    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El Pleno del Ayuntamiento de Sant Antoni de Portmany, en sesión ordinaria de fecha 30/07/2026, acordó aprobar con carácter definitivo, la modificación de la Ordenanza reguladora del régimen tarifario aplicable a la gestión de abastecimiento de agua potable y saneamiento realizada por la mercatil Aguas del Torrente des Furnás S.A., en el municipio de Sant Antoni de Portmany, en el ámbito que se extiende desde el Camino Viejo de Sant Mateu, polígono industrial Montecristo hasta el barrio de Can Xicu Musson, llegando a los alrededores de San Rafael, una vez incorporadas a la misma las modificaciones derivadas del informe sobre evaluación de impacto de género, lo que se hace público para su general conocimiento y en cumplimiento de lo dispuesto en el artículo 70.2 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;ORDENANZA MUNICIPAL REGULADORA DE LA PRESTACIÓN PATRIMONIAL DE CARÁCTER NO TRIBUTARIO del régimen tarifario aplicable a la gestión del servicio de abastecimiento de agua potable y saneamiento, realizada por la mercantil Aguas del Torrente des FurnÁs S.A., en el municipio de Sant Antoni de Portmany&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Vista la Providencia de Alcaldía de fecha 19 de diciembre de 2024, en la que expresa la necesidad de aprobar régimen tarifario aplicable a la gestión del servicio de abastecimiento de agua potable y saneamiento realizada por la mercantil Aguas del Torrente des Furnás S.A., en el municipio de Sant Antoni de Portmany, concretamente en el ámbito que se extiende desde el camino viejo de Sant Mateu, Polígono Industrial Montecristo hasta el Barrio de Can Xicu Musson, alcanzando las inmediaciones de Sant Rafel.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Visto informe técnico-económico en el que se realiza un estudio de las tarifas suscrito por el responsable de Medio Ambiente y con la nota de conformidad suscrito por el Interventor municipal de fecha 17 de febrero de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Visto informe de Secretaría de fecha 4 de abril de 2025 sobre la legislación aplicable y el procedimiento a seguir para la tramitación del expediente administrativo, en el que se concluye que la aprobación de la regularización de las tarifas en los casos de “concesionarios de hecho” puede llevarse a cabo mediante ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Por todo lo expuesto anteriormente, se pretende aprobación de una Ordenanza reguladora del régimen tarifario aplicable a la gestión del servicio de abastecimiento de agua potable y saneamiento realizada por la mercantil Aguas del Torrente des Furnas S.A., en el municipio de Sant Antoni de Portmany, en el ámbito que se extiende desde el camino viejo de Sant Mateu, Polígono Industrial Montecristo hasta el Barrio de Can Xicu Musson, alcanzando las inmediaciones de Sant Rafel, en el sentido siguiente: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;PREÁMBULO&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El art. 25.2 de la Ley 7/1985, de 2 de abril, reguladora de las Bases del Régimen Local establece, entre las competencias propias de los municipios, el abastecimiento de agua potable a domicilio y evacuación y tratamiento de aguas residuales y el art. 26.a) entre los servicios obligatorios en todos los municipios el abastecimiento domiciliario de agua potable. Al ser un servicio de competencia local implica que el mismo se presta directamente por la corporación o bien a través de gestión indirecta, y si fuera prestado por una empresa privada el contrato se debería calificar de concesión de servicios, por cuanto que el mismo se encomienda a título oneroso a una personas jurídica, la gestión de un servicio cuya prestación sea de su titularidad o competencia local , y cuya contrapartida venga constituida bien por el derecho a explotar los servicios objeto del contrato o bien por dicho derecho acompañado del de percibir un precio, en este supuesto, el cobro de las tarifas del suministro del agua (art. 15 de la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público). El derecho de explotación de los servicios implicará la transferencia al concesionario del riesgo operacional. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El servicio público de abastecimiento de agua en poblaciones es un servicio de competencia local, de carácter mínimo y, por tanto obligación de todos los Ayuntamientos con independencia de su población. Tiene además carácter reservado, lo que significa que es de titularidad local, quedando excluidos de su prestación los sujetos privados. Así se deduce de lo establecido en los artículos 25, 26 de la Ley 7/1985.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En el caso del presente expediente, resulta que hay una parte del municipio de Sant Antoni de Portmany, que se extiende desde el camino viejo de Sant Mateu, Pol. Industrial de Montecristo hasta el Barrio de Can Xicu Musson, alcanzando las inmediaciones del núcleo de Sant Rafel, donde dicho servicio está siendo prestado mediante particulares, en este caso, la sociedad AGUAS DEL TORRENTE DES FURNAS SA, que no ostenta título administrativo alguna para la prestación delegada de dicho servicio. