    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Visto el informe técnico con propuesta de resolución de día 16 de diciembre de 2025, y de acuerdo con el artículo 9.1 del Texto refundido de la Ley de evaluación ambiental de las Illes Balears aprobado por Decreto legislativo 1/2020, de 28 de agosto, y el punto 8. d) del artículo 2 del Decreto 10/2025, de 14 de julio, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, y el Decreto 13/2025, de 31 de julio, por el que se corrigen los errores detectados en el Decreto 10/2025,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;RESUELVO FORMULAR&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;El Informe de impacto ambiental del proyecto de una captación de aguas subterráneas (sondeo) para regadío en el polígono 1, parcela 38, del t.m. de Consell.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;1. Determinación de sujeción a evaluación ambiental y tramitación.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Según se establece en el artículo 7.2.a) de la Ley 21/2013, son objeto de una evaluación de impacto ambiental simplificada los proyectos comprendidos en el anexo II de esta ley.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;De acuerdo con el RD 445/2023, de 13 de junio de 2023, que modifica los anexos I, II y III de la Ley 21/2013, la actividad proyectada se incluye en el Anexo 2, Grupo 3 (perforaciones, dragados y otras instalaciones mineras e industriales) letra a):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;em&gt;3º Perforaciones para el abastecimiento de agua.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Por lo tanto, este proyecto ha de seguir la tramitación ambiental como Evaluación de Impacto Ambiental Simplificada establecida en el capítulo II sección 2ª de la Ley 21/2013; también debe cumplirse el Decreto legislativo 1/2020, de 28 de agosto, por el que se aprueba el Texto Refundido de la Ley de Evaluación Ambiental de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;2. Descripción del proyecto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El proyecto consiste en realizar un sondeo para la captación de aguas subterráneas y destinarlas al regadío en la finca Son Jordi, polígono 1, parcela 38 TM de Consell. La referencia catastral de la parcela es 07016A001000380000DM, y está clasificada como rústica y de uso principal agrario. La finca tiene una superficie total de 27.783 m&lt;sup&gt;2&lt;/sup&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El punto de sondeo proyectado está en las siguientes coordenadas UTM-ETRS89: X=483180, Y = 4392112, cota: Z = 158 m.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Según se indica en el proyecto, el sondeo se hará por roto-percusión &lt;strong&gt;a una profundidad máxima de 233 metros&lt;/strong&gt;. La perforación se hará sin recuperación del testigo, y se cimentarán un mínimo de 15 m, contados desde la boca del sondeo. Posteriormente se entubará en su totalidad usando una tubería ciega, a excepción de la zona acuífero, que se hará con tubería ranurada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Una vez efectuada la perforación, el entorno inmediato del sondeo se pavimentará con una losa de hormigón de 50 cm de lado, con verte aguas hacia el exterior. Finalizado el sondeo, se cubrirá la boca con una tapa metálica sin oberturas laterales o superiores para impedir el acceso al sondeo hasta que se instale la bomba.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Cuando la bomba esté instalada, a una profundidad máxima de 158 m, se colocará a la salida del sondeo un tubo piezométrico, un contador volumétrico y un grifo de toma de muestras a la salida del sondeo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Las características del sondeo son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;-Caudal máximo instantáneo de extracción de la bomba: 0,5 l/s.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;-Volumen anual máximo: 7.000 m&lt;sup&gt;3&lt;/sup&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;-Uso: regadío&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;-Profundidad máxima del sondeo: 233 m&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;-Longitud de cimentación: mínimo de 50 cm&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Una vez estabilizadas las instalaciones del sondeo, el promotor indica que se hará la desinfección del agua utilizando un producto adecuado y de acuerdo con lo indicado en el anexo 8, punto 2.3.3, del plan hidrológico de les Illes Balears (PHIB) en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Si el sondeo fuera negativo (no se encontrara agua) o con agua salinizada, el proyecto recoge el procedimiento de sellado para evitar accidentes y posibles contaminaciones del acuífero por derrame de contaminantes, de acuerdo con el artículo 125 del PHIB, y el anexo 8.