![CDATA[<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="background-color:null">En fecha 27 de marzo de 2026 la vicepresidenta primera y consejera ejecutiva de Cultura y Patrimonio dictó la siguiente resolución</span></em></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Hechos</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Se ha emitido memoria justificativa sobre la tramitación de la convocatoria de subvenciones 2025-2026 para actividades del Catálogo de actividades culturales del Consell Insular de Mallorca (CACIM) para entidades de la administración local o los organismes públicos que dependen de ella.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. En el expediente de referencia consta informe favorable de la directora insular de Hacienda y Presupuestos, sobre el gasto anticipado correspondiente en este expediente y pone de manifiesto el cumplimiento de los requisitos previstos en la base 34.9 de la ejecución del presupuesto 2026. Todo esto en relación con el gasto anticipado y por un importe total de 1.101.906,25 €, con cargo a las aplicacions presupuestarias 20.33450.46201 y 20.33450.46801 del ejercicio 2027, para tramitar esta convocatòria de subvenciones. </span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. El 18 de marzo de 2026 el Consejo Ejecutivo acordó autoritzar a la vicepresidenta primera y consellera ejecutiva de Cultura y Patrimonio aprobar esta convocatoria, por un importe total máximo de 1.101.906,25 €.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. En fecha 27 de marzo de 2026 la Intervención delegada de la Misericordia ha fiscalizado favorablemente el expediente.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Fundamentos de derecho</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. La Ordenanza General de Subvenciones del Consell de Mallorca.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. El decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. La Ley 38/2003, de 17 de noviembre, general de subvenciones y el Real Decreto 887/2006, de 21 de julio, por el cual se aprueba el reglamento de la Ley 38/2003 general de subvenciones.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. La Ley 39/2015, de 1 de octubre del procedimento administrativo común de las administraciones publicas. Y la Ley 40/2015, de 1 de octubre del regimen juridico del sector publico.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. La Ley 4/2022, de 8 de junio, de consejos insulares.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">6. El Reglamento Organico del Consell de Mallorca, el Decreto de organitzación del Consell de Mallorca y las Bases de ejecución del presupuesto del Consell de Mallorca del año 2026.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Por todo esto, dicto la siguiente:</span></span></span></span></p>
<p style="text-align:center"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Resolución</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Aprobar la convocatoria de subvenciones 2025-2026 para actividades del Catálogo de actividades culturales del Consell Insular de Mallorca (CACIM) para entidades de la administración local o los organismes públicos que dependen de ella.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. Autorizar un gasto anticipado de 1.101.906,25 € con cargo a las aplicaciones presupuestarias 20.33450.46201 (1.089.281,25 €) y 20.33450.46801 (12.625,00 €) del ejercicio 2027 para tramitar la convocatòria mencionada. No obstant lo anterior, al tratarse de una convocatòria de gasto anticipado, queda condicionada a la existència de Crédito adecuado y suficiente para la financiación en el ejercicio presupuestario en el cual se imputa el gasto (2027).</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. Publicar la convocatoria en el </span><em><span style="background-color:null">Boletín Oficial de las Islas Baleares</span></em><span style="background-color:null">.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Contra esta resolución, que no pone fin a la vía administrativa, se puede interponer el recurso de alzada en el plazo de un mes, a contar a partir del dia siguiente de su publicación. El recurso puede interponerse formalment ante el Consejo Ejecutivo o ante el Pleno del Consell Insular de Mallorca, que es el organo competente para resolverlo. </span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Contra la desestimación expresa de este recurso de alzada, se puede interponer el recurso contencioso administrativo ante la sección Contenciosa Administrativa del Tribunal de Instancia, en el plazo de dos meses, a contar a partir del dia siguientede recibir la notificación de desestimación de dicho recurso de alzada.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Si transcurridos tres meses desde la interposición del recurso de alzada y habeis recibido la notificación expresa, se entiende desetimado por silencio y puede interponerse el recurso contencioso administrativo ante el Juzgado de lo Contencioso Administrativo de Palma que corresponda, sin limitación de tiempo.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">No obstant lo anterior, puede interponerse, si procede, cualquier otro recurso que considere oportuno. Todo esto de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa la la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></span></p>

