font-family:&quot;Times New Roman&quot;,Times,serif"><em>«</em></span><em>La vigencia de este concierto será de tres años, con fecha de inicio día 17 de abril de 2023, y se podrá ampliar y renovar por el mismo plazo</em><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><em>».</em></span></p> <p><strong><span style="background-color:#ffffff">4.</span></strong><span style="background-color:#ffffff; color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"> Mediante Resolución de la Presidencia del IMAS núm. 16634 de 9 de julio de 2025, se acordó la actualización y fijación de precios de los servicios para personas con discapacidad, incluidos en la cartera insular de servicios sociales, que pueden ser objeto de concertación social para los años 2025-2027 (BOIB núm. 89, de 12 de julio de 2025).</span></p> <p><strong><span style="background-color:#ffffff">5. </span></strong><span style="background-color:#ffffff; color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">El 24 de julio de 2025, la Presidencia del IMAS dictó Resolución núm. 18078, de revisión de precios de la concertación del servicio de apoyo a la vivienda para personas con </span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">discapacidad intelectual y/o trastorno del desarrollo</span><span style="background-color:#ffffff; color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">, incluido en la red pública de servicios sociales para personas con discapacidad de Mallorca (</span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">BOIB núm. 102, de 2 de agosto de 2025</span><span style="background-color:#ffffff; color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">).</span></p> <p><strong>6.</strong><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"> El 26 de febrero de 2026, la jefa del Servicio de Personas con Discapacidad, con el visto bueno de la directora insular de Personas con Discapacidad, ha emitido informe de evaluación de la eficacia y la eficiencia de dicha concertación social (Código CSV: K9AADU93FYV7ZTFAFD4H).</span></p> <p><strong>7.</strong><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"> Mediante informe, de 10 de marzo de 2026, emitido por la jefa del Servicio de Personas con Discapacidad, con el visto bueno de la directora insular de Personas con Discapacidad, se propone renovar la concertación social del servicio de apoyo a la vivienda para personas con discapacidad intelectual y/o trastorno del desarrollo, por tres anualidades (Código CSV: K9AADWJR4EYY3VJR4YZX).</span></p> <p><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">Además, en el citado informe se propone designar como responsable de los acuerdos de acción concertada de este servicio, a la jefa de Servicio de Personas con Discapacidad.</span></p> <p><strong><span style="background-color:#ffffff">8. </span></strong><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">Por parte del Servicio de Autorizaciones, Acreditación, Registro e Inspección de Servicios Sociales, en fecha 25 de febrero de 2026, se informa favorablemente sobre los servicios de apoyo a la vivienda para personas con discapacidad intelectual y/o trastorno del desarrollo de las entidades concertadas, los cuales constan autorizados, acreditados y vigentes, así como de la inexistencia de expediente sancionador en materia de servicios sociales por infracciones de las que constan en los artículos 128 y 129 de la Ley 4/2009, de Servicios Sociales de las Islas Baleares durante los últimos 24 meses.</span></p> <p><strong><span style="background-color:#ffffff">9. </span></strong><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><span style="background-color:#ffffff">Por resolución del presidente del IMAS, </span></span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">de 10 de marzo de 2026</span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><span style="background-color:#ffffff">, se acuerda iniciar la tramitación del procedimiento de renovación de la concertación social </span>del servicio de apoyo a la vivienda para personas con discapacidad intelectual y/o trastorno del desarrollo (Código CSV: K9AADWLN4FL44XT4LCNN).</span></p> <p><strong><span style="background-color:#ffffff">10. </span></strong><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><span style="background-color:#ffffff">El gasto previsto por este expediente es de </span></span><strong>16.899.307,98€</strong><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><span style="background-color:#ffffff">, con cargo a la partida presupuestaria 40.23140.26000, y dado su carácter plurianual, el Servicio de Contabilidad y Presupuestos, ha emitido en fecha 13 de marzo de 2026, informe favorable de autorización al gasto </span>(Código CSV: K9AADWVPWQXWCJD22KJN)<span style="background-color:#ffffff">.</span></span></p> <p><strong><span style="background-color:#ffffff">11. </span></strong><span style="background-color:#ffffff; color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">Las entidades concertadas </span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">del servicio de apoyo a la vivienda para personas con discapacidad intelectual y/o trastorno del desarrollo</span><span style="background-color:#ffffff; color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">, han manifestado mediante declaración responsable que consta en el expediente</span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">,</span><span style="background-color:#ffffff; color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"> su conformidad con la renovación de dicha concertación por un periodo de tres anualidades y que continúan cumpliendo con los requisitos exigidos para la concertación.