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El plazo estimado de ejecución de los trabajos de perforación y entubado por sondeo es de 2 a 5 días.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Según los cálculos que constan en el proyecto, el presupuesto total, incluyendo las medidas adoptadas para evitar, reducir, corregir y compensar los posibles efectos ambientales, será de 6.025 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;3. Resumen del documento ambiental&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Análisis de las alternativas evaluadas&lt;/strong&gt; en el proyecto:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Alternativa 0:&lt;/strong&gt; no hacer el sondeo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Según la valoración del promotor, si no se dispone de una red de riego en la finca, se tendría que contratar camiones para transportar el agua. Esto supondría el movimiento periódico de vehículos, con el consecuente incremento de emisión de gases de efecto invernadero.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Por otra parte, las aguas de aportación mediante camiones cisterna provendrían de otros sondeos ubicados en la misma agua subterránea, lo que supondría un cono de depresión con riesgo de mayor salinización de la masa del agua y la creación de nuevos aljibes para contenerla.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Además, durante los meses de verano hay mucha demanda de agua y los camiones tienen dificultades para suministrarla debido a la alta presión turística y al incremento de las necesidades hídricas de la vegetación en periodos de mayor sequía. El documento ambiental plantea la opción de recoger agua de lluvia sin embargo, considera que esta aportación hídrica sería insuficiente en comparación con las necesidades del cultivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Alternativa 1:&lt;/strong&gt; hacer el sondeo en otra ubicación. Según el promotor, esta alternativa implicaría una eliminación más acusada de la vegetación con el fin de hacer zanjas de canalización de tuberías que lleguen a la zona de riego o al aljibe si fuera el caso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Alternativa 2 &lt;/strong&gt;(escogida por el promotor): a juicio del promotor, la elección del punto de sondeo está proyectada con la finalidad de incrementar la posibilidad de encontrar agua durante la perforación, de reducir la eliminación de vegetación y de disminuir las molestias a la fauna.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;También considera que es la mejor opción para poder acceder la maquinaria al lugar de actuación, lo que supondría una reducción de emisiones de gases de efecto invernadero, ya que se intenta evitar el tráfico de camiones cisterna y evitar construir más aljibes con zanjas de conducción de agua de riego.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;De acuerdo con las consideraciones descritas en el Anexo 8 de &lt;em&gt;«Condiciones técnicas para la ejecución, equipamiento y clausura de sondeos y pozos»&lt;/em&gt; del PHIB, el documento ambiental recoge las siguientes fases con los posibles impactos ambientales y platea algunas medidas correctoras para paliarlos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Durante la fase de construcción &lt;/strong&gt;se prevén los siguientes impactos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Posible eliminación de vegetación para el acceso de las máquinas (solo en caso necesario).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Limpieza de la zona en la que se instalará la perforadora, el compresor y el camión de los materiales de perforación. En esta fase se ocupará una superficie de unos 60 m&lt;sup&gt;2&lt;/sup&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Generación de ruido durante la perforación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Generación de vibraciones durante la perforación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Utilización de espumas durante las tareas de perforación; las espumas serán biodegradables (el promotor adjunta una ficha técnica en el apartado de anexos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Generación de detritos y lodos de perforación inertes. El promotor indica que una vez secos se rotularán para su utilización &lt;em&gt;in situ&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Emisión de gases de efecto invernadero durante la perforación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Impacto visual de la máquina durante la perforación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Eventual derrame de grasas y aceites por avería de la maquinaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Durante la ejecución del sondeo&lt;/strong&gt;, hay riesgo de contaminación del agua del acuífero por sustancias químicas, como derramamientos de combustibles de las máquinas perforadoras u otros contaminantes que puedan infiltrarse en las capas del suelo. La superficie afectada para la ejecución de las obras será de 60 m&lt;sup&gt;2&lt;/sup&gt; para los trabajos de perforación (instalación de la perforadora, el compresor y el camión de materiales).