&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En fecha 15 de julio de 2024, la Presidencia del IMAS aprobó las Bases generales que deben regir los procesos selectivos para cubrir las plazas vacantes de personal funcionario de la Administración especial de la oferta de ocupación pública correspondiente al ejercicio de 2024 del Consejo de Mallorca y de las ofertas de ocupación pública correspondientes a los ejercicios 2021 y 2023 del IMAS y las ofertas de ocupación pública derivadas del Plan estratégico para la reducción de la temporalidad del IMAS aprobado por el Consejo Rector el día 15 de diciembre de 2023 (BOIB núm. 94, de 18 de julio de 2024) con las modificaciones y rectificaciones de errores aprobados mediante la Resolución de 24 de julio de 2024 (BOIB núm. 99, de 27 de julio de 2024) y la Resolución de 7 de agosto de 2024, (BOIB núm. 105, de 10 de agosto de 2024) y la Resolución de 3 de septiembre de 2025 (BOIB núm. 119, de 6 de septiembre de 2025). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En la base 10.2.2 del Anexo-I relativa a los ejercicios del grupo B, se han detectado los errores siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- En el apartado c.1.2) Segundo ejercicio, existe una incongruencia en el número de las cuestiones indicado para poder de obtener la calificación final del ejercicio para el turno libre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- En el apartado c.2.1) Primer ejercicio, existe una incongruencia en el número de las cuestiones indicado para poder de obtener la calificación final del ejercicio para el turno de promoción interna.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En sesión ordinaria de la Mesa sectorial de negociación del IMAS, de fecha 28 de abril de 2026, se aprobó la propuesta de modificación de la base 13.1.e) del Anexo-I de las Bases generales, aprobadas por Resolución de la Presidencia del IMAS de fecha 15 de julio de 2024, en relación con la forma de acreditar la capacidad funcional y la aptitud de las personas aspirantes necesaria para desarrollar las funciones del puesto de trabajo derivado de su nombramiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En fecha 5 de mayo de 2026 la Coordinación de los servicios de Selección y Provisión del IMAS ha emitido informe jurídico favorable en relación con la rectificación de los errores detectados en los apartados c.1.2) y c.2.1) de la base 10.2.2 y la modificación de la base 13.1.e) del Anexo-I de la Resolución de la Presidencia del Instituto Mallorquín de Asuntos Sociales de fecha 15 de julio de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; El artículo 109.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, dispone que las administraciones públicas pueden rectificar, así mismo, o en cualquier momento, de oficio o a instancia de los interesados, los errores materiales, de hecho o aritméticos existentes en sus actos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. La sesión ordinaria de la Mesa sectorial de negociación del IMAS, de fecha 28 de abril de 2026, en la cual, se aprobó la rectificación de los errores detectados en los apartados c.1.2) y c.2.1) de la base 10.2.2 y la modificación de la base 13.1.e) del Anexo-I de la Resolución de la Presidencia del Instituto Mallorquín de Asuntos Sociales (IMAS) de aprobación de las bases generales que deben regir los procesos selectivos para cubrir las plazas vacantes de personal funcionario de la Administración especial de la oferta de ocupación pública correspondiente al ejercicio de 2024 del Consejo de Mallorca y de las ofertas de ocupación pública correspondientes a los ejercicios 2021 y 2023 del IMAS y las ofertas de ocupación pública derivadas del Plan estratégico para la reducción de la temporalidad del IMAS aprobado por el Consejo Rector de día 15 de diciembre de 2023 (BOIB núm. 94, de 18 de julio de 2024). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; De acuerdo con el artículo 7.2.13 de los Estatutos del IMAS, corresponde a la Presidencia convocar y resolver los procedimientos de selección, establecer las bases, los programas y el contenido de las pruebas y nombrar los miembros de los órganos de selección (BOIB núm. 67, de 18 de mayo de 2019). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Rectificar los errores detectados en los apartados c.1.2) y c.2.1) de la base 10.2.2 del Anexo-I, en el sentido siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Respecto de la base &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10.2.2. &lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;c.2.1) Primer ejercicio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;La calificación del ejercicio se hará de la manera siguiente: cada cuestión se calificará de 0 a 10 puntos, la calificación final del ejercicio será la media de la nota obtenida en cada una de las tres cuestiones.&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Para superar esta prueba será necesario obtener la nota mínima de 3 puntos en cada cuestión, y que la nota media de las tres cuestiones sea igual o superior a 5 puntos.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Respecto de la base &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. Presentación de documentos de las personas seleccionadas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El apartado &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13.1. &lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;[...]&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Publicar esta Resolución de rectificación y modificación en el Boletín Oficial de las Illes Balears (BOIB) y en la sede electrónica del Instituto Mallorquín de Asuntos Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta resolución no pone fin a la vía administrativa y contra ella se puede interponer, de acuerdo con el artículo 28.1 de los Estatutos del IMAS aprobados por Acuerdo del Pleno del Consell de Mallorca de 11 de abril de 2019 (BOIB núm. 67, de 18 de mayo de 2019), recurso de alzada ante el Consejo Ejecutivo del Consell Insular de Mallorca, dentro del plazo de un mes, a contar a partir del día siguiente al de la publicación de la presente Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la desestimación expresa del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado de lo Contencioso Administrativo, en el plazo de dos meses, a contar a partir del día siguiente al de la notificación de la desestimación del mencionado recurso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la desestimación por silencio del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado de lo Contencioso Administrativo, en cualquier momento a partir del día siguiente a la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstante lo anterior, se puede ejercitar, si es el caso, cualquier otro recurso que se estime pertinente. Todo ello de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción contencioso-administrativa, y de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
