CAIB CAIB CAIB text/html 9146 111510 9130 720 2026-02-13 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">El Consejo Ejecutivo del Consejo Insular de Eivissa, con la declaración previa de urgencia, de fecha 5 de diciembre de 2025, aprobó la siguiente propuesta:</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>PRIMERO. </strong>Aprobar el convenio de colaboración entre el Consejo Insular de Eivissa y el Ayuntamiento de Sant Josep de sa Talaia para la financiación de los servicios sociales comunitarios básicos para los años 2025-2026-2027, que obra en el expediente con CSV núm. 15706073163607543015 por importe de un millón ocho cientos cincuenta y ocho mil novecientos setenta y un euros con noventa y cinco céntimos de euro (1.858.971,95€), con cargo a la partida presupuestaria 2310 46200, siendo el importe de cada anualidad de:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">- Anualidad 2025: seiscientos cincuenta mil novecientos veinte euros con cincuenta y tres céntimos&nbsp;de euro. Así mismo, en su artículo 16.4 dispone que las administraciones públicas, en el marco de sus competencias respectivas, han de promover las condiciones necesarias para que los derechos sociales de la ciudadanía de las Illes Balears y de los grupos y colectivos en qué se integran sean objecto de una aplicación real y efectiva. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.<span style="line-height:100%">La Ley 4/2009, de 11 de junio, de servicios sociales en las Illes Balears, tiene como finalidad principal conseguir el mayor bienestar social posible en el territorio de las Illes Balears, de forma progresiva y en todos sus aspectos, mediante un sistema de acción social integrado por servicios sociales y medidas de asistencia social que favorecen el desarrollo pleno de la persona en la sociedad para superar y prevenir las causas determinantes de su marginación y promover la plena integración social.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">En relación con las responsabilidades públicas, en esta ley se establece, en su artículo 34, que corresponde a la Administración autonómica, a los consejos insulares y a los municipios ejercer las competencias en esta materia de acuerdo con lo que establecen el Estatuto de autonomía, la Ley de servicios sociales y la legislación de régimen local, de manera que se asegure el funcionamiento correcto del sistema público de servicios sociales.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">El artículo 37 de la referida norma autonómica, establece que corresponde a los consejos insulares la asistencia, asesoramiento y soporte técnico y profesional a los servicios sociales comunitarios y conceder, gestionar y tramitar prestaciones económicas incluidas en las competencias propias en materia de servicios sociales y aquellas que se les encomienden dentro del marco de la planificación general del Gobierno de las Illes Balears. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Y en su artículo 38.1.<em>a</em> prevé que serán de competencia de los municipios, entre otros, crear, organizar y gestionar los servicios sociales que consideren necesarios en su municipio, tanto propios como delegados por otras administraciones, de acuerdo con la cartera de servicios sociales y el plan estratégico correspondiente y los planes estratégicos autonómico y balear. Así como el artículo 12 prevé que los servicios sociales comunitarios son el primer nivel del sistema público de servicios sociales. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3.En relación con la financiación de los servicios sociales comunitarios básicos (de ahora en adelante SSCB), el artículo 70 de la Ley 4/2009 establece, en su apartado primero, que la financiación de los SSCB y de los programas que presten es a cargo de la Comunidad Autónoma de las Illes Balears, de los consejos insulares y de las entidades locales de las Illes Balears y dispone en el apartado tercero que la aportación en concepto de cofinanciación de la comunidad autónoma de las Illes Balears a los consejos insulares y ayuntamientos en ningún caso no puede ser inferior al 50 % del coste de estos, siempre que se cumplan como mínimo las ratios de plantilla establecidas en la normativa que regula estos servicios.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">También prevé que el Gobierno de las Illes Balears pueda aumentar la financiación de los servicios sociales comunitarios, dotando nuevas líneas con los fondos que prevean tipologías de actuación que tienen su desarrollo natural desde el marco de los SSCB. Estos fondos pueden responder a declaraciones de zonas de atención preferente, actuaciones procedentes de desarrollo normativo sectorial o actuaciones prioritarias del Gobierno.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">El importe y la distribución de los créditos que ha de satisfacer la conserjería competente en materia de servicios sociales, tanto en concepto de cofinanciación como de los fondos que se vayan creando, se han de establecer en el Plan de Financiación de los Servicios Sociales Comunitarios que se acuerda en la Conferencia Sectorial de Servicios Sociales y se aprueba por acuerdo del Consejo de Gobierno.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.