    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aprobado el siguiente acuerdo en la sesión plenaria núm. 15 en fecha 04 de diciembre de 2025 en el Ayuntamiento de Capdepera, se somete a información pública en el Boletín Oficial de la Provincia el siguiente texto integral:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PLAN REGULADOR DE LICENCIAS TEMPORALES DE AUTO TAXIS DEL MUNICIPIO DE CAPDEPERA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En virtud del que se establece en el artículo 53.4 de la Ley 4/2014, de 20 de junio de transportes terrestres y movilidad sostenible de las Islas Baleares, se somete a información pública el Plan Regulador de las licencias temporales de auto taxi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Exposición de motivos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;I.- En los últimos años se ha puesto de manifiesto la insuficiencia de la flota existente de taxis en el municipio de Capdepera, de manera que el servicio no queda atendido de forma adecuada. Esta circunstancia provoca molestias y perjuicios a los potenciales usuarios del servicio, y se resiente de ello la imagen que ofrece el municipio como destino turístico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;II.- Se ha podido constatar que esta insuficiencia se concentra durante los meses de la temporada turística alta, ya que la desproporción entre la oferta de este servicio y su demanda produce situaciones de grave desatención del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;III.- Partiendo de ello, desde el Ayuntamiento se han mantenido diversas reuniones con los representantes del sector del taxi, y se ha considerado que la creación de diversas licencias temporales puede ser una medida efectiva por dar una respuesta adecuada a esta problemática.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;IV.- La normativa vigente, en concreto el artículo 53.4 de la Ley 4/2014, de Transportes Terrestres y Movilidad Sostenible de las Illes Balears (en adelante LTTIB) faculta a los Ayuntamientos para la creación de licencias temporales de auto taxi, aunque exige la aprobación de un Plan regulador que determine la adjudicación, las condiciones de prestación del servicio, el número mínimo y máximo, las condiciones a las que deberán sujetarse, los derechos y demás obligaciones, la cantidad de la tasa, los supuestos de revocación, el plazo de duración y demás condiciones que se consideren adecuadas o necesarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;V.- LTTIB somete el otorgamiento de las licencias temporales al cumplimiento de las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Deberán adjudicarse preferentemente a los titulares de licencias de carácter ordinario;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Deberán tener una duración determinada;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Serán intransmisibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Capítulo I&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Características de las licencias temporales&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 1&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Características&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las licencias temporales de ámbito municipal de transporte público de viajeros en vehículos turismo (en adelante licencias de auto taxi) objeto de este Plan deberán reunir los siguientes caracteres:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Temporal:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; la vigencia de las licencias temporales será anual, limitada al periodo comprendido entre el día 1 de mayo y el día 30 de septiembre (ambos incluidos) de cada temporada en concreto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Personal&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;: su otorgamiento irá vinculado a una persona que reúna los requisitos correspondientes y a un único vehículo, que igualmente reúna las características que se determinen para la adscripción de vehículos auto taxi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Preferente:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; tendrán preferencia para su adjudicación las personas (físicas o jurídicas) titulares de licencias ordinarias en el municipio de Capdepera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d)&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; Limitado: &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;solo podrá asignarse una licencia temporal por persona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e)&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; Intransmisible:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; las licencias temporales no podrán transmitirse en ningún caso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Revocable: &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;independientemente de la extinción de la autorización por caducidad, la Corporación podrá revocar la licencia temporal por incurrir en la pérdida de cualquiera de los requisitos exigidos que hayan motivado el otorgamiento, así como por el reiterado incumplimiento de las condiciones de prestación del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;g) &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Ámbito municipal:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; estas autorizaciones solo habilitan a la prestación del servicio con origen en el ámbito territorial de municipio de Capdepera, sin perjuicio de la posible autorización del Consell de Mallorca para prestar el servicio fuera de este término municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 2&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Número de licencias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Ayuntamiento, una vez analizados los datos que justifiquen la necesidad de incrementar la flota de vehículos para la prestación satisfactoria del servicio, mediante Decreto de Alcaldía fijará el número total de licencias temporales a crear.