    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Visto el informe técnico con propuesta de resolución de día 26 de enero de 2026, y de acuerdo con el artículo 9.1 del texto refundido de la Ley de evaluación ambiental de las Illes Balears aprobado por Decreto legislativo 1/2020, de 28 de agosto, y el punto 8. d) del artículo 2 del Decreto 10/2025, de 14 de julio, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, y el Decreto 13/2025, de 31 de julio, por el que se corrigen los errores detectados en el Decreto 10/2025,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;RESUELVO FORMULAR&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Informe de impacto ambiental del proyecto de canalización de las telecomunicaciones en un tramo de la calzada de la cima del Puig de Sant Salvador, TM Felanitx.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1. Determinación de sujeción a evaluación ambiental y tramitación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con el Texto refundido de la Ley de Evaluación Ambiental de las Illes Balears, aprobado por Decreto legislativo 1/2020, de 28 de agosto, deben ser objeto de evaluación de impacto ambiental simplificada los proyectos incluidos en el anexo II de esta Ley. Entre los proyectos incluidos en el anexo 2, el «Proyecto de canalización de telecomunicaciones a un tramo de calzada en la cima del Puig de Sant Salvador, Felanitx»,&lt;span style="background-color:white"&gt; se incluye&lt;/span&gt; en el punto 8. &lt;em&gt;&lt;span style="background-color:white"&gt;Infraestructuras de telecomunicación ubicadas en suelo rústico, entre las que se encuentran las canalizaciones lineales (zanjas, conducciones, galerías técnicas) destinadas a telecomunicaciones, cuando afectan suelo rústico.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por tanto, el proyecto debe tramitarse como una evaluación de impacto ambiental simplificada y seguir el procedimiento establecido en la sección 2ª del capítulo II del título II de la Ley 21/2023, de 9 de diciembre, de evaluación de impacto ambiental. Deben cumplirse también las prescripciones de los artículos 21 y 22 del Texto refundido que le sean de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2. Descripción del proyecto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El proyecto consiste en las actuaciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1. Canalizar y soterrar el tendido aéreo de telecomunicaciones existente en un tramo de la calzada de la carretera de acceso a la cima del Puig de Sant Salvador Ma-4011. Con esta actuación se pretende dar servicio de telefonía conectando la instalación de Telefónica con la torre de telecomunicaciones de Cellnex.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2. Realizar 4 arquetas de 600 x 600 x 600 mm a lo largo del trazado de la zanja para conectar el palo existente y la arqueta de acceso a la torre, con el fin de favorecer el tendido de cajas de alta densidad. La distribución de las arquetas se hará cada 200 m y en los cambios de dirección, tal como está indicado en el pliego de condiciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3. Colocar el cableado en tubos hormigonados longitudinalmente, a una profundidad de 0,4 m.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;4. La distancia mínima de seguridad entre las canalizaciones de agua o gas y las del tendido eléctrico será de 0,20 m. El trazado de la instalación eléctrica está condicionado por la presencia de otros servicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;5. Para las excavaciones se utilizará una mini retroexcavadora, martillos neumáticos, tronzadora y herramientas manuales. El transporte de materiales será con camiones o dúmper.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;6. El conjunto de tubos lo forman placas delgadas de hormigón de 150 kg con 15 cm de ancho. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;7. Las zanjas serán rellenadas con hormigón hasta la rasante del terreno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;8. Los pavimentos actuales serán demolidos antes de la ejecución de las zanjas, y se retirará el mobiliario urbano que haya.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;9. Los materiales y tierras sobrantes serán trasladados a un gestor de residuos autorizado. Según los cálculos del redactor, el volumen total de residuos no reutilizables generados por las obras será de 2 m&lt;sup&gt;3&lt;/sup&gt; (0,9 t/m&lt;sup&gt;3&lt;/sup&gt;), con un peso total de 1,8 toneladas. Estos residuos constarán de tierra, asfalto y grava machacada generados por la apertura de las zanjas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;10. El presupuesto total estimado por la obra civil y la gestión de residuos es de 14.452,98 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3. Resumen del documento ambiental&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el documento ambiental solo se considera la alternativa cero (no ejecución) y la alternativa 1 (ejecución del proyecto).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Alternativa cero: El promotor considera que esta opción supondría la pérdida de oportunidad de dar un servicio a los clientes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Alternativa 1: el técnico justifica la ejecución de las obras por la necesidad de dotar a la torre de Cellnex de fibra oscura, mejorando la capacidad y velocidad de transmisión, de acuerdo con la resolución vigente del director general de Estrategia Digital. