&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;Hechos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;1. El 25 de diciembre de 2025, en el BOIB nº. 171, se publicó la Resolución del consejero de Empresa, Autónomos y Energía de 19 de diciembre de 2025 por la que por la que se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2025 para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas en el Programa FEDER 2021-2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;2. Las personas que figuran en el Anexo de esta Propuesta presentaron una solicitud de subvención en el marco de la convocatoria de referencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;3. Los técnicos de la Dirección General de Economía Circular, Transición Energética y Cambio Climático han examinado las solicitudes y han emitido un informe favorable de los siguientes aspectos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Las personas o entidades solicitantes, por su naturaleza, pueden ser beneficiarias de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Las personas o entidades han adjuntado la documentación prevista en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Las personas o entidades solicitantes están al corriente de las obligaciones con la Seguridad Social y con la Administración tributaria, tanto estatal como autonómica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;4. Los técnicos de la Dirección General de Economía Circular, Transición Energética y Cambio Climático, en aplicación del procedimiento de concesión que establece el apartado séptimo de la citada Resolución, han informado favorablemente sobre la concesión de las subvenciones descritas en el anexo, las que se han calculado de acuerdo con la Resolución de convocatoria de estas ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;5. El orden de prelación de la valoración de los expedientes no viene determinado por el número de expediente, sino por la fecha y la hora de entrada de la solicitud en el registro de la CAIB. El número de expediente lo asigna el aplicativo de gestión de subvenciones una vez ha entrado en su bandeja de entrada que puede diferir de la fecha y hora de entrada real por error en el proceso de transferencia de datos entre sistemas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;6. En fecha 25 de marzo de 2026 se emitió la propuesta de resolución estimatoria provisional del director general de Economía Circular, Transición Energética y Cambio Climático (BOIB n.º 40, de 28 de marzo de 2026).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;7. Se ha agotado el plazo que se concedía para presentar alegaciones sin que se hayan presentado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;1. &lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;3. &lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;4. Decreto 75/2004, de 27 de agosto, por el que se desarrollan determinados aspectos de la Ley de Hacienda y de las leyes de presupuestos generales de la Comunidad Autónoma de les Illes Balears (BOIB núm. 122, de 2 de septiembre de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;5. La Resolución del consejero de Empresa, Autónomos y Energía de 19 de diciembre de 2025 por la que por la que se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2025 para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas dentro del Programa FEDER 2021-2027 (BOIB núm. 171, de 25 de diciembre de 2025).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;Propuesta de resolución definitiva&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Propongo al consejero de Empresa, Autónomos y Energía que dicte resolución en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;1. Aprobar la concesión de una subvención para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas en el Programa FEDER 2021-2027 (FOTOPAR 2026) por un importe total de 13.752,00 euros y 1 beneficiario. En el anexo de esta propuesta figuran los datos de cada beneficiario sobre la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;2. Autorizar la posibilidad de llevar a cabo la actuación con una empresa vinculada, dado que la contratación se realiza a precios de mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;3. Autorizar y disponer el gasto de 13.752,00 euros a 1 beneficiario que figura en el anexo y por las cantidades detalladas para cada uno de ellos, con cargo a la partida presupuestaria indicada en el anexo a los presupuestos de la Comunidad Autónoma. de les Illes Balears. Esta ayuda está cofinanciada con un 60 % a cargo del Programa FEDER 2021-2027 de les &lt;em&gt;Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;4. La concesión de la ayuda está sometida a los requisitos y límites establecidos en el Reglamento (UE) nº. 1407/2013 de la Comisión, de 18 de diciembre de 2013. Por eso, el importe total de las ayudas de minimis que se podrá conceder no puede exceder la cifra de 300.000 euros durante cualquier período de tres ejercicios fiscales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;5. Disponer que las inversiones objeto de la solicitud deben realizarse en un plazo máximo de cuatro meses a contar desde la publicación en el Boletín Oficial de las&lt;em&gt; Illes Balears&lt;/em&gt; de la resolución de otorgamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;6. Establecer que el plazo para justificar la realización de las actividades subvencionadas en ningún caso puede ser posterior al quinto día hábil desde la fecha máxima de ejecución de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;7. Establecer que el pago y la justificación deben realizarse de acuerdo con lo que dispone el apartado décimo de la Resolución del consejero de Empresa, Autónomos y Energía de 23 de diciembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;8. Establecer que los beneficiarios están obligados a cumplir lo dispuesto en el apartado undécimo de la Resolución del consejero de Empresa, Autónomos y Energía de 19 de diciembre de 2025, y la normativa nacional y europea sobre la actividad subvencionada, así como en los supuestos establecidos en el apartado trece en relación con la concurrencia de ayudas. Las obligaciones establecidas en la convocatoria son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;a)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; Llevar a cabo la actividad o la inversión, o adoptar el comportamiento que fundamenta la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;b)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; Justificar la realización de la actividad, así como también el cumplimiento de los requisitos y las condiciones que determinan la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;c) &lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt;Comunicar al órgano que la concede o, si procede, a la entidad colaboradora, la solicitud o la obtención de otras subvenciones para la misma finalidad. Esta comunicación tiene que realizarse dentro del plazo de tres días hábiles desde la solicitud o la obtención de la subvención concurrente y, en todo caso, antes de la justificación de la aplicación que se haya dado a los fondos percibidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;d)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; Encontrarse al corriente de las obligaciones tributarias y de la Seguridad Social ante la Administración del Estado, y de las obligaciones tributarias ante la hacienda autonómica; y acreditarlo, en la forma establecida en el artículo 6 de las bases reguladoras y el apartado quinto de esta convocatoria antes de dictar la propuesta de resolución de concesión y de efectuar el pago. En todo caso, esta acreditación puede sustituirse por una declaración responsable de la persona solicitante cuando se trate de subvenciones de cuantía igual o inferior a 3.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;e) &lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt;Acceder a las actuaciones de comprobación que lleve a cabo la Dirección General de Fondos Europeos como organismo intermedio del Programa FEDER 2021-2027, en las actuaciones de control financiero de la Intervención General de la Comunidad Autónoma de las &lt;em&gt;Illes Balears,&lt;/em&gt; la Sindicatura de Cuentas y cualquier otra autoridad de control. Si del resultado de estas actuaciones de control se detectan irregularidades, se derivará la obligación de reintegro de las cuantías percibidas indebidamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;f)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; Dejar constancia de la percepción y la aplicación de la subvención en los libros de contabilidad o en los libros de registro que, si procede, tenga que llevar el beneficiario de acuerdo con la legislación mercantil o fiscal que le sea aplicable y, si procede, con las bases reguladoras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Todas las medidas de información y publicidad reconocerán el emblema de la UE (documentación administrativa, actividades y actos públicos, difusión en medios de comunicación, publicaciones, cartelería, página web, etc.). La resolución de aprobación de la operación cofinanciada y las publicaciones realizadas en DOUE/BOE/BOIB recogerán expresamente la mención siguiente: “cofinanciado por la Unión Europea”. Para el periodo 2021-2027 los logos se encuentran en la dirección web: &lt;em&gt;https://www.caib.es/sites/programeseuropeus/es/logos&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;q)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; Tiene que informarse al público del apoyo obtenido por el FEDER. Para facilitar el cumplimiento de esta obligación, la Dirección General de Economía Circular, Transición Energética y Cambio Climático tiene que facilitar un código HTML que debe incorporar esta información y que el beneficiario tiene que insertar en su página web.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;9.
