![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Al no haber sido posible la localización de los titulares o responsables de los restos de los vehículos y ciclomotores que se detallan a continuación , y de conformidad con lo establecido en la legislación vigente de procedimiento administrativo común, se hace pública para general conocimiento la <strong>Resolución de Alcaldía número 611 de fecha 24 de mayo de 2026</strong>, cuya parte dispositiva se transcribe a continuación:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Vehículos que se encuentran custodiados en su mayoría en el Depósito Municipal Sa Plana (Polígono 21, Parcela 67) y en la vía pública (Venda Cas Ripolls), presentando todos ellos un estado de deterioro avanzado, despiece y desperfectos que hacen completamente imposible su desplazamiento por medios propios.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">A la vista de los siguientes antecedentes:</span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Informe Técnico de Medio Ambiente, emitido con fecha 21/05/2026 por el Ingeniero Técnico Externo, D. Jose Vicente Hernandez , en el cual se constata que dichos restos carecen de los requisitos propios de un medio de transporte , suponiendo un riesgo evidente para el medio ambiente y la salud pública, actuando además como un foco de acumulación creciente de residuos.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las correspondientes Actas de Comprobación emitidas por la Policía Local referenciadas en la tabla anterior (números 06/2025, 12/2025, 35/2025, 38/2025, 59/2025, 64/2025, 65/2025, 67/2025 y 73/2025).</span></li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformidad con el artículo 21.1.s) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local; el artículo 12.5 de la Ley 7/2022, de 8 de abril, de residuos y suelos contaminados para una economía circular ; y en aplicación del artículo 11.5 de la Ordenanza Municipal reguladora de la gestión de residuos de Sant Joan de Labritja (BOIB N.º 31 de 11/03/2023), el cual habilita la declaración como residuo sólido urbano por vía de urgencia y su gestión subsidiaria por parte de este Ayuntamiento, se dicta la siguiente:</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>RESOLUCIÓN</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>PRIMERO.</strong> Declarar con carácter de urgencia como residuo sólido urbano (RSU) / residuo doméstico los chasis y restos de vehículos descritos en los antecedentes de esta resolución, al haber perdido su condición de vehículos por carecer de los elementos esenciales para circular, presentar signos evidentes de abandono y despiece, y comportar un riesgo de contaminación medioambiental y de afección a la salud pública, de acuerdo con el artículo 2.at) de la Ley 7/2022 y el artículo 11.5 de la Ordenanza Municipal vigente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>SEGUNDO.</strong> Ordenar la retirada y entrega inmediata de manera subsidiaria de todos los elementos referenciados para su tratamiento al Centro Autorizado de Tratamiento de Vehículos (CATV) CA NA NEGRETA S.A. – CIF A07085806, situado en Ctra. de Sant Joan Km. 6,1 – 07840 Santa Eulalia del Río; para su posterior destrucción y descontaminación, instando al centro para que proceda de acuerdo con el artículo 5 y el Anexo III del Real Decreto 265/2021, de 13 de abril, emitiendo de forma obligatoria:</span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Certificado de destrucción para el caso de los automóviles y certificado de tratamiento medioambiental para el resto de los vehículos (ciclomotores).</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Trámite de baja electrónica definitiva de aquellos vehículos en el Registro de Vehículos de la Dirección General de Tráfico de los que se posean datos identificativos.</span></li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>TERCERO.</strong> Al no haberse podido localizar a los responsables ni titulares de la gran mayoría de los restos, publicar la presente resolución en el Tablón de Anuncios del Ayuntamiento y en el Boletín Oficial de las Illes Balears (BOIB) a los efectos de notificación formal para aquellos interesados cuyo domicilio sea desconocido, de conformidad con la legislación de procedimiento administrativo común.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Lo que se hace público para el general conocimiento.</span></p> <p> </p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sant Joan de Labritja, 26 de mayo de 2026</span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">La alcaldesa-presidenta<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">M. ª Tania Marí Marí</span></p> ]] 1210 716028 ![CDATA[Notificación colectiva de declaración de residuos sólidos urbanos (RSU) / residuos domésticos procedentes de vehículos abandonados en el término municipal (Expediente 1579/2025)]] CAIB CAIB 2026-05-28 es 395291 CAIB text/html 29809 es 2026-05-30 2026-05-30 29810
