&lt;p&gt;&lt;strong&gt;BDNS: 897924&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;“Antecedentes:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1. La Memoria justificativa que firma el director insular de Desarrollo Local fecha 12 de marzo de 2026, para llevar a cabo este procedimiento de convocatoria de subvenciones dirigida a los ayuntamientos de Mallorca para organizar actividades de verano, dirigidas al cuidado, vigilancia y entretenimiento de los niños y jóvenes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2. La Resolución de inicio del procedimiento de concesión de subvenciones en ayuntamientos para la organización de actividades de verano dirigidas al cuidado, vigilancia y entretenimiento de los niños, que firma la consejera ejecutiva del Departamento de Promoción Económica y Desarrollo Local, en fecha 13 de marzo de 2026.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3. El importe a destinar para esta convocatoria, prevista en el Plan Estratégico de Subvenciones del Consejo de Mallorca para el ejercicio 2026, es de un total de ochocientos mil euros (800.000,00€) del presupuesto del ejercicio 2026 y con cargo a la aplicación presupuestaria 65 94310 46203 (CONV. SUBV. AJUNT. &lt;span style="display:none"&gt;PARA&lt;/span&gt; ACTIVIDADES DE VERANO) y hay crédito adecuado y suficiente, según se acredita con la operación de reserva de crédito N. Operación 220260003894.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;4. El informe jurídico sobre la propuesta de resolución de aprobación de la presente convocatoria, que ha emitido la TAG Jefe de la Sección de Cooperación Local de la secretaría técnica del Departamento de Promoción Económica y Desarrollo Local, en fecha 13 de marzo de 2026, que es favorable sobre la adecuación a la normativa que le es aplicable, siempre que se someta dicho expediente a la autorización previa del Consejo Ejecutivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;5. El Acuerdo del Consejo Ejecutivo adoptado en sesión de fecha 18 de marzo de 2026, para otorgar la autorización previa a la consejera ejecutiva de Promoción Económica y Desarrollo Local para aprobar la convocatoria de subvenciones dirigida a los ayuntamientos de Mallorca para organizar actividades de verano dirigidas al cuidado, vigilancia y entretenimiento de los niños y jóvenes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;6. La intervención delegada de la Misericordia ha emitido informe de fiscalización previa favorable en fecha 7 de abril de 2026.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Fundamentos de derecho:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1. La competencia de los consejos insulares para dar apoyo a los ayuntamientos se encuentra recogida expresamente en el artículo 70.2 de la Ley Orgánica 1/2007, de 28 de febrero, de reforma del Estatuto de Autonomía de las Islas Baleares, donde se establece que entre las competencias propias del Consejo de Mallorca se incluye la del “Régimen Local”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2. En el mismo sentido, en el artículo 36.1b) de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, establece como competencias propias de los consejos insulares la cooperación económica en los municipios, los cuales, a su vez, tienen competencia para desarrollar actuaciones en materia de &lt;span style="display:none"&gt;ocupación&lt;/span&gt; del tiempo libre y de promoción de la igualdad entre hombres y mujeres, de conformidad con los apartados l) y o) del artículo 25.2 de la mencionada Ley 7/1985.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3. El Decreto de la presidencia del Consejo de Mallorca de 28 de julio de 2023, por el cual se establecen las competencias de los departamentos, atribuye al departamento de Presidencia “el impulso de las actuaciones dirigidas a conseguir la igualdad real entre mujeres y hombres”, así como “Dar apoyo a entidades locales en materia de juventud”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;4. Asimismo, dicho Decreto atribuye al departamento de Promoción Económica y Desarrollo Local, entre otros, la siguiente: “asistencia jurídica en los municipios de Mallorca y cooperar, y asistirlos técnicamente y proponerlos los instrumentos para la cooperación económica”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;5. El Decreto del Presidente del Consejo de Mallorca de fecha 12 de de marzo de 2026, de atribución temporal de competencia en el Departamento de Promoción Económica y Desarrollo Local para tramitar, en el año 2026, los procedimientos administrativos correspondientes a las convocatorias de subvenciones dirigidas a los ayuntamientos de Mallorca para organizar actividades de verano en el 2025 y en el 2026, dirigidas al cuidado, vigilancia y entretenimiento de los niños y jóvenes. Esta atribución temporal de competencia incluye la tramitación presupuestaria inherente (aprobación, concesión y reconocimiento de las obligaciones).