&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;(...)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PROPUESTA DE ACUERDO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMERO&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;.- &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Aprobar&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; el nuevo &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Convenio de encomienda de gestión de la Conselleria de Salut del Govern de les Illes Balears al Consell Insular de Formentera de determinadas funciones del control oficial de mataderos&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;, que consta como Anexo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGUNDO.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Proceder a la&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; firma &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;del presente convenio&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; entre la persona titular de la Conselleria de Salut del Govern de les Illes Balears y el presidente del Consell Insular de Formentera.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TERCERO.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;La formalización del nuevo convenio, así como la extinción del anterior se tienen que&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; publicar en el Boletín Oficial de las Islas Baleares y en la página web institucional del Consell Insular de Formentera.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CUARTO.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Proceder a la&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; designación&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; de dos representantes del Consell Insular de Formentera, y dos representantes de la Conselleria de Salut del Govern de les Illes Balears, como &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;miembros de la Comisión de seguimiento, &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;todo de acuerdo con la cláusula quinta del convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;QUINTO.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Instar al Govern de les Illes Balears a inscribir el convenio en el&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; Registro electrónico estatal de órganos y instrumentos de cooperación del sector público estatal, y&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; que esté disponible en el&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; Registro de convenios y acuerdos de la Administración de la Comunidad Autónoma de las Illes Balears. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEXTO.- Dar cuenta al Pleno &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;de la Corporación, en la próxima sesión que tenga lugar, del presente acuerdo a los efectos oportunos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Partes &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Manuela García Romero, consellera de Salut del Govern de les Illes Balears, en virtud del Decreto 9/2023, de 10 de julio, de la presidenta de les Illes Balears, por el cual se nombran miembros del Govern de las Illes Balears, actuando en representación de la Administración de la Comunidad de las Illes Balears, en el ejercicio de las competencias que le atribuye el Decreto 25/2003, de 24 de noviembre, del presidente de las Illes Balears, por el cual se delega en los titulares de las consejerías la firma de determinados convenios de colaboración y acuerdos de cooperación, en relación con el artículo 80 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Òscar Portas Juan, presidente del Consell Insular de Formentera quien actúa en nombre y representación del Consell Insular de Formentera de fecha 27 de diciembre de 2024 (BOIB núm. 19, 11 de febrero de 2025), en uso de las facultades que le atribuyen los artículos 20.1 i 21.1.k de la Ley 4/2022, de 28 de junio, de consejos insulares, autorizada la firma del presente convenio por la Junta de Gobierno de fecha 05 de diciembre de 2025, en ejercicio estricto de las competencias municipales de la institución administrativa, sin perjuicio de las competencias insulares y autonómicas, según el régimen jurídico administrativo especial de Formentera. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ANTECEDENTES &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El artículo 31.4 del Estatuto de autonomía de las Illes Balears, confiere a la Comunidad Autónoma la competencia del despliegue legislativo y la ejecución en materia de salud y sanidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El artículo 30.48 del Estatuto de autonomía de las Islas Baleares atribuye a la Comunidad Autónoma la competencia exclusiva ─ entre otras─ en materia de promoción de la salud en todos los ámbitos, en el marco de las bases y la coordinación general de la sanidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. De acuerdo con el Decreto 10/2025, de 14 de julio, de la presidenta de las Illes Balears, por el cual se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, corresponde a la Dirección General de Salud Pública de la Conselleria de Salut, entre otras, la competencia en materia de seguridad alimentaria y nutrición y control oficial y registros en materia de salud pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Ley 16/2010, de 28 de diciembre, de salud pública de las Illes Balears, incluye la evaluación, la gestión y la comunicación del riesgo y de los beneficios para la salud derivados de los alimentos y productos alimentarios, incluidas las acciones de vigilancia, de promoción, de protección y de control sanitario que correspondan entre las prestaciones en materia de salud pública dirigidas a proteger la salud de las personas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. De acuerdo con el artículo 70.12 del Estatuto de Autonomía de las Illes Balears el Consell Insular de Formentera tiene competencia en agricultura, ganadería y pesca, calidad, trazabilidad y condiciones de productos agrícolas y ganaderos y de los productos alimentarios que se derivan. Así mismo, tiene funciones ejecutivas y de gestión en materia de sanidad de conformidad con el artículo 71.