&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), publicada en el Boletín Oficial de las Islas Baleares (BOIB) núm. 59, de 10 de mayo de 2025, por la que se convocan, para el ejercicio 2025, subvenciones para la concesión de una ayuda temporal excepcional a las explotaciones del sector ovino de las Illes Balears afectadas por el serotipo 8 de la lengua azul y por las medidas específicas de protección y control, en el marco del Programa de Desarrollo22 AZUL2025_1).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. En fecha 15 de mayo de 2024, SR. JERONI SALOM ALORDA, con NIF ***1105**, titular de la explotación ganadera 034-IB-0000038 y 008-IB-0000236, presentó la solicitud única de la campaña de la PAC 2024, en virtud de la cual solicitaba la ayuda de ovino y cabrú de carne. De acuerdo con el apartado quinto de la Resolución de convocatoria, la solicitud de la ayuda temporal excepcional LBLAVA2025_1 se entiende realizada con la presentación de esta solicitud única.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. En fecha 24 de junio de 2025, el vicepresidente en materia agraria del FOGAIBA dictó resolución de denegación de la ayuda, que fue notificada al interesado mediante publicación en el BOIB en fecha 26 de junio de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. En fecha 18 de julio de 2025, con número de registro de entrada GOIBE512064/2025, ASAJA-BALEARS, con NIF G57050098, actuando en nombre y representación de SR. JERONI SALOM ALORDA, interpuso recurso de alzada contra la resolución antes citada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. En fecha 16 de febrero de 2026, el secretario general [por delegación de la Resolución del consejero de Agricultura, Pesca y Medio Natural de 20 de julio de 2023 por la que se delega el ejercicio de algunas competencias y de la firma de varios actos administrativos y resoluciones en materias de la competencia propia (BOIB núm. 105 de 27 de julio de 2023) que se estimaba el recurso de alzada interpuesto por la persona interesada, se dejaba sin efecto la Resolución impugnada y se ordenaba la comprobación de oficio y verificación del cumplimiento del resto de requisitos exigidos por la convocatoria para que dictara una nueva resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Una vez comprobados los requisitos que establece el apartado del apartado tercero de la Resolución de la convocatoria, se ha constatado que la persona beneficiaria cumple los requisitos para ser beneficiaria de la ayuda y que, por tanto, corresponde la concesión de una ayuda por un importe de 3.000,00 €.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Programa de Desarrollo Rural de las Islas Baleares 2014-2020&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER) y por el que se deroga el Reglamento (CE) núm. 1698/2005 del Consejo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. Reglamento (UE) 2024/3242 del Parlamento Europeo y del Consejo de 19 de diciembre de 2024 por el que se modifica el Reglamento (UE) 2020/2220 en lo que respecta a las medidas específicas adoptadas con cargo al Fondo Europeo Agrario de Desarrollo Rural para proporcionar ayuda adicional a los Estados miembros afectados por desastres&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Propuesta de resolución de concesión &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, se informa favorablemente y proposo al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Conceder la ayuda solicitada a SR. JERONI SALOM ALORDA, con NIF ***1105**&amp;nbsp;un total de 3.000,00 €, relativa a la línea de ayuda “Lengua azul”, detallados en el Anexo I.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Autorizar y disponer el gasto señalado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Notificar la resolución al beneficiario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Determinar que, las obligaciones del beneficiario serán las que establece la convocatoria de referencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución -que no agota la vía administrativa- se puede interponer recurso de alzada ante el consejero de Medio Ambiente, Agricultura y Pesca, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de 16 de marzo, de régimen jurídico de la 122, de la Ley 39/2015, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
