OBJETO, FINALIDAD Y ÁMBITO DE APLICACIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;El objetivo de esta convocatoria es dar apoyo económico a las actuaciones, iniciativas y proyectos de las sociedades y asociaciones que gestionen cotos de caza del municipio de Sant Josep de sa Talaia y las Asociaciones de propietarios de terrenos forestales o rústicos que tengan como objetivo la preservación del entorno, la conservación del paisaje y la prevención de los incendios forestales de los terrenos que gestionen en el municipio de Sant Josep de sa Talaia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;La Ley de Bases de Régimen Local (Ley 7/85) establece en su artículo 25 que es competencia de los municipios la prevención y la extinción de incendios. En este sentido, el Decreto 125/2007 de incendios forestales de las Illes Balears define como actuaciones de prevención de incendios forestales todas aquellas actividades dirigidas a evitar el inicio del incendio forestal es necesario crear las condiciones para minimizar la propagación y limitar al máximo los efectos perjudiciales que puedan ocasionar a personas, bienes, patrimonio rural y medio ambiente en general.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Asimismo, la Ley de Montes (Ley 43/2003) establece en su artículo 43 que corresponde a las administraciones públicas competentes la responsabilidad de la organización de la defensa contra incendios forestales y que deben adoptar, de forma coordinada, medidas que conduzcan a la prevención, detección y extinción de los incendios, independientemente de la titularidad de los montes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Por otra parte, la Ley de Patrimonio Natural y Biodiversidad (Ley 42/2007) establece, en su artículo 5, que las administraciones públicas deben promover la participación y las actividades que contribuyan a alcanzar los objetivos de la ley, entre los que se incluye la gestión sostenible de los recursos naturales, la preservación de la variedad, singularidad y belleza de los ecosistemas naturales y del paisaje.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;En el mismo sentido, el Estatuto de Autonomía de las Illes Balears establece en su artículo 23 que los poderes públicos deben velar por la defensa y la protección de la naturaleza, del territorio, del medio ambiente y del paisaje y establecerán políticas de gestión, ordenación y mejora de su calidad armonizándolas con las transformaciones que se producen por la evolución social, económica y ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Así pues, el actual marco normativo establece de forma clara la responsabilidad de las administraciones locales para llevar a cabo actuaciones de prevención de los incendios forestales y de forma más general la responsabilidad para tomar medidas de gestión sostenible de los recursos naturales y de protección del paisaje.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;El desarrollo rural (mediante la conservación de cultivos y limpieza de masas forestales) es un elemento clave en el mantenimiento del paisaje y en la prevención de los incendios forestales, y cabe destacar que gran parte de los terrenos forestales y rurales del municipio de Sant Josep de sa Talaia se encuentran incluidos en cotos de caza gestionados por sociedades de cazadores y asociaciones de vecinos o están incluidos en asociaciones de propietarios de terrenos forestales o rurales. Estas entidades llevan a cabo actuaciones de mantenimiento de cultivos, recuperación de espacios agrícolas degradados que por otra parte seguirían en estado de abandono, limpieza de bosques, así como actuaciones de mejora y protección del entorno en el que realizan su actividad, favoreciendo así la conservación del medio ambiente, la recuperación de usos tradicionales y colaborando en la prevención de incendios forestales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;De la misma manera, el plan especial de protección Civil de Emergencias para Incendios Forestales de las Illes Balears (INFOBAL), aprobado mediante Decreto 9/2023 (BOIB 26 de 2023), establece en su punto 11 y en el Anexo 6 la necesidad de elaboración y ejecución de planes de autoprotección por riesgo de incendios forestales para aquellas urbanizaciones residenciales que se encuentren en interfaz urbano-forestal. Esta obligación se encuentra reforzada por lo que determina el apartado 3.6 del Real Decreto 893/2013 de Directriz básica de planificación de protección civil de emergencia para incendios forestales (BOE 293 de 2013), así como el artículo 77 de le Ley 3/2019, Agraria de las Illes Balears (BOIB 18 de 9 de febrero de 2019)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;La Concejalía de Medio Ambiente del Ayuntamiento de Sant Josep de Sa Talaia pretende impulsar las actuaciones que permitan la preservación del paisaje y del patrimonio natural del municipio, al tiempo que se fomentan las actuaciones orientadas a la prevención de los incendios