</span></p> <p><strong>12. </strong><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">El Servicio Jurídico-Administrativo y la Intervención Delegada, han emitido sendos informes favorables a la renovación de la concertación social del servicio de apoyo a la vivienda para personas con discapacidad intelectual y/o trastorno del desarrollo, con las entidades concertadas.</span></p> <p><strong>Fundamentos de derecho</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">En cuanto a la competencia,</span></p> <p><strong>1.</strong><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"> La Ley orgánica 1/2007, de 28 de febrero, de reforma del Estatuto de Autonomía de las Islas Baleares (BOIB núm. 32 ext., de 1 de marzo de 2007; corrección de errores BOIB núm. 29, de 28 de febrero de 2008), en concreto el artículo 70.4 relativo a la competencia propia de los consejos insulares en materia de servicios sociales y asistencia social.</span></p> <p><strong>2.</strong><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"> La Ley 14/2001, de 29 de octubre, de atribución de competencias a los consejos insulares en materia de servicios sociales y seguridad social, establece en el artículo 14 la potestad reglamentaria normativa atribuida a los consejos insulares en materia de servicios sociales, dentro del marco de la regulación básica establecida por el Gobierno de las Islas Baleares (BOIB núm. 135, de 10 de noviembre de 2001 y BOE núm. 284, de 27 de noviembre de 2001).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>3.</strong> La Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares (BOIB núm. 89 de 18 de junio de 2009 y BOE </span>núm. 163 de 7 de julio de 2009<span style="color:#000000">) prevé en el artículo 27 y en la disposición final cuarta, que cada Consejo Insular, en el marco de sus competencias, debe definir las prestaciones propias de servicios sociales, Complementando la cartera básica de servicios sociales que aprueba el Gobierno de las Islas Baleares, la cual fue aprobada mediante el Decreto 32/2023, de 26 de mayo, por el que se aprueba la Cartera básica de servicios sociales de las Islas Baleares 2023-2027, se establecen principios generales para las carteras insulares y locales y se modifican diversas normativas del ámbito social (BOIB núm. 70, de 27 de mayo de 2023).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>4.</strong> Los Estatutos del Instituto Mallorquín de Asuntos Sociales (BOIB núm. 67, de 18 de mayo de 2019) aprobados por acuerdo del Pleno del Consell de Mallorca de fecha 11 de abril de 2019, en especial lo establecido en el artículo 2 de acuerdo con el cual el IMAS, como organismo autónomo creado por el Consell de Mallorca, adscrito al Departamento de Bienestar Social del Consell de Mallorca, es el organismo que ejerce las competencias atribuidas por cualquier título al Consell de Mallorca en materia de servicios sociales y protección de menores.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>5.</strong> Decreto de la Presidencia del Consell de Mallorca, de 10 de julio de 2023, por el que se crean los departamentos que deben estructurar el gobierno (BOIB núm. 95, de 11 de julio de 2023), entre los que se encuentra el Departamento de Bienestar Social.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>6.</strong> Decreto de la Presidencia del Consell de Mallorca por el que se nombran los miembros del Consejo Ejecutivo de 10 de julio de 2023 (BOIB núm. 95, de 11 de julio de 2023) por el que se nombra al Sr. Guillermo Sánchez Cifre consejero ejecutivo de Bienestar Social.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>7. </strong>El órgano competente para aprobar esta resolución es la Presidencia del IMAS, de acuerdo con el artículo 7.2.28 de los Estatutos del IMAS (BOIB núm. 67, de 18 de mayo de 2019). No obstante, y de acuerdo con el artículo 8.2.1 las Vicepresidencias del IMAS suplirán a la Presidencia y asumirán sus atribuciones en caso de vacante, ausencia, enfermedad, imposibilidad física u otra causa legal.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">En cuanto al fondo,</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>8. </strong>La Cartera Insular de Servicios Sociales y de los Servicios a Menores y Familia de Mallorca aprobada definitivamente en Pleno del Consell de Mallorca de 13 de julio de 2017 (BOIB núm. 97, de 18 de julio de 2017 y corrección de errores materiales publicada BOIB núm. 161, de 30 de diciembre de 2017) y prorrogada su vigencia hasta la entrada en vigor de la nueva Cartera Insular de servicios sociales de Mallorca, por Acuerdos del Pleno en sesiones de 8 de julio de 2021 (BOIB núm. 95, de 17 de julio de 2021), de 15 de diciembre de 2022 (BOIB núm. 168, de 27 de diciembre de 2022), Acuerdo del Pleno de 14 de diciembre de 2023 (BOIB núm. 176, de 30 diciembre de 2023) y Acuerdo del Pleno de 12 de diciembre de 2024 (BOIB núm. 172, de 31 diciembre de 2024).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>9.</strong> El Reglamento por el que se regula el funcionamiento de los servicios sociales para personas con discapacidad incluidos en la Cartera Insular de servicios sociales y se establecen los requisitos de autorización y acreditación, aprobado en el Pleno del Consell de Mallorca de fecha 11 de mayo de 2023 (BOIB núm. 83, de 20 de junio de 2023).