    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A fecha de la firma electrónica, el director general de Economía Circular, Transición Energética y Cambio Climático ha formulado la siguiente propuesta definitiva:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El 11 de septiembre de 2021, en el BOIB núm.125, se publicó la convocatoria pública de subvenciones para la realización de instalaciones de autoconsumo con fuentes de energía renovable , con o sin almacenamiento, y la incorporación de almacenamiento en instalaciones de autoconsumo con fuentes de energía ya existentes, en el sector residencial, las administraciones públicas y el tercer sector, en el marco del Plan de Recuperación, Transformación y Resiliencia europeo, mediante la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 6 de septiembre de 2021, modificada por la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 19 de octubre de 2022 (BOIB núm.137, de 22 de octubre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La Dirección General de Economía Circular, Transición Energética y Cambio Climático concedió una subvención a las personas o entidades que figuran en el anexo de esta Propuesta en el marco de la convocatoria para instalaciones de autoconsumo con fuentes de energía renovable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Las personas o entidades que figuran en el anexo aportaron la documentación requerida para la justificación de la realización de las actuaciones subvencionadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Los técnicos de la Dirección General de Economía Circular, Transición Energética y Cambio Climático han examinado la documentación aportada y han emitido un informe desfavorable a la justificación de los expedientes descritos en el anexo con la motivación que también figura en él. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El 30 de julio de 2026 se emitió una propuesta de resolución provisional de revocación del director general de Economía Circular, Transición Energética y Cambio Climático (BOIB n.º 98, de 6 de agosto de 2026).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Se ha agotado el plazo de diez días hábiles que se concedía para presentar alegaciones sin que se hayan presentado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El consejero de Empresa, Autónomos y Energía es el órgano competente para resolver este procedimiento dada la estructura orgánica del Gobierno de las Illes Balears y de acuerdo con la Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la cual se establecen las bases reguladoras para la concesión de subvenciones en materia de energía. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La Ley&amp;nbsp;38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El Real Decreto&amp;nbsp;887/2006, de 21 de julio, por el cual se aprueba el Reglamento de la Ley&amp;nbsp;38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El Decreto Legislativo&amp;nbsp;2/2005, de 28 de diciembre, por el cual se aprueba el Texto refundido de la Ley de subvenciones (BOIB n.º&amp;nbsp;196, de 31 de diciembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El Decreto&amp;nbsp;75/2004, de 27 de agosto, por el cual se despliegan determinados aspectos de la Ley de finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las &lt;em&gt;Illes Balears&lt;/em&gt; (BOIB n.º&amp;nbsp;122, de 2 de septiembre de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. El Real Decreto&amp;nbsp;477/2021, de 29 de junio, por el cual se aprueba la concesión directa en las comunidades autónomas y en las ciudades de Ceuta y Melilla de ayudas para la ejecución de varios programas de incentivos ligados al autoconsumo y al almacenamiento con fuentes de energía renovable, así como a la implantación de sistemas térmicos renovables en el sector residencial, en el marco del Plan de Recuperación, Transformación y Resiliencia europeo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. La Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 6 de septiembre de 2021 por la cual se aprueba la convocatoria pública de subvenciones para la realización de instalaciones de autoconsumo con fuentes de energía renovable, con o sin almacenamiento, y la incorporación de almacenamiento en instalaciones de autoconsumo con fuentes de energía ya existentes, en el sector residencial, las administraciones públicas y el tercer sector, en el marco del Plan de Recuperación, Transformación y Resiliencia europeo (BOIB n.º&amp;nbsp;125, de 11 de septiembre de 2021).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. La Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática por la cual se modifica y amplía el crédito de la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 6 de septiembre de 2021 por la cual se aprueba la convocatoria pública de subvenciones para la realización de instalaciones de autoconsumo con fuentes de energía renovable, con o sin almacenamiento, y la incorporación de almacenamiento en instalaciones de autoconsumo con fuentes de energía ya existentes, en el sector residencial, las administraciones publicas y el tercer sector, en el marco del Plan de Recuperación, Transformación y Resiliencia europeo NextGenerationEU (BOIB núm.137, de 22 de octubre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. La Orden&amp;nbsp;HFP/1030/2021, de 29 de septiembre, por la cual se configura el sistema de gestión del Plan de Recuperación, Transformación y Resiliencia, así como por la Orden&amp;nbsp;HFP/1031/2021, de 29 de septiembre, por la cual se establece el procedimiento y formato de la información a proporcionar por las entidades del sector público para el seguimiento del cumplimiento de los hitos y objetivos y de ejecución presupuestaria y contable de las medidas de los componentes del Plan de Recuperación, Transformación y Resiliencia. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Revocar la concesión de las subvenciones detalladas en el anexo y por los importes que en él se indican.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Autorizar y disponer negativamente el gasto a favor de los beneficiarios por los importes detallados en el anexo con cargo a la partida presupuestaria que también se indica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Declarar concluido el procedimiento y, por lo tanto, archivar los expedientes indicados en el anexo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Publicar esta Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta Resolución, que agota la vía administrativa, cabe interponer un recurso potestativo de reposición ante el consejero de Empresa, Autónomos y Energía en el plazo de un mes contado desde el día siguiente al de su publicación, de acuerdo con los artículos&amp;nbsp;123 y 124 de la Ley&amp;nbsp;39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo&amp;nbsp;57 de la Ley&amp;nbsp;3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También cabe interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contados desde el día siguiente al de la publicación de la resolución, de acuerdo con el artículo&amp;nbsp;46 de la Ley&amp;nbsp;29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