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;6. El artículo 39.2. del Reglamento orgánico del Consejo de Mallorca aprobado fecha 12 de abril de 2018, sobre las atribuciones de los consejeros ejecutivos y consejeras ejecutivas como &lt;span style="display:none"&gt;jefes&lt;/span&gt; de sus departamentos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;7. En cuanto a los órganos competentes para la tramitación del expediente, visto el Decreto de atribución temporal de competencia mencionado, son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El órgano competente para aprobar esta convocatoria, es la consejera ejecutiva de Promoción Económica y Desarrollo Local del Consejo de Mallorca por delegación del Consejo Ejecutivo, con la autorización previa dicho órgano colegiado para la aprobación del gasto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El anterior, en base al apartado cuarto del Acuerdo del Consejo Ejecutivo del Consejo Insular de Mallorca de delegación de atribuciones de dicho órgano en los consejeros ejecutivos y consejeras ejecutivas (BOIB nº. 169, de 31 de mayo de 2025), que dispone: “Delegar en los consejeros ejecutivos y las consejeras ejecutivas, competentes en razón de la materia, la aprobación de las convocatorias de ayudas y subvenciones y aportaciones. En todo caso, requerirán de autorización previa del Consejo Ejecutivo &lt;span style="display:none"&gt;para&lt;/span&gt; la aprobación del gasto de las convocatorias de cuantía superior a quinientos mil euros”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El órgano competente para conceder estas subvenciones es la consejera ejecutiva de Promoción Económica y Desarrollo Local del Consejo de Mallorca, en virtud de la atribución que se hace en el artículo 33.2.k) de la Ley 4/2022, de 28 de junio, de Consejos Insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El órgano instructor es la persona que ocupa la Secretaría Técnica del Departamento de Promoción Económica y Desarrollo Local y desarrollará las actuaciones establecidas en el artículo 18 de la Ordenanza General de Subvenciones del Consejo de Mallorca, incluida la formulación de la propuesta de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Por lo tanto, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;Resuelvo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1. Aprobar la convocatoria de subvenciones dirigida a los ayuntamientos de Mallorca para organizar actividades de verano, dirigidas al cuidado, vigilancia y entretenimiento de los niños y jóvenes, que se anexa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2. Autorizar un gasto por un importe de ochocientos mil euros (800.000,00€) del presupuesto del ejercicio 2026 y con cargo a la aplicación presupuestaria 65 94310 46203 (CONV. SUBV. AJUNT. &lt;span style="display:none"&gt;PARA&lt;/span&gt; ACTIVIDADES DE VERANO).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3. Publicar esta convocatoria en el Boletín Oficial de las Islas Baleares y trasladar esta información a la Base de Datos Nacional de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&amp;nbsp;Palma, a la fecha de la firma electrónica&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;CONVOCATORIA DE SUBVENCIONES DIRIGIDA A LOS AYUNTAMIENTOS DE MALLORCA PARA ORGANIZAR ACTIVIDADES DE VERANO DIRIGIDAS AL CUIDADO, VIGILANCIA Y ENTRETENIMIENTO DE LOS NIÑOS Y JÓVENES.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;1. Objeto y finalidad.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El objeto de esta convocatoria es otorgar ayudas a los ayuntamientos de Mallorca para cooperar económicamente con estas entidades en la organización de actividades llevadas a cabo en el verano del año 2025, de educación en el tiempo libre infantil y juvenil dirigidas a niños y jóvenes hasta 17 años y desarrolladas en la isla de Mallorca, para favorecer la conciliación y la gestión de los usos del tiempo de las familias con niños, niñas y adolescentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La finalidad de esta convocatoria es favorecer el entretenimiento saludable de los niños, niñas y jóvenes durante los meses de verano, fomentar su socialización y favorecer la conciliación y la corresponsabilidad durante el periodo estival de vacaciones escolares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;2. Normativa aplicable.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Constituyen las bases generales de esta convocatoria a la Ordenanza general de subvenciones del Consejo de Mallorca (en adelante OGS), aprobada por el Acuerdo del Pleno de 23 de diciembre de 2016 (BOIB nº. 21, de 18.02.2017), modificada por Acuerdo del Pleno de 14 de junio de 2018 (BOIB nº. 96, de 04.08.2018). Por lo tanto, los interesados tienen que cumplir con el contenido tanto de las Bases como de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En todo aquello no previsto a la presente convocatoria ni en el OGS, será de aplicación la Ley 38/2003, de 17 de noviembre, general de subvenciones (BOE nº. 276, de 18 de noviembre de 2003); el Real Decreto 887/2006, de 21 de julio, por el cual se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones; el Decreto legislativo 2/2005, de 28 de diciembre, por lo que se aprueba el texto refundido de la Ley de subvenciones (BOIB nº. 196, de 31 de diciembre de 2005); la Ley 39/2015, del 1 de octubre, de procedimiento administrativo común de las administraciones públicas (BOE núm.236, de 2 de octubre de 2015), el Decreto de Presidencia del Consejo de Mallorca de día 28 de julio de 2023 por el cual se determina la organización del Consejo de Mallorca y las Bases de ejecución del presupuesto del Consejo de Mallorca de 2026.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;3&lt;/strong&gt;.&amp;nbsp;&lt;strong&gt;Beneficiarios.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Pueden ser beneficiarios de estas ayudas los ayuntamientos de la isla de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Para acogerse a esta convocatoria y obtener la condición de persona beneficiaria, se tienen que cumplir los requisitos adicionales siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;No incurrir en las prohibiciones establecidas en el artículo 8 del OGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Estar al corriente del cumplimiento de las obligaciones tributarias y de la Seguridad Social ante la administración del estado, así como de las obligaciones tributarias ante el Consejo de Mallorca y los organismos autónomos que dependen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los que puedan establecerse en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;4. Gastos subvencionables.