En fecha 27 de diciembre de 2017 se aprobó mediante Resolución de la Autoridad de Gestión del Programa de Desarrollo Rural de las Illes Balears, la Estrategia de Desarrollo Local Participativo (EDLP) en el territorio de Mallorca que contiene las actuaciones que se llevarán a cabo durante el período 2014-2020 en aplicación de la medida 19. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En fecha 19 de noviembre de 2020, se publicó en el BOIB nº197 el Acuerdo por el que se aprueban las Bases de la convocatoria, para el año 2020, de ayudas al desarrollo rural de la isla de Mallorca, vinculadas a proyectos relacionados con los ámbitos agrario y/o ambiental y enmarcados en la Estrategia de Desarrollo Local Participativo 2014-2020 de Mallorca. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El día 21 de diciembre de 2020, Evelyn Tewes en nombre y representación de Fundació vida silvestre Mediterrània solicitó una ayuda, para el proyecto “Película documental sobre la abeja melífera y los productos apícolas”. Este proyecto está al amparo de la Convocatoria de ayudas para el desarrollo rural de la isla de Mallorca, relacionados con los ámbitos agrario y/o ambiental y enmarcados en la Estrategia de Desarrollo Local Participativo 2014-2020 de Mallorca.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Analizada toda la documentación presentada, en fecha 20 de octubre de 2021, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor del interesado por importe máximo de 19.997,82 euros, sobre una inversión elegible de 39.420,10 euros (50,73).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El día 21 de octubre de 2022, el beneficiario solicitó el pago FINAL de ayuda de acuerdo con las condiciones establecidas por la resolución arriba mencionada.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El día 8 de octubre de 2025, se emite el informe de moderación de costes, en el que se indica que los importes de las inversiones se encuentran dentro del rango de la estimación por referencia.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Dada la Resolución de concesión de la citada ayuda, y de acuerdo con lo establecido en el apartado décimo de la convocatoria antes mencionada, los beneficiarios se obligan, entre otros, a realizar las actuaciones auxiliadas dentro del plazo establecido ya justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en la forma y plazos determinados en la convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, los interesados ​​presentan las solicitudes de pago, así como la documentación exigida, pero, revisadas éstas, se comprueba que la inversión ejecutada es inferior a la aprobada.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. Los solicitantes declaran que a pesar de la diferencia, se han alcanzado todos los objetivos previstos en el proyecto aprobado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. De acuerdo con el apartado undécimo de la Resolución de convocatoria antes mencionada, en lo referente a en los casos en los que se produzcan desviaciones entre la inversión realizada y la aprobada, se ajustará la ayuda total concedida al importe de la inversión realizada, siempre que se alcance de forma significativa el cumplimiento de los objetivos previstos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11. Visto lo que dispone el artículo 109 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, de acuerdo con el artículo 43 del Decreto legislativo 2/2005, de 28 de diciembre.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fundamentos de derecho </span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Convenio de colaboración entre el Fondo de Garantía Agraria y Pesquera de las Illes Balears como Organismo Pagador, el adjunto a la Gerencia del FOGAIBA como Autoridad de Gestión y el Grupo de Acción Local Asociación Mallorca Rural por lo que se establecen las condiciones para la aplicación de la medida 19 del Programa de Desarrollo200. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER) y por el que se deroga el Reglamento (CE) núm. 1698/2005 del Consejo. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, sobre la financiación, gestión y seguimiento de la Política Agrícola Común, por el que se derogan los Reglamentos (CE) núm. 352/78, (CE) núm. 165/94, (CE) núm. 2799/98, (CE) núm. 814/2000, (CE) núm. 1290/2005 y (CE) núm. 485/2008 del Consejo.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Decreto 64/2005, de 10 de junio, de creación del FOGAIBA.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">12. Orden de la consejera de Agricultura y Pesca de 23 de diciembre de 2005, por la que se dispone que el FOGAIBA asume la ejecución de la política de la consejería de Agricultura y Pesca en lo referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero a partir del 1 de enero de 2006.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">13. Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la comunidad autónoma de las Illes Balears BOIB núm. 082 de 2007; en virtud de la Orden de la consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de Garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que la FOGAIB a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero, a partir de 1 de enero de 2006.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14. Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.</span></span></p> <p style="text-align:center"><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propuesta de resolución de revocación parcial</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, se informa favorablemente y proposo al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Proceder a la revocación parcial de la Resolución de ayuda concedida al beneficiario y por el importe detallados en el Anexo I, que son un total de 1 expediente que comienza con y termina con FUNDACIÓN VIDA SILVESTRE MEDITERRANEA, que suma un importe total de 8.066,67 euros, relativa a la línea de ayuda “02 cargo al FEADER”, puesto que la justificación del gasto ha sido inferior a la aprobada.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.