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Durante la fase de explotación el promotor expone los siguientes riesgos:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Contaminación a través de la boca del sondeo del agua subterránea por derramamientos incontrolados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Explotación por encima de los parámetros permisibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Utilización de energía eléctrica para el funcionamiento de la bomba.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Durante la fase de abandono&lt;/strong&gt; se contemplan las siguientes posibles afecciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Contaminación a través de la boca del sondeo del agua subterránea por derramamientos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Peligro de caída de personas o animales por la boca del sondeo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Molestias por ruido en las tareas de abandono del sondeo&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Las posibles afecciones ambientales&lt;/strong&gt; analizadas en el proyecto son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Sobre la población solo se produciría la molestia por ruido los días que se ejecute el sondeo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Sobre la vegetación habrá eliminación de las especies vegetales en el área de trabajo (20 m&lt;sup&gt;2&lt;/sup&gt;) para la instalación de los materiales que se extraen y los materiales inertes (piedras y rocas). El promotor indica que este material se utilizará para rellenar el sondeo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En el documento ambiental se menciona que &lt;strong&gt;existe riesgo potencial de contaminación de acuíferos&lt;/strong&gt; por &lt;strong&gt;derrame incontrolado de sustancias contaminantes&lt;/strong&gt; en las fases de la construcción, funcionamiento y posible abandono.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En el proyecto &lt;strong&gt;se proponen las siguientes medidas reductoras&lt;/strong&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1) Para evitar la contaminación del acuífero:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Cimentar el espacio anular entre el entubado y las paredes del sondeo en la longitud programada de 15 metros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Pavimentar con una losa de hormigón de 50 cm de longitud con vierte aguas hacia el exterior y con un grosor mínimo de 15 cm por encima de la cota y 30 cm debajo de la cota del terreno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Alejar los focos contaminantes, especialmente los hidrocarburos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Disponer de un bidón para la retirada de paños y de sacos de sepiolita para la absorción de tierra con aceites o grasas en caso de averías de la maquinaria, así como gestionar los residuos con un gestor autorizado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2) Para minimizar las emisiones de CO&lt;sub&gt;2&lt;/sub&gt; a la atmósfera, el compresor contará con las revisiones y mantenimientos periódicos indicados por el fabricante con el fin de evitar más consumo del necesario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3) Para evitar las molestias al vecindario y la fauna provocado por el ruido y vibraciones de la maquinaria:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Se limitarán los trabajos al horario diurno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Se mantendrá la maquinaria en óptimas condiciones (revisiones periódicas y mantenimiento).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;4) Una vez finalizada la obra, el promotor indica que el perforista deberá cerrar la boca de sondeo para evitar el acceso al mismo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Seguimiento:&lt;/strong&gt; el documento ambiental incluye un seguimiento del acuífero con la dirección de un director facultativo que inspeccione los niveles estáticos, certifique el cumplimiento de las normas técnicas del proyecto y que incluya una revisión de la litología perforada, todo de acuerdo con el plan hidrológico de las Illes Balears (PHIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;4. Consultas a las Administraciones públicas afectadas y personas interesadas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El Servicio de Evaluación Ambiental (SAA) solicitó la consulta en relación a la ejecución del proyecto a los órganos competentes y entidades afectadas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Departamento de Territorio, Movilidad e Infraestructuras de la Dirección Insular de Territorio y Paisaje.