Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se convocan subvenciones para las inversiones no productivas vinculadas a la realización de compromisos de agroambiente y clima, correspondientes al año 2024.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.&nbsp;Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA, resolvió favorablemente la concesión de la ayuda a favor de BODEGA SON ANTEM SL, entre otras, que figuran en el anexo de la Resolución de concesión, R7 de fecha 19 de mayo de 2025, al amparo (BOIB núm. 66, de 24 de mayo de 2025) con los datos y los importes correspondientes (con un importe concedido de 12.000,00 euros). </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El apartado décimo de la Resolución de la convocatoria establece las obligaciones del beneficiario.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Dentro del plazo legalmente establecido, con fecha 04 de agosto de 2025, el interesado presenta solicitud del pago total así como la documentación exigida. Analizada ésta, y con la inspección final de fecha 01 de septiembre de 2025, se comprueba que no realizado todos los metros concedidos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. En fecha 17 de septiembre de 2025, el interesado presenta una memoria justificativa, en la que explica una modificación a la selección de bancales a rehabilitar.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que “Procede la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionado la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades indebidamente percibidas”.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Ante todo esto, se propone realizar la revocación parcial ya que no se han rehabilitado todos los metros concedidos y no se admite cambios a tramos no aprobados inicialmente.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fundamentos de derecho</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Con fecha 17 de noviembre de 2024 se publicó, en el Butlletí Oficial de les Illes Balears núm. 169, la Resolución del presidente del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), por la que se convocan subvenciones para las inversiones no productivas vinculadas a la realización de compromisos de agroambiente y clima, correspondientes a los años 2015 a 2019. . </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Orden del conseller de Agricultura, Medio Ambiente y Pesca, de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014-2020. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas..</span></span></p> <p style="text-align:center"><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propuesta de Resolución </span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, se informa favorablemente y propongo al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.Revocar parcialmente la ayuda concedida al beneficiario, mediante la Resolución del vicepresidente del FOGAIBA de día 19 de mayo de 2025, por el importe y con los datos detallados en el anexo de esta resolución, que es un total de 1 expediente y que comienza con BODEGA SON ANTEM SL y termina con BODEGA SON ANTEM SL, que suma un importe de 969,30 euros (financiado por la CAIB en un 100,00%), relativa a la línea de ayudas "Inversiones no productivas", dado que no ha realizado todos los metros concedidos, y que no se admite cambios en tramos no aprobados. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Notificar esta propuesta provisional de resolución a las persona interesada mediante la publicación en el BOIB e informarle que dispone de un plazo máximo de 10 días hábiles, a contar desde el día siguiente a la publicación de esta propuesta, para presentar alegaciones. En caso de no hacer uso de su derecho para alegar, en el plazo indicado, o si manifiestan su decisión de no efectuar alegaciones ni aportar nuevos documentos o justificaciones, esta propuesta tendrá carácter definitivo, y se elevará al vicepresidente del FOGAIBA para que dicte la Resolución de revocación de la ayuda concedida.&nbsp;</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
