&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El 7 de julio de 2026, en el BOIB n.º 85, se publicó la Orden 20/2026, del consejero de Vivienda, Territorio y Movilidad, de 3 de julio, por la que se establecen las bases reguladoras y se aprueban las convocatorias de ayudas al transporte terrestre previstas en el Decreto Ley 1/2026, de 1 abril, por el que se adoptan medidas extraordinarias y urgentes para paliar la crisis económica producida por los efectos de la guerra en Oriente Medio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El punto 1 del apartado séptimo de la convocatoria dispone que la selección de los beneficiarios de las ayudas se realizará mediante el procedimiento de concurrencia no competitiva y por riguroso orden de entrada (sin necesidad, por lo tanto, de comparación y de prelación de las solicitudes). En consecuencia, serán objeto de subvención las solicitudes que cumplan los requisitos y los plazos establecidos en la convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Las personas jurídicas que figuran en la relación que se incluye, como anexo de esta Resolución, presentaron, dentro del plazo establecido en la convocatoria, una solicitud de subvención al amparo de la convocatoria de ayudas destinada a las personas jurídicas titulares de autorizaciones de transporte público de mercancías domiciliadas en el ámbito territorial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. De acuerdo con el artículo 6.2 de la Orden de bases que rige la convocatoria y con el apartado octavo de la convocatoria, corresponderá a la Dirección General de Movilidad la instrucción y la tramitación del procedimiento, en los términos que establece el artículo 16 del Texto refundido de la Ley de subvenciones, así como la comprobación de la justificación y de la aplicación efectiva de la subvención concedida, de acuerdo con lo dispuesto en el artículo 42 del texto refundido mencionado y los artículos 13 y 14 de la Orden de bases. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El personal técnico de la Dirección General de Movilidad examinó las solicitudes incluidas en el anexo de esta Resolución y, de acuerdo con los informes técnicos correspondientes, emitió una valoración desfavorable, dado que las personas solicitantes no cumplían uno o más de los requisitos establecidos en la convocatoria para poder ser beneficiarias de las subvenciones. &lt;/span&gt;&lt;br /&gt;
&lt;span style="background-color:null"&gt;En particular, las comprobaciones efectuadas permitieron constatar, por un lado, que determinados vehículos para los que se solicitaba la subvención, adscritos a autorizaciones de transporte público de mercancías de las clases MDP o MDL, tenían el domicilio situado fuera del ámbito territorial de las Illes Balears. Hecho que incumple los requisitos establecidos en los apartados 2.1.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; de la convocatoria, así como en el artículo 4.3.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;de la Orden de bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Y, por otro, que determinadas personas jurídicas solicitantes ya habían logrado o superado el límite máximo de 300.000,00&amp;nbsp;euros establecido en el artículo 3.2 del Reglamento (UE) 2023/2831 de la Comisión, de 13 de diciembre de 2023, circunstancia acreditada mediante los certificados de las ayudas de minimis recibidos, registrados en la Base de Datos Nacional de Subvenciones (BDNS).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El 18 de septiembre de 2026, la directora general de Movilidad emitió una propuesta de resolución de denegación de cinco solicitudes de subvención, por un importe total de 168.930,00&amp;nbsp;euros, en el marco de la convocatoria pública de ayudas dirigida a las personas jurídicas titulares de autorizaciones de transporte público de mercancías domiciliadas en el ámbito territorial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La propuesta incluía un anexo en el que se identificaban las personas jurídicas solicitantes afectadas y se detallaban, para cada solicitud, los motivos de denegación derivados del incumplimiento de los requisitos establecidos en la convocatoria y en la normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. La propuesta de resolución arriba indicada se publicó en la Sede Electrónica el 18 de septiembre y se otorgó un plazo de cinco días hábiles desde el día siguiente al de la publicación de esta propuesta de resolución en la Sede Electrónica para que las personas incluidas en la misma pudieran alegar lo que consideraran oportuno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Contra la Propuesta de resolución del 18 de septiembre de 2026, de denegación de subvenciones indicada anteriormente, se han presentado dos alegaciones, correspondientes a los siguientes expedientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. En relación con las alegaciones presentadas por Reciclajes MITOAM, SL, en el marco del expediente PJMDMOB-153/2026, el personal técnico de la Dirección General, una vez examinadas las alegaciones y la documentación que consta en el expediente, concluyó que no había quedado acreditado que el vehículo con matrícula 1234-DPF estuviera domiciliado en un municipio de las Illes Balears en fecha de 1 de abril de 2026, tal como exige el apartado segundo de la convocatoria. Esta conclusión se fundamenta en el informe técnico emitido con este fin el 6 de octubre de 2026, que consta en el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. El día 16 de octubre de 2026, se notificó a Reciclajes MITOAM, SL, el escrito de respuesta a las alegaciones formuladas contra la Propuesta de resolución de 18 de septiembre de 2026. