Posteriormente, revisada la plantilla y la tasa de reposición, se ha constatado que durante el ejercicio 2024 quedó vacante una plaza de oficial conductor/a A, ocupada hasta ese momento por un trabajador que estabilizó una plaza de encargado de sección. Esta plaza no se incluyó en la Oferta de Empleo Público de 2025, aunque cumple los requisitos legales y presupuestarios para ser incluida en la Oferta Pública de Empleo vigente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Normativa aplicable</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Real Decreto Legislativo 5/2015, de 30 de octubre, por el que se aprueba el texto refundido de la Ley del Estatuto Básico del Empleado Público.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Real Decreto Legislativo 781/1986, de 18 de abril, por el que se aprueba el texto refundido de las disposiciones legales vigentes en materia de Régimen Local.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Ley 39/2015, de 1 de octubre, del procedimiento común de las administraciones públicas.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Ley 31/2022, de 23 de diciembre, de presupuestos generales del Estado para el año 2024 (prorrogada para 2025).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En consecuencia, por unanimidad se adopta el siguiente acuerdo:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Primero</strong>.
