&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Mediante&amp;nbsp;Resolución&amp;nbsp;del director gerente&amp;nbsp;del FOGAIBA,&amp;nbsp;de 28 de noviembre de 2025, publicada en el BOIB núm. 159, de 2 de diciembre de 2025, se aprobaron&amp;nbsp;la convocatoria, las bases, los&amp;nbsp;ejercicios y&amp;nbsp;el temario, y&amp;nbsp;el baremo&amp;nbsp;de méritos&amp;nbsp;de las pruebas&amp;nbsp;selectivas para&amp;nbsp;el ingreso, por el turno libre y&amp;nbsp;de promoción&amp;nbsp;interna, de acuerdo con&amp;nbsp;la oferta pública de empleo&amp;nbsp;de&amp;nbsp;los años&amp;nbsp;2023, 2024 y&amp;nbsp;2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Entre dichos procedimientos selectivos, se aprobó el de la categoría auxiliar, correspondiente al turno libre. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El día 22 de diciembre de 2025 finalizó el plazo para presentar solicitudes de admisión al proceso&amp;nbsp;de participación&amp;nbsp;en la convocatoria citada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El día 19 de enero de 2026, se publicó la lista provisional de personas admitidas y excluidas en la convocatoria y se dio un plazo de 10 días hábiles para presentar alegaciones. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. En fecha 28 de enero de 2026, dentro del plazo otorgado para subsanación de solicitudes, un aspirante presenta un escrito, al que acompaña la documentación que acredita el cumplimiento de los requisitos para participar en el procedimiento, por lo que debe ser admitida. No se ha recibido ninguna otra alegación. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;Fundamentos de Derecho&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. De acuerdo con el artículo 13 r del Decreto&amp;nbsp;64/2005, de 10 de junio, de creación&amp;nbsp;del Fondo&amp;nbsp;de Garantía&amp;nbsp;Agraria y&amp;nbsp;Pesquera de las Illes Balears, corresponde&amp;nbsp;al director gerente&amp;nbsp;del FOGAIBA seleccionar el personal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El artículo 23.2 &lt;em&gt;&lt;em&gt;in fine&lt;/em&gt;&lt;/em&gt;&amp;nbsp;de la Ley&amp;nbsp;7/2010, de 21 de julio, del sector público&amp;nbsp;instrumental de la Comunidad&amp;nbsp;Autónoma de las Illes Balears, dispone que la selección&amp;nbsp;del personal se ajustará a los sistemas y&amp;nbsp;procedimientos que se establecen en la Ley de Función&amp;nbsp;Pública de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El artículo 27 del Convenio&amp;nbsp;colectivo&amp;nbsp;para&amp;nbsp;el personal laboral al servicio&amp;nbsp;de la Administración&amp;nbsp;de la Comunidad&amp;nbsp;Autónoma de las Illes Balears, al&amp;nbsp;cual se&amp;nbsp;encuentra adscrito&amp;nbsp;el FOGAIBA, prevé la normativa por la que se deben regir las convocatorias de promoción interna y de turno libre. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. De acuerdo con lo dispuesto en el artículo 82 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, los interesados, dentro del trámite de audiencia pueden alegar y presentar los documentos y justificantes que estimen pertinentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;Propuesta&amp;nbsp;de resolución&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Considerando todo esto, propongo al director gerente&amp;nbsp;del FOGAIBA que dicte&amp;nbsp;resolución&amp;nbsp;en los términos siguientes:&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Aprobar la lista definitiva de personas aspirantes admitidas&amp;nbsp;en la convocatoria para&amp;nbsp;el ingreso, por el turno libre, en&amp;nbsp;la categoría de&amp;nbsp;auxiliar, que consta en el anexo&amp;nbsp;1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El hecho de constar en&amp;nbsp;la lista de personas admitidas&amp;nbsp;no implica el reconocimiento a las personas interesadas de que cumplen los requisitos para&amp;nbsp;participar en esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Aprobar la lista definitiva&amp;nbsp;de personas aspirantes excluidas&amp;nbsp;en la convocatoria para&amp;nbsp;el&amp;nbsp;ingreso, por el turno libre, en&amp;nbsp;la categoría&amp;nbsp;de auxiliar, con indicación&amp;nbsp;de las causas de exclusión, en los términos que establece&amp;nbsp;el&amp;nbsp;anexo&amp;nbsp;2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Publicar esta resolución&amp;nbsp;en el &lt;em&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;/em&gt;&amp;nbsp;y en la página web del FOGAIBA (www.caib.es).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Palma, en la fecha de la firma electrónica&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Conforme con la propuesta&amp;nbsp;de la Jefa del Servicio&amp;nbsp;de Gestión&amp;nbsp;de Personal y&amp;nbsp;Contratación, dicto resolución en los mismos términos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución, que no agota&amp;nbsp;la vía&amp;nbsp;administrativa, se&amp;nbsp;puede interponer&amp;nbsp;recurso&amp;nbsp;de alzada ante&amp;nbsp;el presidente&amp;nbsp;del FOGAIBA en el plazo de un mes a contar desde el día siguiente de su&amp;nbsp;publicación, de acuerdo con lo que establecen el artículo&amp;nbsp;58.1&amp;nbsp;de la Ley&amp;nbsp;3/2003 de 26 de marzo, de Régimen Jurídico&amp;nbsp;de la Administración&amp;nbsp;de la&amp;nbsp;Comunidad&amp;nbsp;Autónoma de las Illes Balears y&amp;nbsp;los artículos&amp;nbsp;121 y&amp;nbsp;122 de la Ley&amp;nbsp;39/2015,&amp;nbsp;de 1 de octubre, del Procedimiento&amp;nbsp;Administrativo&amp;nbsp;Común&amp;nbsp;de las Administraciones Públicas, todo&amp;nbsp;ello&amp;nbsp;sin perjuicio&amp;nbsp;de interponer&amp;nbsp;cualquier otro que se estime&amp;nbsp;pertinente&amp;nbsp;en defensa de&amp;nbsp;sus&amp;nbsp;intereses.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
