En el <em>Boletín Oficial de las Illes Balears</em> (BOIB) n.º 77, de 23 de junio de 2018, se publicó el Acuerdo del Pleno de la Comisión de Medio Ambiente de las Illes Balears (CMAIB) de 31 de mayo de 2018, por el que se acuerda la autorización ambiental integrada (en adelante, AAI) a la entidad Sertego Servicios Medioambientales, SLU, para el centro de recepción, almacenamiento y transferencia de residuos ubicado en el término municipal de Sant Antoni de Portmany (expediente n.º IPPC 03/2015).</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El día 14 de enero de 2026, tuvo entrada en el Servicio de Evaluación Ambiental-IPPC (SAA), con registro GOIBE26556/2026, la solicitud de modificación no sustancial de la AAI, presentada por Sertego Servicios Medioambientales SL, consistente en la ampliación de residuos autorizados a gestionar y la instalación de una cámara frigorífica (expediente n.º IPPC M01/2026).</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El día 22 de septiembre de 2026 el SAA-IPPC emite el informe propuesta sobre la modificación no sustancial de la autorización ambiental integrada del centro de recepción, almacenamiento y transferencia de residuos de Sertego Servicios Medioambientales, SLU, en Sant Antoni de Portmany, consistente en la ampliación de residuos autorizados a gestionar y la instalación de una cámara frigorífica.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fundamentos de derecho</span></strong></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El capítulo III del título II de la Ley 9/2022, de 23 de noviembre, de régimen jurídico y de procedimiento de las actividades sujetas a autorización ambiental integrada.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El artículo 10 del Real Decreto Legislativo 1/2016, de 16 de diciembre, por el que se aprueba el texto refundido de la Ley de prevención y control integrados de la contaminación.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El artículo 14 del Real Decreto 815/2013, de 18 de octubre, por el que se aprueba el Reglamento de emisiones industriales y de desarrollo de la Ley 16/2002, de 1 de julio, de prevención y control integrados de la contaminación.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El Decreto 10/2025, de 14 de julio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB n.º 91, de 14 de julio de 2025; corrección de errores BOIB n.º 102, de 2 de agosto de 2025), atribuye a la Dirección General de Armonización Urbanística y Evaluación Ambiental la competencia para otorgar, revisar y modificar las autorizaciones ambientales integradas.</span></span></p> <p style="text-align:justify"><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Consideraciones técnicas</span></span></strong></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El informe 0505/26-CA, emitido por la Sección de Atmósfera el 15 de abril de 2026, es favorable. En sus conclusiones expone que es necesario añadir un nuevo condicionante a las prescripciones en materia de atmósfera de la AAI relativo a cambio climático.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El informe del Servicio de Planificación, emitido el 16 de abril de 2026, es favorable. En sus conclusiones indica que la modificación no afecta a los condicionantes hídricos de la AAI.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El informe de la Sección de Medio Ambiente del Departamento de Gestión Ambiental, Sostenibilidad, Innovación y Transparencia del Consejo Insular de Ibiza, emitido el 21 de abril de 2026, es favorable y no propone realizar cambios a los condicionantes hídricos de la AAI.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El informe R-050/26-RSC del Servicio de Residuos y Suelos Contaminados, emitido el 14 de septiembre de 2026, es favorable. En sus conclusiones indica los cambios a realizar en los condicionantes de Residuos de la AAI.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, dicto la siguiente</span></span></p> <p style="text-align:center"><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Resolución</span></strong></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La capacidad máxima de almacenamiento de residuos peligrosos y no peligrosos es de 94,25 toneladas (la capacidad máxima de almacenamiento de los depósitos fijos y del armario de inflamables supera la cantidad de 50 toneladas de residuos peligrosos).</span></span></p> <p style="margin-left:40px; text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformidad con el apartado d del artículo 23.5 de la Ley 7/2022, los gestores de residuos quedan obligados a no mezclar residuos peligrosos con otras categorías de residuos peligrosos o con otros residuos, sustancias o materiales, incluida la dilución de sustancias peligrosas.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se añade el punto 6.4.3 Gestión de residuos sanitarios:</span></strong></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El almacenamiento de los residuos sanitarios debe efectuarse exclusivamente en la cámara frigorífica, en condiciones de temperatura igual o inferior a 4 °C, con un plazo máximo de permanencia de cinco días desde la producción del residuo y de 24 horas en caso de que no se pueda garantizar esta temperatura, de acuerdo con el artículo 9 del Decreto 136/1996, de 5 de julio, de ordenación de la gestión de los residuos sanitarios en la Comunidad Autónoma de las Illes Balears.