 kWp: 6 meses a contar desde la fecha de la notificación de esta propuesta de resolución provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Para el programa de actuación 1 con potencia pico superior a 100 kWp: 9 meses a contar desde la fecha de la notificación de esta propuesta de resolución provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;—&amp;nbsp;Para los programas de actuación 2, 3 y 4: 5 meses a contar desde la fecha de la notificación de esta propuesta de resolución provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. En cualquier caso, para el ejercicio 2027, la resolución de otorgamiento no podrá establecer una fecha para la realización de la actuación superior al 15 de septiembre de 2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Establecer que el pago y la justificación deben hacerse de acuerdo con lo que dispone el punto decimotercero de la convocatoria de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Establecer que los beneficiarios están obligados a cumplir lo dispuesto en el punto decimocuarto de la Resolución del consejero de Empresa, Autónomos y Energía de 2 de julio de 2026:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a) &lt;/em&gt;Realizar la actividad o la inversión, o adoptar el comportamiento que fundamenta la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b) &lt;/em&gt;Justificar la realización de la actividad, así como el cumplimiento de los requisitos y las condiciones que determinan la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;c) &lt;/em&gt;Comunicar al órgano concedente o, en su caso, a la entidad colaboradora, la solicitud o la obtención de otras subvenciones para la misma finalidad. Esta comunicación debe realizarse dentro del plazo de tres días hábiles desde la solicitud o la obtención de la subvención concurrente y, en todo caso, antes de la justificación de la aplicación que se haya dado a los fondos percibidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;d) &lt;/em&gt;Estar al corriente de las obligaciones tributarias y de la Seguridad Social frente a la Administración del Estado, y de las obligaciones tributarias frente a la hacienda autonómica; y acreditarlo, en la forma establecida en el artículo 6 de las bases reguladoras y el punto octavo de la convocatoria antes de dictar la propuesta de resolución de concesión y de realizar el pago. En todo caso, esta acreditación podrá sustituirse por una declaración responsable de la persona solicitante cuando se trate de subvenciones de cuantía igual o inferior a 3.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;e) &lt;/em&gt;Acceder a las actuaciones de control financiero de la Intervención General de la Comunidad Autónoma de las Islas Baleares, la Sindicatura de Cuentas y cualquier otra autoridad de control. Si, del resultado de estas actuaciones de control, se detectasen irregularidades, se derivará la obligación de reintegro de las cuantías indebidamente percibidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;f) &lt;/em&gt;Dejar constancia de la percepción y aplicación de la subvención en los libros de contabilidad o en los libros de registro que, en su caso, deba llevar el beneficiario de acuerdo con la legislación mercantil o fiscal que le sea aplicable y, en su caso, con las bases reguladoras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;g)&amp;nbsp;&lt;/em&gt;Conservar los documentos justificativos de la aplicación de los fondos percibidos, con inclusión de los documentos electrónicos, mientras puedan ser objeto de actuaciones de comprobación y control, durante un período de cinco años a partir del 31 de diciembre del año en que la autoridad de gestión efectúe el último pago al beneficiario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;h) &lt;/em&gt;Destinar el importe de la subvención a la financiación de la actuación para la que se ha solicitado y mantener la afectación de las inversiones a la actividad subvencionada, en la forma y dentro de los plazos que establezca la convocatoria y, en su caso, la correspondiente resolución o las modificaciones de la misma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;i) &amp;nbsp;&lt;/em&gt;Garantizar la permanencia de la inversión durante un período mínimo de cinco años siguientes al pago final al beneficiario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;j) &lt;/em&gt;Comunicar al órgano que concede la subvención la modificación de cualquier circunstancia que afecte a alguno de los requisitos exigidos para conceder la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;k) &lt;/em&gt;Dar cumplimiento a la normativa comunitaria, nacional y autonómica aplicable en el ámbito de contratación, subvenciones y ayudas de estado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;l) &lt;/em&gt;Mantener un sistema de contabilidad separada para todas las transacciones relacionadas con la operación cofinanciada, o bien un código contable separado, en caso de personas físicas con actividad económica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;m) &lt;/em&gt;Disponer de todos los documentos sobre el gasto que resulten necesarios para tener una pista de auditoría apropiada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;n) &lt;/em&gt;Reintegrar los fondos percibidos indebidamente como consecuencia de las actuaciones de comprobación realizadas por los órganos de control competentes y según lo que establece el artículo 44 del Texto refundido de la Ley de subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;o) &lt;/em&gt;Estar al corriente de las obligaciones tributarias con el Estado, la Seguridad Social y la Comunidad Autónoma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Disponer que toda alteración de las condiciones establecidas para la concesión de la subvención, así como la obtención concurrente de subvenciones o ayudas otorgadas por otras administraciones públicas o entes públicos, nacionales o internacionales, dan lugar a la revisión parcial o total de la subvención y, por tanto, al reintegro de la cantidad correspondiente, más los intereses de demora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Sobre la compatibilidad de ayudas con el mercado interior (ayudas de estado) se aplica lo siguiente: los beneficiarios de las ayudas objeto de esta propuesta de resolución&lt;strong&gt; &lt;/strong&gt;están sujetas al Reglamento (UE) núm. 651/2014 de la Comisión de 17 de junio de 2014 (DOUE 187/1, de 26 de junio) por el que se declaran determinadas categorías de ayudas compatibles con el mercado interior en la aplicación de los artículos 107 y 108 del Tratado, en la sección 7 sobre ayudas para la protección del medio ambiente. De este reglamento se aplicarán los siguientes artículos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— El artículo 36 y 36 ter en la implantación de infraestructura de recarga en el programa de actuación 4.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— El artículo 41 en actuaciones de generación renovables en los programas de actuación 1, 2 y 3.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. Publicar esta Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Manifestar la conformidad con la propuesta de resolución y dictar resolución en los mismos términos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta Resolución, que agota la vía administrativa, cabe interponer un recurso potestativo de reposición ante el consejero de Empresa, Autónomos y Energía en el plazo de un mes contando desde el día siguiente al de su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las &lt;em&gt;Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También cabe interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso del Tribunal Superior de Justicia de las&lt;em&gt; Illes Balears&lt;/em&gt; en el plazo de dos meses contados desde el día siguiente al de la publicación de la resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