<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">1. Bases reguladoras y publicidad</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las bases reguladoras de esta convocatoria se encuentran recogidas en la Ordenanza general de subvenciones del Consell Insular de Mallorca y de los organismos autónomos que dependen de ella publicada en el BOIB núm. 21, de 18 de febrero de 2017; modificada por Acuerdo de Pleno (BOIB núm. 96, de 4 de agosto de 2018).</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El Consell de Mallorca, en cumplimiento de lo previsto en el artículo 19.2 de la Ordenanza General de Subvenciones, publicará esta convocatoria, así como la concesión de las subvenciones, en el </span><em><span style="background-color:null">Boletín Oficial de les Illes Balears</span></em><span style="background-color:null">. Asimismo dará traslado de la información correspondiente a la convocatoria a la Base de Datos Nacional de Subvenciones.</span></span></span></span></p>

Dado que se trata de una convocatoria de gasto anticipado, ésta queda condicionada a la existencia de crédito adecuado y suficiente para la financiación en el ejercicio presupuestario al que se imputa el gasto (2027).</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">3. Finalidad, objeto y condiciones</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La finalidad de esta convocatoria es apoyar a las entidades de administración local o a sus organismos públicos dependientes, en la programación de actividades culturales, a efectos de incentivar y estimular las actividades culturales en toda la isla.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El objeto de esta convocatoria es desarrollar las actividades culturales incluidas en las secciones culturales del Catálogo de actividades culturales del Consell Insular de Mallorca (CACIM), destinadas a la colectividad o al público en general.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las subvenciones que se conceden por cada línea son para ejecutar actividades culturales de las incluidas en la sección correspondiente del Catálogo de actividades culturales del Consell de Mallorca que elija la entidad beneficiaria.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las actividades deben desarrollarse en el ámbito territorial de la entidad beneficiaria y deben ser abiertas al público.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">No se puede compensar el exceso de justificación de actividades y gastos de una línea con las demás líneas.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">4. Temporización de las actividades</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Son gastos subvencionables las actividades desarrolladas desde el 1 de octubre de 2025 y hasta el 31 de diciembre de 2026.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La temporización de los gastos realizados debe coincidir con la temporización de la convocatoria, es decir, entre el 1 de octubre de 2025 y el 31 de diciembre de 2026. Por tanto, las actividades, las facturas y los pagos correspondientes a las actividades subvencionadas deben estar incluidas entre las fechas antes señaladas.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">No obstante, se admitirán los documentos justificativos (facturas) que se hayan emitido y pagado con posterioridad a la fecha de finalización de la ejecución de la actividad, siempre que la expedición de los documentos justificativos no rebasen el plazo de la fecha límite para presentar la documentación justificativa señalada en el punto 14 y, además, que la prestación de servicios objeto de la factura se haya efectuado dentro de la temporización señalada en el párrafo anterior (1 de octubre de 2025 y 31 de diciembre de 2026).</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Asimismo, en su caso, también se entenderán por correctamente justificados los gastos derivados del pago de servicios objeto de esta convocatoria correspondientes a retenciones de IRPF que por la normativa fiscal deban pagarse y tramitarse con posterioridad a las limitaciones temporales previstas en esta convocatoria.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">5. Gastos subvencionables</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Únicamente son subvencionables los gastos del caché de los artistas.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. En el caso de las líneas 1 y 2 el gasto subvencionable es el noventa por ciento (90%) del precio total (IVA incluido) de las actividades culturales que forman parte del Catálogo de actividades culturales del Consell de Mallorca. Por tanto, la entidad beneficiaría deberá asumir un 10 % del gasto de las actividades realizadas. Esto implica que, una vez presentada la justificación, únicamente se reconocerá la obligación y se abonará la subvención por un importe máximo del 90% de los gastos correctamente justificados.