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Consell Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Servicio de Agricultura y Servicio de Reforma y Desarrollo Agrario de la Dirección General de Agricultura, Ganadería y Desarrollo Rural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Servicio de Protección de Especies de la Dirección General de Medio Natural y Gestión Forestal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Ayuntamiento de Consell.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Entidades ecologistas: GOB y Amigos de la Tierra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Según consta en el expediente, han tenido entrada en el SAA el oficio de envío de los siguientes informes técnicos de respuesta:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- En fecha 15 de octubre de 2024 la &lt;strong&gt;Dirección General de Agricultura, Ganadería y Desarrollo Rural&lt;/strong&gt; envió la contestación a la solicitud de un informe sobre el proyecto de captación de aguas subterráneas (sondeo) en el polígono 1, parcela 38 del t.m. de Consell, que concluye lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;em&gt;«En relación al expediente antes citado y vista la documentación presentada, la parcela forma parte de la base territorial de una explotación agraria, inscrita en el Registro Insular Agrario con el núm. 19.853 como Prioritaria.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;em&gt;Actualmente la actividad agrícola en la parcela es de barbecho y en la documentación no se describe la justificación del riego.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;em&gt;Por tanto, esta Dirección General de Agricultura, Ganadería y Desarrollo Rural, mediante el Servicio de Reforma y Desarrollo agrario, informa desfavorablemente el objeto del proyecto, desde el punto de vista agrario»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- En fecha 27 de noviembre de 2024 el Servicio de Protección de Especies de la &lt;strong&gt;Dirección General de Medio Natural y Gestión Forestal&lt;/strong&gt; envió un informe sobre el proyecto de sondeo para regadío en la parcela objeto de este informe que concluye :&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;«&lt;em&gt;[...] informo &lt;strong&gt;favorablemente &lt;/strong&gt;sobre el proyecto de captación de aguas subterráneas (sondeo) polígono 1, parcela 38, del T.M. de Consell.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;em&gt;Este informe se emite sin perjuicio de la obtención de otros informes o autorizaciones que puedan ser necesarias según la legislación vigente»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- En fecha 5 de febrero de 2025 el &lt;strong&gt;Servicio de Ordenación del Territorio del Consell de Mallorca&lt;/strong&gt; envió la contestación a la solicitud de un informe con relación al proyecto antes mencionado, que concluye:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;«&lt;em&gt;Dado el contenido del cuerpo del informe, desde el punto de vista de la ordenación del territorio y del paisaje, &lt;strong&gt;se considera que el proyecto&lt;/strong&gt; de una captación de aguas en el TM de Consell, &lt;strong&gt;no tendrá efectos significativos sobre el medio ambiente &lt;/strong&gt;mientras sirva y sea adecuado a los usos legales de la parcela&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;em&gt;Este informe se emite en relación a las competencias del Consell de Mallorca en materia de ordenación territorial y paisaje, sin perjuicio de las consideraciones que se puedan formular desde otras áreas de la administración dentro del alcance de las competencias que tengan atribuidas, y no presupone ninguna sobre la adecuación a la legalidad de los usos y de las construcciones del asunto.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;5. Elementos significativos del proyecto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1- Según la consulta del visor IDEIB en fecha 20/10/2025, la capa correspondiente al Plan Hidrológico de las Illes Balears indica que el sondeo proyectado se encuentra sobre la masa de agua 1809M2 Penya Flor, con el código ASS_21781_Sol-licitado-AAS_21781, y con las siguientes características:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- La distancia mínima a la zona de riesgo de inundación se encuentra a 758 m del torrente de Sóller.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- La distancia mínima al mar es de : 15.415 m&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;-El sondeo de captación más próximo al punto proyectado en el documento ambiental se encuentra a 155 m de distancia, y está identificado en el Plan Hidrológico con el código IRA_1132_Vigent-A_S_11858, también para uso de regadío (coordenadas ETRS89 UTM31N: X: 483283; Y: 4392228). Pertenece a la finca Son Uyet, polígono 1, parcela 36, del TM de Consell.