font-size: 12px">El apartado 9.3. de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las IllesBalears (FOGAIBA) de 10 de septiembre de 2015 por la cual se convocan, subvenciones para la creación de empresas de jóvenes agricultores, correspondientes en 2015-2019, especifica que la resolución exprés se notificará a las personas interesadas mediante su publicación al Boletín Oficial de las Islas Baleares de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.<span style="display: block; font-size: 12px"><span style="background-color: rgb(255, 255, 255)">1. Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015, por la cual se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores. La Resolución mencionada se modificó en fecha 26 de abril de 2016 (BOIB n.º 54).</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">2. Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de los interesados que figuran en el anexo de la Resolución con los datos y los importes correspondientes.</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: rgb(255, 255, 255)">3. El 8 de septiembre de 2022, en el BOIB n.º 118, se publicó la Resolución de la concesión a los beneficiarios de las ayudas, RES1 de fecha 1 de septiembre 2022, en la cual se incluye JOAN SIQUIER GOMAS (n.º Exp. CEJA2021_1/130), con un importe delgada de 46.700,00 €.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: rgb(255, 255, 255)">4. El 27 de noviembre de 2021 (registro de entrada GOIBE882801), el beneficiario presenta la solicitud del segundo pago y el servicio de gestión de ayudas al desarrollo rural revisa el expediente y se comprueba que no aporta certificado de producción integrada correspondiendo a una prima de 5.000,00 € y que la explotación no logra 42,92 UBM para ser beneficiaria del complemento de orientación ganadera de 6.700,00 €.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: rgb(255, 255, 255)">5. Este hecho implica realizar una revocación parcial de 11.700,00 €, por lo tanto, el importe de ayuda auxiliable es de 35.000,00 € y el pago correspondiente al 2.º tramo será de una cuantía de 11.650,00 €.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">6. El 16 de mayo de 2026 se notifica a la persona interesada a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones, mediante publicación a la página web del FOGAIBA, el informe propuesta provisional de resolución de la revocación parcial.</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">7. Una vez transcurridos los 10 días hábiles, la persona interesada no ha presentado ninguna alegación.</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">8. El artículo 43 del Texto refundido de la Ley de subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que “Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los cuales está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente”.</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: rgb(255, 255, 255)">9. Se ha considerado el informe propuesta provisional de resolución de la revocación parcial/Resolución de revocación parcial de la ayuda concedida a JOAN SIQUIER GOMAS con NIF **3801**, de día 16 de mayo de 2026.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: rgb(255, 255, 255)">Fundamentos de derecho</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: rgb(255, 255, 255)">1. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></span></p> <p style="text-align: center"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Propuesta de Resolución </strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Por todo esto, se propone al vicepresidente del FOGAIBA que dicte una resolución en los términos siguientes:</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">1. Revocar parcialmente las resoluciones de ayuda concedidas a las personas beneficiarias por el importe y con los plazos detallados en el anexo de esta resolución, que es de 1 expediente y que empieza y acaba con JOAN SIQUIER GOMAS, que suma un importe total de 11.700,00 €, relativa a la línea de ayuda «Creación de empresas de jóvenes agricultores».</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">2. Finalizar el procedimiento de revocación del expediente CEJA2021_1/130.</span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">3.