forestales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;​​​​​​​&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;2. RÉGIMEN JURÍDICO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;2.1. La presente convocatoria se somete a la Ley 38/2003, de 17 de noviembre, general de subvenciones, el Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones, en la Ordenanza general de las bases reguladoras de las subvenciones que concede el Ayuntamiento de Sant Josep de sa Talaia (BOIB núm. 66 de 30 de mayo de 2017) y en el Plan estratégico de subvenciones del Ayuntamiento de Sant Josep sa Talaia para los años 2024-2026 (BOIB núm. 36, de 14 de marzo de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Esta convocatoria se expondrá en el tablón de anuncios de la sede electrónica del Ayuntamiento y se publicará en la BDNS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;3. CONSIGNACIÓN PRESUPUESTARIA Y CUANTÍA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Esta convocatoria está dotada con un máximo de 25.000,00€ con cargo al presupuesto municipal de 2026 (partida 136-48022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;4. REQUISITOS GENERALES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Podrán acogerse a esta convocatoria aquellas sociedades de cazadores, comunidades de propietarios de urbanizaciones o residenciales, asociaciones de vecinos que gestionen cotos de caza en el municipio de Sant Josep de sa Talaia y las asociaciones de agricultores o de propietarios de terrenos forestales o rústicos, y que cumplan los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;a) Gestionar terrenos del municipio de San Josep de sa Talaia o representar a comunidades de propietarios de urbanizaciones o residenciales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;b) Tener personalidad jurídica y estar legalmente constituida&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;c) Tener carácter no lucrativo&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;d) Encontrarse al beneficiario al corriente de las obligaciones tributarias, con la seguridad social y con el propio Ayuntamiento de Sant Josep.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;e) No encontrarse el beneficiario incurso en ninguna de las causas de incompatibilidad y cumplir los requisitos fijados en el artículo 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;f) Acreditación del cumplimiento de obligaciones por reintegro de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;g) Estar inscrito en el Registro de Asociaciones del Ayuntamiento (si se tercia).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;5. ACTIVIDADES SUBVENCIONABLES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Sólo se considerarán &lt;strong&gt;actividades&lt;/strong&gt; subvencionables aquellas que se realicen en el municipio de Sant Josep de Sa Talaia, que se puedan justificar con facturas y&lt;strong&gt; que hayan sido realizadas entre el 1 de enero y el 31 de diciembre del año 2025&lt;/strong&gt; &lt;strong&gt;y pagadas hasta el 31 de marzo de 2026&lt;/strong&gt;. Las actividades objeto de la subvención son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;a. &lt;span style="background-color:white"&gt;Siembra y recuperación de cultivos: Siembras o recuperaciones de cultivos de parcelas identificadas catastralmente dentro del municipio de Sant Josep de sa Talaia. Se incluyen en este apartado los gastos de personal, maquinaria, tratamiento de residuos, compra de semillas u otros productos complementarios y otros gastos relacionados. Con la solicitud se entregará la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;i. &lt;span style="background-color:white"&gt;La relación de parcelas identificadas catastralmente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;ii. &lt;span style="background-color:white"&gt;Plano de ubicación de las mismas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;b. &lt;span style="background-color:white"&gt;Prevención de incendios forestales: Serán subvencionables las actuaciones de prevención de incendios forestales tales como la ejecución o mantenimiento de fajas contraincendios, depósitos contraincendios (para medios de extinción aéreos y terrestres), actividades y materiales de difusión/educación y actuaciones similares, realizadas siempre de acuerdo con las instrucciones y permisos correspondientes por parte de las administraciones públicas. Se incluyen en este apartado los gastos de personal, obras, maquinaria y otros gastos relacionados. Con la solicitud se entregará la siguiente documentación (en su caso):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;i. &lt;span style="background-color:white"&gt;Plano que señale las parcelas o caminos donde se ha realizado la actuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;ii. &lt;span style="background-color:white"&gt;Imagen de los materiales para los que se solicita la subvención (depósito contraincendios, materiales de difusión, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;c. &lt;span style="background-color:white"&gt;Redacción de planes de autoprotección de incendios forestales: Redacción, por parte de un experto, del plan de autoprotección de incendios forestales de la urbanización o residencial o agrupación de viviendas. Con la solicitud se entregará la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;i. &lt;span style="background-color:white"&gt;Copia del registro de entrada del plan de autoprotección en la Dirección General de Emergencia del Gobierno de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;ii. &lt;span style="background-color:white"&gt;Copia del proyecto de autoprotección.