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El Reglamento (UE) 2017/625 del Parlamento Europeo y del Consejo, de 15 de marzo de 2017, relativo a los controles y otras actividades oficiales realizadas para garantizar la aplicación de la legislación sobre alimentos y piensos y de las normas sobre salud y bienestar de los animales, sanidad vegetal y productos fitosanitarios, establece que las autoridades competentes tienen que disponer de personal suficiente con la calificación y experiencia adecuadas para poder efectuar con eficiencia y eficacia los controles oficiales y otras actividades oficiales, o bien tener acceso a este personal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. El artículo 28 del Reglamento (UE) 2017/625 permite la delegación de determinadas funciones de control oficial de conformidad con las condiciones establecidas en los artículos 29 y 30.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. El Reglamento de ejecución (UE) 2019/627 de la comisión de 15 de marzo 2019 por el cual se establecen disposiciones prácticas uniformes para la realización de controles oficiales de los productos de origen animal destinados al consumo humano, de conformidad con el Reglamento (UE) 2017/625 del Parlamento Europeo y del Consejo, y por el cual se modifica el Reglamento (CE) n.º 2074/2005 de la Comisión en cuanto a los controles oficiales que regula la sección 2 la Inspección &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;ante mortem&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; y la sección 3 establece los requisitos de la inspección &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;post mortem&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. El histórico de sacrificios de ganada en el matadero de Formentera indica que los animales sacrificados en el matadero han sido criados en la isla y no consta que ni en el decurso de la inspección &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;ante mortem&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; ni &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;post mortem&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; se hayan declarado hallazgos que puedan afectar la salud humana o la sanidad animal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. El Consell Insular de Formentera ─dadas las competencias que tiene atribuidas y que se han descrito en los antecedentes 5 y 6 ─ dispone de personal funcionario veterinario, que se encuentra cualificado para llevar a cabo las tareas de control descritas en los antecedentes 7 a 9.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. Por otra parte, el número de animales sacrificados en el Matadero de Formentera, no supone un nivel de actividad que justifique la creación de plazas de personal veterinario de mataderos de la comunidad autónoma de las Islas Baleares con destino permanente en Formentera, por lo cual esta tarea se ha llevado a cabo mediante el desplazamiento de personal del Servicio de Seguridad Alimentaria de la Conselleria de Salut, con destino en Ibiza, el cual se desplazaba ocasionalmente a Formentera para llevar a cabo las tareas de Control Oficial antes descritas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12. Estas circunstancias condujeron a establecer un sistema de colaboración mediante el cual sería el personal funcionario veterinario del Consell Insular de Formentera, al cual se le encargaría la tarea de llevar a cabo el control oficial de la actividad del matadero de la isla.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13. Varias circunstancias, como la doble insularidad de Formentera, las condiciones del transporte entre Ibiza y Formentera que determinan que tanto las comunicaciones marítimas en pleno verano ─por potenciales saturaciones─ como en épocas de mal tiempo pueden ser dificultosas y el hecho de que el personal funcionario público del Consell Insular de Formentera&amp;nbsp;tenga&amp;nbsp;la titulación y conocimientos adecuados para llevar a cabo, no sólo las tareas propias de acuerdo con sus órdenes de funciones, sino también las propias de otro personal funcionario veterinario otras administraciones como sería el control oficial de animales en mataderos, los sucesivos estados de alarma a raíz de la pandemia de&amp;nbsp;COVID&amp;nbsp;19 ─con las restricciones adicionales de movilidad que esta implicó por sí misma, como también las que se derivaron de las medidas de prevención y control de la transmisión de la enfermedad que se establecieron─ además de otros imponderables, pusieron de manifiesto que era indispensable disponer de personal cualificado que pueda llevar a cabo actividades relativas a los controles oficiales en todos los casos en que se encontraba gravemente afectada su capacidad de desplazamiento de una isla a la otra el personal adecuado para hacer las actividades de control oficial que exige el Reglamento 2017/625, y de este modo no perjudicar el funcionamiento normal del matadero.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;14. Para dar respuesta a esta problemática, el día 22 de noviembre de 2021 se firmó un convenio de colaboración entre la Conselleria de Salut i Consum y el Consell Insular de Formentera para la ejecución de determinadas funciones del control oficial de mataderos con vigencia hasta el 15 de septiembre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15. Transcurridos casi cuatro años desde la firma del mencionado convenio, se ha comprobado que la ejecución por parte de los servicios veterinarios oficiales del Consell Insular de Formentera ha permitido garantizar tanto la actividad de servicio público del matadero como la protección de la salud de la población.