El 25 de diciembre de 2025, en el BOIB núm. 171, se publicó la Resolución del consejero de Empresa, Autónomos y Energía de 19 de diciembre de 2025 por la que se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2026 para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas en el Programa FEDER 2021-2027.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. El 02 de junio de 2026, en el BOIB núm. 69, se publicó la Resolución del consejero de Empresa, Autónomos y Energía por la cual se amplía el crédito asignado en la Resolución del consejero de Empresa, Autónomos y Energía por la cual se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones 2026-2027 para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas dentro del Programa FEDER 2021-2027 </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. Las personas que figuran en el Anexo de esta resolución presentaron una solicitud de subvención en el marco de la convocatoria de referencia.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. A los titulares de los expedientes que aparecen en el anexo se les concedió una subvención en el marco de la convocatoria por los importes que también se indican, de acuerdo con las respectivas resoluciones estimatorias del </span><em><span style="background-color:null">conseller</span></em><span style="background-color:null"> de Empresa, Autónomos y Energía, con fecha y número de BOIB indicados en el anexo.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. Los titulares de los expedientes que aparecen en el anexo han presentado escrito en el que indican que renuncian a la subvención concedida.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Fundamentos de derecho</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. El consejero de Empresa, Autónomos y Energía es el órgano competente para resolver este procedimiento dada la estructura orgánica del Gobierno de las Illes Balears y de acuerdo con la Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de energía.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. La Ley 38/2003, de 17 de noviembre, General de Subvenciones.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. El Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de subvenciones (BOIB núm. 196, de 31 de diciembre de 2005).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. El artículo 94, de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, prevé que la Administración, en el supuesto de renuncia de la persona interesada a sus derechos, aceptará la renuncia completamente y resolverá el procedimiento declarando esta circunstancia, con indicación de los hechos producidos y normas aplicables.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. La Resolución del consejero de Empresa, Autónomos y Energía de 19 de diciembre de 2025 por la que por la que se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2026 para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas en el Programa FEDER 2021-2027 (BOIB núm. 171, de 25 de diciembre de 2025).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">6. La Resolución del consejero de Empresa, Autónomos y Energía de 28 de mayo de 2026 por la cual se amplía el crédito asignado en la Resolución del consejero de Empresa, Autónomos y Energía por la cual se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones 2026-2027 para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas dentro del Programa FEDER 2021-2027 (BOIB n.º 69, de 02 de junio de 2026).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Por todo ello, dicto la siguiente</span></span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="text-align:center"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Resolución</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Aceptar la renuncia a las subvenciones concedidas para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas en el Programa FEDER 2021-2027 (FOTOPAR 2026) a los beneficiarios de los expedientes que aparecen en el anexo.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. Revocar la concesión de las subvenciones detalladas en el anexo y por los importes que también se indican.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. Autorizar y disponer negativamente el gasto a favor de los beneficiarios por los importes detallados en el anexo con cargo a las partidas presupuestarias 2026/G/731A01/78000/00/19701/31111 y 2026/G/731A01/78000/00/19701/FI026 indicadas en el anexo I. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. Declarar concluido el procedimiento y por tanto, archivar los expedientes.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. Publicar esta Resolución en el </span><em><span style="background-color:null">Boletín Oficial de las Islas Baleares</span></em><span style="background-color:null">.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Interposición de recursos</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Empresa, Autónomos y Energía en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