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Capítulo II&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Procedimiento de autorización&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 3&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Iniciación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El procedimiento se iniciará mediante Decreto de Alcaldía, en el cual se concretará el número de licencias temporales que se crean y se aprobará la convocatoria para su adjudicación. La convocatoria para su adjudicación se publicará mediante el correspondiente anuncio en el Boletín Oficial de las Illes Balears (BOIB) y en la página web del Ayuntamiento de Capdepera, lo cual marcará el plazo para la presentación de solicitudes y la documentación complementaria. Se establecerá un plazo de 7 días hábiles, a contar desde el día siguiente a la fecha de publicación en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El anuncio de la convocatoria y los sucesivos anuncios se alojarán en una ventana o en un enlace específico en el portal web del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 4&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Requisitos de las personas solicitantes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La persona solicitante deberá cumplir con los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Ser persona física o jurídica. En el caso de las personas jurídicas, deberá presentar los datos de una persona física para la prestación del servicio, la cual deberá cumplir los requisitos correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Cumplir con las obligaciones fiscales, sociales y laborales establecidos en legislación vigente que sean de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Contar con el carnet de conducir de clase B con una antigüedad mínima de un año y no haber agotado los puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) No haber sido sancionada por resolución firme en los dos últimos años por las infracciones cualificadas como muy graves en el Reglamento General de Circulación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Adoptar el compromiso de adscribir al servicio un vehículo que cumpla con las condiciones establecidas en el presente Plan regulador.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;f) Permiso municipal, tanto del titular como del asalariado, en todo caso.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 5&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Requisitos del vehículo adscrito al servicio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para la prestación del servicio, el vehículo que pretenda adscribirse a la licencia temporal deberá cumplir con las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Capacidad de hasta &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;nueve plazas&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;, incluida la de la persona que conduce.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Deberá estar equipado con un aparato taxímetro de un modelo correctamente instalado y verificado, conforme a lo dispuesto por el Real Decreto 889/2006, de 21 de julio, por el cual se regula el control metrológico del Estado sobre instrumentos de medida, y por la Orden ITC/3709/2006, de 22 de noviembre, por la cual se regula el control metrológico del Estado sobre los aparatos taxímetros, o normativa que la sustituya.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Deberá tener una antigüedad máxima de 10 años desde la fecha de matriculación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d)&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; Color blanco.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Luz verde.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) Deberá llevar en las dos puertas delanteras los mismos distintivos exigidos para los vehículos adscritos a las licencias ordinarias (franja, escudo, número, etc.). &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Una franja verde, con el número de la licencia ordinaria, y al lado una T de color rojo.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 6&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Solicitudes y documentación a presentar&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las solicitudes se deben presentar dentro del plazo de la convocatoria preferentemente por vía telemática de la sede electrónica del Ayuntamiento de Capdepera (obligatorio para personas jurídicas) o de manera presencial, al Registro General del Ayuntamiento, mediante una solicitud y la documentación complementaria correspondiente. También se admitirá la documentación presentada de acuerdo con las disposiciones legales y que cumpla los requisitos establecidos en estas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La presentación de las proposiciones presupone la aceptación por parte de la persona interesada de las condiciones de prestación del servicio, los derechos y las obligaciones, los supuestos de revocación, los plazos de duración, así como las otras condiciones contenidas en el acto administrativo que determine la adjudicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cada persona solicitante debe presentar la solicitud, que se debe adecuar al modelo definido como Anexo I, juntamente con los siguientes documentos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Modelo de declaración responsable (Anexo II), mediante la cual la persona solicitante se responsabiliza y se compromete a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Adscribir a la licencia temporal un vehículo conforme a lo establecido en la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aportar una póliza de seguro de forma ilimitada (o al menos por importe de 50 millones de euros) por su responsabilidad civil por los&amp;nbsp;daños causados en ocasión del transporte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No estar sometida a las prohibiciones por contratar recogidas en el artículo 71 de la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contar con el permiso de conducción vigente con una antigüedad mínima de un año y no haber agotado los puntos, &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;tanto del titular como del asalariado, en todo caso.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contratar con una entidad bancaria que acredite que se dispone de un sistema de cobro mediante tarjeta de crédito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Declaración jurada (Anexo III) de no haber sido sancionado por resolución firme en los dos últimos años por las infracciones cualificadas como muy graves en el Reglamento General de Circulación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;c) Certificado médico, tanto del titular como del asalariado, en todo caso.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;d) Permiso municipal, tanto del titular como del asalariado, en todo caso.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;e) Justificante del recibo del pago de las tasas pertinentes.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;f) Certificado de la Seguridad Social, tanto del titular como del asalariado, en todo caso.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 7&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tasa&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para la adjudicación de la licencia temporal se abonará la tasa prevista para la concesión y expedición de licencias de la Ordenanza fiscal reguladora de la tasa para licencias de auto taxi y otros vehículos de alquiler.