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En el caso de la línea 3 el gasto subvencionable es el total del precio total (IVA incluido) de las actividades culturales que forman parte del Catálogo de actividades culturales del Consell de Mallorca.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. También podrán ser subvencionables los gastos abonados en concepto de indemnización por el ayuntamiento a la artista/empresa/compañía en el supuesto de que por circunstancias de fuerza mayor, debidamente acreditadas, el espectáculo no se haya podido llevar a cabo. En este caso, deberá acreditarse en la fase de justificación que efectivamente se han abonado dichos gastos, así como las circunstancias que han imposibilitado la realización efectiva de la actividad previamente acordada entre el ayuntamiento y el artista/empresa/compañía.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. Por otra parte el Consell de Mallorca entenderá como gasto justificado el del importe de la factura (IVA incluido). Sin embargo, si el importe de la factura es superior (IVA incluido) al importe que consta en el Catálogo de actividades culturales del Consell de Mallorca por dicha actividad, únicamente se tendrá por correctamente justificado el importe que aparece en el Catálogo.</span></span></span></span></p>

<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">6. Realización de las actividades</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El Consell de Mallorca revisa y difunde las actividades culturales subvencionadas que se realizan en los municipios. Por ello, en función de la fecha de concesión, es necesario que las entidades locales beneficiarias envíen la siguiente documentación:</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a. El anexo 2 debidamente formalizado, al menos un mes antes de realizar cada actividad, en la dirección de correo electrónico cacim@conselldemallorca.net. Los eventuales cambios de día, hora o lugar en el desarrollo de la actividad se comunicarán también al citado correo electrónico lo antes posible para tener constancia.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b. Formulario de evaluación de la actividad: una vez realizada la actividad, debe realizarse la evaluación mediante el formulario digital que facilita la sede electrónica del Servicio de Cultura. Este formulario permite enviar las imágenes de la actividad y puede guardarse antes de enviar.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">7. Beneficiarios</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Pueden ser beneficiarios de esta convocatoria las entidades de administración local de Mallorca o sus organismos públicos dependientes cuando, en este último caso, entre sus objetivos y finalidades se encuentre la cultura en general, o determinados aspectos culturales en particular, siempre y cuando las actividades objeto de subvención las gestionen estas entidades, de modo que la colaboración de otras entidades sea meramente residual o secundaria.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En caso de que un ayuntamiento y un organismo público dependiente soliciten subvención por una misma línea, aunque sea por actividades diferentes, se denegará la solicitada por el organismo público.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El municipio de Palma y los organismos públicos dependientes quedan excluidos de esta convocatoria al amparo de la Ley 23/2006, de 20 de diciembre, de capitalidad.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">8. Régimen de concurrencia</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El procedimiento de selección de las entidades beneficiarias se realiza mediante concurrencia no competitiva; por tanto, no es necesaria la comparación entre las solicitudes, ya cada entidad solicitante se le concederá el importe por cada línea que se refleja en la tabla del punto 13 de esta convocatoria.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">9. Órganos competentes para instruir y resolver el procedimiento</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El órgano competente para aprobar la convocatoria es el Consejo Ejecutivo del Consell de Mallorca. Sin embargo, el consejo ejecutivo delegó en los consejeros ejecutivos y consejeras ejecutivas, competentes por razón de la materia, la aprobación de las convocatorias de ayudas y subvenciones.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El órgano competente para resolver las concesiones de esta convocatoria es la vicepresidenta primera y consejera ejecutiva de Cultura y Patrimonio.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La instrucción corresponde al secretario técnico del Departamento de Cultura y Patrimonio, que debe llevar a cabo todas las actuaciones o los actos de trámite necesarios para velar por el cumplimiento de los requisitos de la convocatoria.