&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1. El 16 de enero de 2026 tuvo entrada en la Dirección General de Economía Circular, Transición Energética y Cambio Climático la solicitud presentada por TIRME, SA, con NIF A07326473, mediante la cual solicitan la autorización administrativa de una instalación fotovoltaica para autoconsumo sin excedentes situada en el polígono 9, parcela 256 del término municipal de Llucmajor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2. El 25 de febrero de 2026 se admitió a trámite la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3. El 13 de marzo de 2026, una vez examinada la documentación inicial, esta Dirección General emitió un oficio de requerimiento de subsanación de deficiencias, mediante el cual se solicitó al promotor la aportación de la documentación técnica y administrativa necesaria para completar la solicitud y permitir la continuidad de la tramitación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;4. El 17 de marzo de 2026, el promotor aportó la documentación requerida. Este hecho daba cumplimiento al requerimiento formulado y permitía la continuación de la tramitación administrativa del expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;5. El 1 de abril de 2026, esta Dirección General envió al órgano gestor del &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt; el anuncio de información pública correspondiente, y simultáneamente notificó al promotor la necesidad de realizar el pago de la tasa asociada a la publicación del anuncio, con indicación de que tenía que comunicar a esta Dirección General la justificación del pago una vez que se hubiera realizado. El 10 de abril de 2026, el promotor comunicó a esta Dirección General la confirmación del pago de la tasa de publicación del anuncio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;6. El 16 de abril de 2026, se publicó en el BOIB n.º 49 el anuncio de información pública del expediente durante un plazo de quince (15) días, de acuerdo con la tramitación de urgencia derivada de la declaración del proyecto como proyecto industrial estratégico, y sin perjuicio de la prioridad y celeridad aplicadas durante toda la tramitación administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;7. El 21 de abril de 2026, la empresa Redexis, SAU, presentó un informe con número de referencia AFD-IB24/2026, mediante el cual confirmaba la no existencia de afecciones con la red de gas de distribución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;8. El 24 de abril de 2026, el promotor aportó el proyecto ejecutivo de la instalación fotovoltaica para autoconsumo, con el fin de obtener la autorización administrativa previa conjuntamente con la autorización del proyecto de ejecución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;9. El 30 de abril de 2026, la Agencia Balear del Agua y la Calidad Ambiental (Abaqua) emitió dos informes: uno del Área de Construcción y Gestión de Abastecimiento y Desaladoras en el que indicaba que, en base a la información facilitada, no existe ninguna interferencia con las actividades descritas; y otro del Área de Planificación y Construcción de Saneamiento y Depuración en el que indicaba la ausencia de interferencias directas sobre sus instalaciones y cañerías.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;10. El 6 de mayo de 2026 Red Eléctrica de España presentó un informe con referencia PET000004901 en el que se indica que no presenta oposición al proyecto, dado que no existen afecciones con instalaciones de su titularidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;11. El 6 de mayo de 2026 Redexis Infraestructuras, SL, presentó un informe con referencia AFT-38/2026 en el cual confirmaba la no existencia de afecciones con gasoductos de transporte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;12. Los técnicos de la Dirección General de Economía Circular, Transición Energética y Cambio Climático han examinado la documentación aportada y han emitido un informe en el que se concluye, sin entrar a valorar técnicamente el proyecto, que se han cumplido todos los trámites requeridos en el procedimiento de autorización administrativa previa y de autorización administrativa de construcción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;13. Con fecha 12 de mayo de 2026, el director general de Economía Circular, Transición Energética y Cambio Climático formuló una propuesta de resolución favorable al otorgamiento de la autorización administrativa previa y de la autorización administrativa de construcción de la instalación fotovoltaica para autoconsumo IF Planta de Compostaje Llucmajor, la cual fue notificada al promotor a fin de que pudiera formular observaciones o poner de manifiesto posibles errores u omisiones antes de dictarse la resolución definitiva, en el plazo de diez (10) días.