&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Mediante Resolución del director gerente del FOGAIBA de 28 de noviembre de 2025, publicada en el BOIB núm. 159, de 2 de diciembre de 2025, se aprobaron la convocatoria, las bases, los ejercicios y el temario, y el baremo de méritos de las pruebas selectivas para el ingreso, por turno libre y de promoción interna, de acuerdo con la oferta pública de empleo de los años 2023, 2024 y 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Entre estos procedimientos selectivos se aprobó el de la categoría técnico/a superior, especialidad jurídica, correspondiente al turno libre.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. El día 22 de diciembre de 2025 finalizó el plazo para presentar solicitudes de admisión al proceso de participación en la convocatoria mencionada.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. El día 19 de enero de 2026 se publicó la lista provisional de personas admitidas y excluidas en la convocatoria y se concedió un plazo de 10 días &amp;nbsp;hábiles para presentar alegaciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. En fecha 17 de febrero de 2026 se publicó en el BOIB la Resolución del director gerente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA), de 12 de febrero de 2026, por la cual se aprueba la lista definitiva de personas admitidas y excluidas, con indicación de las causas de exclusión, correspondiente a la convocatoria de las pruebas selectivas para el ingreso, por turno libre, de acuerdo con la oferta pública de empleo de los años 2023, 2024 y 2025, de la categoría de técnico/a superior, especialidad jurídica.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;5. En fecha 17 de febrero de 2026 tuvo entrada en el Registro del FOGAIBA el escrito presentado por una aspirante excluida, al cual acompaña copia del título académico de licenciada en derecho.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;strong&gt;Fundamentos de Derecho&lt;/strong&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. De acuerdo con el artículo 13 r del Decreto 64/2005, de 10 de junio, de creación del Fondo de Garantía Agraria y Pesquera de las Illes Balears, corresponde al director gerente del FOGAIBA seleccionar al personal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. El artículo 73 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las Administraciones Públicas, dispone lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;em&gt;&lt;em&gt;“Los trámites que deban ser cumplimentados por los interesados deberán realizarse en el plazo de diez días a partir del siguiente al de la notificación del correspondiente acto, salvo en el caso de que en la norma correspondiente se fije un plazo distinto.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En cualquier momento del procedimiento, cuando la Administración considere que alguno de los actos de los interesados no reúne los requisitos necesarios, lo pondrá en conocimiento de su autor, concediéndole un plazo de diez días para cumplimentarlo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. A los interesados que no cumplan lo dispuesto en los apartados anteriores, se les podrá declarar perdidos el derecho al trámite correspondiente. No obstante, se admitirá la actuación del interesado y producirá sus efectos legales, si se produjera antes o dentro del día en que se notifique la resolución en la que se tenga por transcurrido el plazo”. &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De acuerdo con ello, resulta admisible la actuación del aspirante que acredita el requisito dentro del plazo previsto en el artículo mencionado.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;strong&gt;&lt;strong&gt;Propuesta de Resolución&lt;/strong&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Atendiendo a todo ello, propongo al director gerente del FOGAIBA que dicte resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;strong&gt;Primero&lt;/strong&gt;&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. Modificar la resolución, de fecha 12 de febrero de 2026, por la que se aprueba la lista definitiva de personas admitidas y excluidas, con indicación de las causas de exclusión, correspondiente a la convocatoria de las pruebas selectivas para el ingreso, por el turno libre, de acuerdo con la oferta pública de empleo de los años 2023, 2024 y 2025, de la categoría de técnico/a superior, especialidad jurídica, en el sentido siguiente: :&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1. El anexo 1 queda redactado de la manera siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De conformidad con la propuesta de la jefa del Servicio de gestión de personal y contratación, dicto resolución en los mismos términos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra esta resolución, que no agota la vía administrativa, se puede interponer recurso de alzada ante el presidente del FOGAIBA en el plazo de un mes a contar desde el día siguiente al de su publicación, de acuerdo con lo que establecen el artículo 58.1 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears, y los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, todo ello sin perjuicio de interponer cualquier otro que se estime pertinente en defensa de los intereses propios.&lt;/span&gt;&lt;/p&gt;
