Aprobar inicialmente las Bases específicas reguladoras de las subvenciones del Patronato Municipal de Deportes del Ayuntamiento de Eivissa para clubes deportivos del municipio que compiten fuera de la isla de Eivissa</span><em><span style="background-color: null">.</span></em></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">SEGUNDO. </span></strong><span style="background-color: null">Someter el proyecto de Bases específicas reguladoras para las subvenciones del Patronato Municipal de Deportes del Ayuntamiento de Eivissa para clubes deportivos del municipio que compiten fuera de la isla de Eivissa a un período de información pública, por plazo de treinta días, mediante anuncio publicado en el Boletín Oficial de las Illes Balears y en el tablón de anuncios de la sede electrónica del Patronato Municipal de Deportes del Ayuntamiento de Eivissa, a fin de que el vecindario y las persones legítimamente interesadas puedan examinar el expediente y formular reclamaciones, objeciones u observaciones.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">TERCERO. </span></strong><span style="background-color: null">Informar que, en el supuesto que durante el plazo de información pública no se presente ninguna reclamación o sugerencia, el acuerdo inicialmente adoptado se entenderá definitivamente aprobado sin necesidad de un nuevo acuerdo expreso por parte de la Junta Rectora del Patronato Municipal de Deportes del Ayuntamiento de Eivissa.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Durante el plazo expresado, las bases estarán a disposición de los interesados en el tablón de anuncios de la sede electrónica del Patronato Municipal de Deportes del Ayuntamiento de Eivissa.</span></span></span></span></p> <p style="text-align: center"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">BASES ESPECÍFICAS REGULADORAS DE LAS SUBVENCIONES DEL PATRONATO MUNICIPAL DE DEPORTES DEL AYUNTAMIENTO DE EIVISSA PARA CLUBES DEPORTIVOS DEL MUNICIPIO QUE COMPITEN FUERA DE LA ISLA DE EIVISSA</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 1. Objeto</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El objeto de estas bases específicas es regular la concesión de subvenciones, en régimen de concurrencia competitiva, destinadas a los clubes deportivos del municipio de Eivissa que asuman los gastos derivados de la participación de sus equipos o deportistas en competiciones deportivas oficiales fuera de la isla de Eivissa.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">A estos efectos, la persona beneficiaria de la subvención será siempre el club deportivo solicitante, sin perjuicio de que la actividad subvencionada corresponda a la participación de uno o varios equipos o deportistas vinculados a la entidad.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Las subvenciones se estructuran en dos líneas diferenciadas:</span></span></span></span></p> <ul> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Línea A) Subvenciones y ayudas para la participación en competiciones deportivas oficiales fuera de la isla de Eivissa para deportes de equipo.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Línea B) Subvenciones y ayudas para la participación en competiciones deportivas oficiales fuera de la isla de Eivissa para deportes individuales.</span></span></span></span></li> </ul> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">A estos efectos, podrán ser objeto de subvención, entre otros, los gastos de desplazamiento, alojamiento y manutención; los gastos federativos, licencias, inscripciones, arbitrajes, cuotas o derechos de participación; los gastos de equipaciones, material deportivo y material técnico necesario; los gastos de salud, fisioterapia, asistencia médica, farmacia y prevención de lesiones; así como las nóminas, facturas y costes de personal técnico, deportivo, auxiliar y/o jugadores que estén directamente vinculados a la participación en las competiciones oficiales objeto de subvención.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Asimismo, podrán considerarse subvencionables aquellos gastos de logística, transporte de material, seguros, acreditaciones, visados, documentación federativa o internacional y otros gastos necesarios para la participación en competiciones de ámbito balear, estatal, europeo o mundial, siempre que quede debidamente acreditada su relación directa con el objeto de la subvención.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Cada club solicitante solo podrá presentar una única solicitud de subvención, que deberá corresponder necesariamente a una sola línea de subvención, sin que sea posible concurrir simultáneamente a más de una línea dentro de la misma convocatoria.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 2. Personas beneficiarias</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Podrán ser beneficiarias de las subvenciones reguladas en estas bases las entidades deportivas sin ánimo de lucro, legalmente constituidas, que cumplan los requisitos establecidos en estas bases y en la convocatoria correspondiente, y que asuman directamente los gastos derivados de la participación de sus equipos o deportistas en competiciones deportivas oficiales fuera de la isla de Eivissa.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Los equipos y deportistas por los que se solicite la subvención deberán estar vinculados a la entidad solicitante mediante la correspondiente licencia federativa o documentación federativa acreditativa, y deberán participar en competiciones oficiales debidamente reconocidas, organizadas o autorizadas por la federación deportiva competente e incluidas en el calendario oficial correspondiente.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">En ningún caso los equipos o deportistas tendrán la condición de beneficiarios directos de la subvención. Esta condición corresponderá exclusivamente a la entidad solicitante, que asumirá todas las obligaciones derivadas de la concesión, ejecución, justificación, publicidad, control y, en su caso, reintegro de la subvención.