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los impactos ambientales analizados en el documento son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Durante la fase de ejecución del proyecto:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1.&lt;/strong&gt; Ocupación temporal del espacio de las obras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2.&lt;/strong&gt; Sobre la atmósfera: emisión de gases de combustión y partículas en suspensión e incremento del ruido producido por el tráfico de vehículos y maquinaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.&lt;/strong&gt; Sobre el clima: incremento del consumo energético o la emisión de gases de efecto invernadero.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;4.&lt;/strong&gt; Generación de residuos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5.&lt;/strong&gt; Según el documento ambiental, no se prevén efectos significativos sobre:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- El suelo, ya que la obra se ejecuta íntegramente en la calzada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- El agua.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Los espacios protegidos, los hábitats, el paisaje y el patrimonio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;6.&lt;/strong&gt; Tampoco considera que haya afecciones significativas sobre el uso del suelo, las infraestructuras y servicios, la salud humana ni la microeconomía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Durante la fase de funcionamiento: el documento ambiental concluye que una vez finalizada la obra no habrá impactos ambientales significativos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;4. Consultas a las administraciones públicas afectadas y personas interesadas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Entre el 25 de abril y el 5 de mayo de 2025, &lt;span style="background-color:white"&gt;el Servicio de Evaluación Ambiental solicitó las siguientes consultas previas a las administraciones afectadas y entidades interesadas para determinar si el proyecto debe sujetarse o no a evaluación de impacto ambiental ordinaria, según los artículos 45 a 47 de la Ley 21/2013 de 9 de diciembre, de evaluación ambiental: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Ayuntamiento de Felanitx (SIR núm. de registro: 2025-E-RC-3538).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Servicio de Cambio Climático (VALIB núm. 386024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Departamento de Medio Natural: Servicio de Planificación del Medio (VALIB núm. 383696).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Dirección General de Emergencias e Interior (VALIB 383617).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Departamento de Territorio, Movilidad e Infraestructuras (GOIBE362716/2025).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Servicio de Patrimonio Histórico del Consell de Mallorca (SIR núm. de reg.:REGAGE25e00036191481).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Entidades ecologistas: Amigos de la tierra (Núm. Reg.: GOIBE361750/2025) y GOB&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el expediente constan los siguientes informes de las administraciones consultadas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1. &lt;/strong&gt;Servicio de Cambio Climático y Atmósfera. Dirección General de Economía Circular, Transición Energética y Cambio Climático (de fecha 21/05/2025, VALIB núm. 390891),&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Que concluye lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;« [...] Por todo ello, y en relación a la perspectiva climática en la tramitación ambiental, no se prevé que el proyecto pueda tener efectos significativos, por lo que se emite informe favorable.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2. &lt;/strong&gt;Servicio de Protección de Especies,&lt;span style="background-color:white"&gt; (del 04/06/2025, VALIB núm. 394721)&lt;/span&gt; que concluye:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;“Por todo ello, informo&lt;strong&gt; favorablemente&lt;/strong&gt; sobre el Proyecto de canalización de telecomunicaciones en el Puig de San Salvador, TM. Felanitx, con los siguientes condicionantes:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;1. Hay que preservar la vegetación natural que se encuentra en la zona. No se pueden hacer acopios de materiales, residuos o maquinaria sobre áreas que presenten vegetación.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;2. Con el fin de respetar el nido de halcón peregrino presente en la zona del proyecto, hay que evitar las tareas generadoras de ruidos importantes durante la época de nidificación de la especie, (de febrero a julio).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;3. Habrá que llevar a cabo batidas de búsqueda y retirada de ejemplares de tortuga mediterránea antes del inicio de las obras. Estas prospecciones no deben realizarse en los meses de frío, dado que las tortugas se encuentran enterradas y no se podrían detectar.