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;14. Con fecha 13 de mayo de 2026, el promotor remitió un escrito, con número de registro GOIBE354394/2026, mediante el cual manifiesta su conformidad con la propuesta de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1. La Ley 2/2020, de 15 de octubre, de medidas urgentes y extraordinarias para el impulso de la actividad económica y la simplificación administrativa en el ámbito de las administraciones públicas de las Illes Balears para paliar los efectos de la crisis ocasionada por la COVID-19.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2. El Real Decreto Ley 23/2020, de 23 de junio, por el que se aprueban medidas en materia de energía y en otros ámbitos para la reactivación económica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3. La Ley 10/2019, de 22 de febrero, de Cambio Climático y Transición Energética.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;4. La Ley 13/2012, de 20 de noviembre, de medidas urgentes para la activación económica en materia de industria y energía, nuevas tecnologías, residuos, aguas, otras actividades y medidas tributarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;5. El Real Decreto 413/2014, de 6 de junio, por el que se regula la actividad de producción de energía eléctrica a partir de fuentes de energía renovables, cogeneración y residuos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;6. El Decreto 96/2005, de 23 de septiembre, de aprobación definitiva de la revisión del Plan Director Sectorial Energético de las Illes Balears, modificado por el Decreto 33/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;7. La Ley 24/2013, de 26 de diciembre, del Sector Eléctrico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;8. El Real Decreto 244/2019, de 5 de abril, por el que se regulan las condiciones administrativas, técnicas y económicas del autoconsumo de energía eléctrica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;9. La Ley 3/2019, de 31 de enero, Agraria de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;10. El Decreto Legislativo 1/2020, de 28 de agosto, por el que se aprueba el Texto refundido de la Ley de Evaluación Ambiental de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;11. &lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;13. El Real Decreto 1955/2000, de 1 de diciembre, por el que se regulan las actividades de transporte, distribución, comercialización, suministro y procedimientos de autorización de instalaciones de energía eléctrica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;14. El Decreto 10/2025, de 14 de julio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;15. La Resolución del consejero de Empresa, Autónomos y Energía 24 de julio de 2025 de delegación de competencias y de suplencia de los órganos directivos de la Consejería.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;16. El Real Decreto 997/2025, de 5 de noviembre, por el que se aprueban medidas urgentes para el reforzamiento del sistema eléctrico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ol&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La instalación se clasifica en el grupo b.1.1, «Instalaciones que únicamente utilizan la radiación solar como energía primaria mediante la tecnología fotovoltaica», de acuerdo con el artículo 2 del Real Decreto 413/2014.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2. Aprobar el proyecto de ejecución aportado el 24 de abril de 2026, sin entrar a valorar técnicamente su contenido, siempre que se cumplan las condiciones de los informes emitidos por las administraciones consultadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3. Disponer que, antes del inicio de las obras, el promotor tiene que presentar a la Dirección General de Economía Circular, Transición Energética y Cambio Climático la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— Justificante de haber liquidado ante el ayuntamiento la tributación municipal correspondiente, tal y como prevé el artículo 29 del Plan Director Sectorial Energético de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— Nombramiento del técnico director de obras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— Declaración responsable del promotor en la que se compromete a la correcta gestión de los residuos una vez finalizada su vida útil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;4. Indicar que, una vez ejecutadas las instalaciones objeto de esta autorización, el titular tiene que presentar la solicitud de puesta en servicio, a la que tiene que adjuntar un certificado de final de obra subscrito por un técnico facultativo, así como las pruebas reglamentarias y el resto de documentación exigida en la reglamentación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;5. Informar que esta autorización se concede sin perjuicio de las concesiones y autorizaciones que sean necesarias relativas a las licencias municipales, la ordenación del territorio y el medio ambiente, y a cualesquiera otras motivadas por disposiciones que le sean aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;6. Notificar esta resolución al interesado y publicarla en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
