&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;«Examinado el expediente de obra tramitado por el procedimiento de declaración de Interés General establecido en el artículo 37 de la Ley 6/1997, de 8 de julio, del suelo rústico de las Illes Balears que se detalla a continuación: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Y considerando, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;PRIMERO.-&lt;/strong&gt; Que se han cumplido los trámites previstos en el artículo 37 de la Ley 6/1997, de 8 de julio, del suelo rústico de las Illes Balears; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SEGUNDO.-&lt;/strong&gt; Que a la vista del expediente y de la documentación que figura, y entendiendo que quedan justificados los requisitos exigidos por el artículo 26 de la mencionada Ley. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En virtud de lo que se ha manifestado, esta Comisión Insular, previa propuesta de la Ponencia Técnica de Ordenación del Territorio y Urbanismo, adopta el siguiente &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ACUERDO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1º) Declarar el Interés General de la actividad expresada, con independencia de la licencia municipal o de otras autorizaciones que puedan ser preceptivas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2º) Significar igualmente que, transcurridos seis meses desde la notificación de este acuerdo sin que se haya solicitado la licencia municipal, se iniciará el expediente de caducidad, de acuerdo con lo que establece el apartado 4 del mencionado artículo 37 de la Ley 6/1997, de 8 de julio, del suelo rústico de las Illes Balears.» &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La publicación de este acuerdo se hace en reserva de la aprobación del Acta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra este acuerdo, que no pone fin a la vía administrativa, se puede interponer recurso administrativo de alzada dentro del plazo de un mes, y se computa a partir del día siguiente al que se produce la publicación. El recurso de alzada se puede presentar formalmente ante esta Comisión Insular de Ordenación del Territorio y Urbanismo o ante el Consejo Ejecutivo del Consejo Insular de Mallorca, que es el órgano competente para su resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra la desestimación expresa del recurso de alzada se puede interponer recurso contencioso administrativo ante el Juzgado Contencioso Administrativo de Palma, en el plazo de dos meses, a contar a partir del día siguiente al de la recepción de la notificación del acto de desestimación del recurso administrativo de alzada mencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra la desestimación por silencio administrativo del recurso de alzada se puede interponer el recurso contencioso administrativo, en el plazo de seis meses contadores a partir del día siguiente a la desestimación por silencio, que se entiende producida si transcurren tres meses desde la interposición del recurso sin que no se haya dictado y notificado la resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todo eso de conformidad con lo que prevé el vigente Reglamento orgánico del Consejo Insular de Mallorca, y los artículos 30, 40, 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas y la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No obstante, se puede ejercer, si es el caso, cualquier otro recurso que se estime pertinente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