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Las entidades beneficiarias deberán cumplir, además, los siguientes requisitos:</span></span></span></span></p> <ol class="lower-alpha" start="1"> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Ser entidades deportivas, grupos asociativos deportivos u otras entidades deportivas sin ánimo de lucro, legalmente constituidas.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Estar inscritas en el Registro Municipal de Asociaciones del Ayuntamiento de Eivissa, con anterioridad a la finalización del plazo de presentación de solicitudes.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">No estar afectadas por ninguna de las prohibiciones para obtener la condición de beneficiarias previstas en el artículo 13 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Estar al corriente de las obligaciones tributarias y económicas con la Agencia Estatal de Administración Tributaria, la Agencia Tributaria de las Illes Balears, la Seguridad Social y el Ayuntamiento de Eivissa.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">No tener pendiente de justificación ninguna subvención, salvo que se hubiera concedido una prórroga a tal efecto, ni ser deudor por resolución en la que se declare la procedencia del reintegro de una subvención anterior.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Estar vinculadas a una federación deportiva oficialmente reconocida por el Consejo Superior de Deportes (CSD), o bien participar en modalidades deportivas autóctonas reconocidas por la Dirección General de Deportes del Gobierno de las Illes Balears.</span></span></span></span></li> </ol> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Quedan expresamente excluidas de la condición de beneficiarias, respecto del objeto de esta subvención, las entidades deportivas que soliciten ayuda para equipos o deportistas cuya participación corresponda a opens, torneos privados, ligas no federadas, competiciones amistosas, exhibiciones o cualquier otra competición que no tenga carácter oficial o que no esté reconocida formalmente por la federación deportiva correspondiente.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El Patronato Municipal de Deportes podrá comprobar de oficio la veracidad de la documentación presentada y requerir a la entidad solicitante la documentación complementaria que considere necesaria para acreditar el cumplimiento de los requisitos establecidos en este artículo.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 3. Diario oficial en que se publicará el extracto de la convocatoria, por conducto de la Base de Datos Nacional de Subvenciones, una vez que se haya presentado ante esta el texto de la convocatoria y la información requerida para su publicación; y forma y plazo en que deben presentarse las solicitudes.</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">1. Estas bases se publicarán en el Boletín Oficial de las Illes Balears (BOIB) y en el tablón de anuncios de la sede electrónica del Patronato Municipal de Deportes del Ayuntamiento de Eivissa. De conformidad con los artículos 18.2 y 23.2 de la Ley General de Subvenciones, el Ayuntamiento de Eivissa remitirá a la BDNS la convocatoria correspondiente y un extracto de la misma se publicará en el BOIB, de acuerdo con el procedimiento establecido en el artículo 20.8 de la Ley General de Subvenciones.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">2. La solicitud se realizará presentando el impreso de instancia normalizado, adjuntando la documentación correspondiente, en el Registro General del Ayuntamiento, o bien a través de alguna de las formas previstas en el artículo 16.4 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">De acuerdo con el artículo 14.2 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas, están obligadas a relacionarse a través de medios electrónicos con las administraciones públicas para realizar cualquier trámite de un procedimiento administrativo las siguientes personas:</span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">a) Las personas jurídicas.</span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">b) Las entidades sin personalidad jurídica.</span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">c) Quienes ejerzan una actividad profesional para la cual se requiera la colegiación obligatoria, para los trámites y actuaciones que lleven a cabo con las administraciones públicas en ejercicio de dicha actividad profesional. En todo caso, dentro de este colectivo se entenderán incluidos los notarios, registradores de la propiedad y mercantiles.</span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">d) Quien represente a una persona interesada que esté obligada a relacionarse electrónicamente con la Administración.</span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">e) Las personas empleadas de las administraciones públicas para los trámites y actuaciones que se efectúen con ellas por razón de su condición de empleado/a público/a, tal como determine reglamentariamente cada administración.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Las personas obligadas deberán presentar las solicitudes de subvenciones a través de la sede electrónica municipal del Patronato Municipal de Deportes del Ayuntamiento de Eivissa. Si alguno de los sujetos a los que hace referencia el artículo 14.2 y 14.3 de la LGS presenta su solicitud presencialmente, las Administraciones Públicas requerirán al interesado para que la subsane a través de su presentación electrónica. A estos efectos, se considerará como fecha de presentación de la solicitud aquella en la que haya sido realizada la subsanación (artículo 68. Subsanación y mejora de la solicitud).</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">La presentación de la solicitud comporta la autorización de la persona solicitante para que el Ayuntamiento de Eivissa obtenga de forma directa los certificados telemáticos, en su caso, para la acreditación de las circunstancias previstas en los artículos 18 y 19 del RD 887/2006, de 21 de julio, de encontrarse al corriente de las obligaciones tributarias ante la Administración estatal, autonómica y Ayuntamiento de Eivissa, así como estar al corriente del cumplimiento de las obligaciones ante la Seguridad Social, en aplicación del Convenio en materia de interoperabilidad telemática entre las administraciones públicas del ámbito territorial de las Illes Balears, al que se ha adherido el Ayuntamiento de Eivissa.