&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. En fecha 26 de agosto de 2016 se aprobó mediante Resolución de la autoridad de gestión del Programa de Desarrollo Rural de las Illes Balears por la que se convoca la selección de las Estrategias de Desarrollo Local Participativo en los territorios de Menorca y de Eivissa y Formentera, para el período de programación 2014-2020. 2. En fecha 10 de diciembre de 2020 se aprobó mediante Resolución de la Autoridad de Gestión del Programa de Desarrollo Rural de las Illes Balears, la modificación de la Estrategia de Desarrollo Local Participativo de Eivissa y Formentera en la que se incluye la posibilidad de ayudas a inversiones en proyectos productivos dentro de la acción estratégica de asesoramiento, que pasa a denominarse agrarias y otros actores del complejo agroalimentario insular, especialmente a nuevas incorporaciones en el sector agrario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. En fecha 25 de abril de 2022, se publicó en el BOIB nº55 Acuerdo por el que se aprueba convocatoria de ayudas para inversiones en las explotaciones agrarias beneficiarías del proyecto Diseño e implementación de Planes Estratégicos de Gestión Empresarial de titulares de explotaciones agrarias jóvenes y de reciente incorporación para los años 2022 a 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. En fecha 24 de mayo de 2022, con NRGE MARIA DEL CARMEN TUR ESCOFETE en nombre y representación de Jordi Serapio Riera solicitó una ayuda en el marco de la citada convocatoria para el proyecto “ELEMENTOS DE UNA NUEVA PLANTACIÓN DE VIÑA”. Este proyecto está incluido en la convocatoria de ayudas para inversiones en las explotaciones agrarias beneficiarías del proyecto Diseño e implementación de Planes Estratégicos de Gestión Empresarial de titulares de explotaciones agrarias jóvenes y de reciente incorporación a Eivissa y Formentera, para los años 2022 a 2023. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. Analizada toda la documentación presentada, en fecha 21 de octubre de 2024 se emitió una propuesta de resolución en la que se detallaban determinadas inversiones solicitadas y que no se consideraron subvencionables. La interesada hizo alegaciones a esta propuesta provisional en fechas 6 de noviembre de 2024 y 20 de agosto de 2025. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6. Revisadas las alegaciones, que se estimaron parcialmente, en fecha 18 de noviembre de 2025, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor del interesado por un importe máximo de 42.047,84 euros, sobre una inversión elegible de 84.095,67. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;7. El día 18 de noviembre de 2025, se emite el informe de moderación de costes, en el que, se indica que los importes con denominación «Cierre con malla ganadera + conejera» de las inversiones no cumplen con los requisitos de moderación de costes. En consecuencia, su coste elegible será de 41.766,05 € de un coste de la solicitado de 71.268,30 €.&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8. El día 3 de diciembre de 2025, el beneficiario solicitó el pago FINAL de ayuda de acuerdo con las condiciones establecidas por la resolución arriba mencionada. 9. Dada la Resolución de concesión de la mencionada ayuda, y de acuerdo con lo establecido en el apartado décimo de la convocatoria antes mencionada, los beneficiarios se obligan, entre otros, a realizar las actuaciones auxiliadas dentro del plazo establecido ya justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en la forma y plazos determinados en la convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;10. Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, el interesado presenta la solicitud de pago, así como la documentación exigida. No obstante, revisada ésta, se comprueba que la inversión ejecutada es inferior a la aprobada.&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;11. Los solicitantes declaran que a pesar de la diferencia, se han alcanzado todos los objetivos previstos en el proyecto aprobado. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;12. De acuerdo con el apartado undécimo de la Resolución de convocatoria antes mencionada, en lo referente a en los casos en los que se produzcan desviaciones entre la inversión realizada y la aprobada, se ajustará la ayuda total concedida al importe de la inversión realizada, siempre que se alcance de forma significativa el cumplimiento de los objetivos previstos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;13. Visto lo que dispone el artículo 109 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, de acuerdo con el artículo 43 del Decreto legislativo 2/2005, de 28 de diciembre. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos de derecho &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. &lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Propuesta de resolución de revocación parcial&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Por todo ello, se informa favorablemente y proposo al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Proceder a la revocación parcial de la Resolución de ayuda concedida al beneficiario y por el importe detallados en el Anexo I, que son un total de 1 expediente que comienza y termina con MARIA DEL CARMEN TUR ESCOFECHO, que suma un importe total de 27.449,30 euros, relativa a la línea de ayuda “Pro0a de Desarrollo2 FEADER”, puesto que la justificación del gasto ha sido inferior a la aprobada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Notificar la resolución a cada uno de los beneficiarios del Anexo I.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
