CAIB ![CDATA[Resolución del consejero de Empresa, Autónomos y Energía, a propuesta a propuesta definitiva del director general de Economía Circular, Transición Energética y Cambio Climático por la que se deniegan las subvenciones para actuaciones de apoyo a la movilidad eléctrica (programa MOVES III 2025)]] CAIB 12018 es 2026-03-05 ![CDATA[<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En fecha de la firma electrónica, el director general de Economía Circular, Transición Energética y Cambio Climático &nbsp;ha formulado la propuesta definitiva siguiente:</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hechos</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El 3 de julio de 2025, se publicó la convocatoria pública de subvenciones para&nbsp; actuaciones de soporte a la movilidad eléctrica (Programa MOVES III 2025) mediante la Resolución del consejero de Empresa, Empleo y Energía de 1 de julio de 2025. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Las personas o entidades que figuran en el anexo de esta Propuesta presentaron una solicitud de subvención en el marco de la convocatoria de referencia. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Los técnicos de la Dirección General de Economía Circular, Transición Energética y Cambio Climático, en aplicación del procedimiento de concesión establecido en el apartado séptimo de la Resolución mencionada, han informado desfavorablemente sobre la concesión de las subvenciones descritas en el anexo, con la motivación que también figura en él. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. En fecha 19 de enero de 2026, se emitió la Propuesta de resolución provisional del director general de Economía Circular, Transición Energética y Cambio Climático por la cual se deniegan las subvenciones en el marco de la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (programa MOVES III 2025) (BOIB n. º 12, de 24 de enero de 2026). </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. En fecha 28 de enero de 2026, Martín Javier Díaz García, titular del expediente MOVESIII25-1766/2025 presentó un escrito de alegaciones a la Propuesta provisional denegatoria. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El motivo de denegación de la subvención es el siguiente: <em>«Se ha comprobado que el solicitante tiene concedidas ayudas de minimis que no se declararon en la solicitud por lo cual no se puede continuar con el procedimiento de acuerdo con el artículo 69. 4 de la Ley 39/2015 del PAC». </em></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white">En fecha 29 de enero de 2026</span>, se emitió un informe técnico en que se informa favorablemente a las alegaciones presentadas por Martín Javier Díaz García dado que se ha comprobado que el solicitante si había declarado correctamente las ayudas recibidas sujetas a mininis en el momento de la solicitud y se cometió un error por parte del órgano administrativo. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. En fecha 19 de febrero de 2026 , se publicó en el BOIB núm. 23, Resolución del consejero de Empresa, Autónomos y Energía, a propuesta definitiva del director general de Economía Circular, Transición Energética y Cambio Climático, de 13 de febrero de 2026 por la cual se deniegan las subvenciones en el marco de la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (programa MOVES III 2025). </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white">7. Posteriormente, se detectó que en fecha 30 de enero de 2026, Joaquin Martines Guarneri, titular del expediente MOVESIII25-1846/2025, había presentado alegaciones a la Propuesta de denegación de la ayuda y no se resolvieron en la Resolución de denegación de 13 de febrero de 2026 (BOIB núm. 23, d</span>e 19 de febrero de 2026). </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. Por el motivo descrito en el antecedente anterior, en fecha 23 de febrero de 2026 se dictó la Resolución de revocación de la Resolución del consejero de Empresa, Autónomos y Energía, a propuesta definitiva del director general de Economía Circular, Transición Energética y Cambio Climático, de 13 de febrero de 2026 por la cual se deniegan las subvenciones en el marco de la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (prog<span style="background-color:white">rama MOVES III</span> 202<span style="background-color:white">5) (BOIB n. º 26, de 26 de febrero de 2026). </span></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. En la propuesta de resolución se deniega la subvención a Joaquin Martines Guarneri por el siguiente motivo: «Las actuaciones son anteriores al 1 de enero de 2025, por lo cual se incumplen los apartado 4. 1. b) y 4. 1. c) de las bases de la convocatoria. »</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el escrito de alegaciones, Joaquin Martines Guarneri , indica que la convocatoria MOVESIII25 solo incluye las actuaciones realizadas a partir del 1 de enero de 2025, sin establecer una cobertura para aquellos casos que se vieron afectados por el cierre imprevisto de la convocatoria anterior (MOVESIII). </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En fecha 2 de febrero se emitió un informe técnico en que se informa desfavorablemente a las alegaciones presentadas por Joaquin Martines Guarneri dado que la factura de adquisición del vehículo es anterior al 1 de enero de 2025, por lo cual se incumplen las bases de la convocatoria MOVESIII2025 y se recuerda que el 9 de octubre de 2025 se aprobó la convocatoria MOVES CAIB, para atender las solicitudes afectadas por la derogación del Real decreto ley 9/2024 y que el Real decreto ley 3/2025 no ha incluido como válidas (BOIB núm. 136, de 14 de octubre de 2025) . </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Ley 38/2003, de 17 de noviembre, General de Subvenciones. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones (BOIB n. º 196, de 31 de diciembre). </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. La Orden de la Consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la cal se establecen las bases reguladoras para la concesión de subvenciones en materia de energía (BOIB nº72, 24 de mayo de 2008). </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. La Resolución del consejero de Empresa, Empleo y Energía de 1 de julio de 2025 por la cual se aprueba la convocatoria pública de subvenciones para actuaciones de soporte a la movilidad eléctrica (programa MOVESIII 2025) (BOIB nº85, de 3 de julio de 2025). </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Propuesta de resolución definitiva</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propongo al consejero de Empresa, Autónomos y Energía que dicte una resolución en los siguientes términos :</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Denegar la concesión de una subvención para actuaciones de apoyo a la movilidad eléctrica (Programa MOVESIII 2025) &nbsp;a los beneficiarios que figuran en el anexo, de acuerdo con la motivación que también figuran en él. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, dicto la siguiente</span></span></span></p> <p style="text-align:center"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Manifestar la conformidad con la propuesta de resolución y dictar su resolución en los mismos términos. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Empresa, Autónomos y Energía en el plazo de un mes a contar desde el día siguiente de la notificación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico del Administración de la Comunidad Autónoma de las Illes Balears. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