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">3. La persona solicitante podrá denegar expresamente el consentimiento, aportando los correspondientes certificados.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">4. La documentación y/o los datos que debe acompañar la solicitud es la indicada en el impreso de instancia normalizado, anexo a la convocatoria correspondiente.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">5. El plazo de presentación de solicitudes será el que determine la convocatoria correspondiente.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 4. Condiciones de solvencia y eficacia que deban reunir las personas jurídicas a que se refiere el apartado 2 del artículo 12 de la Ley General de Subvenciones</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">No se prevén entidades colaboradoras. El Patronato de Deportes será la única entidad que actuará como órgano de adjudicación de las subvenciones.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 5. Procedimiento para la concesión de la subvención</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El procedimiento de concesión de subvenciones se tramitará en régimen de concurrencia competitiva, de acuerdo con lo establecido en el artículo 22 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Tiene la consideración de concurrencia competitiva el procedimiento mediante el cual la concesión de las subvenciones se realiza a partir de la comparación de las solicitudes presentadas, a fin de establecer una prelación entre ellas de acuerdo con los criterios de valoración fijados en estas bases y adjudicar, habiendo notificado la resolución de concesión con el límite fijado y dentro del crédito disponible, aquellas que hayan obtenido mayor valoración en aplicación de los criterios o principios de publicidad, transparencia, concurrencia, objetividad, no discriminación, eficacia y eficiencia.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">1. Inicio.</span></strong><span style="background-color: null"> El procedimiento de concesión de subvenciones se iniciará mediante la presentación de una instancia en la que se solicita la subvención, se especifica la actividad a subvencionar y se declara el carácter con el cual la persona solicitante actúa.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">2. Instrucción.</span></strong><span style="background-color: null"> En el caso de que la solicitud o la documentación sean incorrectas o incompletas, el Patronato Municipal de Deportes del Ayuntamiento requerirá su subsanación en un plazo de diez días. Una vez transcurrido este plazo sin que la persona solicitante haya dado cumplimiento al requerimiento, se considerará que desiste de la petición y se archivará el expediente. De acuerdo con el artículo 45.1.b) de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas, la publicación de estos requerimientos de subsanación se realizará en el tablón de anuncios de la sede electrónica del Patronato Municipal de Deportes del Ayuntamiento de Eivissa.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Una vez comprobada la documentación presentada que consta en el expediente y el informe del órgano colegiado (Comisión de Valoración), el órgano instructor deberá formular la propuesta de resolución provisional, debidamente motivada, que se notificará a las personas interesadas mediante la publicación en el tablón de anuncios de la sede electrónica del Patronato Municipal de Deportes del Ayuntamiento de Eivissa, con un plazo de diez días para formular alegaciones.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Se podrá prescindir del trámite de audiencia cuando no figuren en el procedimiento ni sean tenidos en cuenta otros hechos que los aducidos por los interesados. En este caso, la propuesta de resolución formulada tendrá carácter definitivo. Las propuestas de resoluciones provisionales y definitivas no crean derecho alguno a favor de la persona beneficiaria propuesta, hasta que no se le haya notificado la concesión por el órgano competente.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">3. Resolución.</span></strong><span style="background-color: null"> El acto que resuelva el procedimiento de concesión de la subvención deberá ser motivado y expresar la persona solicitante o la relación de personas solicitantes a las que se concede la subvención y la cantidad otorgada. Asimismo, se hará constar de manera expresa la desestimación del resto de solicitudes. De acuerdo con el artículo 45.1.b) de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas, la publicación de esta resolución se realizará en el tablón de anuncios de la sede electrónica del Patronato Municipal de Deportes del Ayuntamiento de Eivissa.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">La competencia para otorgar las subvenciones corresponde al órgano fijado en el artículo 9 de estas bases.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">4. Publicidad de las subvenciones concedidas.</span></strong><span style="background-color: null"> El acuerdo de resolución del procedimiento de concesión se publicará en la sede electrónica del Patronato Municipal de Deportes del Ayuntamiento de Eivissa y en la Base de Datos Nacional de Subvenciones (BDNS).</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 6. font-size: 12px"><span style="background-color: null">A efectos de las presentes bases, se establece un límite máximo de personas computables por modalidad deportiva, con la finalidad de garantizar una distribución equitativa de los recursos públicos y evitar que el cálculo de la subvención se vea alterado por desplazamientos o personas que excedan los límites ordinarios de participación federativa.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">2. Deportes individuales: </span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">En las competiciones de deportes individuales se tomará como máximo el número de deportistas inscritos que hayan participado efectivamente en la competición oficial, y se podrá incluir:</span></span></span></span></p> <p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">1 técnico o auxiliar, cuando el número de deportistas inscritos y participantes en la&nbsp;</span></span></span></span><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">competición sea entre 2 y 6 deportistas.