<span style="line-height:100%">El Consejo Insular de Eivissa tiene competencia propia en materia de servicios sociales y asistencia social en virtud de la Ley 12/1993, de 20 de diciembre, de atribución de competencias a los consejos insulares en materia de servicios sociales y asistencia social, y de la Ley 14/2001, de 29 de octubre, de atribución de competencias a los consejos insulares en materia de servicios sociales y seguridad social, en los términos y con el alcance que establecen estas leyes.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.<span style="line-height:100%">La Ley 4/2022, de 28 de junio, de consejo insulares, prevé en su art.120 que los consejos insulares pueden suscribir convenios con sujetos de derecho público y privado, sin que esto implique la cesión de la titularidad de la competencia.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.<span style="line-height:100%">En data 30/05/2025, el Consejo de Gobierno aprobó el Plan de financiación de los SSCB de las Illes Balears para los años 2025, 2026 y 2027, el cual estuvo informado favorablemente por la Conferencia Sectorial de Servicios Sociales en la sesión de día 10 de abril de 2025, con los siguientes objetivos:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-</span>&nbsp;Establecer el marco de colaboración entre la Conserjería de Famílies i Afers Socials y los Consejos Insulares para la financiación del conjunto de las prestaciones de los SSCB a las respectivas islas entre el 1 de enero de 2025 y el 31 de diciembre de 2027, de los cuales son titulares las entidades locales.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">- Mantener y desarrollar una red de SSCB, gestionada por las entidades locales, así como darles soporte en el desarrollo de las competencias que les atribuyen tanto la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local, como la Ley 4/2009, de 11 de junio, de servicios sociales de las Illes Balears y el resto de normativa aplicable.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-Garantizar un nivel mínimo de prestaciones homogéneas a todas las personas dentro del territorio de la comunidad autónoma de las Illes Balears, independientemente del municipio donde vivan.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">- Mantener un escenario de cumplimiento de las ratios del Decreto 48/2011, de 13 de mayo. Se fijan como ratios de los servios comunitarios básicos para el período de este plan: 1 Trabajador/a Social i 1 Educador/a Social a jornada completa por 5.000 habitantes y 1 Auxiliar de Administración por cada 10.000 habitantes.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">- Dar soporte a los gastos derivados de las intervenciones profesionales individuales-familiares y las derivadas del trabajo grupal y comunitario.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-Agilizar la tramitación administrativa imprescindible para la financiación de los SSCB, en la medida que, a la vez, el Plan constituye un documento adecuado a la normativa vigente, consensuado a los órganos correspondientes y un instrumento jurídico válido para aprobar las transferencias contables necesarias.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Visto que el citado plan define las prestaciones que se financian desde el Gobierno de las Illes Balears, así como los criterios de distribución, para los años 2025, 2026 y 2027, del crédito disponible para el desarrollo de los SSCB para todas las Illes Balears de 46.190.385,75€ que se gestionarán a través de transferencia de fundo vía el artículo 70 de la Ley 4/2009. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.<span style="line-height:100%">Con la aprobación del citado Plan, el Gobierno de las Illes Balears se compromete a la financiación de los SSCB de la isla de Eivissa para las anualidades 2025, 2026 y 2027, siempre y cuando se cumplan con las ratios de profesionales establecidas en el Decreto 48/2011, de 13 de mayo. Para determinar si un ayuntamiento cumple con la ratio mínima establecida para cada anualidad se hará según la población del año 2024, según los datos del IBESTAT (Instituto de Estadística de las Illes Balears), que en el caso de la población del municipio de Sant Josep de sa Talaia, al referido plazo, era de 30.480 personas.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">8.El crédito que prevé la Conserjería de Famílies i Afers Socials del Gobierno de las Illes Balears para la financiación del conjunto de los SSCB de la isla de Eivissa, siempre y cuando, se cumplan las ratios referidas anteriormente es de 6.039.575,55€, con las anualidades siguientes: </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Importe año 2025: 2.001.391,85€ </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Importe año 2026: 2.036.791,85€</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Importe año 2027:2.001.391,85€.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">9.