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. En relación con las alegaciones presentadas por TRABLISA Distribución, SL, en el expediente PJMDMOB-174/2026, una vez examinadas por el personal técnico jurídico de la Dirección General de Movilidad, se concluyó que no quedaba acreditado que los vehículos con las matrículas 3284LJR y 9326-NBS estuvieran domiciliados en un municipio de las Illes Balears el 1 de abril de 2026, tal como exige el apartado segundo de la convocatoria, con independencia que los vehículos se hubieran mencionado en la solicitud o en la documentación anexa, según consta en el informe técnico de 6 de octubre de 2026, que consta en el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12. El 8 de octubre de 2026 se notificó a TRABLISA Distribución, SL, el oficio de respuesta a las alegaciones presentadas contra la Propuesta de resolución de 18 de septiembre de 2026.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13. Por todo lo expuesto, se desestiman las alegaciones presentadas en los expedientes PJMDMOB-153/2026 y PJMDMOB-174/2026, manteniéndose la Propuesta de resolución, de 18 de septiembre de 2026, de denegación de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;14. De acuerdo con el artículo 6.1 de la Orden de bases y con el apartado octavo de la convocatoria, el órgano competente para dictar las resoluciones de denegación de las subvenciones es el consejero de Vivienda, Territorio y Movilidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. &lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El Decreto 75/2004, de 27 de agosto, de desarrollo de determinados aspectos de la Ley de finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears (BOIB n.º 122, de 2 de septiembre de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. La Ley 6/2025, de 23 de julio, de presupuestos generales de la Comunidad Autónoma de las Illes Balears para el año 2025, prorrogados para el año 2026 (BOIB n.º 98, de 24 de julio de 2025).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. La Orden 39/2025, de 23 de diciembre, del consejero de Economía, Hacienda e Innovación por la que se desarrollan las particularidades presupuestarias y contables que deberán regir la prórroga de los presupuestos hasta que entre en vigor la ley de presupuestos generales de la Comunidad Autónoma de las Illes Balears para el año 2026 (BOIB n.º 173, de 30 de diciembre de 2025). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. El Reglamento (UE) 2023/2831 de la Comisión, de 13 de diciembre de 2023, relativo a la aplicación de los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea a las ayudas &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;minimis&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; (DOUE n.º 2831, de 15 de diciembre de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, y vista la propuesta de la directora general de Movilidad de 18 de septiembre de 2026, dicto la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Denegar la concesión de las subvenciones a los solicitantes que figuran en el anexo de esta Resolución, de acuerdo con la motivación que también figura, en el marco de la convocatoria pública de subvenciones para las personas jurídicas titulares de autorizaciones de transporte público de mercancías domiciliadas en las Illes Balears, que empieza con VALERIANO ALLES CANET, S.L., NIF n.º ***4287**, importe solicitado de 64.800,00&amp;nbsp;euros y expediente n.º&amp;nbsp;PJMDMOB-2/2026, y acaba con TRABLISA DISTRIBUCION, S.L., NIF n.º&amp;nbsp;***1403**, importe solicitado de 1.000,00&amp;nbsp;euros y expediente n.º&amp;nbsp; PJMDMOB-174/2026.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El importe total de los expedientes que figuran en el anexo es de 168.930,00&amp;nbsp;euros y&lt;em&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/em&gt;corresponde a cinco solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Notificar esta resolución de denegación de subvenciones mediante su publicación en la Sede Electrónica de la Administración de la Comunidad Autónoma de las Illes Balears y en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Baleares&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta Resolución, que agota la vía administrativa, se podrá interponer un recurso potestativo de reposición ante el consejero de Vivienda, Territorio y Movilidad en el plazo de un mes desde el día siguiente al de su notificación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También se podrá interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses desde el día siguiente al de su notificación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