</span></span></span></span></p> <p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">2 técnicos o auxiliares, en el caso de que se superen los 7 deportistas inscritos y participantes en la competición.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 7. Criterios objetivos de otorgamiento de la subvención</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Para garantizar la concurrencia competitiva en la adjudicación de las subvenciones, de conformidad con lo dispuesto en el artículo 17.3.e) de la Ley General de Subvenciones, las solicitudes presentadas se valorarán y seleccionarán teniendo en cuenta los criterios objetivos establecidos en las presentes bases.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Los criterios de valoración se aplicarán sobre la solicitud presentada por el club beneficiario, teniendo en cuenta los equipos o deportistas por los cuales la entidad solicita la subvención y respecto de los cuales acredita asumir los gastos derivados de su participación en competiciones oficiales fuera de la isla de Eivissa.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">A estos efectos, los equipos y deportistas computados deberán constar vinculados al club solicitante mediante la correspondiente licencia federativa o documentación acreditativa equivalente, y deberán participar efectivamente en las competiciones oficiales objeto de subvención.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Solo se valorarán aquellos equipos, deportistas, desplazamientos, resultados o gastos que estén debidamente acreditados y que guarden relación directa con la actividad subvencionada.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El importe de la subvención concedida a cada club solicitante dependerá de los puntos obtenidos en la línea de subvención a la que opte, de acuerdo con los criterios de valoración establecidos en estas bases.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Podrán ser beneficiarios de esta modalidad aquellas entidades que participen en competiciones consideradas por las respectivas federaciones como competiciones oficiales de ámbito europeo, nacional o autonómico en sistema de campeonatos, ligas y copas.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Con el fin de garantizar la objetividad y la equidad en la valoración de las competiciones y resultados deportivos, se aplicarán factores correctores que ajustan la puntuación en función de la realidad de cada disciplina deportiva.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; Cuantía individualizada de la subvención o criterios para su determinación</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">1. La cuantía de las subvenciones será la que determine la convocatoria correspondiente, de acuerdo con las Bases de Ejecución del Presupuesto del Patronato Municipal de Deportes y el Plan Estratégico de Subvenciones del Ayuntamiento de Eivissa. </span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">La cuantía de la subvención se determinará de acuerdo con los siguientes criterios:</span></span></span></span></p> <ul> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Ninguna subvención podrá superar la cantidad máxima que se establezca en la convocatoria correspondiente.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Ninguna subvención podrá superar, en todo caso, el porcentaje máximo del 100 % del gasto subvencionable.</span></span></span></span></li> </ul> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Una vez aplicada la fórmula de reparto, si alguna entidad supera el importe máximo establecido o el 100 % del gasto subvencionable, su subvención se reducirá hasta el límite correspondiente.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El crédito sobrante podrá redistribuirse proporcionalmente entre el resto de entidades beneficiarias de la misma línea que no hayan alcanzado dichos límites, de acuerdo con la puntuación obtenida, siempre dentro del crédito disponible y sin superar el coste de la actividad subvencionada.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Se consideran gastos subvencionables aquellos que respondan a la naturaleza de la actividad subvencionada y se realicen en el plazo establecido en la convocatoria correspondiente.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">De conformidad con el artículo 58.2 del RD 887/2006, además de la cantidad total máxima de los créditos disponibles, podrá fijarse una cuantía adicional que no requerirá una nueva convocatoria para su aplicación a la concesión de subvenciones, en caso de haberse incrementado el importe del crédito presupuestario disponible como consecuencia de una generación, una ampliación o una incorporación de crédito. La distribución del incremento se realizará proporcionalmente a la puntuación obtenida por cada proyecto presentado.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">La convocatoria deberá hacer constar expresamente que la efectividad de la cuantía adicional queda condicionada a la declaración de disponibilidad de crédito como consecuencia de las circunstancias antes señaladas y, en su caso, previa aprobación de la modificación presupuestaria que proceda, en un momento anterior a la resolución de la concesión de la subvención.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">2. Se consideran gastos subvencionables, de acuerdo con lo dispuesto en el art. 31 de la LGS, los gastos realizados antes de la fecha de finalización del período de justificación establecido y que guarden relación directa con el objeto de la subvención.</span></span></span></span></p> <p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">a) Se consideran gastos subvencionables:</span></span></span></span></p> <p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Los gastos subvencionables se establecerán en la convocatoria correspondiente.