El &lt;span style="background-color:#ffffff"&gt;1&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;0 &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;d&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;e &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;noviembre&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;de &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;2025&lt;/span&gt;, las organizaciones sindicales y empresariales firmantes del Convenio Colectivo del sector del transporte regular de viajeros de Baleares&lt;strong&gt; &lt;/strong&gt;se reunieron para constituir la Comisión paritaria del convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El &lt;span style="background-color:#ffffff"&gt;1&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;1&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt; d&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;e &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;nov&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;i&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;em&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;bre de 2025&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;, &lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;J&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;osé Carlos Sedano Almiñana&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;,&lt;/span&gt; en representación de la Comisión Paritaria del Convenio Colectivo, solicitó el registro, el depósito y la publicación de la citada Acta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El artículo 90.3 del Texto Refundido de la Ley del Estatuto de los Trabajadores, aprobado por el Real Decreto Legislativo 2/2015, de 23 de octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Real Decreto 713/2010, de 28 de mayo, sobre registro y depósito de convenios, acuerdos colectivos de trabajo y planes de igualdad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El artículo 45 de la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Inscribir y depositar el Acta de constitución de la Comisión Paritaria del Convenio colectivo del sector del transporte regular de viajeros de Baleares de 10 de noviembre de 2025, en el Registro de Convenios Colectivos de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Disponer la publicación del acta en el &lt;em&gt;Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Ordenar la traducción del texto a la lengua catalana y hacer constar que la versión castellana del texto es la original firmada por la Comisión Paritaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Notificar esta Resolución a la persona interesada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En la ciudad de Palma (Mallorca-Illes Balears), a día 10 de noviembre de 2025, siendo las 12 horas, en los locales de la Federación Empresarial Balear de Transportes (FEBT), sitos en la calle Aragón nº 215, piso 1º, puerta derecha, se reúnen las personas al margen izquierdo relacionadas al objeto de celebrar la primera reunión, constitutiva, de la Comisión Paritaria del Convenio Colectivo para el sector del Transporte regular de viajeros por carretera de la Comunidad Autónoma de las Illes Balears, de acuerdo con lo previsto en el&amp;nbsp;Artículo 38º&amp;nbsp;del texto convencional, posibilitando que la reunión se realice tanto de forma presencial como telemática, acogiéndose a esta última modalidad D. Jaume Aliaño, D. Iván Tizón y D. José María Cardona y Dña. Catín Arguimbau.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Levanta la presente acta D. Manuel Sánchez Rubio, abogado asociado de la firma “C. SEDANO &amp;amp; ASOCIADOS”, asesor de la representación empresarial, por acuerdo de las partes y aceptación del designado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El orden del día es la constitución de la Comisión Paritaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.- Constitución de la Comisión Paritaria.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Comisión queda formada por diez miembros de las representaciones firmantes, cinco designados por la parte empresarial y cinco por la parte sindical. Los titulares son nombrados por cada una de las organizaciones, sin perjuicio de su sustitución o suplencia en caso de ausencia de estos. Los miembros de cada parte podrán delegar por escrito entre sí mismos el voto en caso de ausencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los representantes nombrados son los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se acuerda que la secretaría de actas la llevará el despacho profesional de “C.SEDANO &amp;amp; ASOCIADOS”, asesores de la parte empresarial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se acuerda que la persona que actúe como Secretario redactará el acta de cada reunión dentro de los diez días siguientes hábiles a su celebración y la circulará a las partes para su revisión. El acta se aprobará y firmará en la reunión siguiente de la Comisión, por un representante de cada organización junto con el Secretario de actas, salvo la presente, que será firmada por todos los presentes, incluido quien asiste de forma telemática. Las actas recogerán los asistentes, el orden del día y los acuerdos o desacuerdos que se adopten, y se adjuntarán los documentos que se acuerde. Las manifestaciones de parte serán dictadas por el ponente que las quiera realizar y, si son extensas, las hará aportando escrito firmado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El acta de la presente reunión es aprobada y firmada en el día de la fecha, mediante firma electrónica de los que han asistido de forma telemática, para refrendar los acuerdos adoptados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Comisión Paritaria tiene establecido, según el&amp;nbsp;Artículo 38º&amp;nbsp;del convenio, como domicilio de la misma a efectos de notificación, la sede del Tribunal D'Arbitratge i Mediació de les Illes Balears (TAMIB), en 07003 Palma (Mallorca-Illes Balears), Avda. Comte de Sallent n° 11, 2ª planta. Igualmente se habilita, a efectos de las comunicaciones previstas en el convenio colectivo, la siguiente dirección de correo electrónico:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;cptransporteregular@tamib.es&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.