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">10. Plazo y lugar de presentación de solicitudes</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las solicitudes de subvenciones deben presentarse en el plazo de 15 días hábiles, contados a partir del primer día hábil siguiente a la fecha de publicación de esta convocatoria en el </span><em><span style="background-color:null">Boletín Oficial de les Illes Balears</span></em><span style="background-color:null">.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La presentación de solicitudes tiene que hacerse mediante el Registro electrónico del Consell de Mallorca </span><strong><span style="background-color:null">.</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">11. Documentación que debe juntarse a la solicitud</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las entidades solicitantes deben presentar la siguiente documentación que se señala de acuerdo con los modelos aprobados por el órgano gestor:</span></span></span></span></p>

<li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El anexo 1. Solicitud de subvención (debe presentarse un Anexo 1 por cada línea para la que se solicite la ayuda).</span></span></span></span></li>
<li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Documentación acreditativa de la vigencia del cargo del representante legal de la entidad en virtud de la cual actúa el firmante de la solicitud.</span></span></span></span></li>
</ul>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">12. Plazo de resolución y notificación</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El plazo máximo para resolver y notificar la resolución de la concesión será de seis meses, a contar a partir del día que finalice el plazo de presentación de las solicitudes, transcurridos los cuales sin que se haya dictado la resolución, se entenderán desestimadas todas las solicitudes.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La notificación de la concesión se practicará mediante publicación en el </span><em><span style="background-color:null">Boletín Oficial de les Illes Balears</span></em><span style="background-color:null">, de acuerdo con lo previsto en el artículo 45.1.b) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">13. Importe de las subvenciones</span></strong></span></span></span></p>

<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">A efectos de la determinación del importe de la subvención, los tramos establecidos se corresponden con los que vienen determinados en el Plan de obras y servicios del Reglamento de cooperación municipal. Por otra parte, el número de habitantes del municipio que se tomará como referencia es el que publica el Instituto Nacional de Estadística (INE) relativo al año 2025.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La participación en las líneas de ayuda comporta la aceptación por parte de la entidad beneficiaria del importe de la subvención en el momento de la solicitud.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La determinación del importe de la subvención debe respetar los siguientes criterios y límites</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. El importe de la subvención no puede sobrepasar, aisladamente o en concurrencia con otras ayudas, subvenciones, ingresos u otros recursos obtenidos para llevar a cabo la misma actividad cultural, los gastos de ejecución de las actividades subvencionadas.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. La subvención no puede exceder de la cantidad solicitada.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">14. Justificación de la subvención</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La justificación de la subvención concedida puede presentarse desde el 1 y hasta el 31 de enero de 2027.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Se debe presentar una justificación completa para cada línea de actividades subvencionadas, y cada justificación debe registrarse separadamente.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">No se puede compensar el exceso de justificación de actividades y gastos de una línea con las demás.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las facturas y los justificantes del presupuesto subvencionable ejecutado deben presentarse siguiendo los requisitos regulados en el artículo 48.2 de la Ordenanza general de subvenciones.</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:null"><span style="background-color:null">La presentación de la documentación justificativa tiene que hacerse a través del </span></span><strong><span style="color:null"><span style="background-color:null">Registro electrónico del Consell de Mallorca .</span></span></strong></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La actividad deberá corresponderse con la comunicación inicialmente presentada, más allá de los cambios que se hayan podido dar durante su ejecución. Los cambios que haya podido sufrir el desarrollo de la actividad se tendrán que detallar en la memoria técnica ( Anexo 3), junto con la explicación de los motivos que los han generado.