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;La jurisprudencia ha venido constantemente a amparar el ejercicio de potestades administrativas frente a estas empresas “concesionarias de hecho”, pese a no contar con una relación jurídica bilateral entre estas y el Ayuntamiento, y ello sobre la base de la condición esencial del servicio y su carácter estrictamente público. A modo de ejemplo, a parte del anterior citado, la STS de 28 de octubre de 1993, que considera que el suministro de agua potable a urbanizaciones por empresas privadas sin vínculo concesional “debe encuadrarse dentro de la libertad de empresa, pero mediatizada por la intervención administrativa”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En el presente supuesto, al no existir vínculo contractual no es posible la revisión de precios de un contrato que no existe, y que la empresa está prestando de forma voluntaria. Ahora bien, es necesario tener en cuenta que se puede dar la circunstancia de la ruptura del equilibrio en la prestación. Así, el Informe 76/2021, de 29 de julio, de la Junta Consultiva de Contratación Pública del Estado señala: “La ejecución de prestaciones a favor de una entidad pública en ausencia de todo contrato público que la ampare no puede realizarse de forma que una de las partes se enriquezca de modo indebido. Tal cosa ocurriría si la entidad contratante exigiese la realización de la prestación sin pagar cantidad alguna a cambio. Por esta razón, es tradicional en un nuestro derecho entender que el carácter sinalagmático de la relación jurídica entablada se quebraría si la entidad contratante no paga adecuadamente por la prestación realizada, vulnerando el principio de justo equilibrio entre las prestaciones…”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Teniendo en cuenta que el propio Ayuntamiento de Sant Antoni de Portmany, ha venido aprobando modificaciones a la Ordenanza municipal reguladora de la prestación patrimonial de carácter no tributario derivada de la gestión del servicio público de abastecimiento y agua potable, respecto al contrato de gestión de servicio público, es lógico y proporcionado, y además se daría pleno cumplimiento a los principios de legalidad e igualdad, regular mediante ordenanza, al menos el régimen tarifario de dichos “concesionarios de hecho” como el caso de este expediente. De dicha forma se garantiza cumplir con los principios de transparencia y participación ciudadana. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En virtud del principio de proporcionalidad, se contiene la regulación imprescindible respecto al régimen tarifario, que es el objetivo que pretende la norma. Por cuanto a los principios de necesidad y eficacia, los fines perseguidos son claros, siendo su regulación mediante ordenanza el más adecuado para su consecución, puesto que afecta a un indeterminado número de personas y por un tiempo indeterminado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Artículo 1. Objeto &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El objeto de la presente ordenanza es fijar el régimen de prestación de servicios, en cuanto al régimen tarifario, del suministro de agua potable y saneamiento por parte de la prestadora del servicio privado AGUAS DEL TORRENTE DES FURNAS SA cuyo servicio se extiende desde el camino viejo de Sant Mateu, Pol. Industrial de Montecristo hasta el Barrio de Can Xicu Musson, alcanzando las inmediaciones del núcleo de Sant Rafel.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Artículo 2. Obligados al pago&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Están obligados al pago las personas físicas y jurídicas que sean titulares del contrato de suministro o utilicen o se beneficien por la prestación de los citados servicios. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Artículo 3. Obligación de contribuir &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Nace la obligación de satisfacer el régimen tarifario cuando se inicia la prestación del servicio. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Artículo 4. Tarifa &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Las tarifas exigibles por los servicios de abastecimiento de agua potable serán las siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Disposición Adicional&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;La presente ordenanza tendrá carácter provisional y estará vigente mientras el Ajuntament de Sant Antoni de Portmany no acuerde el establecimiento del servicio municipal de suministro de agua potable y saneamiento en los ámbitos objeto de esta Ordenanza, e inicie la prestación del referido servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;La presente Ordenanza municipal entrará en vigor a los quince días de su publicación íntegra en el Boletín Oficial de las Islas Baleares, de conformidad con los artículos 65-2º y 70-2º de la Ley 7/1985, de 2 de abril, Reguladora de las bases del Régimen Local, permaneciendo en vigor hasta su modificación o derogación expresa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra el presente Acuerdo, podrá interponerse recurso contencioso-administrativo, ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de Baleares con sede en Palma, en el plazo de dos meses a contar desde el día siguiente a la publicación del presente anuncio, de conformidad con el artículo 46 de la Ley 29/1998, de 13 de julio, de la Jurisdicción Contencioso-Administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