<span style="line-height:100%">En el caso de la isla de Eivissa, el Plan de Financiación prevé que la distribución del importe previsto por parte del Gobierno de las Illes Balears se distribuya en los fondos de financiación del 1 al 6 (este incluido), quedando excluidos los fondos 4 y 7 de financiación, exceptuando el año 2026 que está previsto que el Ayuntamiento de Eivissa reciba financiación a cargo del Fondo 7. A continuación se expone del objeto de cada un de los Fondos mediante los cuales se financian los SSCB de la isla de Eivissa:</span></span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fondo 1: (Urgencia social para familias con niños, niñas y adolescentes)</strong> financia ayudas de urgencia social para familias con personas menores de 18 años a cargo, con un presupuesto total anual para la isla de Eivissa de 50.241,89 €.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>El Fondo 2 (VECA):</strong> financia ayudas para garantizar el derecho básico de alimentación, ocio y cultura de menores durante las vacaciones escolares con un presupuesto total anual para la isla de Eivissa de 48.934,96€.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>El Fondo 3 (LOPIVI),</strong> financia actuaciones preventivas y de detección de maltrato infantil vinculadas a la Ley orgánica de protección integral a la infancia y la adolescencia frente a la violencia, con un presupuesto total anual por isla de Eivissa de 83.208,15€.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>El Fondo 5 (Profesionales básicos UTS),</strong> financia parte del coste salarial de las Unidades de Trabajo Social con un presupuesto total anual para la isla de Eivissa de 1.493.301,84€ condicionado al cumplimiento de ratios por parte de los municipios.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>El Fondo 6 (Prestaciones básicas), </strong>financia las prestaciones del Sistema Público de Servicios Sociales: Información y Orientación; Soporte a la Unidad de Convivencia y Ayuda a Domicilio; Prevención e Inserción Social y Alojamiento Alternativo, con un presupuesto total anual para la isla de Eivissa de 325.705,01€. </span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>El Fondo 7 (Plan de Desarrollo Gitano), </strong>financia el Plan de Desarrollo Gitano con un presupuesto total únicamente para el año 2026 de 35.400€</span></span></li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">10.<span style="line-height:100%">De conformidad con el Plan de financiamiento de los servicios sociales, el Consejo Insular de Eivissa recibirá para cada anualidad, de parte del <strong>Gobierno de las Illes Balears,</strong> los importes señalados en el antecedente octavo del presente convenio, los cuales se han de distribuir y transferir a los diferentes ayuntamientos de la isla de Eivissa, según se detalla a continuación: </span></span></p> <table border="1" style="width:100%"> <tbody> <tr> <td> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Este convenio tiene como objeto establecer las condiciones de colaboración entre el Consejo Insular de Eivissa y el Ayuntamiento de Sant Josep de sa Talaia para la financiación de los SSCB de este municipio para los años 2025, 2026 y 2027.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Los SSCB financiados con este convenio se prestarán con el contenido y con los criterios que se establecen en el Plan de financiamiento de los SSCB de las Illes Balears para los años 2025, 2026 y 2027, aprobado por el Consejo de Gobierno el 30 de mayo de 2025.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>2.Estructura y objeto de la financiación</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">El referido Plan de financiación tiene como objeto principal reforzar el primer nivel de atención del Sistema Público de Servicios Sociales mediante la consolidación del número de profesionales de las Unidades de Trabajo Social (UTS) y la intervención de las UTS dentro del marco de los SSCB. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">La aportación prevista por parte del Gobierno de las Illes Balears está condicionada al cumplimiento de las ratios referidas anteriormente, de manera que si un ayuntamiento no cumple la ratio exigida no podrán beneficiarse de la financiación correspondiente del Fondo 5, pero sí podrán recibir el resto de financiamiento previsto para el resto de Fondos. </span></span></p> <p> </p> <p><span style="font-family:Times New Roman,Times,serif; En todo caso, el Gobierno de las Illes Balears solo cofinancia los gastos correspondientes a los períodos en que efectivamente se han ejecutado y que respetan las ratios mínimas establecidas, sin perjuicio de los acuerdos de la Conferencia Sectorial en relación con los mecanismos correctores necesarios, como un posible lindar de incumplimiento además, entre otras.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Se considerará cumplimiento de ratios el período de hasta a 90 días naturales dentro del cómputo anual, para lugares de trabajo no cubiertos, siempre que se pueda acreditar que se trata de plazas dotadas presupuestáriamente y que el procedimiento de contratación se ha iniciado el día siguiente del día en el cual se produzca la ausencia, tanto por ampliaciones de plantilla como por cobertura de bajas o nuevas contrataciones de plazas ya cubiertas anteriormente. Los dos pilares fundamentales en los que se sustenta esta prestación son la existencia de un alojamiento digno y una estructura básica de relación y convivencia.