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">De acuerdo con el artículo 38, apartado a), de la citada Ordenanza, la modalidad de justificación es la cuenta justificativa del gasto realizado, con aportación de justificantes de gasto. La cuenta justificativa se elaborará según lo regulado en el artículo 39 de la Ordenanza, con las siguientes especificidades:</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">A) MEMORIA TÉCNICA:</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Anexo 3. Declaración responsable sobre las actividades realizadas (se debe presentar un anexo 3 por cada línea).</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. Medidas de difusión de la subvención concedida por parte de la persona beneficiaria, de acuerdo con lo previsto en el punto 15 de esta convocatoria.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. Al menos dos fotografías/imágenes con un plano general realizadas durante la actividad objeto de las ayudas o subvención. Sin embargo, si ya se han adjuntado al formulario de evaluación no es necesario presentarlas en este trámite.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null"> 4. En su caso, documentación del contrato firmado previamente entre el ayuntamiento beneficiario y el artista o empresa contratada (las entidades beneficiarias disponen de un modelo en la sede del Consell de Mallorca). Sin embargo, el incumplimiento de lo previsto en este punto no comportará la declaración de pérdida del derecho al cobro de la subvención.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. Cualquier otra documentación que le sea requerida a efectos de comprobar la realización del proyecto o actividad cultural subvencionada.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">B) MEMORIA ECONÓMICA:</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Anexo 4-A. Relación de gastos (se debe presentar un anexo 4-A por cada línea). Este documento debe enviarse, también, en formato digital editable (hoja de cálculo).</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. Anexo 4-B. Relación de ingresos (se debe presentar un anexo 4-B por cada línea). Si las actividades están financiadas únicamente por la subvención del Consell de Mallorca y los fondos propios del ayuntamiento, será suficiente con marcar la casilla correspondiente que declara este hecho.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. Las facturas u otros documentos con valor probatorio equivalente con validez en el tráfico jurídico mercantil o con eficacia administrativa, justificativos del gasto subvencionable, que deben estar expedidas a nombre de la entidad beneficiaria y abonadas por ésta. Los justificantes de pago de estas facturas.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las facturas presentadas deben cumplir con los requisitos previstos en el Real decreto 1619/2012, de 30 de noviembre, por el que se aprueba el reglamento que regula las obligaciones de facturación.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las facturas deben presentarse ordenadas y numeradas siguiendo los requisitos regulados en el artículo 48 de la Ordenanza general de subvenciones del Consell de Mallorca, es decir, deben agruparse con el mismo orden establecido en la relación de gastos que debe presentar con el anexo 4-A.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">De acuerdo con el apartado 1 del citado artículo, puede acreditarse el pago de las facturas objeto de justificación mediante certificación de las obligaciones reconocidas, emitida por el secretario/secretaria-interventor/a, detallando cada factura, su número, el importe, agrupadas con el mismo orden establecido en la relación de gastos señalada en el párrafo anterior.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En caso contrario, el pago se acreditará mediante la presentación de la documentación prevista en el artículo 48.2 de la Ordenanza General de Subvenciones, en función de su forma de pago.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. Cualquier otra documentación que se derive de esta convocatoria o le sea requerida a efectos de comprobar la justificación de las actividades culturales que se presentan para ser justificadas.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">15. Medidas de difusión de la subvención concedida por parte de la entidad beneficiaria</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">De acuerdo con lo previsto en el artículo 15 de la Ordenanza General de Subvenciones del Consell de Mallorca los beneficiarios deben difundir que el Consell de Mallorca subvenciona la actividad cultural.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Concretamente la entidad debe publicar en las redes sociales y página web propia (si dispone) que el Consell de Mallorca ha subvencionado la actividad de que se trate. En la citada noticia/entrada, además de la información correspondiente a la subvención, se incluirá el logotipo del Consell de Mallorca. Esta publicidad sobre la concesión de la subvención debe realizarse aunque la fecha de concesión sea posterior a la celebración de la actividad. Esta difusión debe incluirse con una captura de pantalla en la memoria justificativa de la actividad (anexo 3).