&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. El 17/08/2018 el vicepresidente de Ports de les Illes Balears emitió una carta informativa relativa al estado de las concesiones de las casetas de&amp;nbsp;Portocolom, y concretamente, en relación con la extinción de estas el día 29 de julio de 2018, por haber transcurrido el plazo máximo de 30 años desde la entrada en vigor de la Ley 22/1988, de 28 de julio de Costas. Simultáneamente Ports de les Illes Balears informó públicamente del procedimiento para solicitar nuevas concesiones (www.portsib.es).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Un número considerable de interesados han presentado solicitudes de nueva concesión, que figuran en el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. El 20/11/2024 se formalizaron las actas de reversión de las concesiones administrativas relativas a las casetas del puerto de&amp;nbsp;Portocolom.&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. En este momento está en fase de ejecución el&amp;nbsp;&lt;em&gt;Proyecto&amp;nbsp;constructivo&amp;nbsp;de&amp;nbsp;rehabilitación&amp;nbsp;de&amp;nbsp;los&amp;nbsp;conjuntos&amp;nbsp;de casetas varaderos de Portocolom y la reforma de la urbanización de diversas partes del puerto de Portocolom, &lt;/em&gt;la finalización está prevista para enero de 2027, habiéndose formalizado la recepción parcial por la puesta en servicio de la zona denominada ES&amp;nbsp;BABO.&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. En el&amp;nbsp;BOIB&amp;nbsp;n.º 82 de 20/06/2026 se publicó la lista provisional de solicitudes para la ocupación de las casetas de ES&amp;nbsp;BABO&amp;nbsp;otorgando el plazo de 10 días para presentar alegaciones.&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Consideraciones jurídicas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. La competencia exclusiva sobre el dominio público portuario en los puertos de las Islas Baleares que no sean declarados de interés general corresponde a la Comunidad Autónoma, según lo dispuesto en el artículo 30.5 de la Ley Orgánica 2/1983, del Estatuto de Autonomía de las Islas Baleares, reformada por la LO 1/2007, de 28 de febrero, y de acuerdo con el artículo 3 de la Ley 10/2005, de Ports de les Illes Balears. En este sentido el artículo 26.2 de esta Ley atribuye a Ports de les Illes Balears las facultades ejecutivas respecto a los puertos de competencia autonómica.&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. La Ley 10/2005, de 21 de junio, de ports de les Illes Balears, dispone en el artículo 59 que la utilización por parte de terceros del dominio público portuario para usos en los que concurran circunstancias especiales de exclusividad, de intensidad, de peligrosidad o de rentabilidad, o que comporten la ejecución de obras o de instalaciones, requiere el otorgamiento de la preceptiva autorización o concesión administrativa, según corresponda.&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. La mencionada Ley 10/2005, en la disposición transitoria&amp;nbsp;7ª, establece que las concesiones vigentes otorgadas con anterioridad a la entrada en vigor de la Ley 22/1988, de 28 de julio, de costas, finalizarán de acuerdo con aquello regulado en la disposición transitoria&amp;nbsp;5ª&amp;nbsp;de la mencionada Ley y en la disposición transitoria&amp;nbsp;14ª&amp;nbsp;del Reglamento general para su desarrollo y ejecución, hoy disposición transitoria&amp;nbsp;16ª&amp;nbsp;del Real Decreto 876/2014, de 10 de octubre.&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. De acuerdo con esta disposición transitoria&amp;nbsp;16ª&amp;nbsp;del Real Decreto 876/2014 &lt;em&gt;“se considerará en todo caso incompatible con los criterios de ocupación del dominio público establecidos en la Ley 22/1988, de 28 de julio, el mantenimiento de concesiones a perpetuidad, por tiempo indefinido o sin plazo limitado. En todo caso, se entenderá que las concesiones vigentes antes del 29 de julio de 1988 fueron otorgadas por un plazo máximo de 30 años a contar desde esta fecha...”,&lt;/em&gt; por lo que las mencionadas concesiones se consideran extinguidas desde el pasado día 28 de julio de 2018, como es el caso de las casetas de&amp;nbsp;Portocolom.&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. El artículo 65 de la mencionada Ley establece que quedan sujetas a autorización previa de Ports de les Illes Balears las actividades que se desarrollen en el espacio portuario que no requieran la ejecución de obras, como también la ocupación del dominio público portuario con instalaciones desmontables o bienes muebles por un periodo de hasta 4 años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6. El artículo 57 del Decreto 11/2011, de 18 de febrero, de aprobación del Reglamento de despliegue y ejecución de determinados aspectos de la Ley 10/2005, regula el procedimiento de otorgamiento de autorizaciones, que, con carácter general, se inicia a solicitud de la persona interesada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;7. &lt;span style="background-color: white"&gt;El arte.74.3 de la Ley 22/1988 de 28 de julio de la Ley de Costas establece que respecto a las concesiones y autorizaciones dispone:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="background-color: whitesmoke"&gt;En el otorgamiento de las solicitudes se observará la orden de preferencia que se establezca en las normas generales y específicas correspondientes. En su defecto serán preferidas las de mayor utilidad pública. Solo en caso de identidad entre varias solicitudes se tendrá en cuenta la prioridad en la presentación.