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 8&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Subsanación de deficiencias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vez transcurrido el plazo de presentación de solicitudes, se abrirá un periodo de tres días hábiles para la subsanación de las eventuales deficiencias en la acreditación suficiente del cumplimiento de los requisitos. El plazo empezará a contar a partir del día siguiente a la publicación del correspondiente anuncio en la web municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Transcurrido este plazo sin haberse subsanado las deficiencias detectadas, la persona solicitante quedará excluida del proceso de adjudicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 9&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Lista provisional de personas admitidas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de no existir deficiencias a subsanar, o una vez subsanadas las mismas o, en todo caso, transcurrido el plazo habilitado con esta finalidad sin que se haya efectuado la subsanación, se elaborará la lista provisional de personas admitidas, que será expuesta al público a través de la web municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vez publicada la lista provisional, se abrirá un plazo habilitado con esta finalidad para que las personas interesadas puedas alegar, en todo caso, lo que a su derecho convenga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 10&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Lista definitiva de personas admitidas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vez transcurrido el plazo por la presentación de alegaciones sin que se hayan presentado o, en su caso, resueltas las mismas, se aprobará la lista definitiva de personas admitidas, que se expondrá al público a través de la web municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta lista clasificará las personas admitidas según lo dispuesto en el siguiente artículo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 11&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Criterios de adjudicación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para la adjudicación de las licencias temporales se seguirán los siguientes criterios:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Tendrán preferencia las personas (físicas o jurídicas) titulares de licencias ordinarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Solo podrá adjudicarse una sola licencia temporal a cada titular de licencias ordinarias o persona solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En caso de existir más personas solicitantes titulares de licencias ordinarias que licencias temporales disponibles, las temporales se otorgarán por sorteo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En caso de existir menos solicitantes titulares de licencias ordinarias que licencias temporales disponibles, las temporales que no les correspondan por preferencia se adjudicarán al resto de solicitantes, acudiendo al sorteo en caso de existir más aspirantes que licencias a otorgar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. En el caso de existir menos solicitantes titulares que licencias disponibles, por sorteo entre los no adjudicatarios, se establecerá su orden de relación de cara a la eventual adjudicación de vacantes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 12&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Adjudicación provisional&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las licencias temporales se adjudicarán provisionalmente siguiendo los criterios establecidos en el artículo anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cuando sea necesario acudir al sorteo, este se realizará en acto público ante la secretaría de la Corporación Municipal en la fecha y lugar a anunciar en la página web.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para el caso en que se presenten más solicitudes que número de licencias a otorgar, se constituirá un contingente de reserva al cual poder acudir en los supuestos de renuncias o vacantes sobrevenidas, formado por las solicitudes que no se hayan adjudicado ordenadas conforme al sorteo realizado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 13&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Aprobación de la relación de personas adjudicatarias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Mediante Decreto de Alcaldía se aprobará provisionalmente la relación de personas adjudicatarias, que se publicará en la web municipal al efecto de notificación individual en cada una de ellas, otorgándoles un plazo para el cumplimiento de la obligación de aportar la restante documentación necesaria para la finalización del expediente de autorización correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de&amp;nbsp;existir más solicitudes que licencias temporales disponibles, la relación de personas adjudicatarias contendrá también el contingente de reserva determinado por el sorteo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La publicación de la relación de personas adjudicatarias equivaldrá&amp;nbsp;a la concesión provisional de la licencia temporal, cuya eficacia quedará condicionada a la presentación, por parte de la persona interesada, de la documentación en los plazos señalados a continuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 14&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Documentación que ha de presentarse&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La eficacia del otorgamiento de la licencia temporal debe estar condicionada a la presentación, por parte de la persona, de la documentación en el plazo de siete días hábiles desde la publicación a que se refiere el artículo anterior, preferentemente por vía telemática:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Certificados acreditativos de estar al corriente con la Seguridad Social establecidos en la legislación vigente con una antigüedad máxima de 6 meses o autorización expresa firmada para su consulta por parte del Ayuntamiento, &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;tanto del titular como del asalariado, en todo caso.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;b) Declaración jurada de acreditación de que tanto el titular como el asalariado, en todo caso, no han sido sancionados por resolución firme por infracciones cualificadas como muy graves.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;​​​​​​​&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Acreditación de disponibilidad de un vehículo turismo que cumpla con los requisitos del artículo 5.