</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Por otra parte, y sin perjuicio de lo mencionado en el párrafo anterior, si la concesión de la subvención se produce antes de la celebración de la actividad subvencionada, y la entidad beneficiaria realiza otro tipo de publicidad (prensa, pósters, trípticos, entradas..), podrá incluir el logotipo del Consell de Mallorca, mencionando que la actividad está subvencionada por el Consell de Mallorca. Esta publicidad se adjuntará con la documentación justificativa.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Dichos logotipos se pueden encontrar en el siguiente enlace: Identidad corporativa</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">16. Obligaciones de las entidades beneficiarias</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Sin perjuicio de lo previsto en el artículo 9 de la Ordenanza General de Subvenciones del Consejo de Mallorca, son obligaciones de las personas beneficiarias:</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a) Ejecutar el proyecto o actividad que fundamenta la concesión de la subvención.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b) Justificar, ante el órgano que concede la subvención, el cumplimiento de los requisitos y condiciones, así como la realización de la actividad y el cumplimiento de la finalidad que determinan la concesión o disfrute de la subvención.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">c) Someterse a las actuaciones de comprobación, que debe efectuar el órgano que concede la subvención o la entidad colaboradora, si procede, y cualquier otra de comprobación y control financiero que pueden llevar a cabo los órganos de control competentes, tanto nacionales como comunitarios, y aportar toda la información que le requieran en el ejercicio de las actuaciones anteriores.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">d) Comunicar al órgano que concede la subvención la obtención de otras subvenciones, ayudas, ingresos o recursos que financien las actividades subvencionadas. Esta comunicación debe efectuarse tan pronto como se conozca y, en todo caso, antes de la justificación de la aplicación dada a los fondos percibidos.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">e) En caso de que se deniegue al Consell de Mallorca la autorización para la obtención de los certificados de estar al corriente de las obligaciones tributarias y con la Seguridad Social, deberá acreditarse, antes de dictarse la propuesta de resolución de concesión, que está al corriente del cumplimiento de las obligaciones tributarias con el Estado, y de las obligaciones con la Seguridad Social, aportando los certificados. También tendrá que aportar los certificados mencionados en el momento que le requiera esta corporación para poder abonar la subvención.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">f) Disponer de los libros contables, registros diligenciados y otros documentos debidamente auditados en los términos que se exige en la legislación mercantil y sectorial aplicable a la persona beneficiaria en cada caso, así como todos los estados contables y registros específicos exigidos en la convocatoria de las subvenciones, con el fin de garantizar el adecuado ejercicio de las facultades de comprobación.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">g) Conservar los documentos justificativos de la aplicación de los fondos recibidos, incluyendo los documentos electrónicos, mientras puedan ser objeto de las actuaciones de comprobación y control.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">h) Adoptar las medidas de difusión establecidas en el punto anterior.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">i) Reintegrar los fondos percibidos en los casos previstos en el art. 56 de la Ordenanza General de Subvenciones del Consell de Mallorca.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">17. Pago de la subvención</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El reconocimiento de las obligaciones y pagos de las subvenciones se abonará en un único pago en 2027, una vez justificada la subvención.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">18. Pérdida del derecho al cobro de la subvención</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Será de aplicación lo previsto en el artículo 56 de la Ordenanza General de Subvenciones del Consell Insular de Mallorca, con las siguientes particularidades:</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Si la entidad beneficiaria incumple las obligaciones contempladas en el art. 9 de la Ordenanza General de Subvenciones del Consell Insular de Mallorca, o altera aspectos relevantes del proyecto que se hayan podido tener en cuenta para conceder la ayuda, los órganos competentes del Consell deben declarar la pérdida del derecho a cobrarla. En consecuencia, la entidad beneficiaria perderá el derecho a cobrarla o, si ya la ha cobrado, deberá reintegrarla, de acuerdo con lo que establece el artículo 57 de la Ordenanza General de Subvenciones del Consell Insular de Mallorca.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. Dado que el importe de la concesión se determina por importe cierto, no debe aplicarse el ajuste a la baja del importe de la subvención por razón del grado de ejecución de la actividad subvencionada, siempre que esto no implique superar el coste total de la actividad cultural subvencionada, una vez deducidos los ingresos ajenos o las subvenciones que la han financiado, si hay.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En el caso de las líneas 1 y 2, una vez justificada la subvención, se reconocerá la obligación como máximo por un importe correspondiente al 90% de los gastos correctamente justificados.</span></span></span></span></p>