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Todas las actividades para las que se solicite la subvención deben disponer de los correspondientes permisos, autorizaciones y/o licencias necesarias para su realización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;6. RÉGIMEN DE LAS AYUDAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;6.1. La concesión de la subvención se realizará mediante el régimen de concurrencia competitiva. Sólo podrán obtener subvención aquellos solicitantes que reúnan los requisitos exigidos en esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;6.2&lt;strong&gt;. Se establece como único medio de notificación de todos los actos de trámite del presente procedimiento, el tablón de anuncios de la sede electrónica del Ayuntamiento (www.santjosep.org).&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;6.3. Requerimientos de defectos de las solicitudes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Si las solicitud no cumple los requisitos establecidos en la normativa de la convocatoria, el órgano instructor tendrá que requerir, según establece la base 6,2, a la entidad interesada que le presente en el plazo máximo e improrrogable de 10 días y le ha de indicar que, si no lo hiciere, se considerará que ha desistido de la solicitud, con la resolución previa que se tiene que dictar en los términos que prevee el art. 68 de la Ley 39/2015, de 1 e octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Una vez pasado el plazo para la presentación del requerimiento de documentación o de la presentación de alegaciones , y una vez resueltas estas por el órgano colegiado, el órgano instructor publicará la lista provisional de admitidos y excluidos para participar en el procedimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Una vez pasado el plazo para la subsanación de documentación o presentación de alegaciones a la publicación de la lista provisional , y una vez resueltas por el órgano colegiado, el órgano instructor publicará la lista definitiva de la concesión de la ayuda,y en caso de no haber alegaciones a la lista provisional de entenderá elevada a definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;6.4. Sólo podrán obtener subvención aquellos solicitantes que, reuniendo los requisitos exigidos, cumplan las condiciones señaladas en la base 4.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;6.5. Las ayudas objeto de esta convocatoria son compatibles con otras ayudas por parte de cualquier otro organismo, administración o institución pública o privada. La suma total de las ayudas percibidas para la misma actividad no podrá ser, en ningún caso, superior al coste total de la actividad subvencionada. El beneficiario estará obligado a comunicar al Ayuntamiento la obtención de otras subvenciones o ayudas para la misma finalidad, procedentes de cualquier administración o ente público, nacional o internacional, así como de toda entidad o institución privada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;6.6. Las ayudas no podrán ser superiores a los gastos originados por la actividad objeto de esta convocatoria, sin perjuicio de las limitaciones presupuestarias. Si el total de ayudas a conceder superase la consignación presupuestaria de esta línea de subvenciones, éstas se distribuirán de forma proporcional, garantizando un mínimo para todos los solicitantes con actuaciones subvencionables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Estas subvenciones no generan ningún derecho a la obtención de otras ayudas en ejercicios posteriores y, por tanto, tampoco se pueden alegar como precedente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;7. SOLICITUD, DOCUMENTACIÓN Y PLAZO DE PRESENTACIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;7.1. Las solicitudes de subvención se formalizarán mediante el modelo normalizado que puede encontrarse en la página web del Ayuntamiento. Las instancias deben registrarse en la sede electrónica del Ayuntamiento de Sant Josep de sa Talaia o en la forma establecida en el art. 16 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. En este caso deberá pasar aviso por correo electrónico a la dirección:mediambient@santjosep.org.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;7.2. Los solicitantes, junto con el modelo de solicitud deben presentar la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;a. Copia del CIF / NIF de la entidad solicitante y copia del DNI / NIF del representante de la entidad (en caso de no haber sido presentados en convocatorias anteriores).