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;16. El Artículo 11 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público establece que la realización de actividades de carácter material o técnico de la competencia de los órganos administrativos se puede encargar a otros órganos de la misma Administración o de otra, siempre que entre sus competencias estén estas actividades, por razones de eficacia o cuando no se posean los medios técnicos idóneos para ejercerlas. La encomienda de gestión no supone la cesión de la titularidad de la competencia ni de los elementos sustantivos de su ejercicio, y es responsabilidad del órgano o entidad al cual encarga dictar todos los actos o resoluciones de carácter jurídico que apoyen o en los cuales se integre la actividad material concreta objeto de encargo. La encomienda se formaliza mediante convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;17. Por todo esto, por razones de eficacia, se considera necesario, encargar la ejecución de funciones del control oficial a los mataderos al Consell Insular de Formentera con la correspondiente compensación económica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo esto, ambas partes formalizan este convenio por el cual se encarga la gestión de determinadas tareas de control oficial del Matadero de Formentera, de acuerdo a las siguientes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CLÁUSULAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primera. Objeto &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El objeto del presente convenio es el encargo por parte de la Conselleria de Salut del Govern de les Illes Balears al Consell Insular de Formentera de la ejecución de determinadas funciones del control oficial sanitario al Matadero de Formentera y establecer las condiciones en las cuales se tienen que ejecutar, en los términos que se describen en las cláusulas siguientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las actividades se llevarán a cabo por el veterinario oficial del Consell Insular en servicio activo, o aquel que lo reemplace a causa de nuevos ingresos, provisión definitiva del lugar, cobertura temporal de vacante del lugar o cobertura de bajas de larga duración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segona. Encomienda&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;A. Es objeto de la encomienda la ejecución ordinaria de los siguientes controles sanitarios:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La inspección &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;ante mortem&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, que define el artículo 17 del Reglamento 265/2017 como la comprobación, antes de las tareas de sacrificio, del cumplimiento de los requisitos de salud humana y de salud y bienestar animal, incluyendo, si cabe, el examen clínico de cada animal, y la comprobación de la información sobre la cadena agroalimentaria a que se refiere el anexo II, sección III, del Reglamento (CE) núm. 853/2004.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La inspección &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;post mortem&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, definida cómo la comprobación en mataderos del cumplimiento de los requisitos aplicables a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Las canales, tal como se definen en el anexo I, punto 1.9, del Reglamento CE n.º 853/2004, y los despojos tal como se definen en el punto 1.11 del anexo, a los efectos de decidir si la carne es apta para el consumo humano, la eliminación segura de los materiales especificados de riesgo, la salud y el bienestar de los animales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Otras actividades: comprobar el cumplimiento de los requisitos aplicables a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) La higiene de la producción de carne&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) La manipulación y la eliminación de los subproductos animales&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) La salud y el bienestar de los animales&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Solo en casos de sospecha o cuando no se pueda posponer esta tarea, la toma de muestras para la investigación de residuos de medicamentos veterinarios y de contaminantes en los productos de origen animal destinados a consumo humano, detectar la presencia de agentes zoonóticos y enfermedades animales, y comprobar el cumplimiento de los criterios microbiológicos que define el artículo 2.b) del Reglamento (CE) n.º 2073/2005 de la Comisión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;B. Quedan excluidos del encargo los controles sanitarios efectuados cuando en la jornada exclusivamente se sacrifiquen animales para consumo. Estos controles, si se da el caso, se llevarán a cabo, bajo la responsabilidad directa y por personal cualificado del propio Consell Insular de Formentera. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercera. Obligaciones del Consell Insular de Formentera&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Corresponde al Consell Insular de Formentera, mediante los servicios veterinarios que tengan adscritos lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Ejecutar las actuaciones de control oficial descritos en la cláusula segunda del presente convenio de acuerdo con los requisitos establecidos en el Reglamento 627/2019 y otros requisitos que sean de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. De acuerdo con el artículo 32 del Reglamento UE 625/2017:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Comunicar al Servicio de Seguridad Alimentaria los resultados de las actividades que se hayan efectuado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Informar inmediatamente al Servicio de Seguridad Alimentaria cada vez que los resultados de los controles oficiales indiquen un incumplimiento o la probabilidad de que se produzca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Cooperar con el Servicio de Seguridad Alimentaria y prestarle asistencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell Insular de Formentera ha de garantizar que los funcionarios que lleven a cabo las funciones encargadas estén en posesión de la titulación de licenciado o graduado en veterinaria, que actúan con imparcialidad y no tienen que tener ningún conflicto de intereses en relación con las funciones encargadas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarta. Obligaciones de la Conselleria de Salut&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Corresponde a la Conselleria de Salut, a través del Servicio de Seguridad Alimentaria de la Dirección General de Salud Pública:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Dirigir mediante la elaboración y puesta a disposición de los servicios veterinarios del Consell Insular de los procedimientos normalizados para llevar a cabo el control oficial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Dar soporte técnico e incluir a los grupos de trabajo y actividades formativas en materia de control oficial en los mataderos organizados por la Dirección General de Salud Pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Proporcionar los medios necesarios para la toma de muestras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Mantener informado al veterinario de las tendencias y novedades que, relacionadas con el sacrificio de los animales, se tratan en el sí de la Comisión Europea o de otras administraciones competentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Ejecutar la potestad sancionadora, incluso la aplicación de medidas cautelares, en caso de detección de infracciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. La realización de los controles oficiales en situaciones de sacrificios extraordinarios consecuencia de la detección de una epizootia. