&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En fecha 1 de octubre de 2020, los ayuntamientos de Santa Eugenia y Sencelles y ABAQUA suscribieron un convenio de colaboración para la gestión, mantenimiento y mejora asociada a la EDAR de Santa Eugenia, mediante el cual ABAQUA gestiona dicha instalación, obligándose a ejecutar todas aquellas actuaciones necesarias para garantizar el correcto funcionamiento de la depuradora. La citada EDAR de Santa Eugenia presta servicio a las aguas procedentes del núcleo de Biniali (Sencelles).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En fecha 19 de junio de 2024, el equipo técnico del Área de Planificación y Construcción de Saneamiento de ABAQUA informó sobre los problemas de capacidad de la planta depuradora de la EDAR de Santa Eugenia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En fechas 20 y 21 de junio de 2024, ABAQUA trasladó a los ayuntamientos de Santa Eugenia y Sencelles dicho informe con el fin de solicitar los terrenos necesarios donde ejecutar la ampliación de la EDAR de Santa Eugenia. Todo ello, de conformidad con lo previsto en la letra B, apartado segundo, de la cláusula segunda del convenio de fecha 1 de octubre de 2020, que establece como obligación de los ayuntamientos facilitar la disponibilidad de los terrenos necesarios para ejecutar aquellas actuaciones imprescindibles para garantizar el correcto funcionamiento de la EDAR de Santa Eugenia y de las instalaciones complementarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En fecha 20 de junio de 2024 se reunió la comisión de seguimiento prevista en el convenio de colaboración firmado entre las tres partes. En dicho acto, ABAQUA reiteró la necesidad urgente de ejecutar las obras de ampliación de la depuradora, para lo cual se requería la disponibilidad de la parcela 244. Por este motivo, el 29 de diciembre de 2025, el Ayuntamiento de Sencelles formalizó ante la notaría María Rosario Rodríguez de la Rubial López, con número de protocolo 1435, la escritura pública de compraventa&amp;nbsp;respecto de la parcela núm. 244 del polígono 10 del término municipal de Sencelles que se describe a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Porción de tierra denominada Son Gelat, situada en el término municipal de Sencelles, con una superficie de media cuarterada, equivalente a treinta y cinco áreas y cincuenta y una centiáreas, que linda: al norte, con el resto de la finca matriz; al sur, con el resto de la finca matriz; al este, con la finca de los herederos de Gabriel Coll; y al oeste, con el resto de la finca matriz.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Inscrita en el Registro de la Propiedad de Inca núm. 1, tomo 3687, libro 204, folio 35, del término municipal de Sencelles, finca registral 9422.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;La finca descrita constituye la parcela 244 del polígono 10 del Catastro de Rústica de Sencelles, con referencia catastral 07047A010002440000OP&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En fecha 25 de marzo de 2026, el Área de Planificación y Construcción de Saneamiento de ABAQUA emitió informe en relación con la viabilidad técnica de los terrenos adquiridos por el Ayuntamiento de Sencelles para la ejecución del proyecto de ampliación y mejora del tratamiento de la EDAR de Santa Eugenia, en el que se señalaba:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«La actuación de ampliación y mejora del tratamiento de la EDAR de Santa Eugenia podrá llevarse a cabo en los terrenos descritos en la escritura aportada por el Ayuntamiento de Sencelles el pasado 29 de diciembre de 2025 (parcela 244 del polígono 10 de Sencelles), adoptando en fase de proyecto y de obras las medidas correctoras necesarias para mantener la seguridad de las personas y bienes, disminuir la vulnerabilidad y para la autoprotección frente a eventuales episodios de inundación de la EDAR de Santa Eugenia».&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En fecha 28 de abril de 2026 se redactó una memoria y propuesta de inicio del expediente de aceptación de la parcela 244 del polígono 10 de Sencelles, sobre cuya base el director gerente de ABAQUA propuso al Consejo de Administración de esta entidad iniciar el expediente para aceptar la cesión gratuita de la parcela 244 del polígono 10 de Sencelles para la ampliación de la EDAR de Santa Eugenia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En fecha 30 de abril de 2026, el Consejo de Administración de ABAQUA adoptó, entre otros, los siguientes acuerdos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«Primero.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="background-color:null"&gt; Iniciar el expediente para aceptar la cesión gratuita de la parcela 244 del polígono 10 de Sencelles que se describe a continuación:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Porción de terreno denominada Son Gelat, situada en el término municipal de Sencelles, con una superficie de media cuarterada, equivalente a treinta y cinco áreas y cincuenta y una centiáreas, que linda: al norte, con el resto de la finca matriz; al sur, con el resto de la finca matriz; al este, con la finca de los herederos de Gabriel Coll; y al oeste, con el resto de la finca matriz.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;El objeto de esta cesión es ejecutar la ampliación de la depuradora de Santa Eugenia en los términos establecidos en el convenio de colaboración suscrito entre ABAQUA y los ayuntamientos de Santa Eugenia y Sencelles el 1 de octubre de 2020.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Segundo.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="background-color:null"&gt; Delegar la firma en el director gerente de ABAQUA para tramitar el expediente, así como para firmar todos los documentos necesarios para hacer efectiva esta aceptación de cesión gratuita.»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En fecha 14 de octubre de 2026, el secretario general de ABAQUA, a la vista del informe de fecha 25 de marzo de 2026 del Área de Planificación y Construcción de Saneamiento de ABAQUA sobre la parcela 244 del polígono 10 de Sencelles, informó favorablemente sobre la aceptación de la mencionada parcela.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Normativa aplicable&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El artículo 25 de la Ley 7/2010, de 21 de julio, del sector público instrumental de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Los artículos 38 y 41 de la Ley 6/2001, de 11 de abril, de Patrimonio de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Los artículos 58 y 126 del Decreto 127/2005, de 16 de diciembre, por el que se aprueba el Reglamento de desarrollo de la Ley 6/2001, de 11 de abril, de Patrimonio de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El artículo 20 del Decreto 100/2015, de 18 de diciembre, por el que se aprueban los Estatutos de la Agencia Balear del Agua y de la Calidad Ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, el director gerente de ABAQUA adopta la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aceptar la cesión gratuita a favor de ABAQUA de la parcela 244 del polígono 10 del Catastro de Sencelles con la finalidad de ejecutar la ampliación de la depuradora de Santa Eugenia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los datos identificativos del inmueble son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Referencia catastral: 07047A010002440000OP.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Anotar en el Registro de Bienes y Derechos de ABAQUA la parcela 244 del polígono 10 de Sencelles, finca registral 9422.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarto.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Publicar esta Resolución en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quinto.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Contra esta Resolución, que pone fin a la vía administrativa, podrá interponerse alternativamente recurso potestativo de reposición ante el Consejo de Administración de ABAQUA en el plazo de un mes, o directamente recurso contencioso-administrativo ante la jurisdicción contencioso-administrativa en el plazo de dos meses, de conformidad con lo previsto en los artículos 123.1 y 124.1 de la Ley &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
