    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La jefa de Departamento de Formación y Selección de la EBAP ha formulado la propuesta de resolución siguiente:&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Hechos:&lt;/strong&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Días 17 y 18 de noviembre de 2025, la Universitat de las Illes Balears solicitó la aprobación de 4 acciones formativas por un importe total de 4.845€. Visto que la primera propuesta presentada se consideró de carácter general y que no había disponibilidad presupuestaria suficiente, inicialmente solo se aprobó la acción formativa "III Plan de igualdad de la Universitat de les Illes Balears (2023/2027): marco normativo", por un importe de 1.332 €.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Teniendo en cuenta que los empleados públicos de la Universitat de les Illes Balears cotizan en la financiación de los fondos del AFEDAP y que se ha generado un remanente en el crédito finalista de este fondo a raíz de la adjudicación de un expediente de contratación administrativa, se ha considerado adecuado aprobar las otras dos acciones formativas de carácter sectorial presentadas por la Universidad ("Aproximación a las violencias machistas y marco normativo de protección en la UIB" y "Las retribuciones del personal de la UIB"), visto que esta decisión resulta equitativa en relación con la financiación que la Universidad aporta a este fondo.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. De acuerdo con el que establece el artículo 12 de la Ley 3/2007, de 27 de marzo, de la función pública de la Comunidad Autónoma de las Illes Balears, corresponde a la EBAP la formación, la capacitación y el perfeccionamiento del personal al servicio de la Administración autonómica y de las entidades que dependen. Así mismo, esta norma añade que, en los términos que se establezcan, corresponde al EBAP la realización de actividades formativas y de selección del personal al servicio de las otras administraciones del ámbito territorial de las Illes Balears.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. El artículo 1 del Decreto 191/1996, de 25 de octubre, por el que se regulan las condiciones generales de las actividades formativas que organiza la Consejería de Interior (actualmente, Consejería de Presidencia y Administraciones Públicas), indica que el Instituto Balear de Administración Pública (actualmente, Escuela Balear de Administración Pública) es el principal instrumento de la política formativa de la Administración pública de las Illes Balears, y elabora periódicamente diferentes planes de formación que responden a los principios de eficacia y de calidad de las actividades formativas, con el fin de favorecer la participación del personal al servicio de la Administración.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. El artículo 5.1 del Decreto 31/2012, de 13 de abril, por el que se aprueban los Estatutos de la Escuela Balear de Administración Pública, incluye, entre sus funciones, la promoción, la organización y la gestión de la formación, el reciclaje y el perfeccionamiento del personal de la Comunidad Autónoma y, si procede, del resto de administraciones de su ámbito territorial.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. La Resolución de la consejera de Presidencia y Administraciones Públicas y presidenta de la Escuela Balear de Administración Pública (EBAP) de 30 de julio de 2024 (BOIB 101, del 1 de agosto) modificada por la Resolución de la consejera de Presidencia y Administraciones Públicas y presidenta de la EBAP de 23 de septiembre de 2024 (BOIB 128, de 28 de septiembre) que fija las áreas de formación y los ámbitos funcionales en los que se tienen que estructurar los planes de formación que organiza la EBAP.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5. La Ley 30/2015, de 9 de septiembre, por la que se regula el sistema de formación profesional para el empleo en el ámbito laboral, así como el Acuerdo de formación para el empleo en las administraciones públicas, que fue modificado y ratificado por Mesa General de Negociación de las Administraciones Publicas el 15 de marzo de 2018.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6. De conformidad con el punto cuarto del Acuerdo del Consejo de Dirección de la Escuela Balear de Administración Pública (EBAP) de 8 de enero de 2026 por el cual se aprueba a la convocatoria de las actividades formativas para el personal al servicio de la Administración de la Comunidad Autónoma de las Illes Balears para el primer semestre del año 2026, se delega en la Dirección Gerencia de la Escuela Balear de Administración Pública la modificación o la supresión de actividades en función de la demanda y la disponibilidad presupuestaria (BOIB núm. 6, 13 de enero de 2026).&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Propuesta de Resolución&lt;/strong&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra esta resolución, que agota la vía administrativa,&lt;span style="color:#ee0000"&gt; &lt;/span&gt;se puede interponer un recurso potestativo de reposición ante el Consejo de Dirección de la EBAP en el plazo de un mes, a contar a partir del día siguiente a de la publicación en el Boletín Oficial de las Illes Balears, de acuerdo con los artículos 123 i 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;También puede interponerse directamente un recurso contencioso-administrativo ante el Juzgado Contencioso-Administrativo de Palma en el plazo de dos meses contados desde el día siguiente a la publicación de esta Resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
