    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Se hace público que el Consejo Ejecutivo en sesión de carácter ordinario de 13 de abril de 2026, adoptó el siguiente acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Primero.&lt;/strong&gt; Aprobar el acuerdo de cesión entre el Consejo Insular de Menorca y la zona 17ª comandancia de la Guardia Civil en las Illes Balears para ceder el uso de un vehículo aéreo no tripulado (dron) titularidad del Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; Revocar el anterior contrato de cesión de un dron a la Guardia Civil aprobado por el Consejo Ejecutivo en sesión ordinaria de fecha 28 de julio de 2025, por imposibilidad de formalizar el contrato con esta figura jurídica por parte de la Guardia Civil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Tercero.&lt;/strong&gt; Notificar este acuerdo de cesión a la zona 17ª comandancia Guardia Civil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Cuarto.&lt;/strong&gt; Ordenar la publicación de este acuerdo de cesión en el &lt;em&gt;Boletín Oficial de las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;ANEXO&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Acuerdo de cesión entre el Consejo Insular de Menorca y la zona 17ª comandancia de la Guardia Civil en las Illes Balears para la cesión de uso de un vehículo aéreo no tripulado (dron) titularidad del Consejo Insular de Menorca&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Partes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Adolfo Vilafranca Florit, presidente del Consejo Insular de Menorca, en nombre y representación de la institución que preside, y en virtud de lo que dispone el artículo 34.1.b) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, y en ejercicio de las atribuciones que le confiere el artículo 21.1 k de la Ley 4/2022, de 28 de junio, de consejos insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Alejandro Hernández Mosquera, coronel jefe de la zona 17ª de la Guardia Civil en Illes Balears, nombrado por Resolución de 12 de noviembre de 2018 de la Secretaría de Estado de Seguridad, en ejercicio de las atribuciones conferidas en el apartado segundo de la Orden general 23/1998, sobre reorganización de las zonas de la Guardia Civil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1. El Consejo Insular de Menorca, de conformidad con el artículo 70 de la Ley Orgánica 1/2007, de 28 de febrero, de reforma del Estatuto de autonomía de las Illes Balears, es competente en las actividades, entre otras, en materia de agricultura, ganadería, pesca, caza, recursos cinegéticos, denominaciones de origen, artesanía y proyección económica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2. Respecto de las competencias de agricultura, ganadería, pesca, caza y recursos cinegéticos del Consejo Insular de Menorca, se ejerce la función ejecutiva, incluyendo las potestades inspectora y sancionadora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3. La Guardia Civil tiene atribuido el ejercicio de las funciones previstas en la Ley Orgánica 2/1986, de 13 de marzo de Fuerzas y Cuerpos de Seguridad, entre las cuales se encuentran, «velar por el cumplimiento de las leyes y disposiciones generales […] y asegurar la conservación y custodia de los bienes que se encuentren en situación de peligro por cualquier causa».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;4. La actividad desarrollada por la Guardia Civil en el cumplimiento de las competencias que le son atribuidas en las disposiciones relativas a la conservación de la naturaleza, el medio ambiente, los espacios protegidos, los recursos hidráulicos, la caza, la pesca, el patrimonio histórico y la ordenación del territorio, es un claro exponente del principio de cooperación entre administraciones públicas. Esta cooperación se materializa en la práctica en la comunicación constante con el Consejo Insular de Menorca, y el apoyo que presta la Guardia Civil, específicamente en las áreas de vigilancia e inspección, facilitando así la incoación de los correspondientes expedientes sancionadores cuando proceda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;5. Las partes coinciden en considerar que la cesión de un vehículo aéreo no tripulado (un dron) a la Guardia Civil redundaría en un aumento sustantivo de la eficiencia y la eficacia en las funciones atribuidas a cada una de las partes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;6. Este acuerdo de cesión se fundamenta jurídicamente de conformidad con los artículos 143, 144.1 g y 144.2 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, los cuales amparan la cooperación entre administraciones públicas en materia patrimonial en que se ceden medios materiales entre éstas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Así, teniendo en cuenta la disposición adicional décima de la Ley 4/2022, de 28 de junio, de consejos insulares, la Ley de aplicación para este negocio jurídico es la Ley 6/2001, de 11 de abril, de patrimonio de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Concretamente, el artículo 61 de la Ley 6/2001, de 11 de abril, del patrimonio de la Comunidad Autónoma de las Illes Balears faculta la cesión gratuita de bienes entre administraciones e instituciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En aplicación del artículo 