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Contrato para cubrir de forma ilimitada la responsabilidad civil por los daños que se causen con motivo del servicio, y durante el tiempo de vigencia de la autorización por los daños ocasionados por razón del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) Acreditación de haber efectuado un depósito retornable de 500€ en la Tesorería del Ayuntamiento de Capdepera, que responderá en caso de:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Renuncia a la obtención de la autorización definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No presentar la documentación necesaria para poder obtener definitivamente la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No cumplir con la obligación de retirar del vehículo (y acreditarlo así ante el Ayuntamiento) ni portar todos los signos externos identificativos en el plazo máximo de un mes desde la finalización de la vigencia de la licencia temporal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El incumplimiento de la obligación de presentar el permiso de circulación pasado a particular en el plazo máximo de un mes desde la finalización de la vigencia de la licencia temporal. En caso de no ser posible presentar este requisito dentro del plazo indicado, podrá presentarse un justificante de la Jefatura Provincial de Tráfico de la solicitud del cambio del permiso de circulación pasado a particular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstante, deberá presentarse el permiso tan rápido como se obtenga el mismo a lo largo del plazo de duración de la licencia. Transcurrido el periodo de vigencia de la licencia temporal y comprobado por el Ayuntamiento el cumplimiento de los requisitos anteriores, se efectuará devolución del depósito siempre que se sigan cumpliendo los restantes requisitos establecidos para la devolución&amp;nbsp;del depósito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;g) Copia del contrato con una entidad bancaria que acredite que se cuenta con un sistema de cobro mediante tarjeta de crédito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;h) Datos del vehículo el cual se adscribirá a la licencia temporal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;i) Copia del permiso municipal de conductor de Capdepera, tanto del titular como del asalariado, en todo caso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;j) Justificante de las tasas pertinentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 15&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Adjudicación definitiva&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vez aportada la documentación requerida, mediante Decreto de Alcaldía se aprobará la relación definitiva de las personas adjudicatarias de licencias temporales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se denegarán las licencias temporales adjudicadas provisionalmente a las personas aspirantes que no hayan aportado toda la documentación requerida dentro del plazo concedido al efecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las personas a las que se haya adjudicado definitivamente una licencia temporal deberán empezar a prestar en el plazo máximo de tres días hábiles, a contar a partir del día siguiente de la notificación de la resolución, excepto autorización expresa en supuestos de fuerza mayor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 16&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cobertura de vacantes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si una vez dictada la resolución de la adjudicación provisional las personas adjudicatarias renunciasen a la licencia temporal y, si cabe, esta no llegase a adquirir eficacia definitiva por falta de presentación de la documentación referida, la plaza correspondiente a esta licencia quedará vacante, otorgándose a la persona solicitante que corresponda según el orden del sorteo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La renuncia, la falta de presentación de la documentación, o el retraso injustificado para empezar a prestar el servicio comportará la declaración de vacante de la licencia temporal, de acuerdo con el procedimiento administrativo que se lleve a cabo con tal finalidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 17&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tarjeta de transportes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A las personas solicitantes que finalmente cumplan con todos los requisitos y consigan el otorgamiento definitivo de una licencia temporal se les expedirá una tarjeta de transporte acreditativa del título habilitante obtenido, con indicación de la persona titular, número de taxi temporal, plazo de vigencia y matrícula del vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;​​​​​​​&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Capítulo III&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Prestación del servicio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 18&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Vehículo de prestación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La prestación de este servicio se efectuará exclusivamente mediante el uso del vehículo ofrecido para la autorización temporal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- SUSTITUCIÓN DEFINITIVA: En caso de que, durante la prestación del servicio, la persona titular de la autorización temporal desee sustituir el vehículo vinculante a la autorización otorgada, deberá de comunicarlo al Ayuntamiento, con la acreditación de la disponibilidad del nuevo vehículo, sus datos, modelo y matrícula, y la acreditación del cumplimiento de los mismos requisitos u otros mejores que tenía el vehículo a sustituir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Además, deberá acreditar, mediante certificado de la ITV, haber retirado todos los distintivos externos del vehículo original.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Comprobado lo anterior, el Ayuntamiento dictará resolución para autorizar y emitir con esta finalidad nueva tarjeta de transporte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de no cumplirse los requisitos anteriores la sustitución será denegada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- SUSTITUCIÓN TEMPORAL: Excepcionalmente, podrá accederse a una sustitución temporal en caso de avería o accidente. En estos casos, la persona interesada lo deberá solicitar al Ayuntamiento mediante instancia, que deberá acompañar de la acreditación de disponer de un vehículo para la prestación del servicio, con los requisitos del artículo 5 y la certificación del taller mecánico, acreditativa de la incidencia y la duración estimada de la resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En estos casos excepcionales se admitirá que la titularidad del vehículo no coincida con la de la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Igual que en el caso anterior, el Ayuntamiento, una vez comprobado el cumplimiento de todos los requisitos, dictará resolución con la autorización de la sustitución temporal y la emisión con esta finalidad de nueva tarjeta de transporte (también de carácter temporal).