En fecha de 11 de abril de 2024 se publicó, en el Boletín Oficial de las Islas Baleares núm. 48, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para el año 2024, subvenciones para inversiones en la prevención de los daños causados ​​en los bosques por incendios forestales, desastres naturales y catástrofes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. En fecha de 25 de mayo de 2024 se publicó, en el Boletín Oficial de las Islas Baleares núm. 69, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se modifica la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 26 de marzo de 2024, por la que se convocan, para los años 202 bosques por incendios forestales, desastres naturales y catástrofes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor del beneficiario COOPERATIVA DE LA TIERRA DE LEVANTE, S.COOP, por importe de 16.456,00€ para llevar a cabo las siguientes inversiones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

En fecha 20 de septiembre de 2025, se publicó en el Boletín Oficial de las Islas Baleares la notificación de resolución de concesión de prórroga a COOPERATIVA DE LA TIERRA DE LEVANTE, S.COOP hasta el 31 de octubre de 2025 para la justificación de la realización de la inversión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. En fecha 30 de octubre de 2025, dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, la persona interesada presenta la solicitud de pago de 3,76 ha de aclareo de arbolado forestal así como la documentación exigida. 6. En fecha 13 de noviembre de 2025, los servicios de gestión forestal realizan inspección final de la realización de las inversiones y/o actuaciones llevadas a cabo y levantan la correspondiente acta informando que las superficies que se han realizado son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

De acuerdo con el apartado undécimo de la Resolución de convocatoria antes mencionada, en lo referente a subvenciones para inversiones en la prevención de los daños causados ​​a los bosques por incendios forestales, desastres naturales y catástrofes en los casos en que se produzcan desviaciones entre la inversión realizada y la aprobada, se ajustará la ayuda total concedida a la su naturaleza, sea susceptible de satisfacción parcial, y siempre que se acerquen de forma significativa al cumplimiento total de los objetivos previstos y supongan al menos un 50% de ejecución de la cantidad total de inversión aprobada en la resolución de concesión inicial. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;5. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Propuesta de resolución de revocación total &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, se informa favorablemente y proposo al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Revocar totalmente la resolución de ayuda concedida a la persona beneficiaria por el importe y con los plazos detallados en el anexo de esta resolución, que es un total de 1 expediente y que comienza y termina con COOPERATIVA DE LA TIERRA DE LEVANTE, S.COOP, que suma un importe total de 16.456,00 euros, relativa a la por incendios forestales, desastres naturales y catástrofes”, puesto que la justificación del gasto ha sido inferior a la aprobada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Notificar esta resolución a la persona beneficiaria mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución -que no agota la vía administrativa- se puede interponer recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo de 16 de marzo, de régimen jurídico de la 122, de la Ley 39/2015, del Procedimiento Administrativo Común de las Administraciones Públicas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
