&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Marcos Serra Colomar, alcalde del Ayuntamiento de Sant Antoni de Portmany por nombramiento del Pleno de 17 de junio de 2023, en nombre y representación de esta entidad, actuando en virtud de las facultades previstas en el artículo 21.1.b) de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Las partes se reconocen mutuamente la capacidad necesaria para formalizar este Convenio de conformidad con los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.&lt;/strong&gt; El día 19 de noviembre de 2025, el Consejo Ejecutivo del Consejo Insular de Ibiza aprobó el Convenio específico de colaboración entre el Consejo Insular de Ibiza y el Ayuntamiento de Sant Antoni de Portmany, para facilitar el acceso a la vivienda, firmado el día 24 de noviembre del 2025, y publicado en el BOIB n.º 161 de 6 de diciembre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Consta en la cláusula primera, sobre objeto del convenio:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;«El objeto del convenio es establecer la cooperación económica por parte del Consejo Insular de Ibiza con el Ayuntamiento de Sant Antoni de Portmany (de ahora en adelante el Ayuntamiento), con motivo de la realización de actuaciones e inversiones para facilitar el acceso a la vivienda y paliar las dificultades existentes en esta materia en el municipio, en el marco de sus competencias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;En concreto, según las actuaciones previstas en la memoria presentada por el Ayuntamiento en fecha 09/07/25 con RGE 2025021807, se prevé la realización de las siguientes actuaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;a) Ayudas al alquiler a jóvenes del municipio: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Aportación del Consejo Insular de Ibiza: 464.268,32 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Se concederá una ayuda económica máxima de 534.268,32 euros al Ayuntamiento, a cargo de fondos propios del Consejo Insular de Ibiza prevista en el Plan Insular de Cooperación Municipal para la anualidad 2025.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Según la cláusula décima, de revisión y modificación del convenio, el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;«Los términos de este convenio podrán ser revisados siempre que no alteren el importe de la ayuda total concedida. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Cualquier otro tipo de modificación de los términos del presente convenio, tendrá que ser aprobada por las partes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La sustitución de las actuaciones e inversiones, incluidas en el Anexo I del presente convenio por otras será motivo de modificación del mismo. La modificación será incluida a este Convenio en forma de adenda.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El día 28 de noviembre de 2025, el Ayuntamiento de Sant Antoni de Portmany pidió mediante escrito con RGE n.º 2025039294 a este Consejo, una modificación de los importes de las ayudas al alquiler destinadas a los residentes del municipio solicitadas inicialmente, en el sentido de:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. &lt;/strong&gt;El día 26 de enero de 2026, se celebró la Comisión de seguimiento prevista en el Convenio específico de colaboración entre el Consejo Insular de Ibiza y el Ayuntamiento de Sant Antoni de Portmany, para facilitar el acceso a la vivienda, firmado el día 24 de noviembre del 2025, y publicado en el BOIB n.º 161 de 6 de diciembre de 2025. Los miembros asistentes, acordaron la modificación de la cláusula primera, sobre objeto del convenio, y la cláusula cuarta, sobre obligaciones del Consejo Insular de Ibiza, según la solicitud presentada por el Ayuntamiento de Sant Antoni de Portamany con RGE n.º 2025039294, de fecha 28 de noviembre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. &lt;/strong&gt;Consta en la cláusula décima del convenio que: "Los términos de este convenio podrán ser revisados siempre que no alteren el importe de la ayuda total concedida. Cualquier otro tipo de modificación de los términos del presente convenio, tendrá que ser aprobada por las partes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La sustitución de las actuaciones e inversiones, incluidas en el Anexo I del presente convenio por otras será motivo de modificación del mismo. La modificación será incluida a este Convenio en forma de adenda."&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4.&lt;/strong&gt; Las modificaciones objeto de la presente adenda no suponen ninguna modificación de los importes previstos en el convenio (70.000 € imputados a la partida 9420.46200).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5. &lt;/strong&gt;La Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, en su artículo 36, establece que es competencia de las diputaciones o entidades equivalentes, como es el caso de los Consejos Insulares de acuerdo con el artículo 41 de la dicha ley, la asistencia y la cooperación jurídica, económica y técnica en los municipios, así como la cooperación en el fomento del desarrollo económico y social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6.&lt;/strong&gt; La Ley 7/1985 también prevé la competencia de asegurar la prestación integral y adecuada en todo el territorio insular de los servicios de competencia municipal y, en este sentido, el Consejo Insular de Ibiza puede otorgar subvenciones y ayudas con cargo a sus fondos propios para la realización y el mantenimiento de obras e inversiones de competencia municipal, las cuales se podrán instrumentar mediante planes específicos u otros tipos de instrumentos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7.&lt;/strong&gt; De lo contrario, en el marco de los principios generales que tienen que regir las relaciones entre las diferentes administraciones públicas de la dicha Ley 40/2015, de 1 de octubre, se dispone en el artículo 3 que las administraciones públicas, en sus relaciones, se rigen por los principios de cooperación, colaboración y coordinación, y en su actuación por los criterios de eficacia y servicio efectivo a los ciudadanos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Las partes se reconocen mutuamente la capacidad legal necesaria para formalizar esta Adenda modificativa del Convenio de colaboración firmado el día 24 de noviembre del 2025, de acuerdo con las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