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Sin embargo, este supuesto, por la excepcionalidad de su régimen y considerando la duración de la vigencia de la autorización temporal, no podrá exceder de quince días. En caso de que la previsión de sustitución temporal exceda del plazo indicado, la persona interesada deberá acudir al procedimiento de sustitución definitiva antes regulado, excepto en caso de autorización expresa en supuestos debidamente justificados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Transcurrido el plazo de duración máxima de quince días de esta sustitución temporal, la persona titular de la autorización deberá acreditar ante el Ayuntamiento haber retirado los distintivos externos del vehículo autorizado temporalmente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta acreditación deberá producirse en el plazo máximo de tres días hábiles desde la finalización del periodo de quince días, sin que, en ningún caso, los dos vehículos puedan simultanear la prestación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 19&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Persona prestadora del servicio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las personas titulares de las licencias temporales deberán encontrarse dadas de alta de forma ininterrumpida en el régimen especial de trabajadores autónomos durante los días de vigencia de la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta obligación también recae sobre la persona propuesta como conductora en caso de ser diferente de la persona solicitante de la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Todas las personas conductoras de una autorización temporal deberán acreditar estar en posesión del permiso B de conducción o superior y del permiso municipal de conductor expedido por el Ayuntamiento de Capdepera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 20&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Condiciones de prestación del servicio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Necesariamente, al menos en una parte de la jornada, se prestará el servicio a través de las distintas paradas existentes en el término municipal de Capdepera. Se considerará cumplida esta obligación cuando se haya realizado un mínimo del 50% de la jornada en las paradas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el caso de los adjudicatarios de licencias ordinarias, esta obligación también afectará a la prestación del servicio con el vehículo o vehículos adscritos a la licencia ordinaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;​​​​​​​&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La prestación del servicio con licencia temporal no estará sujeta a ninguna limitación horaria, debiendo las personas titulares asegurar la prestación del servicio durante todos los días correspondientes al plazo de vigencia de la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 21&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Eliminación de signos externos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vez concluido el periodo de vigencia de la licencia temporal, las personas adjudicatarias quedarán obligadas a eliminar del vehículo todos los signos externos identificativos de la actividad y acreditarlo en el plazo máximo de un mes desde su finalización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de licencias que incluyan más de una temporada, los signos se deberán retirar al finalizar la temporada y volverse a colocar al inicio de la siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 22&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Régimen tarifario&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las tarifas a aplicar los titulares de licencias temporales serán las mismas aplicables para las licencias de carácter ordinario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Capítulo IV&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Incumplimiento de las condiciones de la licencia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 23&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Régimen sancionador&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El incumplimiento por parte de la persona titular de una licencia temporal de las condiciones de prestación y demás prescripciones contenidas en el presente Plan regulador, normativa aplicable en materia de transportes, o por la pérdida de alguna de las condiciones exigidas para su obtención, determinará la apertura del correspondiente expediente con cuya tramitación, previa audiencia de la persona interesada, esta podrá ser sancionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 24&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Revocación de la licencia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Ayuntamiento podrá revocar la autorización por incurrir en la pérdida de cualquiera de los requisitos exigidos, así como por el reiterado incumplimiento de las condiciones de prestación del servicio, lo cual supondrá la pérdida de todos los derechos vinculantes a la autorización y la imposibilidad de prestar el servicio que esta amparaba.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Antes de resolver la revocación de cualquier autorización será preceptivo el trámite de audiencia a la persona interesada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La revocación, como cualquier otro acto administrativo, podrá recorrerse en vía administrativa. La revocación en ningún caso tendrá carácter de sanción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 25&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Revocación por circunstancias extraordinarias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si, por la concurrencia de circunstancias extraordinarias, se produjera una contracción generalizada de la demanda del servicio de taxi, hasta el punto de que esta pudiera cubrirse de manera suficiente con la flota de taxis con licencia ordinaria, excepcionalmente mediante resolución de Alcaldía podrán revocarse con carácter general todas las licencias temporales otorgadas, sin derecho a reclamar indemnización alguna por ello.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
