<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">De una parte, Sandra Fernández Herranz, consejera de Familias, Bienestar Social y Atención a la Dependencia del Govern de les Illes Balears en virtud del Decreto 7/2025 del 11 de julio, de la presidenta de las Illes Balears, de modificación del Decreto 8/2023, del 10 de julio, de la presidenta de las Illes Balears, por el cual se determina la composición del Govern y se establece la estructura de la Administración de la Comunitat Autònoma de les Illes Balears y el Decreto 8/2025 del 11 de julio, de la presidenta de las Illes Balears por el cual se dispone el cese y nombramiento de miembros del Govern de les Illes Balears, en representación de la Administración de la Comunitat Autònoma de les Illes Balears, con CIF S0711001H, en el ejercicio de las facultades que le atribuye la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunitat Autònoma de les Illes Balears.</span></span></span></p>

<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Cada una de ellas es reconocida en la respectiva y correspondiente representación que ejerce y con la capacidad legal necesaria para la firma del presente documento.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Exponen</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">1. Mediante Acuerdo del Consell de Govern de 14 de marzo del 2025, se aprobó la previsión de las prestaciones y los servicios que se deben concertar durante el año 2025. Esta previsión fue modificada mediante Acuerdo del Consell de Govern de 5 de septiembre del 2025.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">2. El 16 de septiembre del 2025, la directora general de Familias, Infancia, Juventud, Diversidad e Igualdad emitió un informe justificativo relativo a la necesidad de concertar plazas del servicio de vivienda de emancipación para jóvenes de 18 a 25 años que han sido tutelados por la Administración para los años 2025-2029.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">3. En la misma fecha, la consejera de Familias, Bienestar Social y Atención a la Dependencia resolvió iniciar el expediente de concertación del servicio de vivienda de emancipación para jóvenes de 18 a 25 años que han sido tutelados por la Administración para los años 2025-2029.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">4. En fecha de 5 de noviembre del 2025, el jefe de departamento de Menores y Familias emitió un nuevo informe de determinación del módulo económico máximo a aplicar en el concierto del servicio de vivienda de emancipación para jóvenes mayores de 18 años que han sido tutelados por la Administración, con las siguientes cantidades, en relación a la isla de Mallorca:</span></span></span></p>

En fecha de 14 de noviembre del 2025, Intervención General de la Comunidad Autónoma de les Illes Balears emitió un informe de fiscalización previa favorable.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">6. La Resolución de la consejera de Familias, Bienestar Social y Atención a la Dependencia por la cual se convoca la acción concertada del servicio de vivienda de emancipación para jóvenes de 18 a 25 años que han sido tutelados por la Administración (BOIB núm. 151, del 15 de noviembre), establecía un plazo de 7 días hábiles para presentar solicitudes.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">7. Finalizado el plazo para la presentación de solicitudes, el 9 de marzo del 2026, el jefe de departamento de Menores y Familias emitió informe de comprobación del cumplimento de los requisitos establecidos en la convocatoria por parte de la Fundación Aldaba, y, en la misma fecha, la directora general de Familias, Infancia, Juventud, Diversidad e Igualdad consideró la citada entidad, con CIF G82453606 idónea para la concertación de 6 plazas para la prestación del servicio de vivienda para jóvenes de 18 a 25 años que han sido tutelados por la Administración.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">8. En fecha 15 de abril de 2026, la consejera de Familias, Bienestar Social y Atención a la Dependencia autorizó la concentración de 6 plazas del servicio de vivienda de emancipación para jóvenes de 18 a 25 años que han sido tutelados por la Administración con la Fundación Aldaba, con CIF G82453606 y autorizó el gasto máximo estimado a favor de esta enditad por importe de 341.001,84 € (trescientos cuarenta y un mil y un euros con ochenta y cuatro céntimos), a distribuir entre 2026 y 2030, periodo de vigencia del concierto.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Que, estando ambas partes conformes con el concierto, lo llevan a cabo de acuerdo con las siguientes:</span></span></span></p>

<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El objeto es la concertación con la Fundación Aldaba, con CIF G82453606, de 6 plazas ofrecidas en la convocatoria de conciertos sociales para la prestación del servicio de vivienda de emancipación para jóvenes de 18 a 25 años que han sido tutelados por la Administración.</span></span></span></p>