</span></span></span></span></p> <p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">b) No se consideran subvencionables:</span></span></span></span></p> <p style="margin-left: 40px"><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Los gastos no subvencionables se establecerán en la convocatoria correspondiente.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Solo serán subvencionables los gastos asumidos directamente por el club beneficiario y vinculados de manera directa a la participación de los equipos o deportistas incluidos en la solicitud en competiciones deportivas oficiales fuera de la isla de Eivissa.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Las facturas, justificantes de gasto y justificantes de pago deberán estar emitidos o corresponder al club beneficiario, salvo los supuestos excepcionales que pueda admitir la convocatoria de manera expresa y debidamente justificada.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">No se considerarán subvencionables los gastos particulares asumidos directamente por los deportistas, familiares, técnicos o terceras personas que no hayan sido reintegrados o asumidos por el club beneficiario de acuerdo con la documentación justificativa correspondiente.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 9. Órganos competentes para la ordenación, instrucción y resolución del procedimiento de concesión de la subvención y el plazo en que será notificada la resolución</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">1. De acuerdo con la base 46, punto 5, de las Bases de Ejecución del Presupuesto municipal vigente, el órgano competente para la aprobación de las bases reguladoras específicas será el Pleno de la Corporación o las juntas rectoras, en el caso de los organismos autónomos y/o consorcios adscritos. </span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El órgano competente para la aprobación de las sucesivas convocatorias, así como los acuerdos de concesión, será la Junta de Gobierno Local o las juntas rectoras, en el caso de los organismos autónomos y/o consorcios adscritos, excepto en el caso de aquellos que tengan carácter plurianual, que deberán ser aprobadas por el Pleno de la Corporación.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">2. De conformidad con el artículo 14 de la Ordenanza general reguladora de las bases para el otorgamiento de subvenciones por parte del Patronato Municipal de Deportes del Ayuntamiento de Eivissa, el órgano instructor se designará en la convocatoria y con carácter general lo serán los servicios administrativos de la Concejalía delegada que promueve la subvención. </span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">La convocatoria específica establecerá la composición de una comisión evaluadora integrada como mínimo por una Presidencia, una Secretaría con voz pero sin voto y un número de vocales no inferior a dos, relacionados con el objeto de la convocatoria, que tendrá como finalidad examinar las solicitudes y emitir un informe que sirva de base a la propuesta de resolución.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Las actividades de instrucción deberán comprender las actuaciones conducentes a la evaluación de las solicitudes o peticiones, efectuadas de acuerdo con los criterios, formas y prioridades de valoración establecidos en la norma reguladora de la subvención.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Corresponde al órgano instructor llevar a cabo de oficio las actuaciones necesarias para determinar, conocer y comprobar los datos en virtud de los cuales debe dictarse la resolución, y en concreto:</span></span></span></span></p> <ol class="lower-alpha" start="1"> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Determinar las personas participantes admitidas a la convocatoria;</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Resolver las dudas de interpretación que puedan surgir en relación con las bases reguladoras de la subvención y la convocatoria correspondiente;</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Solicitar los informes de la comisión evaluadora y de otros órganos.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Evaluar las solicitudes de acuerdo con los criterios de valoración establecidos.</span></span></span></span></li> </ol> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Sin perjuicio de las especificidades procedimentales que puedan establecerse en las convocatorias específicas, respetuosas con la legalidad vigente, el procedimiento será el siguiente:</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">En virtud de la documentación que consta en el expediente, el órgano instructor deberá formular la propuesta de resolución provisional, debidamente motivada, que se notificará a las personas interesadas mediante su publicación en el tablón de anuncios de la Sede Electrónica del Patronato Municipal de Deportes del Ayuntamiento de Eivissa y, en su caso, en la página web municipal, además de en la forma que pueda establecer la convocatoria correspondiente, con un plazo de diez días para formular alegaciones.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Se podrá prescindir del trámite de audiencia cuando no figuren en el procedimiento ni sean tenidos en cuenta otros hechos que los aducidos por las personas interesadas. En este caso, la propuesta de resolución formulada tendrá carácter definitivo.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">3. Examinadas por el órgano instructor las alegaciones aducidas por las personas interesadas, se formulará la propuesta de resolución definitiva. La resolución deberá ser motivada y deberá contener:</span></span></span></span></p> <ul> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">La relación de personas solicitantes a las que se propone la concesión de la subvención y, en su caso, la desestimación del resto de solicitudes o la inadmisión, así como la no concesión por desistimiento de la persona solicitante, u otras causas establecidas en la normativa específica aplicable.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">La cuantía de la subvención; si lo prevé la convocatoria, el órgano competente deberá prorratear entre las personas beneficiarias de la subvención el importe global máximo destinado a las subvenciones.