2025-12-03 CAIB 860 2025-12-06 71896 CAIB es es 2025-12-06 ![CDATA[Resolución de aprobación de la concesión de las ayudas de la convocatoria para la rehabilitación y/o conservación de bienes inmuebles integrantes del patrimonio histórico situados en la isla de Mallorca, 2025]] ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">El 28 de noviembre de 2025, la vicepresidenta primera y consejera ejecutiva de Cultura y Patrimonio dictó la siguiente </span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Resolución</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>“Antecedentes</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1.De acuerdo con la base de ejecución 21 del presupuesto de gastos del Consejo Insular de Mallorca del 2025, se ha acreditado la competencia para aprobar la convocatoria de ayudas para la rehabilitación y/o conservación de bienes inmuebles integrantes del patrimonio histórico situados en la isla de Mallorca, 2025.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2.El Consejo Ejecutivo, en la sesión de día 23 de julio de 2025 autorizó a&nbsp; la vicepresidenta primera y consejera<span style="display:none">&lt;A[consejera|consellera]&gt;</span> ejecutiva de Cultura y Patrimonio para aprobar &nbsp;la convocatoria de ayudas mencionada.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3.El 20 de agosto de 2025, la vicepresidenta primera y consejera<span style="display:none">&lt;A[consejera|consellera]&gt;</span> ejecutiva de Cultura y Patrimonio dictó la resolución de aprobación de la indicada convocatoria y autorizó el correspondiente gasto, por un importe total de 650.000,00€, con cargo a la aplicación 20.33620.78903.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">4.El extracto de la convocatoria se publicó en el BOIB nº121, de día 11 de septiembre de 2025 y el texto completo en la Base de Datos Nacional de Subvenciones (BDNS).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">5. Se presentaron 16 solicitudes dentro del plazo establecido a la convocatoria. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">6. La Comisión Técnica de Evaluación se reunió el día 17 de noviembre de 2025.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">7. En el Acta de la Comisión figuran las solicitudes admitidas, las excluidas y la puntuación de los expedientes una vez aplicados los criterios de valoración fijados en la base 12 de la convocatoria, así como, la propuesta de concesión con el reparto del crédito. Igualmente, consta que no ha sido necesario establecer una prelación entre las solicitudes admitidas dado que el crédito ha resultado suficiente para atenderlas todas, de conformidad con las bases 10 y 13.1 de la convocatoria, en relación con el artículo 17.1 de la Ordenanza general de subvenciones del Consejo de Mallorca (OGS).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">8. El 19 de noviembre de 2025, el secretario técnico de Cultura y Patrimonio, como órgano instructor de la convocatoria emitió informe en el sentido que la fase de concesión cumple con la normativa de aplicación y que las personas propuestas, como beneficiarias, en el acta de la Comisión Técnica de Evaluación cumplen con todos los requisitos necesarios para acceder a las subvenciones y, específicamente, están al corriente del cumplimiento<span style="display:none">&lt;A[cumplimiento|cumplido]&gt;</span> de las obligaciones tributarias y de la Seguridad Social ante la Administración del Estado, así como, de las obligaciones tributarias ante el Consejo Insular de Mallorca.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">9. El 19 de noviembre de 2025, el jefe<span style="display:none">&lt;A[cabeza|cabo|jefe]&gt;</span> del servicio jurídico de Patrimonio Histórico emitió informe favorable sobre los aspectos jurídicos de la concesión de las subvenciones.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">10.En el presupuesto de gastos del Consejo de Mallorca de 2025 existe el crédito adecuado y suficiente para asumir el gasto derivado de la concesión de las ayudas por un importe total de 650.000,00€, con cargo de la aplicación 20.33620.78903.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">11. El día 28 de noviembre de 2025, la Intervención Delegada (Centre La Misericòrdia) fiscalizó de conformidad la concesión de las subvenciones. (FLP 2025/6757).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Fundamentos<span style="display:none">&lt;A[Fundamentos|Cimientos]&gt;</span> de derecho</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">1. La Ordenanza General de Subvenciones del Consejo Insular de Mallorca, aprobada por acuerdo del Pleno de 23 de diciembre de 2016 (BOIB nº. 21, de 18/02/2017), modificada por Acuerdo del Pleno de 14 de junio de 2018 (BOIB nº. 96, de 04/08/2018), a partir de ahora OGS.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="line-height:107%"><span style="line-height:107%">2. El Decreto Legislativo 2/2005, de 28 de diciembre, por<span style="display:none">&lt;A[por|para]&gt;</span> el cual se aprueba el Texto Refundido de la Ley de Subvenciones.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">3. La Ley 38/2003, de 17 de noviembre, General de Subvenciones y el Real decreto 887/2006, de 21 de julio, por el cual se aprueba el Reglamento de la Ley 38/2003 General de Subvenciones.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">4. La Ley 4/2022, de 28 de junio, de Consejos Insulares (BOIB nº. 88, de 07/07/2022).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">5. La Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">6. El órgano competente para aprobar la concesión de las subvenciones es la vicepresidenta primera y consejera<span style="display:none">&lt;A[consejera|consellera]&gt;</span> ejecutiva del Departamento de Cultura y Patrimonio, conforme al artículo 33.2 k) de la Ley 4/2022, de 28 de junio, de consejos insulares, en relación&nbsp; al vigente Decreto de la presidencia del Consejo Insular de Mallorca, de día 28 de julio de 2023, por el cual se establecen las competencias de los Departamentos del Consejo Insular de Mallorca.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">7.De acuerdo con el artículo 8.2 e) de la OGS y la base 7.3 de la convocatoria, para poder obtener la condición de beneficiario se tiene que estar al corriente de las obligaciones tributarias con la Agencia Tributaria, la Seguridad Social y el Consejo de Mallorca. Examinados todos los expedientes constan los certificados positivos de estar al corriente con la Agencia Tributaria, la Seguridad Social y el Consejo Insular de Mallorca.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">8.El procedimiento de concesión previsto en las bases 10 y 13.1 de la convocatoria, en relación con el artículo 17.1 de la OGS es en régimen de concurrencia competitiva, de manera que las solicitudes se tienen que valorar de acuerdo con los criterios de valoración detallados en el punto 12 la convocatoria y se tiene que establecer una orden de prelación entre ellas.
