<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Mediante Resolución de la consejera de Presidencia y Administraciones Públicas de 19 de diciembre de 2023 se aprobaron la convocatoria, las bases, los ejercicios y temario, y el baremo de méritos de las pruebas selectivas para el ingreso, por el turno libre, en los cuerpos de la Administración especial de la Comunidad Autónoma de las Illes Balears (BOIB núm. 172, de 21 de diciembre de 2023).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="background-color:#ffffff">2. En fecha 17 de marzo de 2026 se publicó en el BOIB núm. Resolución de la consejera de Trabajo, Función Pública y Diálogo Social por la que se aprueba la lista de aspirantes que han superado las pruebas selectivas para el ingreso, por el turno libre, al cuerpo facultativo técnico, escala humanística y ciencias sociales, especialidad técnico en </span></span><span style="color:#000000"><span style="background-color:#ffffff">ocupación</span></span><span style="color:#000000"><span style="background-color:#ffffff"> y mercado de trabajo, para las islas de Mallorca y Menorca de la Administración de la Comunidad Autónoma de las Illes Balears y se ofrecen los puestos de trabajo.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. Una vez que las personas aspirantes que han superado el proceso selectivo, han presentado la solicitud y se ha comprobado el cumplimiento de los requisitos, deben ser nombradas personal funcionario de carrera </span><span style="color:#000000"><span style="background-color:#ffffff">del cuerpo facultativo técnico, escala humanística y ciencias sociales, especialidad técnico en </span></span><span style="color:#000000"><span style="background-color:#ffffff">ocupación</span></span><span style="color:#000000"><span style="background-color:#ffffff"> y mercado de trabajo de la Administración de la Comunidad Autónoma de las Illes Balears.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Fundamentos de derecho</strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. La Ley 3/2007, de 27 de marzo, de la función pública de la Comunidad Autónoma de las Illes Balears.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3. La Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">4. El Decreto 27/1994, de 11 de marzo, por el que se aprueba el Reglamento de ingreso del personal al servicio de la Comunidad Autónoma.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">5. El artículo 5.2 del anexo del Decreto 31/2012, de 13 de abril, por el que se aprueban los Estatutos de la Escuela Balear de Administración Pública.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">6. El Decreto 10/2025, de 14 de julio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears y posteriores modificaciones.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">7. La base 16 de la Resolución de la consejera de <span style="color:#000000">Presidencia y Administraciones Públicas de 19 de diciembre de 2023 </span>por la que se aprueban <span style="color:#000000">aprobar la convocatoria, las bases, los ejercicios y temario, y el baremo de méritos de las pruebas selectivas para el ingreso, por el turno libre, a los cuerpos de la Administración especial de la Comunidad Autónoma de las Illes Balears.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Por todo ello, dicto la siguiente</span></span></p>

Adjudicar los puestos de trabajo, de acuerdo con lo indicado en el anexo de esta Resolución, a las personas aspirantes que han superado las <span style="color:#000000">pruebas selectivas para el ingreso, por el turno libre, al cuerpo facultativo técnico, escala humanística y ciencias sociales, especialidad técnico en ocupación y mercado de trabajo de la Administración de la Comunidad Autónoma de las Illes Balears.</span>, después de haber presentado la documentación pertinente, de acuerdo con la petición de destino efectuada y la puntuación obtenida en el proceso selectivo. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3. La toma de posesión debe efectuarse en la consejería correspondiente, en el plazo de tres días hábiles contados a partir del día siguiente al de la publicación de esta Resolución en el <em>Boletín Oficial de las Illes Balears</em>.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Antes de tomar posesión del puesto adjudicado, la persona interesada deberá hacer constar que no ocupa ningún puesto de trabajo ni que realiza ninguna actividad en el sector público de las que se comprenden en el artículo 1 de la Ley 53/1984, de 26 de diciembre, de incompatibilidades del personal al servicio de las administraciones públicas.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Si realiza alguna actividad privada, incluidas las de carácter profesional, deberá declararlo en el plazo de diez días hábiles contados desde el día siguiente de la toma de posesión, para que el órgano competente acuerde la declaración de compatibilidad o de incompatibilidad.</span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">4. Una vez publicado el nombramiento, para adquirir la condición de funcionario de carrera debe efectuarse el juramento o la promesa de acatar la Constitución, el Estatuto de Autonomía de la Comunidad Autónoma de las Illes Balears y el ordenamiento vigente y tomar posesión en el plazo reglamentario.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">5. Declarar desiertas 1 plaza para la isla de Mallorca y 2 plazas para la isla de Eivissa correspondientes a la oferta de ocupación público para el año 2021, objeto de este procedimiento, ofrecidas en la convocatoria de las pruebas selectivas para el ingreso, por el turno libre, a los cuerpos de la Administración especial de la Comunidad Autónoma de las Illes Balears (BOIB núm. 172, de 21 de diciembre de 2023).</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">En consecuencia, los siguientes puestos, vinculados a esta convocatoria, no se han podido cubrir con personas que hayan superado este proceso selectivo: </span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. Declarar desistidas de su solicitud por caducidad y excluidas del procedimiento, a las personas que no han presentado el escrito de elección de los puestos de trabajo ofrecidos, por orden de preferencia, y la documentación acreditativa del cumplimiento de los requisitos, de acuerdo con la base 16 de la convocatoria.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">7. Publicar esta Resolución en el </span><span style="color:#000000"><em>Boletín Oficial de las Illes Balears</em></span><span style="color:#000000">, en la Sede Electrónica de la Administración de la CAIB y en el Portal del Opositor.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Interposición de recursos</strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Contra esta Resolución, que pone fin a la vía administrativa, se puede interponer un recurso potestativo de reposición ante la consejera <span style="color:#000000"><span style="background-color:#ffffff">de Trabajo, Función Pública y Diálogo Social</span></span> en el plazo de un mes, a contar a partir del siguiente a su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común, y el artículo 57 de la Ley 3/2003, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.</span></span></p>