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">La especificación de la evaluación y de los criterios seguidos para efectuarla.</span></span></span></span></li> </ul> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El expediente de concesión de subvenciones contendrá el informe del órgano instructor en el que conste que de la información que figura en su poder se desprende que las personas beneficiarias cumplen todos los requisitos necesarios para acceder a ella.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Las propuestas de resolución provisional y definitiva no crean derecho alguno a favor de la persona beneficiaria propuesta, frente a la Administración, mientras no se haya publicado la resolución de concesión.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">4. Plazo para resolver y efectos del silencio </span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El plazo para resolver y notificar la resolución del procedimiento no podrá exceder de seis meses desde la fecha de finalización del plazo para presentar las solicitudes. Si en este plazo no se ha notificado resolución expresa, se entenderá desestimada por silencio administrativo negativo la solicitud de subvención, de conformidad con el artículo 25 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 10. Obligaciones de las personas beneficiarias de las subvenciones</span></strong></span></span></span></p> <ul> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Realizar el proyecto relacionado con la línea/s de subvención en el que se fundamenta la concesión de las subvenciones.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Acreditar ante el Patronato de Deportes del Ayuntamiento de Eivissa la realización del proyecto, así como el cumplimiento de los requisitos y condiciones que determinan la concesión de la ayuda.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Disponer de los libros contables, registros y demás documentos en los términos exigidos por la legislación mercantil y sectorial aplicable a la persona beneficiaria de la subvención.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Conservar los documentos justificativos de la aplicación del fondo recibido.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Informar al Patronato de Deportes del Ayuntamiento de Eivissa de todas las subvenciones recibidas destinadas a la actividad objeto de subvención y esta comunicación se efectuará tan pronto como se conozca y, en todo caso, con anterioridad a la justificación del uso dado a los fondos recibidos.</span></span></span></span></li> </ul> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Las entidades subvencionadas, asimismo, adquieren las siguientes obligaciones:</span></span></span></span></p> <ol> <li> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Presentar los documentos recogidos en el artículo anterior, en el artículo 30 de la Ley General de Subvenciones y los que específicamente se determinen en la convocatoria correspondiente. </span></span></span></span></p> </li> <li> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Presentar toda la documentación que le sea solicitada en relación con la facultad de control de la actividad subvencionada. </span></span></span></span></p> </li> <li> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Hacer constar en toda información, publicación o publicidad que se efectúe de la actividad, que la misma está subvencionada por el Ayuntamiento de Eivissa. En concreto, las entidades beneficiarias deberán cumplir las obligaciones de publicidad y difusión de la financiación municipal en los términos establecidos en el </span><strong><span style="background-color: null">anexo 1</span></strong><span style="background-color: null"> de estas bases. </span></span></span></span></p> </li> <li> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Comunicar al Patronato Municipal de Deportes del Ayuntamiento de Eivissa cualquier alteración o modificación que se produzca en su ejecución. </span></span></span></span></p> </li> <li> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Mantener las condiciones y elementos declarados en el proyecto que sirvieron de base para otorgar la subvención. </span></span></span></span></p> </li> <li> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Las actividades desarrolladas y su publicidad deberán respetar el principio de igualdad de oportunidades entre mujeres y hombres. </span></span></span></span></p> </li> <li> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Toda la documentación o material de publicidad que se genere en las actividades desarrolladas deberá estar en catalán.</span></span></span></span></p> </li> </ol> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El Patronato de Deportes y el Ayuntamiento de Eivissa no se harán responsables de las obligaciones contraídas por las personas beneficiarias como consecuencia de la realización de sus actividades.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 11. Pago</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El pago de la subvención se efectuará mediante transferencia bancaria a la cuenta corriente designada a tal efecto por la entidad beneficiaria.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El pago de la subvención se realizará en dos plazos:</span></span></span></span></p> <ol> <li> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El primer pago se efectuará una vez aprobada la resolución de concesión de la convocatoria. </span></span></span></span></p> </li> <li> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El segundo pago se efectuará una vez presentada y revisada la justificación de la subvención, siempre que se acredite adecuadamente el cumplimiento de la finalidad para la cual se concedió la subvención y la correcta aplicación de los fondos percibidos.</span></span></span></span></p> </li> </ol> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El porcentaje correspondiente a cada uno de los pagos se determinará expresamente en la convocatoria correspondiente.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 12. Determinación, si procede, de los libros y registros contables específicos para garantizar la adecuada justificación de la subvención</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">No se prevén.