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;4. En caso de quedar zanjas abiertas, habrá que realizar revisiones diarias para detectar la fauna que pueda haber caído en el interior. Se colocarán elementos para permitir la salida de la fauna.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Este informe se emite sin perjuicio de la obtención de otros informes o autorizaciones que puedan ser necesarias según la legislación vigente.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3. &lt;/strong&gt;Departamento de Medio Natural, de fecha 08/05/2025&lt;span style="background-color:white"&gt;, &lt;/span&gt;que concluye:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;«[...] os comunico que el proyecto (43a/2025 AIA) por el que se pide informe &lt;strong&gt;no está dentro de Red Natura 2000 ni dentro de ningún espacio natural protegido&lt;/strong&gt; y, por el tipo de actuación, no es previsible ningún tipo de afección que disminuya las garantías medioambientales. Por tanto, no es perceptivo el informe de evaluación de las repercusiones ambientales a lo que se refiere el artículo 39 de la Ley 5/2005, de 26 de mayo, para la conservación de los espacios de relevancia ambiental (LECO)»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;4. &lt;/strong&gt;Servicio de Gestión Forestal y Protección del Suelo, DG de Medio Natural y Gestión Forestal. Consejería de Agricultura, Pesca y Medio Natural, &lt;span style="background-color:white"&gt;de&lt;/span&gt; fecha 17/10/2024, que concluye:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;"Dadas las características y la naturaleza de la actuación, se informa lo siguiente como administración competente en materia forestal:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;• Sin ningún inconveniente o consideración específica con relación al riesgo de incendio forestal, aunque en cualquier caso, durante la realización de las obras habrá que cumplir el Decreto 125/2007, de 5 de octubre, por el que se dictan normas sobre el uso del fuego y se regula el ejercicio de determinadas actividades susceptibles de incrementar el riesgo de incendio forestal, especialmente con respecto a las medidas de prevención durante la época de peligro de incendio forestal y las acciones coyunturales de prevención ( art. 82.c).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;• Referente a utilizar maquinaria y equipos, en terreno forestal y áreas contiguas de prevención, cuyo funcionamiento genere deflagración, chispas o descargas eléctricas susceptibles de provocar incendios forestales, debe tenerse en cuenta lo siguiente:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;- El artículo 48.6.d de la Ley 43/2003, modificada por el RD15/2022, que prohíbe el uso de estas máquinas cuando el riesgo de incendios sea muy alto o extremo (Alerta Fuego 4) Se puede consultar en la página &lt;strong&gt;alertafoc.caib.es &lt;/strong&gt;el nivel diario de alerta por riesgo meteorológico de incendio forestal vigente.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;- Las máquinas que se utilicen en terrenos forestales o menos de 500 metros de los mismos se utilizarán extremando las precauciones en su uso y adecuado mantenimiento (se aplicarán métodos de trabajo que eviten la provocación de chispas). El abastecimiento de gasolina de esta maquinaria debe realizarse en zonas de seguridad aclaradas de combustible vegetal. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;- También recordar que el cumplimiento de las medidas incluidas en este informe no excluye de la responsabilidad de los propietarios/promotores en el cumplimiento de la legislación específica adecuada y en el uso responsable de los medios que puedan ser causantes de un incendio forestal o de los daños que un incendio forestal pueda causar."&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5. &lt;/strong&gt;Servicio de Explotación y Conservación del Consell de Mallorca, de fecha 05/08/2025 (expediente 1293125H), que concluye lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;"Informo que para poder continuar con la tramitación del expediente para las obras de paralelismo soterrado por canalización de telecomunicaciones en la carretera Ma-4011 entre el PK 4+900 y el PK 5+250, y dado que la solución establecida en el proyecto presentado no se adapta a la Ley 5/1990 de Carreteras de la CAIB,&amp;nbsp; nos tendrán que hacer llegar el proyecto modificado correspondiente o la adenda del mismo. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Esta adenda al proyecto constructivo deberá ir firmada por técnico competente y deberá incluir todas las actuaciones a llevar a cabo situados a menos de 50 metros de la arista exterior de la explanación de la carretera Ma-4011. Se deberán incluir también en los planos la definición del dominio público viario, del resto exterior de la explanación y de la zona de protección, previa solicitud al Sección de Topografía del Departamento de Territorio, Movilidad e Infraestructuras. En esta documentación deberán cumplirse los condicionantes establecidos en este informe y acotar las distancias indicadas."&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;6. &lt;/strong&gt;Departamento de urbanismo del Ayuntamiento de Felanitx, de fecha 20/05/2025, que concluye:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;«&lt;em&gt;A criterio del técnico que suscribe y respecto a la realización del Proyecto de canalización de telecomunicaciones en el Puig de Sant Salvador, en la documentación presentada no hay aspectos relevantes a mencionar y se&lt;strong&gt; informa favorablemente.