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2- Una vez consultada la cartografía del visor IDEIB, se comprueba que las características de las aguas subterráneas dentro de la zona prevista de actuación presentan un &lt;strong&gt;estado cuantitativo malo&lt;/strong&gt; (índice de explotación &amp;gt; 100 %) y un &lt;strong&gt;estado cualitativo bueno&lt;/strong&gt;. Entre las delimitaciones que figuran en el Plan Hidrológico de las Illes Balears (artículos 123.4 y 123.5) figura la prohibición de su explotación, excepto por reordenación existentes, agricultura, geotermia y abastecimiento urbano.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3- &lt;strong&gt;Vulnerabilidad del proyecto frente al riesgo de accidente grave o catástrofe:&lt;/strong&gt; el punto proyectado para hacer el sondeo se corresponde con un área catalogada como Zona de Bajo Riesgo de Incendios y de Bajo Riesgo de Inundación (fuente: Visor IDEIB, consulta del 21/10/2025).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;4- La parcela está dentro de suelo &lt;strong&gt;rústico de régimen general&lt;/strong&gt; (SRG). Se califica al Sistema de Información Geográfica de Parcelas Agrícolas (SIGPAC) como tierra arable, cultivable de cereales (no arroz).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;5- &lt;strong&gt;Figuras de protección ambiental:&lt;/strong&gt; la zona del sondeo no está afectada por figuras LEN reflejadas en la Ley 1/91 de Espacios Naturales de las Illes Balears y actualizadas según las diferentes normativas que se han aprobado hasta 2015 (ANEI, ARIP y AAPI).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;No hay hábitats de interés comunitario en la parcela proyectada ni especies catalogadas o protegidas, según la consulta de hábitats y del bioatlas (fuente: visor IDEIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;6- &lt;strong&gt;Patrimonio cultural e histórico&lt;/strong&gt;: En el visor IDEIB (consulta de día 20/10/2025) se comprueba que dentro del área del sondeo no hay bienes de interés etnológico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;6. Consideraciones técnicas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Por todo lo anterior, una vez analizados los criterios del anexo III de la Ley 21/2013, de 9 de diciembre, de evaluación ambiental, y dada la naturaleza del proyecto y la ubicación propuesta, &lt;strong&gt;no se prevén efectos adversos significativos sobre el medio ambiente&lt;/strong&gt; con la ejecución del proyecto, siempre que se apliquen las medidas preventivas y correctoras del documento ambiental y las propuestas en este informe.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Conclusiones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Primero. &lt;/strong&gt;No sujetar a evaluación de impacto ambiental ordinaria el proyecto de una captación de aguas subterráneas para regadío en el polígono 1, parcela 38 del t.m. de Consell, ya que no tiene efectos adversos significativos sobre el medio ambiente, siempre que se cumplan las medidas propuestas en el documento ambiental firmado el 19/08/2024 por la técnica responsable y de redacción del proyecto, Ana Gázquez Valverde, ingeniera de minas y licenciada en ciencias ambientales, y con los &lt;strong&gt;siguientes condicionantes&lt;/strong&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1. Durante las fases de ejecución, explotación y abandono del sondeo se debe cumplir con el contenido normativo del anexo 8. Condiciones técnicas para la ejecución, equipamiento y abandono de pozos y sondeos, del Plan Hidrológico de las Illes Balears, aprobado mediante el Real Decreto 49/2023, de 24 de enero (BOIB 28 de 4/03/2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2. Para evitar el riesgo de contaminación del agua del acuífero por sustancias químicas, como derramamientos de combustibles de las máquinas perforadoras u otros contaminantes que puedan infiltrarse en las capas del suelo, deben aplicarse las siguientes medidas preventivas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;a) Llevar a cabo los trabajos de acuerdo con las normativas técnicas para minimizar los riesgos de contaminación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;b) Cerrar y sellar adecuadamente el pozo abandonado, de acuerdo con el capítulo III, artículo 125 y anexo 8 del PHIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;c) Realizar un control y mantenimiento adecuado de la maquinaria y el seguimiento y control de los materiales de extracción, los posibles derramamientos de aceite o sustancias contaminantes, implementar sistemas de vigilancia para detectar posibles fugas o contaminaciones durante la