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Serán subvencionables las actuaciones de gasto corriente&lt;em&gt; &lt;/em&gt;dirigidas, de manera directa o indirecta, a la puesta en marcha, desarrollo y ejecución de actividades dirigidas a niños y jóvenes, llevadas a cabo en el periodo de vacaciones escolares del verano del año 2025, eso es, que estén comprendidas entre el 23 junio de 2025 (dado que día 20 finalizó el curso escolar 2024-2025) y el 9 de septiembre de 2025 (dado que día 10 de septiembre empezó el curso escolar 2025-2026). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Tienen que ser actividades de educación en el tiempo libre infantil y juvenil de tipo puntual y no son subvencionables las actividades escolares, las complementarias escolares, las extraescolares y las salidas escolares. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Asimismo, los gastos tienen que estar efectivamente abonados en la fecha en que finalice el plazo de presentación de solicitudes de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los gastos correspondientes al pago del impuesto sobre el valor añadido (IVA) sólo serán subvencionables si la entidad no lo puede recuperar o no compensar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Sin una finalidad tajante, serán subvencionables las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;a) Gastos de personal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Únicamente será subvencionable los gastos de personal a cargo del capítulo I de los presupuestos de la entidad beneficiaria, cuando la contratación de personal responda a la ejecución de un programa de carácter temporal establecido de acuerdo con lo que dispone el artículo 10.1 c) del Texto refundido del Estatuto Básico del Empleado Público, aprobado por el Real decreto legislativo 5/2015, de 30 de octubre, y en el artículo 15.2 del Texto refundido del Estatuto de los Trabajadores, aprobado por el Real decreto legislativo 2/2015, de 23 de octubre, o lo que puedan establecer los convenios colectivos del personal laboral de cada entidad local. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los gastos de personal subvencionables incluyen tanto los costes salariales como las cuotas patronales en la Seguridad Social, del personal contratado para llevar a cabo actividades derivadas del objeto de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En cuanto a las indemnizaciones por terminación de contrato, sólo son subvencionables a los nuevos trabajadores que hayan sido expresamente contratados para el desarrollo, puesta en marcha, y ejecución del proyecto, teniendo que quedar claramente acreditado este aspecto, así como que el importe indemnizado corresponde al periodo de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Sólo se subvencionarán las contrataciones de personas por cuenta ajena, de acuerdo con la normativa laboral o de función pública en que la persona organizadora figure como empleadora ante la Seguridad Social, a no ser que la entidad haya subcontratado la organización de la actividad, caso en que se aceptará que la entidad adjudicataria sea la empleadora. En ningún caso se subvencionará la contratación de un servicio externo aislado para contar con este personal, aunque sea parcialmente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;b) Gastos derivados de la prestación de las actuaciones cuando se desarrollen con medios ajenos. Los contratos adjudicados tendrán que sujetarse al régimen jurídico y la normativa de contratación del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;c) Gastos corrientes de conservación y reparación de las dependencias habilitadas para la prestación, siempre que no tengan la naturaleza de gastos de inversión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;d) Otros gastos subvencionables: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Seguros de accidente y de responsabilidad civil necesarios para dar cobertura a las actuaciones que se realicen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Material fungible no inventariable, imprescindible para la realización de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los gastos de alquiler de espacios destinados al desarrollo de las actividades de verano.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los gastos destinados al transporte de los niños o jóvenes en el lugar donde se llevan a cabo las actividades de verano.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los gastos destinados a la organización de excursiones y otras actividades lúdicas parecidas con la finalidad de fomentar el entretenimiento de los niños.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los gastos destinados a meriendas o comidas de los niños que acudan a estas actividades durante el verano. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los gastos de limpieza o de vigilancia de las escuelas de verano o de otro edificio de titularidad o alquilado por el ayuntamiento beneficiario para dedicarlo al cuidado, vigilancia o entretenimiento de los niños&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En todo caso, el importe de los gastos subvencionables no puede ser superior al valor de mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Asimismo, no se considerarán subvencionables, entre otros gastos que no respondan a la finalidad de la subvención, las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los gastos correspondientes a los capítulos 6 a 9 de los presupuestos de gastos de las entidades locales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los intereses deudores de las cuentas bancarias&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los gastos de procedimientos judiciales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Las gratificaciones personales de carácter extraordinario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los gastos derivados de acciones que tengan como objetivo promocionar a la institución en sí misma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Las que no hayan sido efectivamente realizadas y abonadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;5. Crédito presupuestario.