El 14 de mayo de 2026, se publicó en el <em>Boletín Oficial de las Illes Balears</em> la Resolución de la consejera de Familias, Bienestar Social y Atención a la Dependencia de 7 de mayo de 2026 por la que se aprueba la convocatoria de subvenciones destinadas a entidades privadas sin ánimo de lucro que desarrollan programas de interés general con cargo a la asignación tributaria del 0,7 % del IRPF y del Impuesto sobre Sociedades, correspondiente a los años 2026 y 2027, para proyectos a ejecutar durante los años 2027 y 2028.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El 17 de septiembre de 2026, se publicó en el <em>Boletín Oficial de las Illes Balears</em> la Primera propuesta de resolución provisional de la directora general de Bienestar Social de 11 de septiembre de 2026 de exclusión, concesión y denegación de las solicitudes presentadas en la convocatoria de subvenciones destinadas a entidades privadas sin ánimo de lucro que desarrollan programas de interés general con cargo a la asignación tributaria del 0,7 % del impuesto sobre la renta de las personas físicas y el impuesto sobre sociedades, correspondiente a los años 2026 y 2027, para proyectos a ejecutar durante los años 2027 y 2028.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El 6 de octubre de 2026, se reunió la Comisión Evaluadora prevista en el punto 10.1 de la convocatoria y aprobó el informe técnico relativo a los proyectos excluidos por concierto o por no estar al corriente con las obligaciones contables con el Protectorado de Fundaciones de la consejería de la Primera propuesta de resolución provisional de la directora general de Bienestar Social de 11 de septiembre de 2026.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Los proyectos que, a consecuencia de la estimación de las alegaciones presentadas o de la rectificación de oficio efectuada por la Comisión Evaluadora, han pasado de la situación de exclusión a la de inclusión, han sido valorados por el personal técnico del Servicio de Servicios Sociales, de acuerdo con lo que dispone el punto 12.5.a del anexo de la convocatoria. De acuerdo con el punto 11.4 de la convocatoria, el órgano instructor del procedimiento debe iniciar un nuevo trámite de audiencia para que las entidades interesadas puedan presentar alegaciones a la puntuación obtenida por el proyecto presentado.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fundamentos de derecho</span></strong></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Ley 4/2009, de 11 de junio, de servicios sociales de las Illes Balears, que en el artículo 3 establece que los objetivos de las políticas sociales son, entre otros, prevenir y atender las situaciones de vulnerabilidad de las personas y de los grupos en situación de exclusión social. Asimismo, el artículo 4 dispone, entre los principios rectores, el de universalidad e igualdad, por el que los servicios públicos deben garantizar a todo el mundo el derecho de acceso a los servicios sociales y el uso efectivo en condiciones de igualdad, equidad y justicia distributiva.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El Decreto 8/2023, de 10 de julio, de la presidenta de las Illes Balears, por el que se determina la composición del Gobierno y se establece la estructura de la Administración de la Comunidad Autónoma de las Illes Balears, modificado por el Decreto 1/2025, de 3 de febrero, de la presidenta de las Illes Balears, por el que se modifica el Decreto 8/2023, de 1 de julio, de la presidenta de las Illes Balears, por el que se determina la composición del Gobierno y se establece la estructura de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 17, de 6 de febrero de 2025), y por el Decreto 7/2025, de 11 de julio, de la presidenta de las Illes Balears, de modificación del Decreto 8/2023, de 10 de julio, de la presidenta de las Illes Balears, por el que se determina la composición del Gobierno y se establece la estructura de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 89, de 12 de julio de 2025), incluye, bajo la dirección del Gobierno, la Consejería de Familias, Bienestar Social y Atención a la Dependencia, de la cual depende la Dirección General de Bienestar Social.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. El Decreto 10/2025, de 14 de julio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, atribuye a la Dirección General de Bienestar Social las competencias, entre otras, de gestión de programas de servicios sociales y de fomento de los programas de inclusión social.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. La Orden de la consejera de Asuntos Sociales y Deportes de 5 de marzo de 2021 por la que se establecen las bases reguladoras de las subvenciones en materia de servicios sociales y de juventud (BOIB núm. 34, de 11 de marzo de 2021).</span></span></p> <p style="text-align:center"><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propuesta de resolución provisional</span></strong></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propongo a la consejera de Familias, Bienestar Social y Atención a la Dependencia que dicte una resolución en los términos siguientes:</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Incorporar de oficio al procedimiento de concesión los proyectos de las entidades que constan en el anexo 1 de esta propuesta de resolución provisional.</span></span></p> <p style="text-align:justify"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.