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Se podrá imputar el coste de los recursos asignados tanto a equipamientos propios como concertados, así como las ayudas económicas o en espacie para el pago de estancias temporales en establecimientos privados (hostales, pensiones...).</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-Prevención e Inserción Social: prestaciones específicas, programas o acciones instrumentales de tipología diversa, como proyectos comunitarios, dirigidos tanto a individuos como grupos específicos y a la comunidad a la cual pertenecen, para favorecer su propia promoción y las posibilidades de participación social, evitando los efectos de la marginación y la exclusión social y movilizando los recursos y estrategias necesarias para la adquisición y desarrollo de habilidades psicosociales que permitan la inserción y adaptación social a esta comunidad.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; Compromisos asumidos por el Ayuntamiento</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Los ayuntamientos con la aprobación del presente convenio y en cumplimiento con lo establecido con el Plan de Financiación de los SSCB de las Illes Balears para los años 2025, 2026 y 2027, se comprometen a:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>a)</em> Cofinanciar y gestionar los programas y las actividades de las prestaciones sociales básicas objeto de la financiación de acuerdo con las condiciones establecidas.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>b)</em> Registrar en el sistema de información HSI todos los datos correspondientes a las intervenciones sociales llevadas a cabo y de las personas y familias usuarias que se han beneficiado.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>c)</em> Facilitar toda la información y documentación que el Consejo Insular y Gobierno les requiera para la correcta justificación de los fondos en las diferentes fases de presentación, evaluación y justificación y concretamente los modelos y plazos detallados en el punto quinto del presente convenio y otros que se acuerden.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>d)</em> Cumplir las ratios profesionales recogidas en el artículo 10 del decreto 48/2011 por el cual se regulan los principios generales y las directrices de coordinación de los SSCB</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>e) </em>Tener la entrada de los servicios sociales municipales la placa identificativa, facilitada por el GOIB en que figure la cofinanciación de la Conserjería de Famílies i Afers Socials, del Consejo Insular de Eivissa y del Ayuntamiento. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>f) </em>Justificar la realización y el gasto de las actividades objeto del plan de financiación según lo detallado en el punto quinto de este documento.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>4. Compromisos asumidos por el Consejo Insular de Eivissa</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">El Consejo Insular de Eivissa, con la aprobación del citado Plan de Financiación y del presente convenio se compromete a: </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>a)</em> Efectuar los pagos a los que se ha comprometido según las condiciones establecidas en el presente convenio con el detalle y las anualidades presupuestarias.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">b) Dar soporte, asistencia técnica a los profesionales de los equipos municipales para contribuir a un óptimo despliegue de las actuaciones objeto del presente convenio. En esta línea el Consejo de Eivissa podrá convocar reuniones de seguimiento y coordinación y organizar acciones formativas.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>c)</em> Facilitar los modelos de impresos para la presentación, la valoración y la justificación de las actividades objeto de financiación, tanto los diseñados por el servicio de planificación del Gobierno Balear, como los complementarios del Consejo que se acuerden, así como instrucciones específicas y soporte para rellenar los modelos. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>d)</em> Colaborar con el Gobierno de las Illes Balears en la planificación y la evaluación de los servicios sociales, así como participar en las diferentes reuniones de coordinación, estudio, formación y grupos de trabajo; en el diseño y la elaboración de los modeles de recogida de información y datos y en la configuración de estadísticas básicas y facilitar información y documentación de utilidad en todos estos ámbitos. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>e)</em> Participar en las acciones de mejora de los sistemas de información de manera que den respuesta a las necesidades de disponer de una herramienta informática de gestión de expedientes y de la tasca de los servicios sociales, así como, la explotación estadística para una adecuada planificación, evaluación y justificación de los diferentes programas llevados a cabo y trasladar a quien corresponda las demandas de los ayuntamientos por estos aplicativos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>5. Solicitud, justificación y previsión de pago de les transferencias</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>AÑO 2025</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. Para la <strong>primera transferencia, </strong>la cual se ha de hacer efectiva dentro el año<strong> </strong>2025, se ha de considerar, por un lado el resultado de la justificación de los fondos percibidos y ejecutados correspondientes al año 2024 y por otro lado el grado de cumplimiento de las ratios mínimas del ayuntamiento correspondientes al año 2025.