En fecha de 28 de diciembre de 2023 se publicó, en el Boletín Oficial de las Islas Baleares núm. 175, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, mediante procedimiento anticipado de gasto, subvenciones para inversiones en las explotaciones agrarias correspondiente al año 2024, modificada mediante la resolución de fecha 26 de febrero de 2024 (BOIB núm.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. El 15 de abril de 2025, el vicepresidente en materia agraria del FOGAIBA dictó una Resolución de concesión de ayudas para inversiones en las explotaciones agrarias, que se publicó en el Boletín Oficial de las Islas Baleares número 47, de 17 de abril de 2025, en la que figuraba una concesión.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. De conformidad con el apartado sexto de la citada Resolución, el plazo para presentar las solicitudes finalizó el día 17 de abril de 2026.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. El artículo 70.3 del Reglamento de la Ley de Subvenciones, aprobado por Real Decreto 887/2006, de 21 de julio, establece que transcurrido el plazo establecido de justificación sin que ésta se haya presentado ante el órgano competente, éste requerirá al beneficiario para que en el plazo improrrogable de 15 días la presente.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. Considerando esto, el 30 de abril de 2026 se publicó en la web del FOGAIBA el requerimiento para que presentaran en el plazo de 15 días hábiles las solicitudes de pago correspondientes y la documentación que justifica las inversiones, de acuerdo con el artículo 70.3 del Reglamento de la Ley de Subvenciones, aprobado por Real Decreto 887/2006, de 21 de julio. 6. Una vez transcurrido el plazo mencionado no han presentado la documentación requerida, por lo que debe revocarse la ayuda de acuerdo con el artículo 92.1 del Reglamento de la Ley de subvenciones.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">7. El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas establece la obligación de la Administración a dictar resolución expresa y notificarla. En su párrafo segundo especifica que "En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con la indicación de los hechos producidos y las normas aplicables". </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">8. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que “Soca la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos de los que está condicionado a la concesión de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades percibidas indebidamente”. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">9. Ante todo esto, se propone realizar la revocación total debido al incumplimiento de la obligación de realizar, pagar y justificar las inversiones concedidas dentro del plazo establecido.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000"><strong>Fundamentos de derecho </strong></span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">1. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Propuesta de resolución de revocación total </strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Por todo ello, se informa favorablemente y proposo al vicepresidente en materia agraria del FOGAIBA que dicte resolución en los siguientes términos: </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Revocar totalmente la resolución de ayuda concedida al beneficiario por el importe detallado en el anexo de esta resolución, que es un total de 1 expediente, que comienza por y termina con el pomelo de mercadal, srm. y que suma un importe total de 84.000,00€.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2.