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;b. Copia de los Estatutos de la entidad (en caso de no haber sido presentados en convocatorias anteriores).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;c. Cuenta justificativa, la cual tendrá que contener una Memoria de actuación y una Memoria económica con el detalle previsto en el artículo 72 del RLGS y con la información requerida en el punto 5 de la presente convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;d. Facturas que justifiquen los gastos realizados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;e. Justificante de pago de las facturas (certificado de la empresa proveedora, extracto bancario).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;f. Modelo de solicitud de transferencia bancaria para pagos del Ayuntamiento de Sant Josep de sa Talaia, disponible en las oficinas municipales. (En caso de no haber sido presentado con anterioridad).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;g. Declaración responsable, de no encontrarse incurso en ninguna de las causas de incompatibilidad y cumplir los requisitos que fija el artículo 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones (&lt;strong&gt;ver anexo II&lt;/strong&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;h. Declaración responsable del cumplimiento de obligaciones por reintegro de subvenciones (&lt;strong&gt;anexo II&lt;/strong&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;i. Declaración de las subvenciones recibidas o solicitadas para la misma finalidad y compromiso de comunicar a la entidad local, las que se obtengan en el futuro (&lt;strong&gt;anexo III&lt;/strong&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;j. Declaración responsable de encontrarse al corriente de las obligaciones tributarias, con la Seguridad Social y con el mismo Ayuntamiento de Sant Josep y autorización al Ayuntamiento para solicitar a la Agencia Tributaria y a la Seguridad Social los datos fiscales del solicitante, que sean necesarias (&lt;strong&gt;anexo IV&lt;/strong&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;k. Declaración responsable sobre la situación relativa al IVA del solicitante (&lt;strong&gt;anexo V&lt;/strong&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Si los documentos exigidos en la solicitud ya se hubieran presentado al Ayuntamiento en otra ocasión, la persona solicitante podrá acogerse a lo que establece el artículo 53.d) de la Ley 39/2015, d 1 de octubre, del procedimiento administrativo común de las administraciones públicas, siempre que se haga constar la fecha y el órgano o dependencia donde se presentaron o emitieron. La presentación de la solicitud supone la aceptación, por parte de la persona interesada, de las prescripciones contenidas en la correspondiente convocatoria. El Ayuntamiento de Sant Josep de sa Talaia, en cualquier momento, puede solicitar a los interesados la documentación y la información complementaria que considere necesaria para resolver el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;7.3. Plazo de presentación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;El plazo de presentación de solicitudes será de 15 días contados a partir del día siguiente a la publicación del extracto de la convocatoria en el BOIB.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;8. CUANTÍA DE LAS AYUDAS Y CRITERIOS DE VALORACIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;8.1. Cuantía de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;La cuantía de las subvenciones podrá ser del 100% del coste de la actividad, siempre que el importe de la ayuda, aisladamente o en concurrencia con otras subvenciones o ayudas, no supere el coste de la actividad para la que se solicita la subvención. En ningún caso será subvencionable el pago de impuestos, tasas o tributos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;En cualquier caso, el importe máximo de la subvención para cada entidad será de 15.000,00 €. Específicamente, la ayuda máxima para la redacción de los proyectos de autoprotección (de acuerdo con el apartado 5) será de 4.000,00 €, aunque será compatible con otras actividades hasta el importe máximo de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;En caso de que las solicitudes formuladas que cumplan los requisitos superen la cantidad disponible, se distribuirá el fondo de forma proporcional a la puntuación obtenida según los criterios de valoración establecidos en estas bases, garantizando un mínimo para todos los solicitantes con actuaciones subvencionables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;8.2) Criterios de valoración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Los criterios para la valoración de las solicitudes será el siguiente (máximo de 60 puntos):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;a. Siembras y recuperación de cultivos: 10 