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Se destina la cantidad de ochocientos mil euros (800.000,00€) para gastos corrientes del presupuesto del ejercicio 2026 y con cargo a la aplicación presupuestaria 65 94310 46203 &lt;em&gt;(CONV. SUBV. AJUNT. &lt;span style="display:none"&gt;PARA&lt;/span&gt; ACTIVIDADES DE VERANO&lt;/em&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La concesión de las subvenciones se condiciona a la existencia de crédito adecuado y suficiente en el momento de la resolución de la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;6. Naturaleza de la subvención y límites.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Las subvenciones de esta convocatoria son de carácter voluntario y eventual, anulables, revocables y reducibles, así como reintegrables por las causas previstas en el OGS y el resto de normativa aplicable. Además, no generan ningún derecho a obtener otras subvenciones en años posteriores y no se pueden alegar como precedente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Asimismo, son compatibles con otras ayudas y subvenciones que pueda recibir el beneficiario &lt;span style="display:none"&gt;para&lt;/span&gt; la misma actuación subvencionada, siempre que el cómputo total de las ayudas o subvenciones recibidas no supere el coste total de la actividad que la entidad beneficiaria tiene que desarrollar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El importe de la subvención obtenida no puede ser en ningún caso de una cuantía que de manera aislada o en concurrencia con otras subvenciones, ayudas u otros ingresos, públicos o privados, supere el coste de la actividad. En los casos en que se produzca un exceso de financiación sobre el coste de la actividad a consecuencia del otorgamiento de otras subvenciones por parte de entidades públicas o la obtención de otros ingresos, se tiene que reintegrar el importe excedido. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Con respecto a las cuotas que se cobran a las familias usuarias, en caso de que se hayan establecido tasas o precios públicos o privados en la prestación del servicio, los ingresos generados se tienen que deducir de los gastos directos subvencionables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La cuantía de la subvención no podrá superar el 100% del importe solicitado subvencionable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;7. Importe y régimen de concesión. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La concesión de las subvenciones reguladas para la presente convocatoria pública se llevará a cabo mediante régimen de concurrencia NO competitiva, de acuerdo con el artículo 17.2 del OGS, eso es, no es necesaria la comparación de solicitudes y la prelación para resolver la convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;De esta manera, si hay crédito suficiente para atender las cuantías solicitadas, se otorgará a cada ayuntamiento beneficiario la cuantía solicitada, siempre que sus solicitudes cumplan los requisitos establecidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En caso de que el crédito presupuestario no llegue para la satisfacción del 100% del gasto solicitado y justificado, se realizará el sumatorio de la totalidad de los mencionados gastos justificados y se otorgará a cada ayuntamiento la parte proporcional correspondiente al crédito presupuestario aprobado (800.000,00€). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En el supuesto de que el sumatorio de la totalidad de los gastos justificados no agote al crédito asignado, el importe sobrante revertirá a la aplicación presupuestaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Dado que la presentación de la solicitud implica la presentación de la justificación de los gastos de la actuación objeto de subvención, esta derivará en el reconocimiento de la obligación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;8. Presentación de solicitudes.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El plazo para presentar la solicitud junto con la documentación prevista será de quince (15) días hábiles contadores a partir del día siguiente a la fecha de publicación de esta convocatoria en el Boletín Oficial de las Islas Baleares. Si el último día es inhábil, se tiene que entender prorrogado hasta el primer día hábil siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Las instancias se tienen que presentar telemáticamente en el registro electrónico general del Consejo de Mallorca &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;https://cim.sedipualba.es/segex/tramite.aspx?idtramite=12082&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Las solicitudes se tienen que formalizar mediante las instancias y los anexos que facilita el Consejo Insular de Mallorca, que pueden descargarse desde la Sede electrónica del Consejo de Mallorca, a través de la dirección de internet https://seu.conselldemallorca.net y han de contener los datos necesarios para identificar correctamente la entidad y a la persona que la presenta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Dado que los