I.M.</span></span></span></td> </tr> </tbody> </table> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformidad con lo establecido en el artículo 14 de convocatoria, la percepción de la presente ayuda queda sujeta al estricto cumplimiento de los siguientes obligaciones por parte de las personas beneficiarias:</span></p> <ul style="list-style-type:disc"> <li><span>Conservar los documentos justificativos de la aplicación de los fondos recibidos.</span></li> <li><span>Someterse a las actuaciones de comprobación y control financiero previstas por la normativa vigente en materia de subvenciones.</span></li> <li><span>Reintegrar los fondos percibidos en los supuestos contemplados en el artículo 37 de la Ley General de Subvenciones y, en particular, por obtener la ayuda falseando las condiciones requeridas u ocultando aquellas que lo hubieran impedido, o mostrando resistencia, excusa, obstrucción o negativa a las actuaciones de comprobación y control financiero previstas en el artículo 14 de la Ley General de Subvenciones.</span></li> <li><span>Cumplir las restantes obligaciones que se detallan en el artículo 14 de la Ley General de Subvenciones.</span></li> <li><span>Conocer y aceptar íntegramente las bases específicas reguladoras de estas ayudas y la presente convocatoria, y saber que, en caso de falsedad en los datos o en la documentación aportada u ocultación de información, de la que se pueda deducir intención de engaño en beneficio propio o ajeno, se les puede excluir de este procedimiento y pueden ser objeto de sanción al considerarse una infracción muy grave de conformidad con el artículo 58.a) de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, de modo que las sanciones a esta infracción son las tipificadas en el título IV de la misma ley. Asimismo, en su caso, los hechos podrán ponerse en conocimiento de la Fiscalía por si pueden ser constitutivos de ilícito penal.</span></li> <li><span>Las personas beneficiarias deberán comunicar la aceptación de la subvención; no obstante, pasados 5 días hábiles desde la publicación en el Boletín Oficial de les Illes Balears (BOIB) de la resolución definitiva sin respuesta alguna, se entenderá que la persona beneficiaria acepta la subvención</span><strong><span>.</span></strong></li> <li><span>Las personas beneficiarias de la ayuda por la adquisición de la primera vivienda deberán mantener la propiedad durante 5 años desde la concesión, utilizándola exclusivamente como residencia habitual y permanente, sin posibilidad de arrendarla, cederla o darle otro uso. El incumplimiento de estas obligaciones, conllevará la devolución íntegra de la ayuda recibida, incluyendo intereses legales, pudiendo además ser sancionado económicamente y perder el acceso a futuras subvenciones. En casos graves, como fraude o falsificación documental, podrían derivarse responsabilidades civiles o penales, y la administración competente podrá iniciar acciones legales para exigir la restitución de fondos. Excepcionalmente, situaciones justificadas de fuerza mayor podrán ser evaluadas previo consentimiento del órgano competente.</span></li> </ul> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra la presente Resolución que pone fin a la vía administrativa, puede interponer alternativamente recurso de reposición potestativo ante la Alcaldesa de este Ayuntamiento, en el plazo de un mes a contar desde el día siguiente al de la recepción de la presente notificación o publicación de la resolución, de conformidad con los Artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas; o bien interponer directamente recurso contencioso-administrativo, ante el Juzgado de lo Contencioso-Administrativo de Palma, en el plazo de dos meses, a contar desde el día siguiente al de la recepción de la presente notificación, de conformidad con el Artículo 46 de la Ley 29/1998, de 13 de julio, de la Jurisdicción Contencioso-Administrativa. Si se optara por interponer el recurso de reposición potestativo no podrá interponer recurso contencioso-administrativo hasta que aquel sea resuelto expresamente o se haya producido su desestimación por silencio.