&lt;/strong&gt;»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5. Elementos significativos del entorno del proyecto.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;- Régimen de protección territorial:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El proyecto se ejecuta dentro de un&lt;strong&gt; Área Natural de Especial Interés (ANEI) &lt;/strong&gt;de alto nivel de protección (suelo rústico, adaptación a la LSR y la LEN). Se trata de un espacio natural protegido &lt;/span&gt;por la Ley 5/2005, de 26 de mayo, para la conservación de los espacios de relevancia ambiental (LECO) y por la Ley 1/1991, de 30 de enero, de espacios naturales y de régimen urbanístico de las áreas de especial protección de las Illes Balears (LEN)&lt;span style="background-color:white"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Esta área no forma parte de la Red Natura 2000.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;- Riesgos naturales:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;De acuerdo con el Plan Territorial de Mallorca, la zona se ubica en un área de riesgo extremadamente alto de incendios (según el IV Plan General de Defensa contra Incendios Forestales de las Illes Balears) y un &lt;strong&gt;área de alto riesgo de desprendimientos&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;- Biodiversidad&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:white"&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La consulta al Bioatles indica la presencia en la zona de las siguientes&lt;strong&gt; especies &lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;catalogadas o amenazadas: &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;- Aves:&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; &lt;/em&gt;Halcón peregrino&lt;em&gt; (&lt;em&gt;Falco peregrinus&lt;/em&gt;); &lt;/em&gt;Roquero solitario&lt;em&gt; (&lt;em&gt;Monticola solitarius&lt;/em&gt;); &lt;/em&gt;Cuco común&lt;em&gt; (&lt;em&gt;Cuculus canorus&lt;/em&gt;); &lt;/em&gt;Torcecuello euroasiático&lt;em&gt; (&lt;em&gt;Jynx torquilla&lt;/em&gt;); &lt;/em&gt;Chochín común&lt;em&gt; (&lt;em&gt;Troglodytes troglodytes&lt;/em&gt;). &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;- Reptiles:&lt;/strong&gt; Tortuga mediterránea (&lt;em&gt;Testudo hermanni&lt;/em&gt;). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;- Flora:&lt;/strong&gt; Rusco o acebo menor (&lt;em&gt;Ruscus aculeatus&lt;/em&gt;); Aladierno (&lt;em&gt;Rhamnus alaternus&lt;/em&gt;); Palmito (&lt;em&gt;Chamaerops humilis&lt;/em&gt;); Cojín de monja (&lt;em&gt;Teucrium balearicum&lt;/em&gt;). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Observaciones: &lt;/strong&gt;Hay constancia de la &lt;strong&gt;presencia de un nido de halcón peregrino &lt;/strong&gt;en las proximidades del proyecto, aproximadamente a unos 100 m, distancia que coincide con el umbral mínimo de tranquilidad recomendado para esta especie. Asimismo, la actuación afecta &lt;strong&gt;al Área Importante para los Rapaces Diurnos &lt;/strong&gt;(AIRIB-106, Puig de Sant Salvador) hábitat de reproducción de rapaces. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;- Hábitats de interés comunitario (HIC)&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- 4090 Matorrales xerocánticos endémicos oromediterráneos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;- Hidrología subterránea:&lt;/span&gt;&lt;/strong&gt; las&lt;span style="background-color:white"&gt; obras se sitúan sobre la masa subterránea de San Salvador (&lt;strong&gt;código 1819M1&lt;/strong&gt;). Según el Plan Hidrológico vigente de las Illes Balears (2022-2027), esta masa presenta un estado malo (tanto cuantitativamente como y cualitativamente) y calificada como zona de vulnerabilidad moderada a la contaminación de acuíferos. No se han detectado sondeos cercanos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;- Patrimonio cultural: &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Según el Catálogo de Bienes de Interés Cultural (BIC) y el de Bienes Catalogados (BC) del Consell de Mallorca, la actuación se sitúa cerca del Santuario de Sant Salvador (BIC).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Dentro del ámbito municipal, hay otros elementos incluidos en el Catálogo de Patrimonio de Felanitx como son: Sa Capelleta (V5-E-05), la Creu d'en Picot (V5-P-03) , las estaciones de Sant Salvador (V5-E-04) y la cruz de Cristo Rey (V5-E-05).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;6. Consideraciones técnicas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En el proyecto y en el documento ambiental se ha identificado las siguientes carencias:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;a) &lt;/span&gt;&lt;/em&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;No se han valorado adecuadamente las posibles incidencias&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:white"&gt; sobre las especies catalogadas o amenazadas presentes en el ámbito de actuación, incluyendo la presencia del nido de halcón peregrino localizado a aproximadamente 100 m.