- Funciones de la Comisión Paritaria.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De conformidad con lo establecido en el&amp;nbsp;Artículo 38º&amp;nbsp;y demás preceptos concordantes del Convenio Colectivo, así como en el&amp;nbsp;Artículo 85&amp;nbsp;del Texto refundido de la Ley del Estatuto de los Trabajadores, la Comisión Paritaria tendrá atribuidas las siguientes funciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Interpretación y Vigilancia:&amp;nbsp;Interpretar la totalidad de los artículos y cláusulas de este convenio, así como vigilar su correcta aplicación y cumplimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Competencias Específicas atribuidas por el Convenio:&amp;nbsp;Ejercer todas las funciones y competencias que expresamente le son atribuidas en el articulado del convenio, entre las que se incluyen, de forma enunciativa y no limitativa:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Confeccionar y acordar las tablas salariales definitivas para los años 2027 y 2028, una vez publicado el dato final del IPC por el INE, levantando acta para su registro y publicación (según&amp;nbsp;Artículo 10º.2).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Intervenir en la coordinación de los reconocimientos médicos periódicos con las Mutuas y órganos competentes (según&amp;nbsp;Artículo 25º).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Entender en las discrepancias que puedan surgir para la no aplicación de las condiciones de trabajo a que se refiere el&amp;nbsp;Artículo 82.3&amp;nbsp;del Estatuto de los Trabajadores, disponiendo de un plazo máximo de siete días para pronunciarse (según&amp;nbsp;Artículo 39º).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Recibir notificación del inicio y resultado de la negociación de los Planes de Igualdad en las empresas del sector (según&amp;nbsp;Disposición adicional cuarta, apartado d)).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Realizar el seguimiento, evaluación y revisión de las medidas planificadas para la igualdad real y efectiva de las personas LGTBI (según&amp;nbsp;Disposición adicional quinta, apartado 6º).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Recibir comunicación de las decisiones adoptadas en los expedientes de acoso contra personas LGTBI, garantizando la confidencialidad de los datos (según&amp;nbsp;Disposición adicional sexta, apartado 5º).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Adecuación a la Normativa Vigente:&amp;nbsp;Analizar y debatir sobre las implicaciones de normativas legales o reglamentarias de posterior entrada en vigor que pudieran afectar al marco de relaciones laborales regulado en este convenio, pudiendo elaborar propuestas de adaptación o desarrollo para su posterior negociación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Intervención en Conflictos y Relación con Órganos Jurisdiccionales:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Ejercer labores de arbitraje y conciliación con carácter previo a cualquier acción judicial o administrativa que se pueda intentar por las partes afectadas por la interpretación y aplicación del convenio (según&amp;nbsp;Artículo 38º).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Emitir informes o dictámenes no vinculantes sobre la interpretación de cláusulas del convenio a solicitud de los órganos jurisdiccionales del orden social, cuando estos lo consideren oportuno para la resolución de un litigio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Someter las controversias y bloqueos surgidos en su propio seno a los procedimientos de mediación y arbitraje del Tribunal de Arbitraje y Mediación de las Illes Balears (TAMIB), de conformidad con lo previsto en el penúltimo párrafo del&amp;nbsp;Artículo 38º&amp;nbsp;del Convenio Colectivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todos los asuntos que se sometan a la consideración de la Comisión, deberán ser remitidos con tiempo suficiente al domicilio de la misma, y siempre a través de una de las organizaciones firmantes del Convenio, sin perjuicio de los requerimientos o peticiones que pudieran provenir de órganos de la administración pública o de la jurisdicción social o que así esté establecido legalmente. No obstante, cualquier parte de la Comisión, podrá proponer a debate y decisión, cualquier tema al inicio de cada una de las sesiones. Los acuerdos se tomarán por acuerdo unánime de ambas partes, sindical y empresarial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las reuniones de la Comisión Paritaria tendrán lugar, previa solicitud de cada una de las partes, o convocatoria del Secretario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No habiendo más asuntos que tratar y siendo las 13 horas, se da por finalizada la reunión en el lugar y fecha indicados en el encabezamiento, levantándose la presente acta para constancia de lo tratado y siendo firmada por los presentes, mandatando al Sr. Carlos Sedano Almiñana, asesor empresarial, para que proceda a los trámites de inscripción y registro de la misma ante la autoridad laboral y solicitud de su publicación en el «BOIB».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
