&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. En fecha 26 de junio de 2026 el consejero ejecutivo de Medio Ambiente, Medio Rural y Deportes dictó resolución de declaración de emergencia cinegética en la isla de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. En fecha 4 de julio de 2026 se publicó dicha resolución en el BOIB número 84.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Se ha observado errores materiales al punto 3 b) a. de la mencionada resolución con respecto a los días autorizados con respecto al control de paloma torcaz (&lt;em&gt;Columba palumbus&lt;/em&gt;) y en la tabla del anexo “COTOS: RESUMEN DE CAPTURAS (a presentar por el titular del coto) RESUMEN DE CAPTURAS CORRESPONDIENTES A LA EMERGENCIA CINEGÉTICA TEMPORAL PARA EL CONTROL POBLACIONAL DE LA PALOMA TORCAZ (&lt;em&gt;Columba palumbus&lt;/em&gt;) Y PALOMA BRAVÍA (&lt;em&gt;Columba livia&lt;/em&gt;) 2026”, tanto a la versión castellana como catalana.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El jefe del servicio de Caza ha emitido informe propuesta para la corrección de los errores materiales detectados en la resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;I. Con respecto a la competencia: &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Ley Orgánica 1/2007, de 1 de marzo, por el cual se aprueba el Estatuto de Autonomía de las Islas Baleares. (BOE nº. 52, de 1 de marzo de 2007)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Decreto 106/2010, de 24 de septiembre, sobre el traspaso en los consejos insulares de las funciones y los servicios inherentes a las competencias propias de estas institucio-nes insulares que actualmente ejerce la Administración de la Comunidad Autónoma de las Illes Baleares en materia de caza y de regulación, vigilancia y aprovechamiento de los recursos cinegéticos, como también de pesca fluvial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Ley 4/2022, de 28 de junio, de consejos insulares (BOIB nº. 88, de 7 de julio de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Reglamento Orgánico del Consell de Mallorca (BOIB nº. 89, de 19 de julio de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Decreto de Presidencia del Consell de Mallorca para el cual se crean los departamentos que tienen que estructurar el Gobierno de 10 de julio de 2023 (BOIB nº. 95, de 11.07.2023).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Decreto de Presidencia del Consell de Mallorca por el cual se crean las direcciones insu-lares y las secretarías técnicas en que se tienen que estructurar los departamentos de (BOIB nº. 97, de 13 de julio de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Decreto de Presidencia por el cual se establecen las competencias de los departamentos del Consell Insular de Mallorca (BOIB nº. 106 de 29 de julio de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;II. Con respecto al procedimiento son de aplicación: &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Ley 3/2003, de 26 de marzo, de régimen jurídico de la administración de la Comunidad Autónoma de las Islas Baleares (BOIB nº. 44, de 03 de abril de 2003).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas. (BOE nº. 236, de 2 de octubre de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 109.2 «Las Administraciones Públicas podrán, asimismo, rectificar en cualquier momento, de oficio o a instancias de los interesados los errores materiales, de hecho o aritméticos existentes en sus actos».&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo lo que se ha expuesto, el vicepresidente segundo y consejero ejecutivo de Medio Ambiente, Medio Rural y Deportes dicta la siguiente,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

Modificar los errores materiales del punto 3 b) a. de la mencionada resolución con respecto a los días autorizados con respecto al control de paloma torcaz (&lt;em&gt;Columba palumbus&lt;/em&gt;) y en la tabla del anexo “COTOS: RESUMEN DE CAPTURAS (a presentar por el titular del coto) RESUMEN DE CAPTURAS CORRESPONDIENTES A LA EMERGENCIA CINEGÉTICA TEMPORAL PARA EL CONTROL POBLACIONAL DE LA PALOMA TORCAZ (&lt;em&gt;Columba palumbus&lt;/em&gt;) Y PALOMA BRAVÍA (&lt;em&gt;Columba livia&lt;/em&gt;) 2026”, tanto a la versión castellana como catalana, quedando de la siguiente manera:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra este acto, que no pone fin a la vía administrativa, se puede interponer el recurso de alzada en el plazo de un mes, a contar a partir del día siguiente de recibir esta notificación. El recurso se puede interponer formalmente ante este consejero ejecutivo/consejera ejecutiva o ante el Consejo Ejecutivo del Consell Insular de Mallorca, que es el órgano competente para resolverlo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra la desestimación expresa de este recurso de alzada, podéis interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, contadores a partir del día siguiente de recibir la notificación de la desestimación de dicho recurso de alzada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si han transcurrido tres meses desde la interposición del recurso de alzada y no habéis recibido la notificación de resolución expresa, se entiende desestimado por silencio y podéis interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de seis meses, contadores a partir del día siguiente de la desestimación presunta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No obstante el anterior, podéis interponer, si procede, cualquier otro recurso que consideráis oportuno. Todo eso de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa y la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