142 del Decreto 127/2005, de 16 de diciembre, por el cual se aprueba el reglamento de despliegue de la Ley 6/2001, de 11 de abril, de patrimonio de la Comunidad Autónoma de las Illes Balears, el régimen jurídico aplicable en este acuerdo de cesión es el que se establece en los artículos 125 y siguientes de este Decreto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;7. De acuerdo con la legislación indicada, el dron y sus accesorios tienen la consideración jurídica de bienes patrimoniales. Estos bienes de titularidad del Consejo Insular de Menorca no tienen carácter demanial, dado que no están afectados ni destinados al uso general ni a ningún servicio público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Sobre este punto, se deja constancia expresa de que los inspectores de pesca del CIM no emplean este dron en sus funciones ordinarias y que el aparato se mantiene sin una adscripción efectiva a ningún servicio de inspección directa de la institución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;A pesar de que la finalidad última del aparato es facilitar funciones de autoridad y vigilancia, como que no están integrados en la estructura operativa actual del Departamento de Economía y Servicios Generales, la cesión a la Guardia Civil acontece la fórmula óptima para garantizar que el bien cumpla con su función de interés público sin tener que ser previamente afectado a un servicio público insular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Además, a estos bienes no se les aplica el principio de inalienabilidad, inembargabilidad e imprescriptibilidad, ni tampoco han sido declarados como bienes demaniales en la normativa mencionada ni a ninguna norma con rango legal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;8. Este acuerdo de cesión gratuita tiene naturaleza administrativa y se rige por sus pactos, por el artículo 61 de la Ley 6/2001, de 11 de abril, del patrimonio de la Comunidad Autónoma de las Illes Balears, y los artículos 142, artículo 125 y siguientes del Decreto 127/2005, de 16 de diciembre, por el cual se aprueba el reglamento de despliegue de la Ley 6/2001, de 11 de abril, de patrimonio de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Ambas instituciones trabajan de manera conjunta en las finalidades de conservación y protección señaladas y desarrollan sus funciones con un claro compromiso de responsabilidad social, conscientes del impacto social y medioambiental de todas sus actividades y de su compromiso con la sociedad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Ambas partes nos reconocemos la capacidad legal necesaria para formalizar este acuerdo de cesión gratuita, que se regirá por los siguientes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Pactos:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Primero. Objecto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Este acuerdo de cesión tiene por objeto regular la colaboración entre la zona 17ª de la Guardia Civil de las Illes Balears y el Consejo Insular de Menorca respecto de la cesión de uso de un vehículo aéreo no tripulado marca DJI Mine 4 PRO, con controlador, doble batería, núm. serie 1581F6Z9A24ANML3, maletín de transporte rígido 1450 y tarjeta Lexar 128 GB Profesional 85 Silver Plus.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los bienes objeto de cesión se destinarán a las funciones propias de inspección y vigilancia de la Guardia Civil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Segundo. Obligaciones del Consejo Insular de Menorca&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Son obligaciones del Consejo Insular de Menorca:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— Ceder el dron especificado en el pacto primero de este acuerdo de cesión con las condiciones que establece este acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— Colaborar con la Guardia Civil de las Illes Balears con los medios humanos y materiales de que dispone para que, conjuntamente, se puedan llevar a cabo todas las actuaciones de control, prevención y persecución de infracciones administrativas y penales que sean necesarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— Cooperar en la medida necesaria para proporcionar la información adecuada a las unidades de la Guardia Civil encargadas de la vigilancia y control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Tercero. Obligaciones de la Guardia Civil&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Son obligaciones de la Guardia Civil:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— Colaborar con el Departamento de Economía del Consejo Insular de Menorca con los medios humanos y materiales de que dispone para que conjuntamente se puedan llevar a cabo todas las actuaciones de control, prevención y persecución de infracciones administrativas y penales que sean necesarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— Utilizar de forma diligente el bien objeto de cesión para dar soporte a las tareas de velar por el cumplimiento de las leyes y disposiciones generales y asegurar la conservación y custodia de los bienes que se encuentren en situación de peligro por cualquier causa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— Informar al Consejo Insular de Menorca de todas aquellas actuaciones que lleve a cabo la Guardia Civil en