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;b. Prevención de incendios forestales: 20 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;c. Redacción de proyectos de autoprotección: 30 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;9. ÓRGANO COLEGIADO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;9.1 El órgano colegiado realizará la valoración técnica de las solicitudes, a partir de un informe técnico de l'Área de Medi Ambient, y elevará el informe al órgano instructor, el cual formulará propuesta de resolución, que, cuando sea definitiva, elevará al órgano resolutorio para las oportunas concesiones de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;9.2 Estará formado por los siguientes miembros:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;El órgano colegiado tiene atribuidas las siguientes funciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;a. Analizar y valorar las solicitudes y el informe técnico de acuerdo a los criterios establecidos en la base 4 y de los criterios establecidos en el punto 9.1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;b. Formular el informe de evaluación y elevarlo al órgano instructor&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;c. Resolver cualquier duda que se presente en la interpretación y aplicación de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;10. INSTRUCCIÓN Y RESOLUCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;10.1. El órgano instructor del procedimiento será personal administrativo del Departamento de Medio Ambiente, que tiene atribuidas las funciones que establece el artículo 24 de la Ley General de Subvenciones y artículo 12 de la Ordenanza general de las bases reguladoras de las subvenciones que concede Ayuntamiento de Sant Josep.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;El órgano instructor, a la vista del expediente y del informe del órgano colegiado, formulará la propuesta de resolución provisional debidamente motivada, que tendrá que notificar a las entidades interesadas, concediendo un plazo de 10 días, contados a partir del siguiente al de la publicación de la propuesta, para que los interesados puedan presentar alegaciones, en su caso, requerirlos para que presenten la documentación que acredite la realidad de los datos afirmados en la declaración&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;10.2 Finalizado este plazo y examinadas las alegaciones que, en su caso, hayan presentado los interesados, el órgano instructor, previo informe del órgano colegiado, formulará la propuesta de resolución definitiva que tendrá que expresar la relación de personas solicitantes para las que se propone la concesión de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;La propuesta de resolución definitiva se elevará al órgano competente para resolver, que dictará resolución definitiva con la lista de solicitantes que hayan obtenido ayudas y la cuantía de las ayudas concedidas, que se notificará de conformidad con lo expuesto en la base 6.2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;10.3 La resolución de concesión de acuerdo con el artículo 14a de la Ordenanza general de las bases reguladoras de las subvenciones que concede el Ayuntamiento de Sant Josep, tendrá que contener la relación de las entidades beneficiarias a las que se otorga la ayuda, con las cuantías individualizadas, así como la desestimación y la no concesión, por desestimiento, renuncia al derecho o imposibilidad material sobrevenida de las solicitudes no atendidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;La resolución incluirá el requerimiento de la justificación de las medidas de publicidad establecidas en el punto 11 de las presentes bases, sin las cuales no se podrá efectuar el pago de la ayuda, de acuerdo con el punto 13 de estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;La resolución será pública de conformidad con lo que prevé el artículo 18.2 de la Ley 38/2003 general de subvenciones y el artículo 17 de la Ordenanza general de las bases reguladoras de las subvenciones que concede el Ayuntamiento de Sant Josep.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;El plazo para la resolución y notificación del procedimiento será de 6 meses desde la fecha de finalización del plazo para la presentación de las solicitudes a los que se refiere la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;11. PUBLICIDAD DE LOS PROYECTOS SUBVENCIONADOS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Cada entidad beneficiaria de una subvención reflejará, en las actividades que realice, la colaboración de la corporación y se expresará que ha sido subvencionada por el Ayuntamiento de Sant Josep de sa Talaia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;La persona o entidad beneficiaria deberá dar adecuada publicidad al carácter público de la financiación del programa, actividad, inversión o actuación objeto de subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Las medidas de difusión pueden consistir en la inclusión de la imagen institucional de la entidad concedente, así como en leyendas relativas a la financiación pública en carteles, placas conmemorativas, materiales impresos, medios electrónicos o audiovisuales, o bien, en menciones realizadas en medios de comunicación u otras que resulten adecuadas al objeto subvencionado y de eficacia equivalente a las citadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;12. FACTURA JUSTIFICATIVA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;12.1. Las facturas tendrán que ser emitidas a nombre de la entidad que solicita la subvención y con anterioridad a la finalización del plazo de solicitud de la subvención que establece el punto 7.3 de la presente convocatoria.