<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null"></span></span></span></span><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En el caso de la línea 3 una vez justificada la subvención, se reconocerá la obligación como máximo por importe del 100% de los gastos correctamente justificados.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. De conformidad con los principios de eficacia y eficiencia en la asignación y utilización de los recursos públicos regulados en el artículo 5 de la Ordenanza General de Subvenciones del Consell de Mallorca, en caso de que el importe de la pérdida del derecho al cobro de la subvención sea igual o inferior a 100,00 €, el centro gestor anulará de importe la oficio la diferencia entre el importe de la subvención concedida y el importe de la subvención reconocida, sin la necesidad de iniciar el procedimiento y posterior declaración de la pérdida del derecho al cobro de una parte de la subvención, y sin que el beneficiario presente renuncia a cobrar esa cantidad.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">19. Ineficacia sobrevenida de la convocatoria</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Si por circunstancias sobrevenidas de interés público y general, el Consell de Mallorca no puede llevar adelante la tramitación de esta convocatoria, el órgano que la aprobó debe dejarla sin efectos, previo informe justificativo de la Secretaría Técnica del centro gestor.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">20. Recursos</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Contra la resolución que aprueba esta convocatoria, que no pone fin a la vía administrativa, puede interponer el recurso de alzada en el plazo de un mes, a contar a partir del día siguiente de su publicación. El recurso puede interponerse formalmente ante el Consejo Ejecutivo o ante el Pleno, que es el órgano competente para resolverlo.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Contra la desestimación expresa de este recurso de alzada, se puede interponer el recurso contencioso administrativo ante la sección Contencioso Administrativa del Tribunal de Instancia, en el plazo de dos meses, a contar a partir del día siguiente de recibir la notificación de la desestimación de dicho recurso de alzada.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Si transcurridos tres meses desde la interposición del recurso de alzada y no ha recibido la notificación de resolución expresa, se entiende desestimado por silencio y puede interponer el recurso contencioso administrativo ante la sección Contencioso-Administrativa del Tribunal de Instancia , sin limitación de tiempo.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">No obstante lo anterior, se puede interponer, en su caso, cualquier otro recurso que considere oportuno. Todo esto de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa y la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. Contra la resolución de concesión de esta convocatoria que no pone fin a la vía administrativa, puede interponer el recurso de alzada en el plazo de un mes, a contar a partir del día siguiente de su publicación. El recurso puede interponerse formalmente ante la vicepresidenta primera y consejera ejecutiva de Cultura y Patrimonio o ante el Consejo Ejecutivo, que es el órgano competente para resolverlo.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Contra la desestimación expresa de este recurso de alzada, se puede interponer el recurso contencioso administrativo ante la sección Contencioso Administrativa del Tribunal de Instancia, en el plazo de dos meses, a contar a partir del día siguiente de recibir la notificación de la desestimación de dicho recurso de alzada.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Si transcurridos tres meses desde la interposición del recurso de alzada y no ha recibido la notificación de resolución expresa, se entiende desestimado por silencio y puede interponer el recurso contencioso administrativo ante la sección Contencioso-Administrativa del Tribunal de Instancia, sin limitación de tiempo.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">No obstante lo anterior, puede interponer, si procede, cualquier otro recurso que considere oportuno. Todo esto de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa y la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></span></p>