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Dar cumplimiento a las obligaciones financieras establecidas en la cláusula séptima en los términos que esta dispone.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quinta. Comisión de seguimiento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se crea una comisión de seguimiento, formada por dos representantes de la Conselleria de Salut y dos representantes del Consell Insular de Formentera, de acuerdo con el artículo 49.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;de la Ley 40/2015, la cual ha de estar integrada por los miembros siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Por parte de la Conselleria de Salut&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. La persona titular de la Dirección General de Salud Pública o aquella en quien delegue.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. La persona titular del Servicio de Seguridad Alimentaria o aquella en quien delegue.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Por parte del Consell Insular de Formentera:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. La consellera de Igualdad, Participación Ciudadana y Sector Primario o la persona en quien delegue.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. La persona veterinaria del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Las funciones de la comisión de seguimiento son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Velar por el cumplimiento de este convenio. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Evaluar su desarrollo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Resolver los problemas de interpretación y cumplimiento que se puedan plantear.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sexta. Duración y modificación de la encomienda&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La vigencia de este Convenio será desde la fecha de su publicación en el Boletín Oficial de las Islas Baleares hasta el 28 de febrero de 2028 en que se tienen que justificar las actuaciones de 2027. Las actuaciones encargadas se realizarán desde su firma hasta el 31 de diciembre de 2027. El convenio se puede prorrogar, si así lo manifiestan las partes firmantes, por dos años más.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los términos del presente Convenio podrán ser modificados de acuerdo mutuo y por escrito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Séptima. Financiación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El coste de las actividades objeto de encomienda se calculará a partir del importe por hora de las retribuciones que en cada momento resulten de aplicación al lugar de trabajo del funcionario veterinario del Consell Insular de Formentera que desarrollará las tareas objeto del encargo (con inclusión de las que puedan corresponder por trabajo en horario nocturno o en festivos), considerando una jornada máxima de 7,5 horas por control oficial desarrollado en el Matadero que se encuentren comprendidos dentro del objeto del encargo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Conselleria de Salut aportará para la ejecución de este encargo una cuantía máxima total de 21.666,66&amp;nbsp;euros total a razón de un máximo de 10.000,00&amp;nbsp;euros anuales para compensar las actividades descritas en este convenio y efectivamente realizadas con cargo a la partida presupuestaria 18101.411A01.46400.40, de los Presupuestos Generales de la Comunidad Autónoma de les Illes Balears, con la distribución por anualidades, importes y partidas presupuestarias siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El pago se hará de la forma siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A la firma del presente convenio de encomienda se hará el pago de 1.666,66&amp;nbsp;euros, para la realización de hasta 8 controles oficiales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 25.3&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;d &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;del Decreto 75/2004, de 27 de agosto, de despliegue de determinados aspectos de la Ley de finanzas y de las leyes de presupuestos generales, el pago se hará por anticipo, y se exceptúa la garantía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Antes del 28 de febrero de 2026, 2027 y 2028, el Consell Insular de Formentera tendrá que justificar el número de controles efectivamente realizados la anualidad anterior mediante un certificado emitido por la consejera de Igualdad, Participación Ciudadana y Sector Primario del Consell Insular de Formentera. En el certificado constará el número de días y de horas de control oficial realmente efectuados, y el importe por hora de las retribuciones del veterinario oficial del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vez presentada la justificación de la anualidad anterior, la Conselleria de Salut abonará como máximo el importe máximo de 10.000 euros (12 meses) para la anualidad siguiente. En caso de que el Consell Insular de Formentera tenga que devolver parte del importe abonado por haberse justificado un importe inferior al previamente transferido, se compensará con la anualidad en curso pendiente de abono, excepto el último año de vigencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si es el caso, presentada la justificación correspondiente al ejercicio de 2027, la liquidación que se derive, generará un resultado inferior al importe de la suma transferida por la Conselleria de Salud al Consell Insular de Formentera, después de haberse realizado la justificación y liquidación de la actividad correspondiente a 2026, el Consell Insular de Formentera tendrá que reintegrar el exceso percibido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 25.3 &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;del Decreto 75/2004, el pago de este importe se hará por anticipo, y se exceptúa la garantía. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Octava&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Causas de resolución del convenio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Son causas de resolución del convenio de encomienda, además de la imposibilidad sobrevenida, legal o material, de poder llevar a término el objeto del convenio, las que prevé el artículo 51 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) La falta de ejecución por parte del Consell Insular de Formentera de los controles objeto de encargo solicitadas por un espacio de tiempo superior a un mes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) El transcurso del plazo de vigencia del convenio sin que se haya acordado la prórroga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) El acuerdo unánime de los firmantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) El incumplimiento de las obligaciones y los compromisos asumidos por parte de alguno de los firmantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Por decisión judicial declaratoria de la nulidad del convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supuesto que se produzcan las causas de resolución y haya actuaciones en curso de ejecución, la comisión establecida en la cláusula quinta acordará como tienen que continuar y acabar las actuaciones en curso de ejecución de conformidad con lo que prevé el artículo 52.3 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La resolución del convenio por incumplimiento por alguna de las dos partes de las obligaciones y compromisos asumidos no da lugar a ninguna indemnización para la otra parte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Novena. Eficacia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Este convenio tendrá efectos des de su publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Como muestra de conformidad, firmamos este convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Firma”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se ha enmendado, de oficio, por el secretario general, la referencia que había en el texto del Convenio a la actuación del presidente, cuando se mencionaba la Ley de consejos insulares de 27 de octubre de 2000, cuando el que corresponde, es, sin duda, la Ley vigente, de consejos insulares, de 28 de junio de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;La Junta de Gobierno, en ejercicio de sus competencias [artículos 130.2, 132 (en relación en el artículo 28) y 134 de la Ley 4/2022, 28 de junio, de consejos insulares], en base a aquello propuesto (que conforme a los artículos 35 y 88.3 y 6 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones publicas supone la motivación de este acto), y el que ha informado el secretario general, una vez introducido el asunto presente en el orden del día -por urgencia justificada, que se ha aprobado por unanimidad, como cuestión adjetiva, adopta, por unanimidad, en cuanto al fondo del asunto -o cuestión sustantiva- lo siguiente&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ACORD&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMERO.- Aprobar &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;el nuevo&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; Convenio de encomienda de gestión de la Conselleria de Salut del Govern de les Illes Balears al Consell Insular de Formentera de determinadas funciones del control oficial de mataderos, &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;que consta como Anexo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGUNDO.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Proceder a la&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; firma &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;del presente convenio&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; entre la persona titular de la Conselleria de Salut del Govern de les Illes Balears y el presidente del Consell Insular de Formentera.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TERCERO.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;La formalización del nuevo convenio así como la extinción del anterior se tienen que &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;publicar en el Boletín Oficial de las Islas Baleares y en la página web institucional del Consello Insular de Formentera.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;QUART.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Proceder a la&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; designación &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;de dos representantes del Consell Insular de Formentera, y dos representantes de la Conselleria de Salut del Govern de les Illes Balears, como&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; miembros de la Comisión de seguimiento, &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;todo según la cláusula quinta del convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;QUINTO.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Instar al Govern de les Illes Balears a inscribir el convenio en el&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; Registro electrónico estatal de órganos e instrumentos de cooperación del sector público estatal, &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;y que esté disponible en el&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; Registro de convenios y acuerdos de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEXTO.- Dar cuenta al Pleno &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;de la Corporación en la próxima sesión que tenga lugar del presente acuerdo a los efectos oportunos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Anexo. - Se da por reproducido el texto del Convenio transcrito más arriba. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Lo cual se hace público para su conocimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