<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El régimen de la concertación se establece en las estipulaciones contenidas en el documento de formalización del concierto y en el Pliego de prescripciones técnicas para la concertación de plazas del servicio de vivienda para jóvenes que han sido tutelados por la Administración.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>3. Personas usuarias</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Las personas beneficiarias del servicio son las personas jóvenes de 18 a 25 años en riesgo de exclusión social que no tienen apoyo, que han sido objeto de una medida de protección y no pueden volver con su familia nuclear, motivo por el que han de asumir un proceso de autonomía personal, y que tienen su domicilio o residencia en el territorio de la comunidad autónoma de las Illes Balears.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>4. Designación y acceso de las personas usuarias</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Corresponde a la persona usuaria o, si procede, a la persona tutora o representante legal, presentar la solicitud de plaza en el Registro de la Consejería de Familias, Bienestar Social y Atención a la Dependencia del Govern de les Illes Balears.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">La tramitación de las solicitudes de acceso al servicio de vivienda de emancipación, así como las resoluciones de denegación o acceso corresponden a la Dirección General de Familias, Infancia, Juventud, Diversidad e Igualdad.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Resuelta la concesión de la plaza, la persona usuaria dispone de un periodo de treinta días naturales de adaptación al servicio. Si existen circunstancias que impidan la atención de la persona usuaria, la entidad tendrá que comunicarlo al órgano competente -mediante informe razonado- que adoptará la resolución que corresponda.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">En caso de no haber disponibilidad de plazas del servicio de vivienda de emancipación, la Consejería de Familias, Bienestar Social y Atención a la Dependencia habilitará una lista de espera que se gestionará de acuerdo con lo dispuesto en la normativa específica vigente.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El servicio está obligado a aceptar a las personas usuarias designadas por la Consejería y, una vez se le haya notificado la resolución de adjudicación de plaza en el servicio, deberá llevar a cabo el ingreso efectivo, de acuerdo con la resolución de adjudicación.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>5. Incidencias</strong></span></span></span></p>
<p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">La Consejería de Familias, Bienestar Social y Atención a la Dependencia debe conocer, en todo momento, las plazas disponibles del servicio. La entidad concertada debe comunicar al Servicio de Familias de la Dirección General de Familias, Infancia, Juventud, Diversidad e Igualdad mediante el correo electrónico pap@dgmenors.caib.es, el mismo día que se produzca, cualquier tipo de variación y incidencia que surja en relación con la atención a las personas usuarias o con su incorporación al centro.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Esta información también debe incluirse en el apartado de Observaciones del listado de facturación mensual que emite la entidad juntamente con la factura.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>6. Facturación del servicio</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">La entidad titular no puede facturar, a las personas usuarias ninguna cantidad adicional por la prestación de los servicios que prevé este Pliego.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Si se ofrecen servicios o prestaciones distintos a los que prevé este Pliego, serán voluntarios y no tendrán carácter discriminatorio ni afán de lucro. En este caso, la entidad debe comunicarlo por escrito a la Consejería de Familias, Bienestar Social y Atención a la Dependencia mediante una memoria técnica del servicio complementario en que conste una descripción de los medios materiales y humanos que utilizará para prestarlo y el listado de personas usuarias que los han ocupado mensualmente.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El importe del servicio por mes fijado se abonará mensualmente a la entidad gestora del servicio de vivienda de emancipación por mensualidades vencidas, con la presentación previa de la declaración de plazas ocupadas del servicio concertado y la lista de las personas usuarias que las han ocupado mensualmente, previa revisión de conformidad del Servicio de Familias.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Sólo pueden facturarse y cobrarse los servicios concertados.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Antes del día 31 de marzo de cada año de vigencia del concierto, la entidad gestora debe presentar una memoria relativa a la prestación del servicio del año anterior, con el resumen de la ocupación mensual del servicio concertado, el número de personas usuarias atendidas y los indicadores que determine la Consejería de Familias, Bienestar Social y Atención a la Dependencia, juntamente con un informe de auditoria externa de las cuentas del servicio y de la aplicación de los fondos recibidos por la entidad en concepto de abono del concierto.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">En todo caso, el servicio concertado queda sujeto al régimen de control financiero ejercido por Intervención General de la Comunitat Autònoma de les Illes Balears o, si procede, a los otros organismos competentes, autonómicos, estatales o europeos.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">La facturación del concierto se realizará de la siguiente manera:</span></span></span></p>