beneficiarios son personas jurídicas obligadas a relacionarse electrónicamente con la administración, las solicitudes se presentarán exclusivamente por vía telemática y se tienen que dirigir al Departamento de Promoción Económica y Desarrollo Local a través del registro electrónico del Consejo de Mallorca, accesible desde la sede electrónica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En el caso de que la solicitud la envíe la entidad local a través de la Dirección Electrónica Habilitada Única (en delante de DEHu), se tiene que tener en cuenta que la recepción de la notificación en la DEHu no equivale a la presentación en el Registro electrónico general del Consejo Insular de Mallorca sino la fecha de comparecencia en la DEHu, que será la fecha de registro válida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Si se utiliza el “Sistema de Interconexión de Registros” (SIR), la fecha de registro válida de la solicitud será la fecha de salida de la entidad local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Con el fin de obtener información para la tramitación de las subvenciones se puede contactar con la Secretaría Técnica del Departamento de Promoción Económica y Desarrollo en el teléfono 971 00 77 39 o por correo electrónico: cooperaciolocal@conselldemallorca.net.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Junto con la solicitud se tiene que presentar la documentación detallada en el punto siguiente de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;9. Formalización de las solicitudes.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Cada ayuntamiento presentará &lt;strong&gt;una única solicitud&lt;/strong&gt; en la cual indicará las actuaciones llevadas a cabo y aportará la documentación exigida en esta convocatoria&lt;strong&gt;.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Por la propia dinámica de la subvención, la justificación se tiene que presentar junto con la solicitud de subvención, lo cual implica que el plazo de justificación son los quince días hábiles que se conceden para solicitar la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Las solicitudes se tienen que formalizar mediante el modelo oficial (&lt;strong&gt;Anexo I&lt;/strong&gt;) y se tienen que adjuntar los documentos que se indican a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;a) &lt;/strong&gt;Declaración responsable (&lt;strong&gt;Anexo II&lt;/strong&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;b) &lt;/strong&gt;Certificado del interventor/secretario de la entidad local con visto bueno del alcalde sobre la realización de la actividad subvencionada y de sus ingresos y gastos (&lt;strong&gt;Anexo III&lt;/strong&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La relación de gastos incluida en el Anexo III se tiene que adjuntar en el expediente electrónico en el momento de la presentación de la justificación en formato Excel/hoja de cálculo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Cuando las actividades hayan sido financiadas, además de la subvención, con fondos propios u otras subvenciones o recursos, o bien tasas o precios públicos, se tiene que acreditar, en la justificación, el importe, la procedencia y la aplicación de estos fondos a las actividades subvencionadas y, en ningún caso, el importe de la subvención concedida puede ser de tal cuantía que, aisladamente o en concurrencia con otras ayudas de cualquier administración pública o de ente públicos o privados, supere el coste total de la actividad que tiene que llevar a cabo la entidad beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;c) &lt;/strong&gt;Certificado que la entidad solicitante está al corriente del cumplimiento de las obligaciones tributarias y de la Seguridad Social ante la Administración del Estado, así como de las obligaciones tributarias ante el Consejo Insular de Mallorca y los organismos autónomos que dependen, impuestas por las disposiciones vigentes, y no es deudora por resolución de procedencia de reintegro (&lt;strong&gt;Anexo IV&lt;/strong&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;d) Justificación de la subvención&lt;/strong&gt;: Las entidades beneficiarias tienen la obligación de justificar delante del órgano que concede la subvención, haber realizado los gastos subvencionables mediante la modalidad de cuenta justificativa del gasto hecho con aportación de justificantes. Así, l&lt;span style="background-color:white"&gt;a documentación a presentar para la justificación de la subvención &lt;/span&gt;mediante la aportación de la cuenta justificativa, tiene que estar integrada por la &lt;strong&gt;Memoria explicativa&lt;/strong&gt; y por &lt;strong&gt;la Memoria económica&lt;/strong&gt; de los costes de la actividad subvencionada:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;-&amp;nbsp;&lt;strong&gt;Memoria explicativa&lt;/strong&gt;: Informe o memoria de actividades realizadas, elaborado por un técnico municipal competente, en lo referente a las actividades subvencionables, con evaluación y valoración de las mismas; tiene que acreditar, justificar y explicar las actividades realizadas y su temporalidad (fecha de inicio y finalización). Tiene que constar un resumen explicativo del tipo de gasto a que responde cada una de las facturas presentadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Esta memoria tiene que contener los datos siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:80px"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Lugar y fechas de realización de las actividades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Número de participantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Número de monitores y monitoras contratados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Ingresos para el proyecto, que tiene que incluir otras subvenciones solicitadas, así como también los ingresos generados por las cuotas que se cobran a las familias usuarias, en caso de que se hayan establecido tasas o precios públicos o privados en la prestación del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Gastos del proyecto, con el detalle de los diferentes conceptos (de personal, material, servicios y otros).