    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt; n.º&amp;nbsp;172, de 31 de diciembre de 2024, se publicó la Resolución del consejero de Empresa, Empleo y Energía por la que se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el fomento de instalaciones de autoconsumo con o sin almacenamiento eléctrico con fuentes de energía renovable promovidas por el sector público, comunidades energéticas, asociaciones empresariales, cooperativas y entidades sin ánimo de lucro dentro de las actuaciones previstas en el Plan de Inversiones para la Transición Energética de las Illes Balears en el marco del Plan de Recuperación, Transformación y Resiliencia financiado por la Unión Europea (Next Generation EU).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Esta convocatoria fue modificada por la resolución del consejero de Empresa, Autónomos y Energía de 24 de marzo de 2026 (BOIB n.º 39, de 26 de marzo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En el &lt;em&gt;Boletín Oficial del Estado&lt;/em&gt; n.º&amp;nbsp;93, de 16 de abril de 2026, se publicó el Real Decreto&amp;nbsp;317/2026, de 15 de abril, por el que se modifica el Real Decreto&amp;nbsp;451/2022, de 14 de junio, por el que se regula la concesión directa de ayudas destinadas a la financiación de estrategias de energía sostenible para las Illes Balears y Canarias, en el marco del Plan de Recuperación, Transformación y Resiliencia. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En el punto 1 del artículo único del Real Decreto 317/2026 se modifica la vigencia de las actuaciones objeto del Real Decreto 451/2022 hasta el 31 de agosto de 2026 y se extiende el plazo de ejecución y justificación de las actuaciones subvencionables hasta el 30 de junio de 2026.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En cuanto a la contribución mínima de las Illes Balears a los Objetivos e Indicadores de Seguimiento, en el punto 5 del artículo único del Real Decreto 317/2026 se modifica la tabla III.A.4, que queda redactada de la siguiente manera:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Las actuaciones objeto de la convocatoria contribuyen al incremento de la capacidad adicional de producción de energía renovable (Objetivo 120) mediante instalaciones de cierto tamaño, así como cierta cantidad de concesiones en que los beneficiarios son administraciones públicas, las cuales necesitan periodos más largos de ejecución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Para conseguir este objetivo, resulta necesario maximizar el grado de ejecución de los proyectos subvencionados. Esto provoca que tenga que ampliarse el plazo de ejecución lo máximo posible, el cual queda fijado en el 31 de mayo de 2026, sin incurrir en el incumplimiento de los hitos y objetivos establecidos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Sin embargo, teniendo en cuenta los plazos administrativos previstos en la normativa de subvenciones y con el fin de poder verificar a 30 de junio de 2026 las actuaciones en la aplicación de gestión de los fondos MRR (CoFFEE), es necesario establecer que el plazo de presentación de la justificación de las actuaciones sea, como máximo, un día posterior al nuevo plazo de ejecución de las actuaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En la letra &lt;em&gt;b)&lt;/em&gt; del punto 1 del apartado sexto de la convocatoria se establece que el periodo de inversión es el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;— Las actuaciones tienen que realizarse desde el 16 de junio de 2022 hasta el 30 de abril de 2026. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Hay que considerar que con esta ampliación de plazo no es necesario incorporar en el presupuesto de la convocatoria la anualidad 2026, puesto que todas las solicitudes han sido resueltas, y las ayudas correspondientes han sido comprometidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El punto 7 del apartado decimocuarto de la convocatoria establece que la resolución de otorgamiento de la subvención tiene que fijar el plazo concreto para justificar la realización de las actividades subvencionadas, que en ningún caso puede ser posterior al décimo día hábil desde la fecha máxima de ejecución de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Por todo ello, dado que es necesario modificar la letra &lt;em&gt;b)&lt;/em&gt; del punto&amp;nbsp;1 del apartado sexto de la convocatoria, para ampliar el plazo para la realización de las inversiones hasta el 31 de mayo de 2026, así como modificar el punto 7 del apartado decimocuarto, con el objeto de establecer el plazo para justificar la realización de las actividades subvencionadas, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. Modificar la letra &lt;em&gt;b) &lt;/em&gt;del punto&amp;nbsp;1 del apartado sexto de la convocatoria, que queda con la siguiente redacción:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;b) Las actuaciones tienen que realizarse desde el día de la presentación de la solicitud hasta el plazo que fije la resolución de otorgamiento. Este plazo no podrá ser posterior al 31 de mayo de 2026.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. Modificar el punto 7 del apartado decimocuarto de la convocatoria, que queda con la siguiente redacción:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;La resolución de otorgamiento de la subvención tiene que fijar el plazo concreto para justificar la realización de las actividades subvencionadas, que en ningún caso puede ser posterior al día siguiente desde la fecha máxima de ejecución de la actividad.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. Establecer que los plazos indicados en los puntos&amp;nbsp;anteriores también se aplican a todas las resoluciones de concesión dictadas con anterioridad a la publicación de esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. Publicar esta Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra esta Resolución, que agota la vía administrativa, cabe interponer un recurso potestativo de reposición ante el consejero de Empresa, Autónomos y Energía en el plazo de un mes a contar desde el día siguiente a su publicación, de acuerdo con el artículo&amp;nbsp;124 de la Ley&amp;nbsp;39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo&amp;nbsp;57 de la Ley&amp;nbsp;3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;También cabe interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso-administrativo del Tribunal Superior de Justicia de las Illes Balears&amp;nbsp; en el plazo de dos meses a contar desde el día siguiente a la publicación, de acuerdo con el artículo&amp;nbsp;46 de la Ley&amp;nbsp;29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