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Las operaciones realizadas para calcular el importe que corresponde abonar al Ayuntamiento de Sant Josep de sa Talaia son los siguientes: </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1.a. <strong>Justificación</strong> de los fondos percibidos y ejecutados el año <strong>2024: </strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">El Ayuntamiento de Sant Josep de sa Talaia presentó, dentro del plazo establecido, la <strong>justificación</strong> de todos los fondos percibidos y ejecutados del año<strong> 2024. </strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">De la justificación aportada se extraen que el citado ayuntamiento cumplió en todo momento con las ratios mínimas establecidas para el año 2024 y por tanto no se ha de aplicar ninguna reducción a la aportación prevista por parte del Gobierno de las Illes Baleares, para el año 2025.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Se da el caso, que como a resultado de la justificación de los fondos percibidos y ejecutados del resto de ayuntamientos correspondientes a la anualidad 2024, se generó un remanente por un importe de 197.708,98€, que se ha de repartir entre los ayuntamientos que han cumplido con la ratio mínima establecida, como es el caso del Ayuntamiento de Sant Josep de sa Talaia. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Una vez aplicado el citado reparto del remanente generado, le corresponde al Ayuntamiento de Sant Josep de sa Talaia el importe de <strong>46.894,82€,</strong> el cual se ha de sumar al importe previsto en la financiación prevista para el año 2025. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1.b. Fase de <strong>presentación</strong> , anualidad<strong> 2025</strong>:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">El referido ayuntamiento una vez aprobado el Plan por el Consejo de Gobierno aportó la documentación que se detalla a continuación: </span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Anexo 3, Ficha 1: Ficha identificativa de centros Servicios Sociales Municipales/puntos de atención. </span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Anexo 3, Ficha 2: Ficha identificativa de profesionales de los centros de Servicios Sociales. </span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Anexo 5, ficha de presentación de proyectos LOPIVI.</span></span></p> </li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Un vez revisada la citada documentación, se extrae que el Ayuntamiento de Sant Josep de sa Talaia <strong> ha cumplido</strong> con la <strong>ratio mínima establecida para el año 2025 de manera discontinua</strong> durante el plazo comprendido entre los días del 1 de enero hasta el 28 de febrero de 2025, en total se incumple con la ratio establecida para el perfil de la auxiliar administrativa 33 días. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Es considera abonar en esta primera transferencia la totalidad de la financiación prevista para el año 2025 por un importe de <strong>604.025,71€ y </strong>en el caso de que el ayuntamiento incumpla con las ratios mínimas establecidas durante el año 2025, se descontará la parte proporcional a la segunda transferencia. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Por tanto, el importe que corresponde abonar al Ayuntamiento de Sant de Josep de sa Talaia para la anualidad 2025 es de <strong>650.920,53€ </strong>(seis cientos cincuenta mil novecientos veinte euros con cincuenta y tres céntimos de euro)</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>AÑO 2026 Y 2027</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. Para la <strong>segunda y tercera transferencia,</strong> con pago previsto antes del 31 de diciembre del año correspondiente, el ayuntamiento deber presentar la documentación que se expone a continuación: </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2.1. Para la <strong>fase de justificación</strong>, dentro del plazo establecido entre el<strong> 1 y el 15 de marzo del año correspondiente</strong>, el ayuntamiento ha de presentar la justificación completa de todos los fondos correspondientes al año anterior, mediante los documentos con la información solicitada del período del 1 de enero al 31 de diciembre de 2025 o 2026, según corresponda:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-Certificado del secretario/a o del interventor municipal con el detalle del gasto ejecutado para cada uno de los fondos financiados. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-Anexo 3 que incluye:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">- anexo 3 - ficha 1 - identificativa de los centros de servicios sociales municipales y puntos de atención, con las actualizaciones que corresponda.