relación con la vigilancia y protección del patrimonio anteriormente descritas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Cuando las circunstancias así lo requieran, se podrá utilizar el bien objeto de cesión para hacer otras tareas de inspección y vigilancia y responsabilidad de la zona 17ª de la Guardia Civil en Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Cuarto. Vigencia&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La cesión de uso de los bienes se realizará en la fecha de la formalización de este acuerdo de cesión y finalizará cuatro años después, sin perjuicio de la posibilidad de acordar posibles prórrogas, que se acordarán por un plazo que no se exceda la mitad del pactado inicialmente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Quinto. Modificación y extinción&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Este acuerdo de cesión se puede modificar por mutuo acuerdo entre los firmantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La modificación se incorporará como anexo al acuerdo y se considerará parte integrante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Son causas de resolución de este acuerdo de cesión:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— El transcurso del plazo de vigencia sin haberse acordado la prórroga&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— El mutuo acuerdo de las partes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— El incumplimiento grave o manifiesto de las obligaciones de una de las partes firmantes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— La concurrencia de causa de fuerza mayor que imposibilite la ejecución del objeto de este acuerdo de cesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Sexto. Incumplimiento&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El incumplimiento de las obligaciones asumidas por cualquiera de las partes en virtud de este Acuerdo será causa de resolución de éste. Especialmente, se considerará incumplimiento el destino del equipo a finalidades diferentes de las previstas o la falta de cuidado en su conservación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En caso de incumplimiento, la parte perjudicada requerirá a la parte incumplidora para que en un plazo de quince días naturales cumpla con las obligaciones pendientes o enmiende las irregularidades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Si transcurrido este plazo el incumplimiento persiste, el Acuerdo quedará resuelto de acuerdo con lo que prevé el artículo 51.2 c de la Ley 40/2015, de 1 de octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Séptimo. Seguimiento, vigilancia, control y ejecución de la cesión&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En el momento de la firma de este acuerdo, se designa para el seguimiento y cumplimiento de la ejecución de éste, así como para la resolución de problemas de interpretación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— Por parte del Consejo Insular de Menorca, la técnica Natàlia Pérez Marquès.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— Por parte de la zona 17ª comandancia de la Guardia Civil en las Illes Balears, el capitán de la Guardia Civil Jefe de la Compañía de Menorca, actualmente el capitán Fernando García Casais.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Cada una de las partes tiene que informar a la otra de cualquier cambio que decida sobre la designación del personal responsable de este acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;​​​​​​​&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Octavo. Revocación y devolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El Consejo Insular de Menorca se reserva el derecho de revocar la cesión del uso del equipo de forma unilateral y antes del plazo previsto por razones de interés público debidamente motivadas o, si el bien fuese necesario, para el ejercicio directo de las competencias del Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En caso de finalización o revocación de la cesión, la Guardia Civil tendrá que devolver el material en el mismo estado de conservación en que le fue entregado, salvo el desgaste natural por su uso ordinario, formalizándose la devolución mediante el acta correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Noveno. Régimen jurídico aplicable&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1. Este acuerdo tiene naturaleza administrativa y queda excluido del ámbito de aplicación de la normativa de contratos de sector público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2. En todo aquello no previsto expresamente en este acuerdo rigen las disposiciones que sean aplicables contenidas en las normas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— La Ley 6/2001, de 11 de abril, del patrimonio de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— El Decreto 127/2005, de 16 de diciembre, por el cual se aprueba el Reglamento de despliegue de la Ley 6/2001, de 11 de abril, de patrimonio de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;— La Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Y, en prueba de conformidad con el contenido de este acuerdo de cesión, lo firmamos en los lugares y en las fechas que constan en las firmas electrónicas de este documento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