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;12.2. Se deberá acreditar el pago de la factura justificativa con anterioridad a la finalización del período de solicitud de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;12.3. La acreditación del abono del gasto del proyecto se llevará a cabo a través de la documentación que a continuación se indica, dependiendo de los medios de pago que se hayan utilizado:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;a. Pago en efectivo: factura, firmada y sellada por el proveedor, en la que se especificará el gasto al que corresponde el pago, fecha y expresión «recibido en metálico», «pagado en metálico», «pagado» o similar. Bajo la firma debe figurar el nombre, apellidos y número de documento de identidad de la persona que firma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;a. Pago con tarjeta de crédito:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Ticket de compra en el que figure el pago con tarjeta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Ticket de compra y resguardo del pago con tarjeta en caso de que no figure en el ticket de compra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Extracto de la cuenta en la que figure el cargo de pago con tarjeta. El extracto de la cuenta puede sustituir por un certificado o título similar de la entidad bancaria en la que, como mínimo, conste el titular y el número de cuenta corriente en el que se carga el pago de la tarjeta, la persona beneficiaria, el concepto por el que se realiza la transferencia y el importe y la fecha de la operación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;b. Pago mediante transferencia bancaria o ingresos en una cuenta bancaria:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Copia del justificante de la orden de transferencia bancaria o del documento bancario acreditativo del pago en el que figuran el concepto de la transferencia o el ingreso, la fecha del documento, el importe, la identificación del concepto, a fin de que quede identificado el pago de la factura, y los datos del ordenante y del destinatario, que deben coincidir con la persona beneficiaria y con el emisor de la factura, respectivamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;e. Pago por domiciliación bancaria:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Esta documentación se puede sustituir por un certificado o título similar de la entidad bancaria en la que conste el titular y el número de la cuenta corriente en la que se ha hecho el cargo y el ordenante del cargo, la persona beneficiaria, el concepto por el que se hace el cargo y el importe y la fecha de la operación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;13. PAGO DE LA AYUDA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;El pago de la subvención aprobada sólo podrá hacerse efectivo una vez dictada la resolución correspondiente y una vez justificada la publicidad de la subvención, de acuerdo con el artículo 11 de la presente convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;14. RÉGIMEN DE RECURSOS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;Contra la resolución que recaiga en este procedimiento, que pondrá fin a la vía administrativa, se podrán interponer los recursos previstos en la legislación vigente. Éstos son los siguientes,:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;El recurso de reposición potestativo ante el órgano que dictó la resolución, en el plazo de un mes, a contar a partir del día siguiente de la notificación de la misma. Contra la desestimación expresa del recurso de reposición, podrá interponerse el recurso contencioso administrativo, en el plazo de dos meses, a contar a partir del día siguiente de la notificación de la desestimación del recurso de reposición. Contra la desestimación por silencio del recurso de reposición, se podrá interponer el recurso contencioso administrativo, en el plazo de seis meses, a contar a partir del día siguiente de la presunta desestimación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:white"&gt;O, directamente, el recurso contencioso-administrativo ante la jurisdicción contencioso-administrativa, en el plazo de dos meses, a contar a partir del día siguiente de la notificación del acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;