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">- anexo 3 - ficha 2 – ficha identificativa de los profesionales de los centros de servicios sociales. (marcando la casilla «fase justificación» y relacionando todas las contrataciones llevadas a cabo o vigentes de 01 de enero a 31 de diciembre del año en curso)</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-Anexo 4. Fichas 123 de datos estadísticas, en formato hoja de cálculo y también en PDF firmado electrónicamente por cada ayuntamiento. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Si así se indica en la correspondiente ficha, los municipios que disponen de HSI deberán presentar obligatoriamente la información a través de esta vía, exportando el informe que generará el aplicativo a pdf y con la correspondiente firma.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-Anexo 6. Ficha Memoria Evaluación Proyectos LOPIVI (Modelo Homologado Ministerio).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-En el caso de que haya períodos de incumplimiento de ratios de personal, se deberá de presentar informe del responsable del Departamento de Recursos Humanos o certificado firmado por el secretario/a del ayuntamiento, en el cual se detalle la causa de incumplimiento indicando el periodo en que el puesto de trabajo no se ha ocupado y acreditar si se ha iniciado el procedimiento de contratación del personal para ocupar el citado lugar de trabajo.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2.2. (marcando la casilla «fase presentación»y relacionando todas las contrataciones llevadas a cabo o vigentes de 01 de enero a la fecha de 28 de febrero del año en curso)</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-Anexo 5, ficha de presentación de proyectos LOPIVI.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-Certificado de retención de crédito anual del año 2026 o 2027, por el importe que le corresponda aportar por lo que respecta a la aportación del Fondo 5 (Profesionales UTS) y al Fondo 3 (LOPIVI).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-En caso que haya períodos de incumplimiento de ratios de personal, se deberá de presentar informe del responsable del Departamento de Recursos Humanos o certificado firmado por el secretario/a del ayuntamiento, en el cual se detalle la causa del incumplimiento indicando el período en que el lugar de trabajo no se ha ocupado y acreditar si se ha iniciado el procedimiento de contratación del personal para ocupar el citado lugar de trabajo.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">En el caso de que el Ayuntamiento de Sant Josep de sa Talaia cumpla con los requisitos y condiciones previstos en el presente convenio, la aportación prevista para las anualidades de los años 2026 y 2027 será de <strong>604.025,71€ </strong>(seis cientos cuatro mil veinticinco euros con setenta y un céntimos de euros)</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Una vez valorada la documentación presentada para la justificación de la financiación recibida y ejecutada en el año anterior y la documentación aportada en la fase de presentación para hacer efectiva la aportación prevista para el año en curso, el Consejo Insular resolverá el orden de transferencia correspondiente.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>6. Gestión económico-técnica</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. En el supuesto de que el Ayuntamiento no justifique la totalidad de los fondos transferidos por el Consejo Insular de Eivissa establecido en el presente convenio, se descontará el importe no justificado del próximo pago. Llegado marzo de 2028, la liquidación final del Plan será la situación de partida de los ayuntamientos para el próximo Plan.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. Concretamente, los remanentes generados una vez justificada la financiación recibida a cargo del Fondo 5 (aportación del GOIB) solo se pueden reasignar al Fondo 6, tanto dentro del mismo municipio como en otro, siempre y cuando se haya completado con la ratio mínima establecida durante todo el año.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Si el ayuntamiento no ha cumplido ratios en ningún momento del año, puede recibir la financiación prevista para todos los fondos, excepto la aportación del Gobierno de las Illes Balears prevista para el fondo 5 y no puede recibir remanentes provenientes de ningún fondo de otros municipios.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3. El ayuntamiento facilitará el acceso a la base de datos de los aplicativos informáticos de registro de los SSCB de cada municipio a los técnicos del Departamento de Benestar Social, Família i Igualtat o de la Dirección General d'Afers Socials con el objeto de facilitar las explotaciones estadísticas necesarias.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">En ningún caso, estas explotaciones eximirán al ayuntamiento de la obligación de certificar los datos requeridos mediante firma de la Secretaria de la institución.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">4. El Departamento de Benestar Social, Família i Igualtat ha de conceder un plazo de quince días hábiles para enmendar los defectos detectados en la documentación presentada.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>7 . Información y divulgación.