<p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">a) La entidad concertada debe presentar una factura en formato electrónico en la aplicación FACe (https://face.gob.es/es), en la que ha de constar el importe de la liquidación de los servicios concertados correspondiente al mes anterior. A esta factura se debe adjuntar, debidamente firmada por el representante legal de la entidad concertada, una relación detallada de las personas usuarias, en formato papel y también mediante archivo informático, según el modelo facilitado por la Consejería.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">b) La justificación debe contener los conceptos siguientes: nombre de las personas usuarias, ordenadas alfabéticamente, DNI/NIE, domicilio del servicio, fecha de inicio, fecha de baja (si procede), número de plazas concertadas, importe deducido en concepto de participación económica de la persona usuaria y coste del servicio fraccionado mensualmente. Así mismo, se debe indicar cualquier observación y/o incidencia relativa a la plaza (absentismo, reserva de plaza, hospitalización, etc.).</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>7. Pago</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El pago de las cantidades justificadas mensualmente se efectuarán de la siguiente forma:</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">a) La Consejería de Familias, Bienestar Social y Atención a la Dependencia, mediante la Dirección General de Familias, Infancia, Juventud, Diversidad e Igualdad, tramitará mensualmente la propuesta de pago en concepto de coste del servicio de las plazas concertadas, con la presentación previa de una factura mensual, por parte de las entidades, de las plazas ocupadas o de los servicios concertados.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">b) El pago de la cantidad que corresponda se llevará a cabo en la cuenta corriente que indique la entidad concertada, esta no puede cobrar ninguna cantidad suplementaria en concepto del servicio de vivienda o por cualquier otra prestación que se deba atender en virtud del concierto suscrito.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">c) La percepción indebida de cantidades por parte de la entidad concertada supone la obligación de reintegrarlas por iniciativa propia o por requerimiento de la Consejería, con la audiencia previa de la entidad interesada y con la tramitación del procedimiento que corresponda, de acuerdo con la legislación de finanzas aplicable.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">d) Sin perjuicio de lo que dispone el apartado anterior, los servicios concertados quedan sujetos al control del carácter financiero y a las funciones inspectoras y sancionadoras de las administraciones competentes en la materia.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>8. Auditorías</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">La Consejería de Familias, Bienestar Social y Atención a la Dependencia puede requerir de oficio a la entidad una auditoría técnica para garantizar la calidad y sostenibilidad del servicio concertado, así como los derechos de las personas usuarias atendidas, de acuerdo con lo previsto en el articulo 27.2 del Decreto 48/2017, de 27 de octubre, por el cual se establecen los principios generales a los que deben someterse los conciertos sociales.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>9. Duración y vigencia del concierto</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Los efectos del régimen del concierto se iniciarán el 15 de abril de 2026 o fecha de formalización del concierto, si es posterior, por un periodo de cuatro años.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>10. Condiciones técnicas de ejecución</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Las condiciones técnicas de ejecución deben ajustarse al Decreto 40/2017 y a la normativa vigente en materia de emancipación.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El Pliego general de condiciones técnicas detalla el objeto, los derechos y las obligaciones de ambas partes, los servicios que han de prestarse, los criterios de intervención con las personas usuarias, el régimen de prestación de servicio, los medios que debe aportar la entidad concertada y el sistema de coordinación con la Administración.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>11. La garantía de los derechos de la persona usuaria y la información a la ciudadanía de sus derechos y deberes.</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">La garantía de los derechos de las personas usuarias es la recogida en los artículos 7 y 9 del capítulo II de la Ley 4/2009, del 11 de junio, de servicios sociales de las Illes Balears.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Los deberes de los usuarios se recogen específicamente en las condiciones de uso del servicio de vivienda de emancipación, el proyecto educativo individual que los usuarios se comprometen a firmar y seguir.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>12. Régimen de penalización por incumplimiento de las condiciones del acuerdo de concierto</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El régimen de penalidades e incumplimientos del concierto se halla regulado en la clausula 16 del Pliego de prescripciones técnicas que rigen la concertación del servicio de vivienda de emancipación para jóvenes de 18 a 25 años que han sido tutelados por la Administración que se incorpora como Anexo al documento de formalización.</span></span></span></p>

