En fecha de 19 de noviembre de 2020 se publicó, en el BOIB nº. 187, el anuncio de la publicación del Acuerdo de la Junta Directiva de la Associació Mallorca Rural Grup d'Acció Local de Mallorca aprobando la Convocatoria, para el año 2020, de ayudas al desarrollo rural de la isla de Mallorca, vinculadas a proyectos relacionados con los ámbitos agrario y/o ambiental y enmarcados en la Estratègia de Desenvolupament Local Participatiu 2014-2020 de Mallorca.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El 18 de septiembre de 2022, el vicepresidente en materia agraria del FOGAIBA dictó una Resolución de concesión de ayudas al Desarrollo rural de la isla de Mallorca, que se publicó en el Butlletí Oficial de les Illes Balears número 127, de 29 de septiembre de 2022, en la que figuraba una concesión a favor del interesado señalado en el anexo adjunto.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. De conformidad con el apartado undécimo de la Resolución mencionada, el plazo para presentar las solicitudes de pago terminó el día 31 de julio de 2025.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El artículo 70.3 del Reglamento de la Ley de Subvenciones, aprobado por Real Decreto 887/2006, de 21 de julio, establece que transcurrido el plazo establecido de justificación sin que ésta se haya presentado ante el órgano competente, éste requerirá al beneficiario para que en el plazo improrrogable de 15 días la presente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Visto esto, el 10 de octubre de 2025 se publicó en la web del FOGAIBA el requerimiento para que presentaran en el plazo de 15 días hábiles la solicitud de pago correspondiente, de acuerdo con el artículo 70.3 del Reglamento de la Ley de subvenciones, aprobado por el Real decreto 887/2006, de 21 de julio. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Una vez transcurrido el plazo mencionado no han presentado la documentación requerida, por lo que debe revocarse la ayuda de acuerdo con el artículo 92.1 del Reglamento de la Ley de subvenciones. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas establece la obligación de la Administración a dictar resolución expresa ya notificarla. En su párrafo segundo especifica que "En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con la indicación de los hechos producidos y las normas aplicables". </span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que “Procede la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades indebidamente percibidas”.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9 Por todo ello, se propone realizar la revocación total debido al incumplimiento de la obligación de realizar, pagar y justificar las inversiones concedidas dentro del plazo establecido. </span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fundamentos de derecho</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Acuerdo de la Junta Directiva de la Associació Mallorca Rural Grup d'Acció Local de Mallorca aprobando la Convocatoria, para el año 2020, de ayudas al desarrollo rural de la isla de Mallorca, vinculadas a proyectos relacionados con los ámbitos agrario y/o ambiental y enmarcados en la Estrategia de Desarrollo Local Participativo 2014-2020 de Mallorca.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. </span></span></p> <p style="text-align:center"><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propuesta de Resolución de Revocación total</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo esto, se informa favorablemente y propongo al vicepresidente en Materia Agraria del FOGAIBA que dicte resolución en los siguientes términos :</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Revocar totalmente la resolución de ayuda concedida al beneficiario por los importes y con los plazos detallados en el anexo de esta resolución, que son un total de 1 expedientes, que comienza y termina con ES CABAS, S.L. , y que suma un importe total de 7.500,00€.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Finalizar el procedimiento y archivar los expedientes que figuran en el Anexo de esta resolución.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.