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">En la entrada de las instalaciones de los servicios sociales municipales a que hace referencia este Convenio de haber una placa identificativa en la cual figure la cofinanciación de la Conserjería de Famílies i Afers Socials, del Consell Insular y del Ayuntamiento de Sant Josep de sa Talaia.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>8 . Seguimiento y evaluación</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">El seguimiento y la evaluación del desarrollo de este convenio se realizará mediante una Comisión Mixta de Seguimiento, formada por dos miembros del Consejo Insular de Eivissa y dos miembros del Ayuntamiento de Sant Josep de sa Talaia. que se tendrá de reunir cuando ambas partes lo acuerden. La Comisión podrá solicitar la participación de terceras personas para tratar aspectos específicos del Convenio, las cuales tendrá voz, pero no voto.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Para realizar el <strong>seguimiento</strong> del Plan, el Consejo Insular de Eivissa podrá solicitar que dentro del plazo comprendido entre el <strong>15 de julio al 31 de agosto, </strong>la documentación correspondiente al período del 1 de enero al 30 de junio del año en curso que se detalla a continuación:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Anexo 3. Ficha centros y personal, en formato hoja de cálculo.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Anexo 9. Informe de seguimiento del grado de ejecución de los Fondos 1 y 2. </span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Fichas 1.2 y 3 de datos estadísticos, con la información correspondiente a los fondos 1 y 2. Si así se indica en la correspondiente ficha, los municipios que disponen de HSI deberán presentar obligatoriamente esta información a través de esta vía. No será necesario enviar este documento firmado. </span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Anexo 10. Certificado del secretario/a de cada ayuntamiento del seguimiento del desarrollo de los proyectos relacionados con el FONDO 3 (LOPIVI)</span></span></p> </li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Para llevar a cabo el seguimiento del Plan, el personal técnico de la Dirección General de Asuntos Sociales podrá solicitar información adicional cuando sea necesario para garantizar la correcta ejecución del Plan de Financiación de acuerdo con los requisitos establecidos por Ministerio de Derechos Sociales, Consumo y Agenda 2030</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>9 . Modificación del Convenio</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Cualquier modificación que altere lo que establece este Convenio se ha de pactar por acuerdo escrito de las partes. En cualquier caso, el documento en que se formalice la modificación se ha de adjuntar a este Convenio como adenda.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>10 . Período de vigencia del Convenio </strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Este Convenio es vigente desde el momento de la firma hasta el 15 de marzo de 2028 y comprende todas las actuaciones descritas en la clausula segunda que sean objeto de las aportaciones correspondientes y que se realicen o se hayan realizado con efectos retroactivos desde el 1 de enero de 2025 hasta el 31 de diciembre de 2027.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>11 . Extinción </strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Este convenio se extingue por expiración del tiempo convenido de acuerdo con lo que establece la clausula anterior o por alguna de las causas de resolución siguientes:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a.<span style="line-height:100%">El mutuo de las partes, que se ha de formalizar por escrito.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b.<span style="line-height:100%">La imposibilidad sobrevenida, legal o material, de cumplir las obligaciones que se deriven del objeto del convenio</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">c.La denuncia previa por escrito de alguna de las partes, con una antelación mínima de tres meses desde el final de la vigencia del convenio</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d.<span style="line-height:100%">El incumplimiento grave y manifiesto, por cualquiera de las partes, de las cláusulas pactadas, con la denuncia previa de una de las partes. En este caso, se pueden exigir las responsabilidades que se deriven de incumplirlas. En caso de incumplimiento del Ayuntamiento de Sant Josep de sa Talaia., deberá reintegrar el importe abonado y del cual no haya efectuado el gasto, de acuerdo con lo que dispone este convenio</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e.<span style="line-height:100%">La decisión judicial declaratoria de la nulidad del convenio</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>12 . Normativa aplicable</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Son aplicables a este convenio la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas y la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Este convenio queda excluido del ámbito de aplicación de la Ley 9/2017, de 8 de noviembre, de contratos del sector público</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>13 .