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Documentación relativa a la subcontratación de la actividad, si ocurre: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:160px; margin-right:0px; margin-top:0px"&gt;o&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&amp;nbsp;Motivación de la necesidad de subcontratación. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:160px; margin-right:0px; margin-top:0px"&gt;o&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&amp;nbsp;Indicación del tipo de contrato formalizado (contrato menor, contrato surgido de un concurso abierto, contrato privado, etc.). No se aceptarán los convenios y acuerdos con entidades para la celebración indirecta de las actividades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:160px; margin-right:0px; margin-top:0px"&gt;o&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&amp;nbsp;En caso de que la subcontratación suponga un gasto de más de 15.000 euros, sin IVA, indicación de las tres ofertas pedidas, con los importes ofrecidos, y de la elección hecha. En caso de no haber escogido la oferta más económica, indicar el motivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:80px"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Documentación acreditativa &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Acreditación de las medidas de difusión en cumplimiento del artículo 15.1 del OGS (punto 12 de la convocatoria).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;-&amp;nbsp;&lt;strong&gt;Memoria económica&lt;/strong&gt;. La memoria económica justifica el coste de las actividades hechas y tiene que contener la documentación siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Las &lt;strong&gt;Facturas emitidas&lt;/strong&gt; por terceros a la persona beneficiaria de la subvención o los documentos de valor probatorio equivalente en el tráfico jurídico mercantil o con eficacia administrativa y la documentación acreditativa de su pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Las facturas o los documentos justificativos de los gastos de la actividad objeto de la subvención tienen que estar expeditas a nombre de la entidad beneficiaria y, además, cumplirán con todos los requisitos que se exigen en el Real decreto 1619/2012, de 30 de noviembre, por el cual se aprueba el Reglamento que regula las obligaciones de facturación. Tienen que constar obligatoriamente, como mínimo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:80px"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Datos fiscales identificativos del proveedor y destinatario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Fecha y número de la factura&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Concepto del gasto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;IRPF y/o IVA (si corresponde)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Cuando la operación documentada en la factura esté exenta o no sujeto al impuesto (IVA) se tiene que hacer constar y se tiene que incluir una referencia a las disposiciones correspondientes de la Directiva 2006/112/CE, de 28 de noviembre, o a los preceptos correspondientes de la Ley 37/1992, de 28 de diciembre, del Impuesto sobre el Valor Añadido o indicación de cuál es la operación exenta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En caso de que la factura esté sujeto a retención de IRPF se tiene que presentar la documentación correspondiente: declaración 111 trimestral o 216 para no residentes, y/o 115, los correspondientes justificantes de pago, la declaración informativa 190 anual o 296 para no residentes y/ o 180 anual y, en su defecto, se tiene que presentar la relación general de bases y descuentos. Asimismo, se presentarán las declaraciones trimestrales/mensuales, según corresponda, de retenciones e ingresos a cuenta de IRPF (MOD. 110/111) y resumen anual (MOD. 190).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Asimismo, en los casos en que las facturas incluyan conceptos subvencionables y no subvencionables o no se impute la totalidad del gasto, se tendrán que especificar los criterios de imputación y los conceptos que se imputan a la subvención. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los &lt;strong&gt;Justificantes de pago&lt;/strong&gt; del gasto hecho que se tienen que presentar junto con las facturas de forma numerada y ordenada, y se tienen que agrupar en el mismo orden que aparece en la relación de gastos (Anexo III).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La documentación acreditativa del pago se justificará según el artículo 48.2 de la Ordenanza general de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;10. Órgano instructor y procedimiento de concesión de las subvenciones.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El órgano instructor es la Secretaría Técnica del Departamento de Promoción Económica y Desarrollo Local, que tiene que llevar a cabo las actuaciones establecidas en el OGS, y formular la propuesta de resolución. