713933 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Mediante acuerdo del Pleno de fecha 26 de marzo de 2026, SEFYCU 4439118, se ha acordado lo siguiente:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hechos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los artículos 48 y 49 de la Ley 4/2014, de 20 de junio, de transportes terrestres y movilidad sostenible de las Illes Balears, establecen que los ayuntamientos regularán, entre otros aspectos, las condiciones de prestación de los servicios de autotaxi.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Ante el inicio de la nueva temporada alta turística, surge la necesidad de regular los turnos de trabajo del sector para garantizar que el servicio público cubra todas las zonas y franjas horarias, dado que la temporada estival supone un incremento exponencial de los usuarios del servicio de taxi, lo que motiva la adopción de medidas que mejoren su prestación y disponibilidad. Por ello, se considera adecuado ampliar la jornada diaria de los taxis, prestando servicio las 24 horas del día.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Ayuntamiento de Palma ha identificado un problema recurrente durante la temporada alta turística: la falta de taxis para servicios no turísticos. Durante este periodo, en el aeropuerto de Son Santjoan se registran salidas de hasta 600 taxis por hora en horas punta, principalmente desde la parada del aeropuerto, que presenta largas colas. En contraste, las paradas del centro de Palma quedan habitualmente sin servicio.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Para solucionar esta situación y equilibrar los servicios turísticos y no turísticos, el presente acuerdo establece turnos de trabajo que limitan el área geográfica de prestación del servicio en el aeropuerto, el puerto, Can Pastilla y Playa de Palma.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Mediante acuerdo del Pleno de 27 de febrero de 2025 se aprobaron los turnos del año anterior con jornadas de 24 horas, tres días de trabajo seguidos y dos de descanso. Para taxis adaptados, se estableció un régimen de 4 días de trabajo, 1 de descanso y un turno de guardia previo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El 3 de marzo de 2026 se celebró la Comisión de Seguimiento del Sector del Taxi de Palma para debatir el sistema de turnos de temporada alta. Tras su valoración, se ha elaborado el presente acuerdo.</span></p> <p><strong>Fundamentos de derecho</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Los artículos 123 y 124 de la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El artículo 29 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Illes Balears. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Los artículos 48 y 49 de la Ley &nbsp;4/2014, de 20 de juny, de transports terrestres i mobilitat sostenible de les Illes Balears.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Los artículos 52 y 91 del Reglamento municipal&nbsp; dels transports públics de viatgers i de les activitats auxiliars i complementàries.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Resolució de la consellera de Treball, Funció Pública i Diàleg Social, per la qual es fa públic el calendari laboral general i local per a l'any 2026 en l'àmbit de les Illes Balears (BOIB núm. 129, de 27 de setembre de 2025).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Les Resolucions de batlia de modificació de la denominació de les àrees municipals, l'estructura i els seus titulars núm. 4444, de 25 de febrer de 2026, (BOIB núm. 32, de 12 de març de 2026); l'Acord de la Junta de Govern de 18 de març de 2026 (BOIB núm. 35, de 19 de març)&nbsp; i la Resolució de batlia de modificació de l'organització dels serveis administratius de l'Ajuntament de Palma núm. 4833, de 6 de març de 2026 (BOIB núm. 32, de 12 de març de 2026).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo esto y de acuerdo con las susodichas disposiciones legales vigentes, se propone al Pleno que adopte lo siguiente,</span></p> <p style="text-align:center"><strong>Acuerdo</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las incorporaciones o bajas se publicarán en la página web municipal del departamento de Movilidad.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La prestación del servicio de autotaxis adaptado (PMR) de acuerdo con los denominados Turnos de Guardia comportan las siguientes obligaciones y características: </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">1) Satisfacer, con absoluta prioridad y diligencia profesional, las demandas de servicios de usuarios que requieren vehículos adaptados, ya sean recibimientos mediante el sistema de radio teléfono municipalmente instalado o mediante cualquier otra modalidad reglamentaria de acceso al servicio, con especial atención a los servicios sanitarios.