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>10</strong><span style="color:#000000"><strong>. </strong>La Directiva 2014/24/UE del Parlamento Europeo y del Consejo, de 26 de febrero de 2014, sobre contratación pública (DOUE núm. 94, de 28 de marzo de 2014).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>11. </strong>La Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares que regula el régimen de concertación en los artículos 89 y siguientes (BOIB núm. 89 de 18 de junio de 2009).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>12.</strong> La Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Islas Baleares (BOIB núm. 146 de 22 de noviembre de 2018), regula en el Capítulo I el «Régimen de colaboración privada en la gestión de servicios sociales para las personas mediante la acción concertada».</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>13. </strong>El Decreto 48/2017, de 27 de octubre, (BOIB número 132 de 28 de octubre de 2017) por el que se establecen los principios generales a los que deben someterse los conciertos sociales (en adelante Decreto 48/2017), cuya vigencia se ha visto parcialmente afectada por la Ley 12/2018 y, en consecuencia, queda en vigor en todo aquello que no contradiga ni se oponga a lo dispuesto en la presente ley<strong>. </strong>En concreto, la Sección 2ª, del Capítulo II del Título III, relativa a la «Renovación de conciertos» que abarca los artículos 21 y 22.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>14. </strong>La Ley 3/2018, de 29 de mayo, del tercer sector de acción social (BOIB núm. 67, de 31 de mayo de 2018), regula en sus artículos 3 y 4 las entidades que tienen la consideración de entidades del tercer sector de acción social.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong><span style="background-color:#ffffff">15. </span></strong>Resolución<span style="background-color:#ffffff"> de la Presidencia del IMAS, </span>núm. 3156 de 20 de febrero de 2023, de aprobación de la convocatoria de la concertación social del servicio de apoyo a la vivienda para personas con discapacidad intelectual y/o trastorno del desarrollo, incluido en la red pública de servicios para personas con discapacidad de Mallorca (BOIB núm. 25, de 25 de febrero de 2023).&nbsp;&nbsp;</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>16.</strong> Resolución de la Presidencia del IMAS, núm. núm. 6648 de 12 de abril de 2023, de adjudicación de la concertación social del servicio de apoyo a la vivienda para personas con </span><span style="color:#000000">discapacidad intelectual y/o trastorno del desarrollo (BOIB núm. 54, de 27 de abril de 2023).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>17.</strong> Los Acuerdos de acción concertada suscritos entre el IMAS y las entidades concertadas para el servicio de apoyo a la vivienda para personas con discapacidad intelectual y/o trastorno del desarrollo, de 1<span style="background-color:#ffffff">3 de abril de 2023.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">En cuanto al procedimiento, además de la normativa antes citada,</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>18. </strong>En concreto, el artículo 22 del Decreto 48/2017, de 27 de octubre, por el que se establecen los principios generales a los que deben someterse los conciertos sociales en el ámbito territorial de las Islas Baleares, donde se regula el procedimiento de renovación de conciertos formalizados.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>19. </strong>La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas (BOE núm. 236, de 2 de octubre de 2015).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>20. </strong>El artículo 214 del Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el Texto refundido de la Ley reguladora de las Haciendas Locales, y considerando el acuerdo de aprobación del régimen de fiscalización e intervención limitada previa de requisitos básicos y toma de razón en ingresos del Consell Insular de Mallorca y de las entidades de su sector público sujetas a función interventora de fecha 12 de diciembre de 2019, el expediente ha sido sometido a la Intervención delegada del IMAS para la emisión del preceptivo informe de fiscalización previa (BOE núm. 59 de 9 de marzo de 2004).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">En virtud de la competencia atribuida legalmente,</span></span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000">Esta resolución no pone fin a la vía administrativa y contra ella se puede interponer, de acuerdo con el artículo 28.1 de los Estatutos del IMAS aprobados por Acuerdo del Pleno del Consell de Mallorca de 11 de abril de 2019 (BOIB núm. 67, de 18 de mayo de 2019), recurso de alzada ante el Consell Executiu del Consell Insular de Mallorca, dentro del plazo de un mes, contador a partir del día siguiente al de la notificación de la presente resolución.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000">Contra la desestimación expresa del recurso de alzada podrá interponerse recurso contencioso-administrativo ante la Sección de lo Contencioso-Administrativo del Tribunal de Instancia, en el plazo de dos meses, contados a partir del día siguiente al de la notificación de la desestimación del citado recurso.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