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 13. Plazo y forma de justificación por parte de la persona beneficiaria o de la entidad colaboradora, en su caso, del cumplimiento de la finalidad para la cual se concedió la subvención y de la aplicación de los fondos percibidos</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Para percibir íntegramente la subvención concedida, las personas o entidades beneficiarias deben justificar ante el Patronato Municipal de Deportes del Ayuntamiento de Eivissa el cumplimiento de la finalidad para la cual se concedió la subvención, así como la correcta aplicación de los fondos percibidos.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">1. Período máximo de justificación </span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">La fecha que fijará el plazo máximo de justificación se establecerá en la convocatoria correspondiente.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">La falta de presentación de la justificación dentro del plazo establecido, o la presentación de una justificación insuficiente, podrá dar lugar a la pérdida del derecho al cobro del segundo pago, así como, si procede, al reintegro total o parcial de las cantidades percibidas, de acuerdo con lo establecido en estas bases y en la normativa aplicable en materia de subvenciones.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">2. Forma de justificación de la subvención </span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">De acuerdo con lo establecido en el artículo 11 de estas bases, el pago de la subvención se realizará en dos plazos, con los porcentajes que se determinen en la convocatoria correspondiente.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Para justificar la subvención, la persona o entidad beneficiaria deberá presentar al Patronato Municipal de Deportes la instancia o formulario de justificación correspondiente, acompañado del resto de documentación justificativa que se determine en estas bases, en la convocatoria correspondiente y en los anexos que formen parte de la misma.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 14. Medidas de garantía que, si procede, se considere necesario constituir a favor del órgano concedente, medios de constitución y procedimiento de cancelación</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">No se prevén.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 15. Posibilidad de efectuar pagos anticipados y abonos a cuenta, así como el régimen de garantías que, en su caso, deben aportar las personas beneficiarias</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Se prevé la posibilidad de efectuar un primer pago anticipado o a cuenta de la subvención concedida, en el porcentaje que determine la convocatoria correspondiente, una vez dictada la resolución de concesión.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Este pago quedará condicionado al cumplimiento de los requisitos para obtener la condición de beneficiaria, a encontrarse al corriente de las obligaciones tributarias, con la Seguridad Social y con el Ayuntamiento de Eivissa, y a no estar incursa en ninguna causa de reintegro.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Dada la naturaleza de las entidades beneficiarias y la finalidad de fomento deportivo de la subvención, no se exigirá la constitución de garantía, salvo que la convocatoria establezca expresamente lo contrario.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El pago restante se efectuará una vez presentada, revisada y aprobada la justificación de la subvención.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 16. Circunstancias que, como consecuencia de la alteración de las condiciones tenidas en cuenta para la concesión de la subvención, podrán dar lugar a la modificación de la resolución</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">No se prevén.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 17. Compatibilidad o incompatibilidad con otras subvenciones, ayudas, ingresos o recursos para la misma finalidad, procedentes de cualesquiera administraciones o entes públicos o privados, nacionales, de la Unión Europea o de organismos internacionales</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Las ayudas recibidas por esta convocatoria son compatibles con la percepción de otras ayudas procedentes de cualquier otra administración o ente público o privado, siempre que su importe sea de tal cuantía que aisladamente o en concurrencia con otras subvenciones no supere el coste total de la actividad subvencionada, de acuerdo con lo previsto en el artículo 19.3 de la Ley General de Subvenciones.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Es obligación de las personas o entidades beneficiarias de las ayudas informar al Patronato de Deportes del Ayuntamiento de Eivissa de todas las subvenciones recibidas con destino a la actividad objeto de subvención y esta comunicación se efectuará tan pronto como se conozca y, en todo caso, con anterioridad a la justificación de la aplicación dada a los fondos percibidos.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 18. Incumplimiento y causas de reintegro</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">En caso de incumplimiento de las bases, así como de los compromisos asumidos por las personas beneficiarias de la subvención, será de aplicación lo previsto en el título IV de la Ley 38/2003, de 17 de noviembre, General de Subvenciones. Como consecuencia de la revocación corresponde reintegrar total o parcialmente la ayuda recibida por las entidades beneficiarias y, si procede, la exigencia del interés de demora, en los siguientes casos:</span></span></span></span></p> <ol class="lower-alpha" start="1"> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El incumplimiento de la finalidad para la cual se concedió la ayuda.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">La obtención de la ayuda sin que se cumplan las condiciones requeridas o cuando se alteren las condiciones tenidas en cuenta para concederla, siempre que sea por causas imputables a la entidad beneficiaria.