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;b) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:white"&gt;No se incorpora un plan de vigilancia ambiental que defina el seguimiento de las obras y las medidas de prevención de incidencias ambientales, como derramamientos aceites o de hidrocarburos susceptibles de contaminar el suelo y del acuífero de San Salvador. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Por todo lo anterior, una vez analizados los criterios del anexo III de la Ley 21/2013, de 9 de diciembre, de evaluación ambiental, y dada la naturaleza del proyecto y la ubicación propuesta, no se prevén efectos adversos significativos sobre el medio ambiente, siempre que se apliquen las medidas preventivas y correctoras del documento ambiental y las propuestas en este informe.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;Conclusiones del informe de impacto ambiental&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;Primero. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:white"&gt;No sujetar a evaluación de impacto ambiental ordinaria el proyecto de canalización de telecomunicaciones en un tramo de la calzada de la cima del Puig de Sant Salvador, TM Felanitx, dado que no tiene efectos adversos significativos sobre el medio ambiente, siempre que se cumplan las medidas propuestas en el documento ambiental firmado en enero de 2025 por el biólogo Jorge Ibáñez Giménez,&amp;nbsp; y los siguientes condicionantes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1.&lt;/strong&gt; Se debe obtener informe favorable del Servicio de Explotación y Conservación del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2.&lt;/strong&gt; Dado que el proyecto se ubica en APR de desprendimiento, en aplicación de la Ley 6/1999, de 3 de abril, de las Directrices de Ordenación Territorial de las Illes Balears y de medidas tributarias, y sus modificaciones: «Los usos ubicados en las áreas de prevención de riesgos solo se pueden autorizar con el informe previo favorable de la administración competente en materia de medio ambiente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3. De acuerdo con el informe del Servicio de Protección de Especies&lt;/strong&gt;, de fecha &lt;span style="background-color:white"&gt;04/06/2025,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Hay que preservar la vegetación natural que se encuentra en la zona. No se pueden hacer acopios de materiales, residuos o maquinaria sobre áreas que presenten vegetación. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Con el fin de respetar el nido de halcón peregrino presente en la zona del proyecto, hay que evitar las tareas generadoras de ruido importantes durante la época de nidificación de la especie, (de febrero a julio). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Habrá que llevar a cabo batidas de búsqueda y retirada de ejemplares de tortuga mediterránea antes del inicio de las obras. Estas prospecciones no deben realizarse en los meses de frío, dado que las tortugas se encuentran enterradas y no se podrían detectar. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- En caso de quedar zanjas abiertas, habrá que realizar revisiones diarias para detectar la fauna que pueda haber caído en el interior. Se colocarán elementos para permitir la salida de esta fauna.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;4. Durante la ejecución de las obras:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Con el fin de&lt;strong&gt; evitar molestias producidas por la contaminación acústica&lt;/strong&gt; se debe acotar el horario de trabajo diario a las horas diurnas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Para &lt;strong&gt;minimizar la emisión de gases de efecto invernadero&lt;/strong&gt;, se debe elegir la maquinaria y equipos modernos y eficientes, adecuados para cada trabajo, que dispongan de sistemas silenciadores y con niveles bajos de ruido y emisiones de gases. Para asegurar su correcto funcionamiento, hacer las revisiones periódicas de la maquinaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Con el fin de&lt;strong&gt; evitar la contaminación atmosférica:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Hacer el control visual de &lt;/span&gt;emisiones de polvo y aplicación de medidas en caso de ser necesario, como evitar movimientos de residuos los días de fuertes vientos, aplicación de riego, etc. Se recomienda tener en cuenta las medidas Guía para el control de las emisiones de polvo en la construcción y demolición.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cubrir las cajas posteriores de los vehículos que transporten cualquier tipo de tierra u otros materiales de construcción con mallas o lonas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;Realizar una correcta manipulación de los materiales: carga y descarga en una zona protegida del viento, evitar gestionar los elementos a gran altura para evitar caídas, dejar el material guardado bien cubierto, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;Siempre que sea posible, se debe reutilizar como material de relleno el procedente de la propia excavación. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Ocupar el suelo estrictamente necesario para la actuación, evitando utilizar espacios vecindarios y alterar su estado. En su caso, se deben rehabilitar aquellas zonas que se hayan ocupado temporalmente y que no estaban previstas. Además, el aparcamiento de la maquinaria y vehículos así como la zona de almacenamiento de materiales de construcción, deben situarse en un área específica y acondicionada para tal fin.