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El órgano instructor tiene que examinar las solicitudes y la documentación adjunta con el fin de determinar si la ayuda se adecua al establecido a esta convocatoria. Tiene que comprobar específicamente que la entidad solicitante cumple los requisitos y que se aporta la documentación que prevé esta convocatoria. Puede requerir a las entidades solicitantes los informes o las aclaraciones que considere convenientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En caso de que la solicitud no reúna los requisitos legales y los que se derivan de estas bases reguladoras específicas y convocatoria, se requerirá a la entidad solicitando, de acuerdo con lo que establece el artículo 68 de la Ley 39/2015, de 1 de octubre, &lt;span style="display:none"&gt;para que&lt;/span&gt;, en un plazo no superior a diez días hábiles, enmiende la falta o acompañe los documentos preceptivos, con la indicación que, si no lo hace, se tendrá por desistida de su petición, previa resolución expresa en los términos que establece el artículo 21 de dicha Ley.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El Departamento de Promoción Económica y Desarrollo Local es el centro gestor responsable del seguimiento de las subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El plazo máximo para resolver y notificar la resolución del procedimiento será de seis meses. El vencimiento del plazo máximo sin haberse notificado la resolución, legitima a los interesados para entender desestimada por silencio administrativo la solicitud de concesión de la subvención. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La concesión se realizará a través de un procedimiento de concurrencia no competitiva en el cual la cuantía máxima de la subvención viene predeterminada en el apartado séptimo de esta convocatoria. Los ayuntamientos tendrán que acreditar, cuando presenten su solicitud, la existencia de una serie de gastos relacionados con las actuaciones mencionadas en el apartado 4 de esta convocatoria, realizadas entre el 23 junio de 2025 (dado que día 20 finalizó el curso escolar 2024-2025) y el 9 de septiembre de 2025 (dado que día 10 de septiembre empezó el curso escolar 2025-2026), y abonadas antes de que finalice él plazo de presentación de solicitudes de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El órgano competente para aprobar esta convocatoria, es la consejera ejecutiva de Promoción Económica y Desarrollo Local del Consejo de Mallorca por delegación del Consejo Ejecutivo, con la autorización previa dicho órgano colegiado para la aprobación del gasto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El anterior, en base al apartado cuarto del Acuerdo del Consejo Ejecutivo del Consejo Insular de Mallorca de delegación de atribuciones de dicho órgano en los consejeros ejecutivos y consejeras ejecutivas (BOIB nº. 169, de 31 de mayo de 2025), que dispone: “Delegar en los consejeros ejecutivos y las consejeras ejecutivas, competentes en razón de la materia, la aprobación de las convocatorias de ayudas y subvenciones y aportaciones. En todo caso, requerirán de autorización previa del Consejo Ejecutivo &lt;span style="display:none"&gt;para&lt;/span&gt; la aprobación del gasto de las convocatorias de cuantía superior a quinientos mil euros”.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El órgano competente para conceder estas subvenciones es la consejera ejecutiva de Promoción Económica y Desarrollo Local del Consejo de Mallorca, en virtud de la atribución que se hace en el artículo 33.2.k) de la Ley 4/2022, de 28 de junio, de Consejos Insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La resolución de concesión o denegación de las ayudas, que no pone fin a la vía administrativa, se notificará a las entidades interesadas, sin perjuicio poder proceder a la publicación. Asimismo, se publicará en la Base Nacional de Datos de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;11. Pago de la subvención.&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En cuanto al pago de la subvención, se procederá a llevarlo a cabo una vez dictada la Resolución de concesión o denegación de las ayudas, dado que las entidades beneficiarias tendrán que haber presentado la justificación del gasto hecho junto con la presentación de la solicitud&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En ningún caso el importe de la subvención, aisladamente o en concurrencia con otras subvenciones, ayudas, ingresos o recursos, puede superar el coste de la actividad subvencionada&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El crédito presupuestario para los reconocimientos de obligación que se tengan que resolver al ejercicio 2027 quedará supeditado a la consignación presupuestaria del ejercicio de este.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;12. Obligaciones de las entidades beneficiarias.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los ayuntamientos beneficiarios estarán obligados a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Comunicar al Departamento de Promoción Económica y Desarrollo Local del Consejo de Mallorca, en cualquier momento, la obtención de ingresos, de subvenciones o de ayudas para la misma finalidad y no consignadas a la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Cumplir el resto de obligaciones que se prevén en el artículo 9 del OGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Llevar a cabo la difusión de la subvención concedida en los términos del artículo 15 del OGS: la persona beneficiaria tiene que dar publicidad adecuada al carácter público de la financiación del programa, actividad, inversión o actuación objeto de subvención. Las medidas de difusión tienen que consistir en la inclusión de la imagen institucional de la entidad que &lt;span style="display:none"&gt;concede&lt;/span&gt; la subvención en medios electrónicos o audiovisuales, o bien en menciones hechas en medios de comunicación u otros que resulten adecuadas al objeto subvencionado y de eficacia equivalente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;13. Criterios objetivos que tienen que regir el otorgamiento y cuantía de las subvenciones.