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La capacidad máxima de almacenamiento simultáneo de la cámara se fija en 2 t.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La cámara debe disponer de registro en continuo de la temperatura, con conservación de los datos durante un mínimo de tres años a disposición del órgano competente para la tramitación y el seguimiento de la AAI, y de un sistema de alarma de desviación de temperatura.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El titular debe disponer de un protocolo de avería de la cámara frigorífica que garantice la detección inmediata de la pérdida de frío (alarma y registro en continuo), la suspensión de nuevas entradas de residuos sanitarios y la evacuación efectiva de los residuos almacenados dentro de las 24 horas siguientes a la pérdida de refrigeración, así como la comunicación de cada activación del protocolo al órgano competente para la tramitación y el seguimiento de la AAI.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Los residuos sanitarios deben recepcionarse y almacenarse exclusivamente en envases cerrados, estancos y resistentes, identificados con el pictograma de riesgo biológico o, en el caso de los medicamentos citotóxicos y citostáticos, con la leyenda correspondiente, etiquetados de conformidad con el artículo 21 de la Ley 7/2022 y con indicación del centro productor y de las fechas de inicio y de cierre del envase, sin que se pueda proceder a su apertura, al trasvase del contenido ni a someterlos a operaciones de combinación o reenvasado en la instalación.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Se debe mantener un programa de limpieza y desinfección de la cámara frigorífica y de los elementos en contacto con los residuos sanitarios, con una periodicidad mínima semanal y, en todo caso, tras cualquier incidencia con afección potencial a la salubridad, con registro de las actuaciones a disposición de las administraciones competentes. El personal que manipule estos residuos debe disponer de formación específica en los riesgos asociados y en las medidas de prevención aplicables.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Las recogidas y expediciones de residuos sanitarios desde la instalación se deben realizar con vehículos de caja cerrada, estanca y de fácil limpieza y desinfección, dotados de medios de contención de derrames, en condiciones que garanticen el mantenimiento de la cadena de frío cuando sea exigible.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Antes de la puesta en servicio de la cámara, el titular debe presentar ante el órgano competente para la tramitación de la AAI, para su incorporación a las obligaciones de la instalación, un protocolo de avería por escrito que incluya, como mínimo: el sistema de detección de la pérdida de refrigeración; la suspensión inmediata de nuevas entradas de residuos sanitarios; la activación de la recogida con vehículo refrigerado y la evacuación efectiva de los residuos almacenados dentro de las 24 horas siguientes a la pérdida de la temperatura de garantía; y la comunicación de cada activación del protocolo al órgano competente para la tramitación de la AAI.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se añade un nuevo punto para los condicionantes de atmósfera:</span></strong></span></p> <p style="text-align:justify"><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.5. Cambio climático</span></strong></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con la MTD 23 asociada a las conclusiones generales sobre las MTD:</span></span></p> <ul style="list-style-type:disc"> <li><span style="line-height:1">Se debe monitorizar el consumo de toda la energía primaria.</span></li> <li><span style="line-height:1">Se debe realizar un plan de eficiencia energética.</span></li> </ul> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En un plazo de tres meses desde la fecha de notificación de esta resolución, el titular deberá presentar:</span></span></p> <ul style="list-style-type:disc"> <li><span style="line-height:1">Plan de eficiencia energética.</span></li> <li><span style="line-height:1">Protocolo de avería de la cámara frigorífica de residuos sanitarios.</span></li> </ul> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Recordar que una vez ejecutadas las actuaciones objeto de la modificación no sustancial, el titular deberá presentar ante la consejería competente en materia de territorio la documentación indicada en el artículo 16 de la Ley 9/2022, de 23 de noviembre, de régimen jurídico y de procedimiento de las actividades sujetas a autorización ambiental integrada.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Informar de que esta autorización se otorga sin perjuicio del resto de autorizaciones y licencias que resulten exigibles.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Ordenar la publicación de esta resolución en el BOIB.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.