<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>13. Coordinación y seguimiento técnico del servicio</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">La entidad gestora debe designar una persona responsable del servicio de acompañamiento de emancipación con objeto de coordinar y supervisar la prestación en ejecución de las indicaciones que la Dirección General de Familias, Infancia, Juventud, Diversidad e Igualdad considere oportunas en relación a la prestación del servicio, y ha de tener las atribuciones suficientes para adoptar, de manera inmediata, las decisiones necesarias para asegurarse el buen funcionamiento.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">De manera periódica, se realizarán reuniones de seguimiento entre la persona responsable de la entidad gestora y el personal técnico de la Consejería de Familias, Bienestar Social y Atención a la Dependencia para valorar el cumplimiento de los objetivo fijado en relación con la prestación del servicio.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">La entidad gestora debe colocar en un lugar visible de sus instalaciones la indicación <em>Servicio concertado con el Govern de les Illes Balears</em>, con el logotipo correspondiente, que le proporcionará la Consejería de Familias, Bienestar Social y Atención a la Dependencia. Así mismo, en las comunicaciones y en las relaciones que establezca por escrito con las personas usuarias de las plazas concertadas, debe hacer referencia a esta circunstancia.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>14. Causas de extinción y resolución</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Con carácter general, serán causas de extinción y resolución del concierto las establecidas en la Ley 12/2018, de 15 de noviembre, de servicios a las personas en las Illes Balears, y en el Decreto 48/2017, de 27 de octubre.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">1. Se extinguirá por cumplimiento y vencimiento del plazo, siempre que no se haya renovado de acuerdo con lo establecido reglamentariamente y de acuerdo con las normas presupuestarias, o por resolución.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">2. Serán causas de resolución las siguientes:</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">a) Incumplimiento de las normas de carácter obligatorio a las que están sujetos los servicios sociales y las obligaciones en materia de seguridad e instalaciones.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">b) Prestación defectuosa de las obligaciones acordadas.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">c) Incumplimiento de los objetivos cualitativos y cuantitativos establecidos, siempre que dicho incumplimiento sea imputable a la entidad concertada, así como de las estipulaciones esenciales del acuerdo.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">d) Infracción de carácter grave de la legislación fiscal, laboral, de Seguridad Social, de integración social de los discapacitados y de prevención de riesgos laborales.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">e) Perdida sobrevenida de las condiciones técnicas, económicas y financieras que habilitaron el acuerdo, la revocación o la caducidad de la autorización de apertura y funcionamiento.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">f) Alteración en el control de la entidad por cambios en la participación del accionariado cuando esta condición haya sido determinante en la formalización del acuerdo de acción concertada.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">g) Renuncia de la entidad concertada.</span></span></span></p>
<p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">h) Aquellas otras que se establezcan reglamentariamente.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">3. Son causas de extinción del concierto social:</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">a. El vencimiento del plazo de duración del concierto, excepto que se renueve de acuerdo con lo previsto en el Decreto.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">b. El acuerdo mutuo de las partes, manifestado con la antelación que se determine en el concierto a efectos de garantizar la continuidad del servicio.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">c. El incumplimiento grave de las obligaciones derivadas del concierto por parte de la Administración o de la entidad titular del servicio, con el requerimiento previo para exigir su cumplimiento.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">d. La extinción de la persona jurídica a la que corresponde la titularidad, excepto lo que prevé el articulo siguiente.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">e. La declaración de concurso de acreedores de la entidad titular del servicio.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">f. La revocación de la acreditación administrativa del servicio.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">g. El cese voluntario, debidamente autorizado, de la actividad del servicio.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">h. La modificación de las condiciones técnicas o de las condiciones económicas por parte de la Administración, cuando la entidad de iniciativa privada no preste su conformidad.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">i. La negativa a atender las personas usuarias derivadas por la administración competente de conformidad con el artículo 9.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">j. La baja demanda de las personas con derecho de acceso al servicio, las condiciones de las cuales se fijarán, si resulta oportuno, en los pliegos técnicos.</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">k. El incumplimiento de las condiciones establecidas en el documento de formalización del concierto o de las condiciones establecidas en los pliegos técnicos. Estos incumplimientos deberán constatarse en el seguimiento y control previstos por el artículo</span></span></span></p>
<p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">l. Aquellas otras causas que establece el concierto.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>15. Jurisdicción competente</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Las cuestiones litigiosas que puedan derivarse de la interpretación, ejecución y, si procede, resolución de este concierto serán sometidas a la jurisdicción contencioso administrativa.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Y, como prueba de conformidad con todos los puntos, suscriben este concierto</span></span></span></p>