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El incumplimiento de la obligación de justificar la finalidad de la ayuda económica recibida en la forma y los plazos establecidos.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">La negativa a someterse a las actuaciones de control previstas o la obstrucción injustificada de dichas actuaciones.</span></span></span></span></li> <li><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Justificación de la subvención fuera de plazo del período de justificación.</span></span></span></span></li> </ol> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Cuando el importe justificado por la persona beneficiaria, con motivo de la rendición de la cuenta justificativa de los gastos, sea inferior a la cantidad concedida, el Patronato de Deportes del Ayuntamiento de Eivissa deberá minorar el importe de la subvención, exigiendo, en su caso, el reintegro de las cantidades indebidamente percibidas.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Para el reintegro deberán aplicarse los procedimientos previstos al efecto en la legislación de finanzas, en los cuales deberá garantizarse la audiencia a las entidades interesadas.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Las cantidades reintegrables tienen la consideración de ingresos de derecho público y pueden ser exigidas por la vía de apremio.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">El incumplimiento de la obligación de justificar la finalidad de la ayuda económica recibida en la forma y los plazos establecidos supondrá, además del reintegro mencionado, la imposibilidad de participar en próximas convocatorias de ayudas municipales, mientras no se realice la devolución del importe reclamado.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 19. Criterios de graduación de los posibles incumplimientos de condiciones impuestas con motivo de la concesión de las subvenciones. Estos criterios son aplicables para determinar la cantidad que finalmente deba percibir la persona beneficiaria o, si procede, el importe a reintegrar, y deberán responder al principio de proporcionalidad</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Si durante la instrucción del expediente, en la fase de justificación o en el transcurso del plazo legal de comprobación se observan incumplimientos parciales o totales de la actividad objeto de subvención, el importe concedido podrá ser objeto de minoración, pérdida del derecho al cobro o reintegro total o parcial, de acuerdo con el principio de proporcionalidad.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">La falta total de justificación, la justificación insuficiente no subsanada, la resistencia al control o la sobrefinanciación de la actividad comportarán el reintegro que corresponda de acuerdo con la normativa aplicable.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">En este sentido, de conformidad con el artículo 17.3.n) de la Ley General de Subvenciones, en relación con el artículo 37.2 de la misma ley, se establecen los siguientes criterios de graduación del posible incumplimiento material de la actividad objeto de esta subvención, y siempre que la persona beneficiaria acredite una actuación inequívoca tendente al cumplimiento de sus compromisos:</span></span></span></span></p> <table border="1" cellspacing="0" class="Table" style="border-collapse: collapse; Responsabilidad, régimen sancionador e inspección</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Las personas beneficiarias de estas subvenciones quedarán sometidas al régimen de responsabilidad y sanciones previsto en la normativa vigente aplicable en materia de subvenciones.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Los órganos técnicos y la Intervención del Ayuntamiento de Eivissa podrán comprobar por los medios que consideren adecuados la inversión de las cantidades otorgadas en relación con sus objetivos.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Artículo 21. Impugnación</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Contra el acuerdo de la Junta Rectora del Patronato Municipal de Deportes del Ayuntamiento de Eivissa de aprobación definitiva de estas Bases podrá interponerse recurso contencioso-administrativo en el plazo de dos meses a contar desde el día siguiente al de la publicación, de conformidad con lo dispuesto en la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">DISPOSICIÓN ADICIONAL</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">Las remisiones a artículos que constan en estas Bases se entenderán realizadas a los preceptos respectivos de las normas posteriores que, en su caso, puedan derogarlos, modificarlos y/o sustituirlos.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">DISPOSICIÓN DEROGATORIA</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="background-color: null">A partir de la entrada en vigor de estas Bases, quedan derogadas las disposiciones generales del Ayuntamiento de Eivissa que se opongan, contradigan o resulten incompatibles con estas.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">DISPOSICIONES FINALES</span></strong></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Primera.</span></strong><span style="background-color: null"> Cuando existan regulaciones específicas de rango superior, las prescripciones de estas Bases se aplicarán con sujeción al principio de jerarquía normativa y como complemento de aquellas.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="background-color: null">Segunda. </span></strong><span style="background-color: null">Todo aquello que no esté previsto en estas Bases y/o en la convocatoria correspondiente, se regirá por las Bases de Ejecución del Presupuesto Municipal vigente del Ayuntamiento de Eivissa, la Ordenanza general reguladora de las bases para el otorgamiento de subvenciones vigente en el Ayuntamiento de Eivissa, la Ley 38/2003, de 17 de noviembre, General de Subvenciones, el Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley General de Subvenciones, la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas, la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, y el resto de normativa específica que resulte aplicable.</span></span></span></span></p> <p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif;
