&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Mediante Resolución del director gerente del FOGAIBA de 28 de noviembre de 2025, publicada en el BOIB núm. 159, de 2 de diciembre de 2025, se aprobaron la convocatoria, las bases, los ejercicios y el temario, y el baremo de méritos de las pruebas selectivas para el ingreso, para el turno libre y de promoción interna, de acuerdo con la oferta pública de empleo de los años 2023, 2024 y 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Entre estos procedimientos selectivos, se aprobó el de la categoría técnico/a de grado medio, especialidad agrícola, en la isla de Mallorca, correspondiente al turno libre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. El día 22 de diciembre de 2025 finalizó el plazo para presentar solicitudes de admisión al proceso de participación en la convocatoria mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. El día 19 de enero de 2026 se publicó la lista provisional de personas admitidas y excluidas en la convocatoria y se otorgó un plazo de 10 días hábiles para presentar alegaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. En fecha 17 de febrero de 2026 se publicó en el BOIB la Resolución del director gerente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 12 de febrero de 2026, por la que se aprueba la lista definitiva de personas admitidas y excluidas, con indicación de las causas de exclusión, correspondiente a la convocatoria de las pruebas selectivas para el ingreso, por el turno libre, de acuerdo con la oferta pública de empleo de los años 2023, 2024 y 2025, de la categoría técnico/a de grado medio, especialidad agrícola, en la isla de Mallorca, correspondiente al turno libre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. Posteriormente se han advertido unos errores que deben ser corregidos, dado que, por un lado, dos aspirantes, a pesar de haber presentado la solicitud en tiempo y forma y cumplir los requisitos de la convocatoria, no aparecieron ni como admitidos ni como excluidos en la lista provisional ni en la definitiva; y, por otro lado, se ha constatado que algunos de los aspirantes admitidos presentaron la solicitud dirigida a otra categoría.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos de Derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. De acuerdo con el artículo 13 r del Decreto 64/2005, de 10 de junio, de creación del Fondo de Garantía Agraria y Pesquera de las Islas Baleares, corresponde al director gerente del FOGAIBA seleccionar el personal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. El artículo 109.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas dispone lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;“&lt;em&gt;2. Las Administraciones Públicas podrán, asimismo, rectificar en cualquier momento, de oficio o a instancia de los interesados, los errores materiales, de hecho o aritméticos existentes en sus actos.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;De acuerdo con esto, dado que se ha comprobado que dos de los aspirantes, omitidos en el listado, sí presentaron la solicitud en tiempo y forma y cumplían los requisitos de la convocatoria, y que otros, admitidos en el listado, se presentaron a una categoría diferente, corresponde rectificar estos errores. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Atendido todo esto, propongo al director gerente del FOGAIBA que dicte resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero.&lt;/strong&gt; Rectificar los errores detectados en el anexo 1 de la resolución del director gerente del FOGAIBA, de 12 de febrero de 2026, por la que se aprueba la lista definitiva de personas admitidas y excluidas, con indicación de las causas de exclusión, correspondiente a la convocatoria de las pruebas selectivas para el ingreso, por el turno libre, de acuerdo con la oferta pública de empleo de los años 2023, 2024 y 2025, de la categoría técnico/a de grado medio, especialidad agrícola, en la isla de Mallorca, correspondiente al turno libre, en el sentido siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