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La convocatoria se tiene que resolver según los siguientes criterios objetivos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1) La existencia de unos gastos destinados a la organización de actividades de verano dirigidas al cuidado, vigilancia y entretenimiento de los niños y jóvenes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2) Que las actuaciones se hayan realizado entre el 23 junio de 2025 (dado que día 20 finalizó el curso escolar 2024-2025) y el 9 de septiembre de 2025 (dado que día 10 de septiembre empezó el curso escolar 2025-2026) y que los gastos se hayan abonado antes de que finalice el plazo de presentación de solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3) Que se acredite documentalmente que las actividades y gastos realizados coinciden con las actuaciones descritas en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;14. Publicidad de la convocatoria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En cumplimiento de lo que se prevé en los artículos 14 y 19.2 del OGS, el Consejo de Mallorca enviará información sobre esta convocatoria y sobre las resoluciones de concesión que se deriven en la Base de Datos Nacional de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La convocatoria de subvenciones se publicará en el BOIB y se colgará en la sede electrónica del Consejo de Mallorca &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;https://seu.conselldemallorca.net/cat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;15. Seguimiento y control de la concesión&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Las entidades beneficiarias de las subvenciones otorgadas por el Consejo de Mallorca, quedan sometidas a las medidas de comprobación y fiscalización en que establece el Decreto legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el texto refundido de la Ley de subvenciones, y por el OGS en cuanto a la concesión y el control de las ayudas públicas. Además, tienen que facilitar toda la información que les requieran el órgano instructor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La ocultación de cualquier información sobre los requisitos da lugar a la denegación o a la revocación de la ayuda otorgada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Asimismo, el incumplimiento de los requisitos que prevé esta convocatoria da lugar a la aplicación del régimen de infracciones y sanciones establecido en el título V del Decreto legislativo 2/2005, de 28 de diciembre y en el OGS. Las infracciones y sanciones que, si &lt;span style="display:none"&gt;ocurre&lt;/span&gt;, se pueden derivar del otorgamiento de las subvenciones que prevé esta convocatoria se rigen por lo que establece &lt;span style="display:none"&gt;para&lt;/span&gt; el procedimiento que recoge el artículo 62 del mismo texto legal y &lt;span style="display:none"&gt;por&lt;/span&gt; el OGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;16. Protección de datos de carácter personal&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Sin perjuicio de las obligaciones en materia de publicidad activa y derecho de acceso a la información pública previstas a la Ley 19/2013, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno, las partes se comprometen a respetar la confidencialidad de la información que se suministra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Asimismo, las partes están obligadas a cumplir las previsiones del reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo de 27 de abril de 2016, relativo a la protección de datos de las personas físicas en cuanto al tratamiento de datos personales y libre circulación de estos datos y por el cual se deroga la Directiva 95/46/CE, y las específicas de la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de derechos digitales, con respecto a los datos personales que, como consecuencia de este procedimiento, se tratan y se comunican entre estas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&amp;nbsp;&lt;strong&gt;17. Recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;De conformidad con el artículo 44 en relación con el 46.6 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa, contra el acuerdo de aprobación de la convocatoria de subvenciones no se podrá interponer recurso en la vía administrativa, si bien se podrá formular potestativamente requerimiento para su anulación o revocación en el plazo de dos meses contadores desde el día siguiente al de su publicación en el Boletín Oficial de las Islas Baleares (BOIB) con carácter previo a la interposición de recurso contencioso administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El requerimiento se entenderá desestimado si en el plazo de un mes desde su presentación no se notifica resolución expresa. El plazo para interponer el recurso contencioso administrativo será de dos meses contadores desde el día siguiente en aquel en el cual se reciba comunicación de la resolución expresa sobre el requerimiento previo o este se entienda desestimado de forma presunta. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Si no se formula requerimiento previo, se podrá interponer directamente recurso contencioso administrativo en el plazo de dos meses contadores desde el día siguiente en el de la publicación del acuerdo de aprobación de la convocatoria en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;A pesar del anterior, se puede interponer, si es el caso, cualquier otro recurso que se estime pertinente.&lt;strong&gt; ”&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