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">2) Atender las demandas de los usuarios, a efectos de obtención de servicios de autotaxi adaptado, con cobertura de las 24 horas de cada jornada, con despliegue y utilización de los medios, instalaciones y maneras de actuación previstos en el Decreto n.º 11078, de 14 de septiembre de 2001 (BOIB n.º 154, de 25 de diciembre).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">3) Al objeto de preservar la especial prestación del servicio a los usuarios con movilidad reducida, durante las jornadas de guardia, los autotaxis afectados se abstendrán de atender servicios generales asignados mediante las emisoras que operan en el ámbito de servicio municipal de autotaxi, limitándose como norma general a los que estén expresamente demandados por usuarios con movilidad reducida, con la única excepción de aquellos servicios que, prestados en momentos marginales de la jornada, no interfieran significativamente en la obligación principal y preferente de prestar servicio a usuarios destinatarios de la adaptación de los vehículos. A fin de preservar esta obligación principal, se instalarán los dispositivos técnicos que permitan atender, de manera preferente, las demandas de estos usuarios, sin interferencia funcional alguna con la transmisión de emisoras de las que operan con carácter general en el servicio municipal de autotaxi.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">4) Estos dispositivos pueden ser de tipo portátil de transmisión-recepción, dispositivo de manos libres, o de la modalidad técnica que garantice satisfacer su finalidad.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">5) Los incumplimientos en la prestación de servicio, relacionados con las determinaciones de la presente regulación, serán objeto de los oportunos procedimientos sancionadores, en aplicación de la tipificación prevista por los artículos 79.16 y 80.2 del Reglamento municipal regulador del servicio, en concepto de falta muy grave o grave, para negar injustificadamente la prestación de servicio o no concurrencia a este, respectivamente.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">6) Las jornadas de guardia, de acuerdo con la vigente normativa general en materia de turnos de autotaxi, se iniciarán a las 06:00 horas del día resultante de la presente regulación, con reincorporación al servicio, después de cada libranza, a las 06:00 horas del día siguiente.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">7) Los distintivos especiales para vehículos adaptados resultarán de exhibición obligatoria, en los términos del artículo 35 g) del Reglamento municipal regulador del servicio, teniendo que estar complementados por el símbolo internacional de accesibilidad.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">8) Las libranzas especiales, resultantes de la presente regulación, serán compatibles con la prestación de servicios interurbanos previa y específicamente demandados por usuarios destinatarios de la adaptación incorporada por los vehículos, en concordancia con las normas reguladoras del régimen específico de recogida de viajeros fuera del término municipal, en trayectos previamente concertados acogidos a régimen de reciprocidad, hacia el Puerto y el aeropuerto de son Sant joan, según el que establece la Orden del consejero de Obras Públicas, Vivienda y Transportes, de 7 de noviembre de 2000 (BOIB n.º 140, de 16/11/2000). Exclusión que incluso afecta los servicios previamente concertados, con origen al Puerto y el aeropuerto de son Sant joan y con destino en cualquier otro municipio.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">9) Sin embargo, a los taxis incluidos en el registro municipal de vehículos accesibles, cuando por razón de avería incorporen temporalmente un vehículo sin adaptación, les será asignado las condiciones de los taxis no adaptados con la libranza del taxis convencional durante la temporada baja, según su número de licencia.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">10) La Policía Local que presta el servicio de transmisiones del susodicho cuerpo y que controla el funcionamiento de la emisora municipal de Taxis Adaptados, hará un seguimiento del uso, de las llamadas de los usuarios y del funcionamiento de la emisora, a fin de dar cuenta al Departamento de Movilidad de posibles incumplimientos o irregularidades en la prestación del servicio.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3.-</strong> Por razones de homogeneidad en la técnica de control de las tarifas, la modalidad turística Taxi Tour, implantada mediante Acuerdo plenario de 30 de junio de 2005, será objeto de inclusión en el funcionamiento del taxímetro, así como de señalización exterior en el indicador luminoso de tarifas.