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Como se ha dicho en este momento todavía está en fase de ejecución &lt;em&gt;el&amp;nbsp;Proyecto&amp;nbsp;constructivo&amp;nbsp;de&amp;nbsp;rehabilitación&amp;nbsp;de&amp;nbsp;los&amp;nbsp;conjuntos&amp;nbsp;de casetes varaderos de Portocolom y la reforma de la urbanización de diverses partes del Puerto de Portocolom, &lt;/em&gt;la finalización que está prevista para enero de 2027, habiéndose formalizado la recepción parcial por su puesta en servicio de la zona denominada ES&amp;nbsp;BABO.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Por lo anterior se considera en este momento, el otorgamiento de autorizaciones temporales para la ocupación de las casetas y espacios de amarre colindantes, teniendo en cuenta las solicitudes de concesión presentadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En el&amp;nbsp;BOIB&amp;nbsp;n.º 82 de 20/06/2026 se publicó la lista provisional de solicitudes para la ocupación de las casetas de ES&amp;nbsp;BABO&amp;nbsp;otorgando el plazo de 10 días para presentar alegaciones. Las alegaciones presentadas hacen referencia a que se considera que se tiene que dar prioridad a quien presentó el proyecto básico tal como se requería hasta final del 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Respecto a estas alegaciones se tiene que decir que estos proyectos presentados por los interesados formaron parte de la documentación facilitada al proyectista a quien finalmente el 2020 se encargó la redacción de un proyecto de rehabilitación integral del conjunto de casetas de&amp;nbsp;Portocolom. Se tiene que reconocer que, para los interesados, tener que presentar el proyecto básico supuso además de un coste adicional, precisar de más tiempo para presentar su solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;También se debe tener en cuenta que la necesidad de tener que presentar un proyecto básico suponía que necesariamente se requería que la solicitud tuviera por objeto una caseta en particular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Posteriormente, a partir del año 2020, Ports de les Illes Balears decidió asumir directamente la redacción de un proyecto integral de rehabilitación de las casetas de&amp;nbsp;Portocolom, así como la ejecución de las obras, a los efectos de garantizar la necesaria uniformidad en la actuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Por lo tanto, la prioridad que se establece para el otorgamiento de las autorizaciones de la zona de ES&amp;nbsp;BABO&amp;nbsp;tiene que ser, en primer lugar, por orden de presentación, entre las solicitudes específicas que presentaron proyecto básico y, en segundo lugar, por orden de presentación del resto, incluidas las genéricas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;8. Conforme&amp;nbsp;el art.3.1. e) de la Ley 40/2015 de 1 de octubre las Administraciones&amp;nbsp;Públicas&amp;nbsp;tendrán que respetar sus actuaciones y relaciones, entre otras, el principios de buena fe y confianza legitima.&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;9. El artículo 33.1.d) de la Ley 10/2005, de 21 de junio, de ports de les Illes Balears, atribuye al Consejo de Administración, entre otras funciones, la de otorgar los títulos jurídicos, las concesiones, licencias y autorizaciones para la ocupación del dominio público portuario y para la prestación de los servicios en los puertos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En virtud del Acuerdo de 30 de septiembre de 2021 del Consejo de Administración de Ports de les Illes Balears (BOIB&amp;nbsp;n.º 140, de 12/12/2021), se delegó en el vicepresidente de Ports de les Illes Balears el otorgamiento de autorizaciones, por un periodo máximo de cuatro años, para actividades que se desarrollen en el espacio portuario que no requieren ejecución de obras, para la ocupación del dominio público portuario con instalaciones desmontables o bienes amuebles, y para la prestación de servicios comerciales en el dominio público portuario, que no tengan el carácter de servicios portuarios básicos, y actividades industriales, artesanales o de naturaleza similar.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;10. De conformidad con el artículo 45 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, los actos administrativos serán objeto de publicación cuando lo aconsejen razones de interés público apreciadas por el órgano competente.&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Por todo esto, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. Aprobar la lista definitiva de adjudicatarios condicionada a la aceptación de las condiciones de la autorización, y hacer la oferta de condiciones para el otorgamiento de las correspondientes autorizaciones temporales para ocupación de caseta y amarre en la zona de ES&amp;nbsp;BABO&amp;nbsp;de&amp;nbsp;Portocolom, conforme el anexo 1.&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. Publicar la Resolución en la página web de Ports de les Illes Balears y en el Boletín Oficial de las Islas Baleares (BOIB).&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra esta Resolución, que agota la vía administrativa, puede interponer recurso potestativo de reposición ante el Consejo de Administración de Ports de les Illes Balears, en el plazo de un mes a contar desde el día siguiente de la publicación, de conformidad con aquello que establecen los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;También puede interponer alternativamente recurso contencioso-administrativo ante el Tribunal de&amp;nbsp;Instancia&amp;nbsp;de Palma Sección de lo Contencioso- Administrativo en el plazo de dos meses a contar desde el día siguiente de la publicación, de conformidad con aquello que dispone el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Palma, en la fecha de la firma electrónica&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;em&gt;(11 d&amp;apos;agost de 2026)&lt;/em&gt;&lt;/p&gt;