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Al finalizar la ejecución de las obras, revisar exhaustivamente el terreno y los alrededores para garantizar que no quedan depositados residuos, materiales de obras o excedentes de tierra. En el caso de detectarse, proceder a su retirada y adecuada gestión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;span style="background-color:white"&gt;Se llevará a cabo una correcta gestión de los residuos generados durante la ejecución del vial, tal y como prevé la normativa vigente, así como realizar un estudio estimativo de la generación y posterior gestión de los residuos de la obra. Los residuos se clasificarán por la tipología de material. Los residuos peligrosos se almacenarán en lugares específicos sobre suelo impermeable para evitar infiltraciones en caso de caída o rotura, y se gestionarán a través de un gestor autorizado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- De acuerdo con los requerimientos procedimentales, el promotor debe aportar &lt;strong&gt;un Plan de Vigilancia Ambiental que integre las medidas preventivas y correctoras necesarias, así como e&lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;l programa de seguimiento de las obras. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:white"&gt;Este plan debe garantizar la prevención de incidencias susceptibles de generar impactos sobre el medio ambiente, como derramamientos aceites o de hidrocarburos susceptibles de contaminar el suelo y del acuífero de San Salvador. Igualmente, debe incluir medidas específicas orientadas a evitar alteraciones o perjuicios sobre la fauna y flora protegidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Se recuerda que:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;De acuerdo con el informe técnico del Servicio de Gestión Forestal y Protección del Suelo&lt;/strong&gt;,&amp;nbsp; &lt;span style="background-color:white"&gt;de&lt;/span&gt; fecha 17/10/2024,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Durante la realización de las obras habrá que cumplir el Decreto 125/2007, de 5 de octubre, por el que se dictan normas sobre el uso del fuego y se regula el ejercicio de determinadas actividades susceptibles de incrementar el riesgo de incendio forestal, especialmente con respecto a las medidas de prevención durante la época de peligro de incendio forestal y las acciones coyunturales de prevención (art. 82.c). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- En lo referente a utilizar maquinaria y equipos, en terreno forestal y áreas contiguas de prevención, cuyo funcionamiento genere deflagración, chispas o descargas eléctricas susceptibles de provocar incendios forestales, debe tenerse en cuenta lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- El artículo 48.6.d de la Ley 43/2003, modificada por el RD15/2022, que prohíbe el uso de estas máquinas cuando el riesgo de incendios sea muy alto o extremo (Alerta Fuego 4) Se puede consultar en la página &lt;strong&gt;alertafoc.caib.es &lt;/strong&gt;el nivel diario de alerta por riesgo meteorológico de incendio forestal vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Las máquinas que se utilicen en terrenos forestales, o a menos de 500 metros de los mismos, se utilizarán extremando las precauciones en su uso y adecuado mantenimiento (se aplicarán métodos de trabajo que eviten la provocación de chispas). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- El abastecimiento de gasolina de esta maquinaria debe realizarse en zonas de seguridad claros de combustible vegetal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;Segundo&lt;/span&gt;. &lt;/strong&gt;Se publicará el presente informe de impacto ambiental en el Boletín Oficial de las Illes Balears, de acuerdo con lo dispuesto en el artículo 47.3 de la Ley 21/2013, de 9 de diciembre, de evaluación ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;Tercero.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:white"&gt; El informe de impacto ambiental perderá su vigencia y cesará en la producción de los efectos que le son propios si, una vez publicado en el BOIB, no se hubiera procedido al inicio de la ejecución del proyecto en el plazo máximo de seis años desde la publicación, de acuerdo con lo dispuesto en el artículo 21 bis del Texto refundido de la Ley de evaluación ambiental de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Cuarto. &lt;/strong&gt;El informe de impacto ambiental no debe ser objeto de recurso alguno, sin perjuicio de los que, en su caso, sean procedentes en la vía administrativa o judicial ante el acto, en su caso, de autorización del proyecto, de acuerdo con lo dispuesto en el artículo 47.5 de la Ley 21/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Quinto. &lt;/strong&gt;Esta resolución se emite sin perjuicio de las competencias urbanísticas, de gestión o territoriales de las administraciones competentes y de las autorizaciones o informes necesarios para la aprobación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(Firmado electrónicamente: 28 de enero de 2026)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