ejecución de los trabajos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3. No se permite el vertido de barros de perforación o barros residuales del sondeo sin tratar, de acuerdo con el Decreto 16/2022, de 23 de mayo, por el que se desarrolla el canon sobre el vertido y la incineración de residuos de las Illes Balears: Reglamento que desarrolla el artículo 35.6 y la disposición adicional sexta. Canon sobre el vertido y la incineración de residuos en el punto 4, de la Ley 8/2019, de 19 de febrero, de residuos y suelos contaminados, sobre el canon de vertederos e incineración de residuos, que dice: «&lt;em&gt;La finalidad del canon debe ser fomentar la prevención, la preparación para la reutilización y el reciclaje de los residuos, con la fracción orgánica como fracción preferente, así como desincentivar la eliminación en vertedero y la incineración».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;4. Los lodos del sondeo deben gestionarse de acuerdo con la Ley 8/2019, de 19 de febrero (BOIB núm. 23, de 21/02/2019), de residuos y suelos contaminados de las Illes Balears, con el fin de prevenir y gestionar los residuos y suelos contaminados en las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;5. Durante la ejecución de las obras habrá que cumplir la normativa del Decreto 125/2007, del 11 de octubre, por el que se dictan normas sobre el uso del fuego y se regula el ejercicio de determinadas actividades susceptibles de incremento el riesgo de incendio forestal, especialmente con respecto a las medidas de prevención durante la época de peligro de incendio forestal tal y las acciones coyunturales de prevención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Se recomienda&lt;/strong&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Fomentar el uso de aguas pluviales para el riego de especies vegetales autóctonas de bajo requerimiento hídrico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Diversificar los cultivos en la parcela para mejorar la salud del suelo y reducir la propagación de plagas y enfermedades. Esta práctica contribuye a un sistema de agricultura más sostenible y puede incrementar la resiliencia frente al cambio climático.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Hacer el control de plagas (insectos, lagomorfos o roedores) por medios mecánicos, biológicos o bien con productos aptos en agricultura ecológica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Se recuerda que&lt;/strong&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1. Puesto que el documento ambiental indica que la energía que se empleará para instalar la bomba de extracción será eléctrica, sería recomendable incluir la instalación de un sistema de producción de energía renovable, por ejemplo, mediante placas fotovoltaicas o paneles solares, que permitan reducir al máximo el consumo energético.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2. El promotor debería instalar los sistemas de riego eficientes necesarios para reducir el consumo de agua, revisando periódicamente las conducciones con el fin de detectar cualquier pérdida de agua.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3. Visto que el estado global de la masa de agua es malo (índice de explotación superior al 100 %), se considera recomendable contabilizar de forma conjunta todas las autorizaciones de extracción de agua de la masa de MAS1809M2 Penya Flor para valorar su afección global antes de conceder nuevas autorizaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Segundo. &lt;/strong&gt;Se publicará el presente informe de impacto ambiental en el Boletín Oficial de las Illes Balears, de acuerdo con lo dispuesto en el artículo 47.3 de la Ley 21/2013, de 9 de diciembre, de evaluación ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Tercero.&lt;/strong&gt; El informe de impacto ambiental perderá su vigencia y cesará en la producción de los efectos que le son propios si, una vez publicado en el BOIB, no se hubiera procedido al inicio de la ejecución del proyecto en el plazo máximo de seis años desde la publicación, de acuerdo con lo dispuesto en el artículo 21 bis del Texto refundido de la Ley de evaluación ambiental de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Cuarto. &lt;/strong&gt;El informe de impacto ambiental no debe ser objeto de recurso alguno, sin perjuicio de los que, en su caso, sean procedentes en la vía administrativa o judicial ante el acto, en su caso, de autorización del proyecto, de acuerdo con lo dispuesto en el artículo 47.5 de la Ley 21/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Quinto. &lt;/strong&gt;Esta resolución se emite sin perjuicio de las competencias urbanísticas, de gestión o territoriales de las administraciones competentes y de las autorizaciones o informes necesarios para la aprobación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
